City Council Meeting September 8, 1998 Mayor Stallman called the meeting to order at 7 :01 p.m. Council; Present Beer, Harville, and 'Stockton. Shakespeare Absent . Beer made a motion to approve the Agenda, Minutes of the August 11th meeting, August 26th -special meeting, Clerk's Budget and Financial Reports, 2nd Stockton. MC. Wainwright arrived at 7 :06 p.m. Building Pemits :: Motion Beer to approve the permit for Evalena McNamara for a garage addition, 2nd Stockton. MC. Motion Stockton, 2nd Harville to approve a deck for Richard & Marlys Nelson. MC. Fire Chief Sankot asked the approval of Matt & Brad Meyers to the Fire Department , Motion Harville, 2nd Beer, Ayes Harville , Beer and Wainwright, Stockton Abstained. Chief Sankot explained the new addition to the Fire Station. He will have Blue Prints for the October Meeting. Casey Clark, Clark Farms Ltd. , explained to the Council the dredging of Cell #1 at the Lagoon. The difference in costs if it could be piped to a field or if it had to be trucked out . The Council decided to wait until next year for a decision. The maintenance men will continue to mow what we are now mowing. RESOLUTION 98-09--08- Selzer ' s Annexation to Fairfax. Motion Beer, 2nd Wainwright to approve the Annexation. MC. Sgt . Carol Currans presented the list of calls . They will start ticketing illegal parking, so the citizens were advised to watch their parking. The problem of the City removing trees on their property, was discussed. A committee will be formed to bring some plans to the Council for further progress in the area . Rita Nierling will talk to Vernon Cerveny and see if he would be willing to work on the Grant from Trees Forever again. Dick Ransom, City Engineer presented RESOLUTION 98-09-08 3 Change Order Number 1, on Vanderbilt Street Project . Motion Beer , 2nd Harville , to approve the Change Order . Ayes Beer, Harville , Stockton, Wainwright abstained. Motion Stockton, 2nd Harville for partial payment to Cedar Valley Asphalt. Ayes Beer , Harville, Stockton, Wainwright abstained. Maintenance report: Stockton moved that Lud go to the AWWA Water and Wastewater School, 2nd Harville . MC. The council will wait until spring to sod along Vanderbilt Street where it was dug up on the street project . Motion Stockton, 2nd Wainwright to approve RESOLUTION 98-09-08 2 , Approving the Change of Control of the Cable Communications Franchise. MC Discussion on the following items , establishing a TIF District, Questionnaire from ECIGOG, putting a culvert across Seipman, possibility of establising phone mailboxes for the Mayor and Council . PLAN AND REVAMPING ZONING. , ADJOURNMENT RESOLUTION NO. 98-09-08-2 A RESOLUTION OF TOWN OF FAIRFAX APPROVING THE CHANGE OF CONTROL OF THE CABLE COMMUNICATIONS FRANCHISE WHEREAS, TCI American Cable Holdings, L.P. ("Franchisee"') is duly authorized to operate and maintain a cable communications system in Fairfax, Iowa (the "System") by Town of Fairfax ("Franchise Authority")pursuant to a franchise(the "Franchise") granted by the Franchise Authority; and WHEREAS, pursuant to the Agreement and Plan of Restructuring and Merger among AT&T Corp. ("AT&T"), a newly formed wholly owned subsidiary of AT&T ("Merger Sub"), and Tele- Communications, Inc., the parent of Franchisee ("TCI"), dated as of June 23, 1998 (the "Merger Agreement"), Merger Sub will merge with and into TCI with TCI as the surviving corporation in the merger, and as a result of the transactions contemplated by the Merger Agreement, TCI will became a wholly owned subsidiary of AT&T (the "Transactions"); and WHEREAS, Franchisee will continue to hold the Franchise after consummation of the Transactions; and WHEREAS, FCC Form 394 with respect to the Transactions has been filed with the Franchise Authority; and WHEREAS, the parties have requested consent by the Franchise Authority to the Transactions. NOW,THEREFORE, BE IT RESOLVED AS FOLLOWS; SECTION 1. The Franchise Authority hereby consents to and approves the Transactions to the extent that such consent is required by the terms of the Franchise and applicable law. SECTION 2. This Resolution shall be deemed effective in accordance with applicable law. PASSED, ADOPTED AND APPROVED this day of F `/ 1998. ENGINEER: HALL AND HALL ENGINEERS, CEDAR RAPIDS, IOWA BACKGROUND: ITEM #1: 24" Wide P.C. Concrete Curb wl 6" Gutter; The contract quantity of 1.,3 1'8 L.F, was overun by 27 lineal feet. This was due to curb and gutter being extended further,to the south at the intersection with Church Street. ITEM #2: Type B Asphalt Surface and Base Course; The final quantity of 738.74 tons exceeded the contract quantity of 495 tons by 243.74 tons. The additional quantities were required when an extra inch of A.C.C. surface course was called for. Additional quantities were also required at the intersection with railroad street at the north end of the project. ITEM#6: 4" Thick Sidewalk, Remove and Replace; The final quantity of 682 Square Feet exceeded the contract quantity of 575 square feet by 107 square feet. This was due to the removal and replacement of the entrance to the South Slope Telephone Utility building. ITEM 49: Flowable Mortar to Seal Pipe at the Intersection of Church Street and Vanderbilt Street After exposing an abandoned corrugaded metal storm pipe under the intersection of Vanderbilt and Church Streets, It was determined that the pipe should be filled and sealed to prevent further deterioration which would lead to roadway failure. ITEM #10: Macadam Base Poor subbase material was encountered at station 6+00 in front of the Waterworks Company. 34 tons of macadam base were used to stabilize the subgrade. The price of 13.50 per ton includes the cost of coring out the designated subgrade areas. ITEM #11: Removal, grading, seal coat Replacement, Railroad Street The transition from the new A,C,C, surface to the existing seal coat surface at the intersection of Railroad Street and Vanderbilt Street required additional work to match the existing grade and surface. The lump sum price of$2,500,00 included the removal, regrading and replacement of the existing seal coat.
