Council Meeting
April 13, 1999
Mayor Stallman called the meeting to order at 7:00 p.m.Council present,Beer,Harville,Shakespeare,and
Stockton, Absent Wainwright,
Jeri Serbousek, student at Prairic High attended for a government class,, also in attendance were residents
of East Beverly Road,
Motion Stockton,Td Shakespeare to approve the agenda,minutes of the March 9`s Council Meeting,
Clerk's budget and financial reports.MC.
Building Permits: Motion Harville,2nd Stockton to approve the permit for Marls Neuhaus for a window
and canopy over the window and door.MC.Motion Beer,2°d Shakespeare to approve the Legion requests
to install a canopy and curb. MC.Motion Stockton, 2nd Beer to approve the permit of Todd Jacobs to build
a garage and install a culvert,using the same size as the other culverts along E.Cemetery Rd, MC,
Dean Wheatley,Long-Range Planning Manager for Cedar Rapids,presented the Cedar Rapids Land Use
Plan that would bring their limits out to Fairfax.There was discussion with the residents of Beverly Road
about Cedar Rapids Plans to include them
Vernon Cerveny discussed the City receiving the Living Roadways Grant.The trees have been planted
along Vanderbilt and Main.The Council extended a Thank you to Vernon.for all the time he has spent on
acquiring the Grant,and a job well done.
Brian Capouch, Star Saloon, said that he was getting bids for the siding on the building,and that the work
would be completed before USA Days,
Sgt.Lyle Rusk discussed the list of calls from the Linn County Sheriffs Department, Sgt. Rusk was asked
to keep an eye on the newly planted trees,and to make more trips down to Prairie Creek Park because of
the vandalism.
Discussion on the sodding of Vanderbilt Street. Harville recommended that since the city had 2
maintenance men that they could do the job. After much discussion Shakespeare made a motion that the
sodding be let to Hynek Farms,2"d Stockton_Ayes Shakespeare, Stockton„Beer. Nay Harville.Ab.
Wainwright, MC.
Librarian Terry Thompson is resigning effective June 1",Brenda Haendler was appointed to replace
Maxine Meeks on the Library Board,The Library Board will purchase signs to be placed on the highway
and in Fairfax to mark the way to the Library.

Shakespeare left at 8:10 p.m.
Fire Chief Saukot told the Council that the new addition was completed and invited everyone to take a
tour at the end of the Council Meeting.
Lud explained the bid from Graybill Electronics for the Lift Stations,Motion Beer,TO Stockton to
approve the Bid.MC. Lud will contact contractors about bids for replacing the water line along Prairie
from Hwy 151 to Nickolet,and have them ready for the May meeting.
Motion Beer,2nd Harville to reappoint Dean Hartman and Dennis Heintz to Planning and Zoning and
accept the resignation of Larry McNeal and appoint Robert Collett to fill his unexpired term on Planning
and Zoning.MC.
Opportunity for citizens: Greg Fetter said the Baseball Steak Fry will be June 12`h.A letter will be sent to
Todd Philipps about putting his sidewalks back in around his building.
Motion Stockton,2�d Beer to approve the bills presented for payment.MC.

RESOLUTION NO. 99-04-13-1
RESOLUTION MAKING AWARD OF CONTRACT
1999. WATER TOWER PROJECT
FAIRFAX, IOWA
BE IT RESOLVE D BY THE CITY COUNCIL OF THE CITY OF FAIRFAX,
IOWA.
That the bid of Caldwell Tanks, Inc., Louisville, Kentucky in the amount of
$319,000.00, for the construction of the 1999 Water Tower Project, described in the plans
and specifications hereto fore adopted by this Council after public hearing, be and is
hereby accepted, as the lowest responsible bid received, and a contract is hereby awarded.
The contractor is hereby instructed to promptly execute the construction contract
and return the same to the City Clerk along with all the supporting documents required
therein, including surety bond covering work to be performed and proof of satisfactory
insurance coverage.
That the City Clerk,with the assistance of the Consulting Engineer is thereafter
directed to examine the contract for proper execution and all supporting documents,
including surety bond and proof of insurance coverage to determine satisfactory
compliance with contract specifications. If all documents are in order the City Clerk
shall approve the same in waiting and place written approval on file in the office of the
City Clerk.
That the Mayor and City Clerk be and is hereby authorized and directed to
execute the contract for and on behalf of the City and upon execution the contract shall be
in full force and effect.

A RESOLUTION SETTING THE SALARIES FOR EMPLOYEES OF THE CITY OF
FAIRFAX FOR THE FISCAL YEAR 199912000.
BE IT RESOLVED BY THE CITY COUNCIL OF FAIRFAX,IOWA:
Section 1. The following positions named shall be paid the salaries or wages indicated and the City Clerk
Is authorized to issue checks,less legally required or authorized deductions from the amounts
Set out below,and make such contributions to]PER'S,FICA and other purposes as required by
Law,or order of the City Council,all subject to audit and/or review by the City Council.
CITY CLERK: $9.95 per hour—M,'T,W,&F(32 Office Hours and 4 non office hours)
LIBRARIAN: $9.11 per hour A 23 hrs per week.
CHILDREN'S LIBRARIAN:$6.06 per hour @ 13 hrs per week.
SUBSTITUTE HELP: $5.86 per hour @ 2 hrs per week.
SATURDAY HELP: $5.50 per hour @ 3 firs per week.
]MAINTENANCE MEN:$11.95 per,hour tx 40 hours per week.
Section 2. OVERTIME: Any time over the regular hours shall be taken off'during the pay period as
Regular time.
Section 3. The city shall provide the Clerk and Maintenance men with Wellmark(Blue Cross)insurance.
The city shall be responsible for the$500 deductible. (Single Policy Only.)
Section 4. The Clerk and Maintenance Men shall be paid for the following]Holidays:NEW YEAR'S
DAY,GOOD FJUDAY MEMORIAL DAY,4TH OF JULY,LABOR DAY,THANKSGIVING,
DAY AFTER TkIANK.SGIVING, CHRISTMAS EVE DAY AND CHRISTMAS.
Section 5. The Clerk and Maintenance Men shall be allowed four(4)sick days per year,sick days may be
Accumulated up to thirty(30)days. They shall be allowed three(3)Bereavement Days per year
For immediate family members only. (Spouse,Children,Parents,Brothers, Sisters,and in-laws)
They may not be accumulated,After using five(5)consecutive sick days,at the discretion of the
Mayor,a doctors verification may be requested.
Section 6. Vacation Schedule: Forty(40)hours after one year,eighty(80)hours after three years,and
120 hours after seven years.

Dear Betty
Please provide copies of this letter to the mayor and gather council rnetubers and
anyone on the Planning and Zoning Commission or the Board of Adjustment. Please also
note that it must be, Dept confidential among these groups in order to preserve the
attornoy/client privilege.
You have asked for legal advice concerning several questions Kenny Selzer raised
at the council's March 9�, 1 999 meeting. We have reviewed the relevant documents,Iowa
Code provisions and municipal ordinances and have also conferred with your counsel for
the TIF/Urban Renewal matters,Bcb Josten, You may wish to refer to Mr. Josten's letter
dated March 4, 1999, Our reply to the specific points Mr, 'Selzer has raised is set forth
here.
First,the question was raised whether a developer's restrictive covenants could be
construed as unlawful and therefore somehow expose the City to liability for the same.
As a threshold matter, this would not be considered a goverment action unless the City
affirmatively undertook to enforce the impermissible provision of the agreement,
covenant,deed or other nstrurnent. We have found no authority for the proposition that
the City woald otherwise be exposed to liability for such a private covenant.

Second, a question was raised about the effect of paragraph (6), Iowa Code
section 403.22(Public improvements related to housing and residential development-low
