CITY OF FAIRFAX City Council Meeting October 13 , 1998 Mayor ProTem Wainwright called the meeting to order at 7 : 03 p.m. Council present Beer, Shakespeare and Stockton , Absent Mayor Stallman and Harvill.e. Motion to approve the Agenda, Minutes of September 8th Council Meeting, Clerk' s Budget and Financial Reports by Beer , 2nd Stockton, MC. Motion Wainwright ,, 2nd Beer to approve the building permit for John Helms for an addition to his house .. MC. Dick Ransom, City Engineer, discussed the Water and Sewer Extensions . Dick requested permission for the clerk to publish for bids . Motion Stockton, 2nd Beer the clerk will publish for bids on October 22nd. MC. Sgt Carol Curran presented the Sheriff ' s report . Gordon Sevig talked to the Council about some revisions on the Preliminary Plat for Fairfax Heights Sub Division. Discussion on the Construction Bond. Steve Waln filed a nuisance Complaint about the dirt that was hauled in on the adjoining property. They are requesting that the adjoining property owners either remove or level the dirt pile . Fire Chief Sankot reported that work has begun on the addition to the Fire Station. The fence around the tennis court will be removed to make room for parking. Librarian Terry Thompson gave the Library report . There has been a 6% decrease from last year . The sheriff ' s department will make more runs by the library between the hours o�f 4-8 p.m. ORDINANCE 216 - CONSUMER DEPOSITS - Motion Stockton, 2'nd Shakespeare to approve Ordinance 216 . MC, Beer moved the approval of Ordinance 216 on its first reading and that the procedural requirements as setforth in Section 380 . 3 , Code of Iowa, be suspended as provided for in that section, and that Ordinance 216 be placed on its second and third readings by its title . 2nd Shakespeare . MC. RESOLUTION 98-10-13 , To set Date for Public Hearing on Urban Renewal Plan. Motion Stockton, 2nd Beer to approve the Resolution. MC. Motion Wainwright , 2nd Shakespeare the City Clerk was appointed representative for the "consultation session" with the local county, school district , and community college . The session is set for October 27th at 1 : 00 p . m. at City Hall . MC. Motion Shakespeare , 2nd Wainwright the Clerk was given permission to attend IMFOA meeting October, 21-23 . MC. Discussion on the following items , building codes , tapping fees , park committees and the newsletter . If there are any items for the newsletter they sould be turned in to City Fall by October 30th. Motion Stockton, 2nd Shakespeare to pay the bills presented. Ayes Beer , Shakespeare and Stockton , Wainwright abstained. MC. Motion Shakespeare , 2nd Wainwright to adjourn at 9 : 17 p.m. Marianne Wainwright Mayor Protem Betty Panek, City Clerk t ORDINANCE 216 TITLE VI—Comm NITY DEVELOPMENT AND ENVIRONMENT CHAPTER 1—WATER SERVICE ARTICLE III—WATER RATES SECTION 6-1.0306, SECTION 6-1.0307—PROPERTY OWNER RESPONSIBLE AND SECTION 6-1.0308—LIEN FOR NONPAYMENT BE IT ORDAINED BY THE CITY COUNCIL OF FAIRFAX, IOWA. SECTION 1. The purpose of this ordinance is to amend Section 6-1.0306—Consumer Deposits, Section 6-1.0307—Property Owner Responsible and Section 6-1'.0308—Lien for Nonpayment, of Title VI—Community Development and Environment, Chapter 1—Water Service, Article 3— Water Rates of the City Code of Fairfax, Iowa, SECTION 2. Section 6-1.0306—Consumer Deposits, of Title VI—Community Development and Environment, Chapter 1—Water Service,Article 3—Water Rates of the City Code of Fairfax, Iowa,is hereby amended by deleting Section 6-1.0306 in its entirety and substituting in lieu thereof the following: "6-1.0306 CONSUMERDEIPOSITS. There shall be required from every consumer or prospective consumer of water deposit intended to guarantee the payment of bills for service as follows: 1, A deposit of$90,00 shall be paid to city for residential rental properties where the charges for water services are separately metered and paid directly by the tenant. A deposit of$60.00 shall be paid to the city for all other properties," SECTION 3. Section 6-1.0307 Property Owner Responsible, of Title VI—Community Development and Environment, Chapter 1—Water Service,Article 3—Water Rates of the City Code of Fairfax, Iowa, is hereby amended by deleting Section 6-1,0307 in its entirety and substituting in lieu thereof the following: "6-1,0307 PROPERTY OWNER RESPONSIBLE, All rates or charges for water service, if not paid as provided by Ordinance or Resolution, are a lien upon the premises served and shall be enforced as provided in Section 384.84 of the Iowa Code." SECTION 4. Section 6-1.0308 Lien for Nonpayment of Title VI Community Development and Environment, Chapter 1—Water'Service, Article 3—Water Rates of the City of Fairfax, Iowa, is hereby amended by deleting Section 6-1.0308 in its entirety. SECTioN 5, All ordinances and parts of ordinances in conflict hereof are hereby repealed. SECTION 6. Severability. If any section,provision or part of this Ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, unconstitutional. SEcTIoN 7. Mayor Attest: Q, ity Clerk Fairfax-419915-3\UR Hrg Set Date RESOLUTION NO. 9 8-10 1' 3 Setting date for a public hearing on designation of the Fairfax Urban Renewal Area and on urban renewal plan and project ; WHEREAS, studies have been conducted which show the desirability of designating a. portion of the City of Fairfax as the Fairfax Urban Renewal Area, pursuant to the provisions of Chapter 403, Code of Iowa; and WHEREAS, a proposal has been submitted to the Council under which an area within the boundaries set out in Exhibit A would be designated an urban renewal area; and WHEREAS,this Council is desirous of obtaining as much information as possible from the residents of the City before making this designation; and WHEREAS, a proposed urban renewal plan for a project within that proposed designated area has been prepared and it is now necessary that a date be set for a public hearing on the designation of the area and on that plan and project; NOW, THEREFORE, Be It Resolved by the City Council of the City of Fairfax, Iowa, as follows: Section 1. This Council will meet at the City Hall , Fairfax, Iowa, on the 10`x' day of November, 1998, at 7 o'clock P .m., at which time and place it will hold a public hearing on the designation of the proposed Fairfax Urban Renewal Area described in the preamble hereof and on the proposed urban renewal plan and project for said Area. Section 2. The City Clerk shall publish notice of said hearing, the same being in the form attached to this resolution, which publication shall be made in a legal newspaper of general circulation in Fairfax, which publication shall be not less than four (4) nor more than twenty (20) days before the date set for the hearing.
