Mayor Stallman called the meeting order at 7 : 0.0 p.m. Council
present Beer', Harvil.le, Shakespeare and Wainwright . Absent.
Stockton.
Motion by Beer to approve the agenda, Minutes of the January 12,,
1999, Clerk;s budget and financial reports . MC.
Mayor Stallman opened the Public Hearing on the Well Construction
at 7 : 02 p.m. Questions on the Aquifer and the effect of the new
well on the surrounding wells . The public hearing closed at 7 : 10
p.m. Mike Hart, Hart-Frederick, and Dick Ransom, Hall & Hall,
opened the bids received on the Well Construction. Motion Beer, 2nd.
Wainwright, to issue notice of award, contingent based on review by
Hart and Ransom, and Mayor Stallman given authority to sign all
documents . MC.
RESOLUTION 99-02-09, placing plans, specifications, form of
contract and estimated cost on file and direct publication of the
notice to bidders and set up the public hearing on the 1999 water
storage construction. Motion Beer, 2nd Shakespeare to approve the
Resolution. MC. Stockton arrived at 7 :30 p.m.
Sgt . Carol Curran presented the list of calls from the Sheriff Is
department .
Jerry Michael discussed with the council building inspections and
building permits .
RESOLUTION 99-02-09-1, Approving Plat of Boland" s First Addition
to Linn County, Iowa. Motion Beer, 2nd Wainwright to approve the
Plat. MC.
Motion Stockton, 2nd Beer to approve the Revised Preliminary Plat
of Fairfax Heights 2nd Addition to Fairfax. MC,
Motion Wainwright, 2nd Shakespeare to correct the agenda to read
RM-5 on the rezonings . MC
Rezoning of Fairfax Heights First Addition to Fairfax, lots 11,
12, 13, 29, 50, 51, 71 & 72 from RS to RM-5 . Motion Wainwright, 2nd
Stockton to approve the rezoning. MC. Rezoning of Lots 82-99 in
Fairfax Heights 2nd Addition to Fairfax from C-2 to RM-5, motion
Stockton, 2nd Beer to approve the rezoning. MC. Shakespeare left at

Julie Vorhes and Mice Berkshire, Bluestem, discussed the OCC ban.
ORDINANCE 217, Amending Chapter III, Article 4, "Mandatory
Separation and Recycling of Recyclable Corrugated Cardboard" .
Motion Wainwright, 2nd Harville to approve. Ordinance 217 . Beer,
moved the approval of Ordinance 217 on its first reading and that
the procedural requirements as setforth in section 380 .3, Code of
Iowa, be suspended as provided for, and that Ordinance 217, be
placed on its 2nd and 3rd readings by its title, second Stockton.

Motion Beer, 2nd. Harvi.11e to award Steelsmith (Waste Mangement
Systems) the Garbage, Contract for 3 years . MC.
Motion Narville, 2nd Beer to accept Prairieroad Builders contract
for the street repairs . MC.

'AN ORDINANCE AMEN-DING CATER Title I I I Article IV
OF TIRE MUNICIPAL CODE OF _-Fairfax >
IOWA BY ADDING NEW PROVISIONS TO ESTABLISH
AND DEFINE A NEW SECTION,BEING SECTION
"MANDATORY SEPARATION AND
RECYCLING OF RECYCLABLE CORRUGATED
'CARDBOARD", rROVIDING DEFINITIONS AND
REQUIRING THE SEPARATION AND RECYCLING
OF RECYCLABLE CORRUGATED CARDBOARD.
WHEREAS, pursuaot to Iowa Code 455D,3, the goal of'thc state is to reduce the
amount of the materials in the waste stream by fifty percent by July 1,2000; and
WHEREAS,pursuant to Iowa Code 455B,301A, alternative methods of
managing solid waste and a reduction in the reliance upon land disposal of solid waste
are encouraged through such methods.as volume reduction at the source and recycling
and reuse; and
WHEREAS, pursuant to Iowa Code 455B.302, every city and county of this state
shall provide for the establishment,and operation of a comprehensive solid waste
reduction program consistent Nvith the waste management hierarchy under section
45513-301 A; and
WHEREAS, pursuant to Iowa Code 455D.21, a city council or county board of
supervisors which provides for the collection of solid waste by its residents shall consider
as a proposed ordinance the mandatory curbside collection of recyclable materials which
have been separated from other solid waste; and
WHEREAS, pursuant to Iowa Code 455B.306, all cities and counties shall file
with the director(the Iowa Department of Natural Resources) a comprehensive plan
detailing the method by which the city or county will comply with the requirements of
section 455B,302, said plans (having been films and approved and which sets out a
program for old corrugated cardboard(OCC) recycling, including a landfill bap and
public education; and
WHEREAS,pursuant to the 28E Agreement with the Bluestem Solid Waste
Agency, Members and Associate Members agree to enact ordinances concerning the
collection, gathering, separation, recycling, delivery or any other management or
disposition of solid waste and to enforce said ordinances as required to meet the solid
waste management obligations imposed by state or federal laws.

NOW, THEREFORE, RE IT MDAINED BY THE MY COUNCIL OF THE

1. PURPOSE
The responsibility for proper Solid Waste and Recyclable Materials management
rests with the Generator of the Solid Waste or Recyclable Materials, The responsibility
for rovidin Solid Waste management and those services that avail the Generator
P � proper er P mane S
of the opportunity for proper Solid Waste and Recyclable M a
terials management rests
with cities or tho county, Private,and public service providers transport Solid Waste and
Recyclable Materials to support this management system.
Landfill disposal of Recyclable Corrugated Cardboard is unnecessary. Recyclable
Corrugated Cardboard is easily identifiable, can be readily recycled locally, and facilities
and resources are reasonably available in Linn County for the Recycling mid reuse of
Corrugated Cardboard, Recyclable Corrugated Cardboard should be precluded from
landfill disposal so as to extend landfill capacity, which is a limited resource. This
Ordinance supports the landfall ban of Recyclable Corrugated Cardboard in Linn County
by requiring the separation and Recycling of Recyclable Corrugated Cardboard,
Section 2. DEFINTTIONS
The following words and phrases used in this Ordinance, unless the context
clearly indicates otherwise,, shall have the meaning ascribed to them in this Section.
"Blueatem Solid 'Waste Agency" means the Cedar Rapids/Linn County Solid
Waste Agency created under Iowa Code Chapter 28E.by the City of Cedar
Rapids and Linn County.
"Corrugated Cardboard" includes containers or materials used in containers
that have three or more layers of Kraft paper material; at least two exterior flat
layers with one wavy interior core.
V+Cenerator" means any person or entity whose activities or process produces
solid waste.
"Non-recyclable Corrugated Cardboard" m ea n s car
dboard with permanently
attached packing material and/or non-paper liners; wax-coated cardboard;
cardboard contaminated with oil, paint, blood, or other organic materials; or
cardboard contarniniated with any other Material that renders the corrugated non-
marketable. It does not irnclude cardboard that has been contaminated through
compaction in a hauling vehicle.

"Person" means any individual; municipality, public subdivision or other
governmental or public agency;public or private corporation; partnership, firm or
association; other organization,receiver, trustee,`assignee, agent; other legal
representative of any of the foregoing; or other legal entity.
"Recyclable Corrugated Cardboard" includes marketable corrugated
cardboard that may have glue, staples and/or tape, but dares not have perrrmanently
attached packing material and/or non-paper liners and is not waxed, or
contaminated with oil, paint, blood or other organic materials,
"Recyclable Materials" means those materials cwrnposllrrg.solid waste that can
be collected, processed, and used in the manufacturing of product or good.
"Recycling" means any process by which waste, or materials that would
otherwise become waste, are collected, separated, or processed or returned to use
in the form of raw materials or products. "Recycling" dares not include any form
of energy recovery.
"Solid Waste" means garbage, refuse, rubbish, and other similar discarded solid
or semisolid materials, including but not limited to such materials resulting from
industrial, commercial,agricultural, and domestic activities. Solid waste may
include vehicles as defined by Section 321.1, subsection 90 of the Iowa Code.
Solid waste does not include hazardous waste as defined in Section 4558 4'1 I f

the Iowa Code, or source, special nuclear, or by-product material as defined in the
Atomic Energy Act of 1954, as amended to January 1, 1979,or petroleum
contaminated soil which has beers remediatml to ace table state or federal
standards,
Se i rr 3 As a part of the establishment and operation of a comprehensive
solid waste reduction progmn consistent with the waste management hierarchy under
section 455B,301A of the Jowa Code, and consistent with and to the extent pro,.ided by
the authority granted by Iowa Corte section 45511,302, all Recyclable Corrugated
Cardboard shall be separated by the Generator from all other garbage, refuse and rubbish
fbr the purpose of Recycling, Recyclable Corrugated Cardboard may be mixed with
other approved Recyclable Materials for Recycling. Recyclable Corrugated Cardboard
that has been separated from all other garbage, refuse and rubbish may be mixed with
approved compostable materials and may be composted.
ction 4, VIOLATIONS AND PENALTY
Any Person, firm, or corporation who violates, disobeys, omits, neglects, or who
refuses to comply with, or who resists the enforcement of any of the provisions of this
Ordinance shall, upon conviction,'be fined not more than one hundred dollars ($100.00),
or be imprisoned for not more than thirty (30) days for each offense, Each day that a

violation is permitted to exist shall constitute a separate offense,
Section 55. SEVERABILITY OF PROVISIONS
It is the intention of the City Council that each section, pare ra h, sentence

To fix a date for a public hearing on a loan agreement in a principal amount not to
exceed $500,000
WIiEREAS,the City of Fairfax,in the County of Linn,State oflowa(the„City"), proposes
to enter into a loan agreement(the"Loan,Agreement")in a principal amount not to exceed$500,000
pursuant to the provisions of Section 384.24A of the Code of Iowa for the purpose of paying the cost,
to that extent, of the construction, reconstruction, improvement, extension and equipping of the
Municipal Waterworks System of the City; and the construction of works and facilities useful for
the collection and disposal of sewage and industrial wastes in a sanitary manner, and it is necessary
to fix a date of meeting of the Council at which it is proposed to take action to enter into the Loan
Agreement and to give notice thereof as required by such law;
NOW, THEREFORE, Be It Resolved by the City Council of the City of Fairfax, Iowa, as
follows;
Section 1. This Council shall meet on the 9 1k day of March, 1999, at the
City as i ,in the City,at 7,--00 o'clock p .m.,at which time and place a hearing will
ire held and proceedings will be instituted and action taken to enter into the Loan Agreement,
Section 2. The City Clerk is hereby directed to give notice of the proposed action on the

The City Council of the City of Fairfax,Iowa,will meet on the' °day of March, 1999, at the

proceedings and taking action to enter into a loan agreement(the „Loan Agreement") and borrow
motley in a principal amount not to exceed $540,000 for the purpose of paying the cost, to that

Waterworks System of the City;and the construction of worsts and facilities useful for the collection
and disposal of sewage and industrial wastes in a sanitary manner.
The Loan Agreement is proposed to be entered into pursoant to authority contained in,Section
354.24A of the Code of Iowa and will constitute a general obligation of the City,
At the aforementioned time and place,oral or written objections may be filed or made to the
proposal to enter into the Lean Agreement. After receiving objections,the City may determine to
enter into the .Loan Agreement, in which case, the decision will be final unless appealed to the
District Court within fifteen(.15)bays thereafter.

Meeting of Fairfax Planning and Zoning Commission Monday February
8, 1999 . Present Larry McNeal, Kenny Selzer, Chair protem, Harry
Stallman and Dean Hartman.
1. In consideration of the Final Plat of Boland' s First
Addition(see attached documents) , which is outside the city limits.
Moved by Stallman, seconded by McNeal to approve the plat. Passed
3-0, 1 abstained. Note.: This is not an addition to Fairfax.
2. In consideration of the request for rezoning of Fairfax Heights
First Addition, lots 11,12, 13,29, 50, 51, 71 and 72, from RS to RM-5 .
Moved by McNeal, Seconded by Stallman to approve the request.
Passed 3-0, 1 abstained.
3. In consideration of the revised preliminary plat for Fairfax.
Heights Second Addition to Fairfax, and a request for rezoning of
same, lots 82--99, from C-2 to RM-5. Moved by Stallman, seconded by
McNeal to approve both requests. Passed 3--0, 1 abstained.
Chad Sands, SCIGOG, presented the finial portion of the
comprehensive plan for our consideration. At the March 8, 1999
meeting he will present the revised version for our approval.
