P e , City Clerk RESOLUTION NO. 99-03- 9— d RESOLUTION MAKING AWARD OF CONTRACT WELL 99-3 PROJECT FAIRFAX, IOWA BE IT RESOL-NVEL BY THE CITY COUNCIL OF THE CI"T"Y OF FAIRFAX,IOWA. That the bid of Gingerich Well&Pump Service,Kalona,Iowa, in the amount of $25,690.00, for the construction of the Well 99-3 Project, described in the plans and specifications hereto fore adopted by this Council after public hearing,be and is hereby accepted, as the lowest responsible bid received, and a contract is hereby awarded. The contractor is hereby instructed to promptly execute the construction contract and return the same to the City Clerk along with all the supporting documents required therein, including surety bond covering work to be performed and proof of satisfactory insurance coverage. That the City Clerk,with the assistance of the Consulting Engineer is thereafter directed to examine the contract for proper execution and all supporting documents, including surety bond and proof of insurance coverage to determine satisfactory compliance with contract specifications. AYES: Wainwright NAPES: Tone Beer Harville Shakespeare Stockton Irr �4m ayor ATTEST: Betty e City Ulerk Fairfax/419915-3/2nd Yi Hrg/Prelevy RESOLUTION NO. 99-03-091-3 Authorizing a Loan Agreement and$500,000 General Obligation Corporate Purpose Notes and providing for the levy of taxes to pay the same WHEREAS, pursuant to the provisions of Section 384.24A of the Code of Iowa, the City Council(the "Council") of the City of Fairfax(the "City"),in the County of Linn, State of Iowa, has heretofore proposed to contract indebtedness and enter into a loan agreement in a principal amount not to exceed$500,000 (the "Han Agreement") to provide funds to pay the cost, to that extent, of the construction, reconstruction, improvement, extension and equipping of the Municipal Waterworks System of the City; and the construction of works and facilities useful for the collection and disposal of sewage and industrial wastes in a sanitary manner; NOW, THEREFORE, Be It Resolved by the City Council of the City of Fairfax, Iowa, as follows: Section 1. The City hereby determines to enter into the Loan Agreement with a lender (the "'Lender") to be selected in the future, providing for a loan to the City in the principal amount of$500,000 for the purpose or purposes set forth in the preamble litreof. Section 2. General Obligation Corporate Purpose Notes shall be issued in the principal amount of$500,000 in evidence of the City's obligation under the Doan Agreement at the time such funds are needed. The Notes shall bear interest, shall be payable as to principal and interest on the dates and in the amounts, may be subject to prepayment prior to maturity and may contain such other terms and provisions as shall be determined by the Council at the time the Notes are issued, and this resolution shall then be amended to so provide. Section 3. Section 4. A certified copy of this resolution shall be filed with the County Auditor of Linn County, and said Auditor is hereby instructed to enter for collection and assess the tax hereby authorized. When annually entering such taxes for collection,the County Auditor shall include the same as a part of the tax levy for Debt Service Fund purposes of the City and when collected, the proceeds of the taxes shall be converted into the Debt Service Fund of the City and set aside therein as a special account to be used solely and only for the payment of the principal of and interest on the Notes hereby authorized and for no other purpose whatsoever. Section 5. It is the intention of the City that interest on the Notes be and remain excluded from gross income for federal income tax purposes pursuant to the appropriate provisions of the Internal Revenue Code of 1986, as amended, and the Treasury Regulations in effect with respect thereto (all of the foregoing herein referred to as the "Internal Revenue Code"). In furtherance thereof, the City covenants to comply with the provisions of the Internal Revenue Code as they may from time to time be in effect or amended and further covenants to comply with the applicable future haws, regulations, published rulings and court decisions as 'nay be necessary to insure that the interest on the Notes will remain excluded from gross income for federal income tax purposes. Panek City Clerk City Hall PO Box 337 Fairfax, 1A 52225-0337 RE: Fairfax Urban Renewal Area Our File No. 419915-3 Dear Betty: I am writing to give you additional information about a section of the Urban Renewal Plan which has been approved for the Fairfax Urban Renewal Area, You have asked about the applicability of Section "F" of the Plan, entitled "Residential Development." The first paragraph under Section "F" states the following: The proposed project activities outlined under Section "F' of this Plan will not obligate the City to comply with the low-and-moderate-income requirement for housing development which was adopted by the Iowa General Assembly in 1996. However,to the extent that the City undertakes other activities which directly support residential development, the low-and-moderate-income requirement may apply. By way of background, in 1996 the Iowa General Assembly amended the Urban Renewal Law to require that any City which made tax increment assistance available with respect to infrastructure which would directly benefit the construction of housing, would have to provide a certain percentage of the tax increment benefits to assist families whose incomes met a low-and- moderate-income level. In reviewing this Urban Renewal Plan and the activities which are currently underway, it is my opinion that the City is not required to set aside any tax increment revenues to benefit low and moderate income f'ainilies. However,as the Plan states,to the extent that other kinds of activities would be undertaken in the future,which might be providing direct assistance to housing developers, it might become necessary to set aside 34,71% of the tax increment revenues to be received from those activities to benefit families of low and moderate income.
