City Council Meeting
July 13, 1999
Mayor Stallman opened the meeting at 6.05 p.m. Council present Beer,Wainwright Stockton arrived at
5.15 p.m.Absent Shakespeare and Harvilie.
Discussion on the ditches on East Cemetery Rd. The city will pay to clean the ditches,the residents will
be responsible to follow the grades for their culverts,and the city will seed the ditch in the fall if it is
needed.
Beer moved to approve tho Agenda,Minutes of the June 8'6 Council Meeting,Clerk's Budget and
Financial Reports,2nd Wainwright.MC.
Deputy Sherry Correia,presented the fist of calls. She was asked to do a check on people running the stop
sign on Vanderbilt and Prairie.
Building Pen-nits,Motion Stockton, 2"d Beer to approve the permit for Brian and Tina Merta for a single
family borne.MC Motion Wainwright;2"d Beer to approve the permit for Donald and Betty Regan for an
addition to their home_MC.Motion Stockton,2"d Wainwright to approve the permit of Bill&Wendy Voss
for a covered deck. MC.Motion Wainwright,2nd Beer to approve the permit of Robert&Terresa Krahnier
for a Garage.MC.
RESOLUTION 99-07-13, Final Plat of Fairfax Heights Second Addition to Fairfax,Iowa.Planning and
Zoning approved the Plat on July 12'h.Motion Beer, 24 Stockton to approve the Final Plat.MC.
The rezoning request of Bill Gibney from 9RS to RM was opened for discussion. A petition was placed on
file. The City Engineer,Dick Ransom,discussed the width of the driveway that would go back to this
property. The request was tabled until the other eouncilperson was here.
RESOLUTION 99-07-13-1,Extending the Maturity Date of an outstanding Warrant issued to pay costs in
connection with the construction of the Fairfax Water and Sewer Improvements Project. Motion
Wainwright,2nd Beer to approve Resolution 99-07-13-1,MC,
Prairie Roadbuilders proposal for street work.Motion Stockton 2"d Beer to let Mayor Stallman fine-tune
the proposal,not to exceed$10,000,or with approval of council to exceed that amount.MC.
Carol Niles,new Library Director introduced herself to the council She said that everything was running
smoothly,and the summer reading program was above average.
Fire Department—Cory Stockton wanted to let the public know that with the new station addition,the
station is being manned more hours.He also wanted the public to thank the Firemen for the excellent job
they did on the Fireworks. Without the cooperation of area merchants and citizens,and the contributions at
the gate they would not be able to do the fWworks,so please patronize the local businesses.

cleaning sewer lines and lift stations.MC. Stockton moved to send Lud to Water and Wastewater School

Opportunity for citizens:The water problem on Prairie Ave,certified letter sent to Ron Hilton about

Motion Stockton, 2'Wainwright to approve the bills presented for payment,MC.
Mayor Stallman recessed the meeting at 9:00 p.m.for 10 minutes. Counncilperson Harville was delayed at
work,so he was put on a speaker,Atone to finish the business at hand.ORDINANCES—Motion Beer,2"d
Wainwright to adopt Ordinance 218A—An Ordinance adopting the Unil'brm Building Code.MC.Motion
Beer,2"d Wainwright to adopt Ordinance 218B—An Ordinance adopting the Uniform Mechanical Code.
MC,Motion Wainwright;2"d Beer to adopt Ordinance 2I8C—An Ordinance adopting the Uniform
Plumbing Code.MC.Motion Beer,,2nd Wainwright to adopt Ordinance 218D—An Ordinance adopting the
National Electrical Code.MC.Beer moved the approval of Ordinances 218A thru 218D on its first reading
and that the procedural requirements as setforth in section 380,3, Code.of Iowa,be suspended as provided
for in that section,and that the Ordinances be placed on its second and third readings by its title. Zed
Wainwright.
Bill Gibney rezoning was brought back before the council, motion Stockton,2"d Hazville to deny the
request to rezone from 9RS to RM. All ayes.

AN ORDINANCE AMENDING TITLE 6 OF THE CODE OF
ORDINANCES OF THE CITY OF FAIRFA ,IOWA
BY ADOPTING CHAPTER 9 THEREOF.
BE IT ENACTED by the City.Council of the City of Fairfax,Iowa:
SECTION 1. UNIFORM BUILDING CODE ADOPTED: Sections 6-9.01 through 6-
9.05 as set forth in the attached ordinance are hereby adopted as Chapter 9 of Title 6 of
the Code of Ordinances of Fairfax, Iowa.
SECTION 2. REPEALER.: All ordinances or parts of ordinances in conflict with the
provisions of the attached ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE: If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect
the validity of the ordinance as a whole or any section, provision or part thereof not
adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE: This ordinance shall be in effect from and after its
final passage, approval and publication as provided by law.

69.01 Uniform Building Code (Adoption by
Reference
As hereafter modified, that certain Building Code known as the Uniform Building
Code, 1997 Edition, Volumes 1, 2 and 3, as prepared and edited by the International
Conference of Building Officials, is hereby specifically incorporated hergin by reference,
and shall be known as the "'Building Regulations for the City of Fairfax.:" The Building
Regulations shall be controlling in the construction of buildings and other structures and
in all matters covered by said Building Regulations within the jurisdiction of Fairfax,
Iowa.
As part of the City's Building Regulations, a complete, current and official copy
of the Uniform Building Code shall be kept in the office of the City Clerk pursuant to the
provisions concerning availability hereinafter set forth.

6-10.01 Uniform Mechanical Code (Adoption by Reference)

An owner may do heating-cooling work in the single-family dwelling in which
such owner resides without being licensed, provided that owner demonstrates capability
to do such work by successfully completing a standard examination, and further provided
that owner obtains a permit and otherwise complies with the provisions of the Fairfax
Mechanical Regulations.
6-10.07 Availability of Mechanical Regulations
An official copy of the Mechanical Regulations, including a certificate by the City
Clerk as to their adoption and the effective date thereof, shall be maintained on file in the

WHEREAS, the City Council, Fairfax, Iowa, adopted the Plumbing Regulations

WHEREAS, the Plumbing Regulations authorize the City Council to set building
permit and inspection fees by resolution.
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the City
Council, Fairfax, Iowa, this date met in lawful session, and that the following Table 1-A
Plumbing Permit and Inspection Fee Schedule applicable to the erection, installation,
alteration, repair,relocation,replacement, addition to, or use or maintenance of plumbing
systems within this jurisdiction is adopted and shall be, by this action, effective

The City Council of the City of Fairfax, Iowa, met on July 13, 1999, at 6: 00 o'clock

in the City. Mayor resided and the roll being
called,there were present the Mayor in the chair, and the following named members of the Council

The Council took up and considered the question of extending the maturity date of an
outstanding warrant previously issued to pay costs in connection with the construction of certain.
Water and Sewer improvements. After due consideration and discussion, Council Member
Wainwright T introduced the resolution next hereinafter set out and moved
its adoption. The motion was seconded by Council Member. Beer ,
and passed with record vote as follows:
Ayes: Beer, Stockton, Wainwright
Nays: None
Thereupon, the resolution was declared adopted. Such resolution is as follows:

RES OLUTION NO. 99-07-113-1
Extending the Maturity Date of an outstanding Warrant issued to pay costs in
connection with the construction of the Fairfax Water and Sewer Improvements
Project.
WHEREAS, the City of Fairfax, Iowa (the "City"), has previously authorized the issuance
of a warrant in the principal amount of$500,000 (hereinafter referred to as the "Warrant") for the
purpose of paying costs in connection with the construction of certain Water and Sewer
improvements in the City(hereinafter referred to as the 'Project")bearing interest at the rate of 5%
per annum and scheduled to mature July 1, 1999; and
WHEREAS, the City intends to refund the Warrant through the issuance of bonds or notes,
but the refunding proceeds were not available to the City by July 1, 1999; and
WHEREAS, the owner of the Warrant has agreed to extend the maturity date of the Warrant
to December 1, 1999, upon the terms hereinafter set out;
NOW, THEREFORE,Be It Resolved by the City Council of the City of Fairfax, Iowa, as
follows:
Section 1. The maturity date of the Warrant is hereby extended to December 1, 1999.
Accrued interest on the Warrant shall be continued to December 1, 1999, and the Warrant shall.
continue to bear interest at the rate of 5% per annum from July 1, 1999, to its maturity.
Section 2. The City Council hereby reserves the right to prepay principal of the Warrant
in whole or in part at any time prior to the maturity thereof with accrued interest to the date of such
payment.
Section 3. The Mayor and City Clerk are hereby authorized and directed to enter into
whatever legal documents are required by the owner of the Warrant to effectuate the provisions of
this resolution.
Section 4. It is the intention of the City that interest on the Warrant be and remain.
excluded from gross income for federal income tax purposes pursuant to the appropriate provisions
of the Internal Revenue Code of 1986, as amended, and the Treasury.Regulations in effect with
respect thereto (all of the foregoing herein referred to as the "Internal Revenue Code"). In
furtherance thereof, the City covenants to comply with the provisions of the Internal Revenue Code
as they may from time to time be in effect or amended and further covenants to comply with
applicable future laws, regulations, published rulings and court decisions as may be necessary to
insure that the interest on the Warrant will remain excluded from grass income for federal income
tax purposes. Any and all of the officers of the City are hereby authorized and directed to take any
and all actions as may be necessary to comply with the covenants herein contained.

homes would be the most effected by the water runoff, overload of the
sewer system, water supply, additional traffic and deterioration of

First Addition to Fairfax,„ except that part of Lot 6 described as follows: Beginning at
the NW corner of said lot 6; thence S-1y along the West line of said Lot 6, 88.65.546
feet; thence E-ly along a line parallel to and 88.56 feet South of the North line of said
