OCTOBER 12, 1999
Mayor Stallman opened the meeting at 7:00 p.m Council members Beer,Harville,Stockton and
Wainwright. Absent Shakespeare.
Motion by Beer, 2nd Wainwright to approve the Agenda,Minutes of the September 14"'meeting, Clerk's
Budget and Financial Report.MC.
.Tim Tedrow, Shimberg's,discussed the purchase of meters and he thinks the City should pm-chase the
ones,which can be converted to outside readers.The representative of Watt's Regulator discussed
Backflow protection.
Motion Harville,2nd Stockton to approve the building permit for Mick&Deanna Heintz to build Storage
Buildings behind Cedar Valley Asphalt.Ayes Beer,Harville and Stockton. Wainwright Abstained.Motion
Stockton, 2nd Harville to approve the permit for Mick&Deanna Heintz for a Car Wash in Fairfax Heights
Second Addition,but the struts must be in before they start building Ayes Beer,Harville,Stockton_
Wainwright Abstained.

ORDINANCE 220A—Motion Wainwright to approve Ordinance 220A,Amending Certain section of the
Building Code, on its second reading,2"d Stockton. Wainwright moved the approval of the Ordinance on its
2"d reading and that the procedural requirements as setforth in section 3803,code of Iowa,be suspended as

ORDINANCE NO.2 2 0 A
AN ORDINANCE AMENDING CERTAIN SECTIONS
OF THE CITY OF FAIRFAX BUILDING REGULATIONS
TITLE 6 OF THE CODE OF ORDINANCES, CHAPTER 9
BE IT ENACTED by the City Council of the City of Fairfax, Iowa:
SECTION 1. Section 6-9.03(3) of the Code of Ordinances, Fairfax, Iowa is hereby
amended by adding the following language thereto:
a. Section 106.2, previously deleted by Ordinance No. 219A, adopted August
10, 1999,is hereby reinserted to include the following language:
"2. Reroofing.",
b. Section 106.2.12 of the Uniform Building Code 1997. Edition is amended by
deleting the language shown below as stricken through and by making plural the
first reference to door:
"12. The replacement of 5wy to_trz,n__(22—Windows, and oI opw (14 @xt@r- r

doors within a one(1)year period when replaced with windows or doors of
similar size, style and material, and no stractural change is required for the
framing of the rough opening for said windows or door."
C. A new Section 106.2.13 is hereby adopted as follows:
"13. Siding."
d. A new section 106.2.14 is hereby adopted as follows:
"14. Patios of a slab type provided they: a. do not have any footings or
foundations; and b. are not used for parking; and,c. are neither enclosed nor
to be enclosed."
C. A new section 106.2.15 is hereby adopted as follows:
"15. Structures,including sheds, of less than 120 square feet, except insofar
as their location is concerned; such structures shall be subject to the
permitting process in order that approval of the building inspector be
obtained for the site where the structure is to be located."
SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.

SECTION 3. SEVERABILITY. If any section, provision, or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision or part thereof not adjudged invalid or
unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect after its final
passage, approval and publication as provided by law.

AN ORDINANCE AMENDING TITLE III,CHAPTER 3,SECTION 3-3.11201 OF THE CODE OF
ORDINANCES OF THE CITY OF FAIRFA ,,IOWA
BE IT ENACTED by the City Council of the City of Fairfax,Iowa.
SECTION 1. SECTION MODIFIED:Title III,Chapter 3,Section 3.0201 of the Code of Ordinances of the
City of Fairfax,Iowa,as entrently worded is stricken,and the following is substituted themfor.
PERMITEE:Permit fees shall be set by resolution of the City Council to eover the
Cost of issuing the permit and supervising,registering and inspecting the work. The
Person who makes the permit application shall pay a fee to the Clerk in accordance therewith.
SECTION 2. SE'VERABILITY CLAUSE.If arty seetimi,provision or dart of this ordinance ce shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a

Fairfax Board of Adjustment met on Friday October 29, 1999 at Fairfax City Hall.Merle Hastings,acting
Chair called the meeting to order at 6:05 p.m.Other Board members present were Bryan Balog,Doug
ExIme and Ray Zamastil.Absent,Ralph Emanuel.Others who spoke at the meeting included City Attorney
Scott McLeod, City Clerk Betty P'anek,Darr and Alisa Shakespeare,Steve.Jackson, Jr.,Attorney for the
Shakespeares,Torn and John Banes,Bill Gibney,Marianne Wainwright;Mark Neuhaus and Barb Conner.
The meeting was called to hear the following two appeals of Dan and Alisa Shakespeare:
1. Shakespeares'appeal of the September 16, 1999 decision of the administrative
official for the Fairfax Zoning Ordinance that the Shakespeares'request for recession
of the building permit issued for the property located at 98 West Cemetery Road,
Fairfax,IA,was not timely.
2. Shakespeares'appeal of the October 13, 1999 decision of the administrative official
for the Fairfax Zoning Ordinance that the proposed use set forth in the application
for building permit issued January 13, 1999 for the property at 98 West Cemetery
Road,Fairfax,IA is not in violation of the Fairfax.Zoning Ordinance.
Mr.Hastings stated that,the appeal is a Shakespeare versus the City of Fairfax,not Shakespeare
versus Banes Construction.Mr.Hastings read into the record a letter to the Board of Adjustment from
JoAnn Beer dated October 28, 19'9'9,a copy of which will be attached to these minutes.
First.Appeal--Steve Jackson presented the appeal for the Shakespeares stating that.Mrs.
Shakespeare did not become aware of the building permit being issued until the August 10t`Council
Meeting.The C Clerk advised the application for the building permit was on the January, 1999 Council
Agenda.,which Alisa Shakespeare received as a council member,on January 6"'.She also advised Ahsa
was sent a copy of the January Council minutes,with the February council Agenda, saying that the building
permit had been approved in January.
Steve Jackson introduced.Bill Gibney,who stated that he was at the January City Council
meeting and he thought the council had pushed through the approval of the building permit since they knew
Alisa would be opposed to the Building permit and was not there to voice her concerns.Bill said that some
of the council said it was lucky that Alisa wasn't there and there was some laughter.Marianne Wainwright,
Council Member,stated that there might have been some laughter,but that the matter was not pushed
through in any unusual manner.There was comment from members of the board and those attending that
the lauglter was not very professional.However,the Board noted all applications for building permits must
be m the council agenda that go out to the city council members the Wednesday before the meetings or they
are not acted on.Barb Conner was at the January meeting also and stated that she does not remember it
being pushed through. Mark Neuhaus,former council member,stated that when he was on Council all
building permits were thoroughly discussed and Alisa Shakespeare was on Council when the policy of
sending agendas out on Wednesday was adopted.
After much discussion Bryan Balog moved to deny the first appeal regarding the decision that
the Shakespeares'request to rescind the building permit was not timely made,2"d Doug Exlinc.Ayes
Balog,Exlinc,Hasings and Zamastil. Absent Emanuel,
Second Appeal--Before the Second Appeal could be decided by the board,Bryan Balog had to
leave the meeting at 7:03 p.m.Tom Banes said they would keep the property clean and that they were
trying to move to their present business so they would have room to part up buildings to store their trucks
and equipment. They also wanted to know how they could violate the C-2 Zoning,when there are no
buildings up yet. Attorney Jackson stated that it was the Shakespeares'position that the proposed use as
stated on the application for building permit was an unlawful use under the C2 Commercial zoning for the
property in question.Alisa Shakesare was concerned about the outside storage of equipment and future
appearance of the property and mentioned the need for a privacy fence. The Shakespeare's said that they
would like to sit down and talk with Tom and John Banes to see whether they could come to an
understanding that would benefit both parties.Tom and John made no commitment,but stated they would
be putting up nice buildings and intended to store their equipment inside the buildings for the most part.
They stated they would comply with C2 Commercial.zoning.They indicated that some employee vehicles
would be parked outside.Tom and,John Banes expressed willingness to discuss good neighbor issues with
the Shakespeares.Doug Exline noted that if Banes used the property in the future in a manner not
consistent with the C2 Commercial'zoning that the Shakespeares could take the matter up with the City
Council,Doug Exline stated that the Banes'did everything they were supposed to do to obtain a building
permit.There was discussion that the Shakespeares could appeal an adverse decision by the board to the
courts if they could not work out their differences with the Banes on the use of the property. Attorney
Jackson suggested the board not make a decision tonight in order to allow the parties to meet and try to
work out some conditions which could be made of record.
Merle Hastings made a motion to adjourn the meeting,and set another meeting,so the
Shakespeares and Banes could meet and work out some of the issues.The motion died for a lack of a
second.
Dan Shakespeare suggested that the board make their decision and they would proceed from that.
