Fairfax City Council Meeting
August 11 , 1998
Mayor Stallman called the meeting to order at 7 : 00 p. m. , with
Council : Beer , Shakespeare, Stockton and Wainwright , Absent
Harville .
Shakespeare made the motion to approve the Agenda, Minutes of the
July 14th Council Meeting, Clerk' s Budget and Financial Reports.
2nd Beer . MC,
Vernon Cerveny presented the plans John Hughes would like to do
for his Eagle Scout Project . The Council approved a sign for Linn.
Street Park, landscaping around the sign, scraping and painting the
swing set and monkey bars . Vernon gave the council a report on the
application he is working on for Iowa Living Roadways .
Stockton made a motion to approve the D.O. T. R.O.W. agreement for
Michael Heintz , 2'nd Shakespeare . Ayes Beer , Stockton, and
Shakespeare . Wainwright abstained .
Shakespeare made a motion to approve the renewal of the Handi
Mart Beer Permit , 2nd Wainwright . MC.
Mayor Stallman opened the Public Hearing on Ordinance 214 at 7 : 11
p. m. City Engineer Dick Ransom explained 'what the Well Protection
Ordinace was . No objections the Mayor closed the hearing at 7 : 15
p . m. Motion by Beer to approve Ordinance 214 - Providing for the
Regulations of a Deep Well Site within the City of Fairfax, 2nd
Shakespeare . MC. Beer moved the approval of ORDINANCE 214 on its
first reading and that the procedural requirements as setforth in
Section 380 . 3 , Code of Iowa, be suspended as provided for in that
section, and that Ordinance 214 be placed on its second and third
readings by its Title . 2nd Stockton. MC.
Mayor Stallman opened the Public Hearing on RESOLUTIONS 98-8-11-2
AND 98-8-11-1 , Annexations at 7 : 17 p.m. No objections hearing
closed at 7 : 18p..m. Motion by Beer 2nd Stockton to approve
RESOLUTION 98-8-11-2, LOROCO,LTD annexation and RESOLUTION 98-8-11-
1 Gordon Sevig Annexation. MC.
Discussion on Ron Hilton Grading of his property on Hwy 151.
Adjoining property owners were present to object to his running an
open waterway through their properties . The Council explained that
it was not up to the City to dictate what they should put on their
properties , Therefore the problem must be resolved with the
property owners .
Deputy Bob Johnson presented the list of calls .
Council person Shakespeare left at 8 : 30 p.m.
Motion by Wainwright , 2nd Beer that the City will contract with
ECIGOG to rewrite the cities Comphrensive Plan with the cost not to
exceed $2 ,200 . MC..
Wainwright made the motion to accept Breeden Trees Service bid to
remove 3 trees , stumps and a limb in a tree, 2nd Stockton. The
clerk will ask for a Certificate of Insurance . MC.
Wainwright moved to add the $10 . 00 a month damage waiver to the
Port '0 ' Jonny bill , 2nd Stockton . MC .
Wainwright moved to accept Fisher Excavating bid to remove trees
and grade site in Prairie Creek Park, Option #2 , Time and Material,
2nd Beer . MC.

Stockton moved to approve RESOLUTION 98-8-11 - 3 RUT Annual
Report . 2nd Beer.
Discussion on an annon, letter received, the Council said if the
person did not want to take the time to appear, or give a name it
was not worth the time to discuss it.
Motion Stockton, 2nd Beer to approve the bills presented for
payment . MC.
Stockton moved to adjourn at 9 ; 10 p.m. , 2nd Beer. MC.

RESOLUTION 98-8-1 2
WHEREAS, Robert & Lois Boland, LoRoCo, Ltd. Owners of the following
described property:
The West 1/2 of the NW 1/4 of Section 10 , Township 82 , North Range
8 West of the 5th P.M. , in Linn County, Iowa, lying South of State
Highway 151 .
did make application dated January 12 , 1,998 for the annexation of
said property to the City of Fairfax, Iowa.
WHEREAS , it appears desirable and in the best ,interest of the City
of Fairfax, that said property referred to in said application be
annexed to the City of Fairfax, at this time, now therefore :
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, IOWA:
that the property herein before described, and the same is hereby
annexed to the City of Fairfax, Iowa, in the manner provided in
Section 368 . 7 , Code of Iowa, and such property shall hereinafter be

BE IT FURTHER RESOLVED, that the City Clerk be authorized and
directed to file a certified copy of this resolution, together with
the application of the owners , with the Linn County Recorder and
thereafter to be filed with the Linn County Auditor.

Recently we have had a lot of damage due to vandalism. We know that it is not always
our customers' fault, but unfortunately we have to charge the person/company that is
renting the unit(s) from us. To cut back on the charges due to vandalism we would life
to offer a damage waiver to you. The cost of the damage waiver will be $10.00 per unit
that you rent. If you would like,to add the damage waiver please call me at
319-366-3667. If you do not have the damage waiver added to your monthly billing and
damages do occur we will have no other choice then to bill you for the damages.

ORDINANCE NO. 214
AN ORDINANCE PROVIDING FOR THE REGULATION OF A DEEP WELL SITE
WITHIN THE CITY OF FAIRFAX, LINN COUNTY, IOWA, BY REGULATING THE USE
OF SURROUNDING 200 FEET OF LAND TO PROTECT THE PUBLIC HEALTH,
SAFETY, COMFORT AND GENERAL WELFARE OF THE RESIDENTS OF THE CITY
OF FAIRFAX, LINN COUNTY, IOWA.
WHEREAS, a deep well site has received preliminary approval from the Department of Natural.
Resources of the State of Iowa for a public water system in the City of Fairfax, Linn County, on
the premises described as:
Lot 95 of Fairfax Heights Subdivision in the Northwest Quarter of Section 10,
Township 82 North, Range 8 West of the 5th P.M., Fairfax, Linn County, Iowa.
WHEREAS, it is required that the City of Fairfax, Iowa, the Owner of the proposed well, submit:
proof of the legal control of contiguous land that ensures the separation distances of 200 feet or,
less will be maintained for the life of the well. Said regulation further provides that the City of
Fairfax shall submit proof that no potential sources of contamination will be constructed or
permitted within a 200 feet or less radius of the well for the life of the well, all as hereinafter
set out.
NOW THEREFORE, BE IT ENACTED by the City Council of Fairfax, Iowa:
SECTION I
Description. For the purpose of carrying out the provisions of this ordinance, the following
described area shall be designated as the Fairfax Water System. District:
All property located within the corporate boundaries of the City of Fairfax.
No building or premises shall be used and no building shall be erected except in conformity with
the regulations prescribed herein for the district in which it is located.
SECTION H
Prohibited Uses. The following uses within designated distances of the location of the well site
shall be deemed to constitute a nuisance and shall not be permitted in the Fairfax Water System
District,
Fairfax Well Regulation ordinance 1
Furthermore, upon adoption, no structure or facility of the fallowing enumerated types shall be
located within the distances hereafter set forth from the public deep well, and that during the
]Life of the aforesaid public deep well no potential sources of contamination shall be permitted
within the radius of said well to be constructed as hereinafter set out:
1. Well house floor drains - 5 feet.
2. Water treatment plant wastes - 50 feet.
3. Sanitary and industrial discharges - 400 feet.
4.a. Floor drains from well house to surface - none within 5 feet.
i. 5 - 10 feet water main materials enclosed in concrete permitted.
ii. 10 - 25 feet must be water main material.
iii. 25 - 75 feet must be watertight sewer pipe.
iv. Greater than 75 feet for any unknown pipe material.
4.b. Floor drains from well house to sewers; water, plant. wastes; storm or sanitary
sewers and drains.
i. None permitted within 25 feet.
ii. If between 25 and 75 feet, must be water main material.
iii, If between 75 and 200 feet must be watertight sewer pipe.
iv. Greater than 200 feet for unknown pipe materials.
4.c. Force mains.
i. None permitted within 75 feet,
ii. If within 400 feet, must be water main material.
5. Land application of solid waste - 100 feet.
6. Irrigation of waste water - 100 feet.
7. Concrete vaults and septic tanks - 100 feet.
8. Mechanical wastewater treatment plants - 200 feet.
9. Cesspools and earth pit privies - 200 feet.
10. Soil absorption fields - 200 feet.
11. Lagoons - 400 feet.
12.a Chemical application to ground surface - 100 feet;

13. Animal pasturage - 50 feet.
14. Animal enclosure - 100 feet.

d. Solids stockpile - 200 feet.
e. Storage basin or lagoon - 400 feet.
16. Earthen silage storage trench or pit - 100 feet.
17. Basements, pits, sumps - 10 feet.
18. Flowing streams or other surface water bodies - 50 feet.
19. Cisterns - 50 feet.
20. Cemeteries - 2001 feet.
21. Private wells - 200 feet.
22. Solid waste disposal sites - 1000 feet.
SECTION III
Penalty. 1.) Any person violating any provision of this ordinance shall be guilty of a
misdemeanor and upon conviction thereof shall be punished by a fine not to exceed one hundred
dollars, or imprisonment not exceeding thirty days. Each day any of the above described
nuisances exists constitutes a distinct and separate violation of this ordinance.
2.) Violations may also be corrected by bringing an action in District Court asking
for an injunction to abate any violation, to prevent the occupancy of any building, structure or
land, or to prevent any illegal act, conduct, business, or use.

SECTION IV
Repeals. All ordinances or parts of ordinances in conflict with the provisions of this ordinance
are hereby repealed.
SECTION V
Severability. If any section, provision, or part of this ordinance is adjudged to be invalid or
unconstitutional, such adjudication.shall not affect the validity of the ordinance as a whole or any
section, provision, or part thereof not adjudged invalid or unconstitutional.
SECTION VI
Effective Date. This ordinance shall be in effect after its final passage,approval,and publication
as provided by law.
