Mayor Voss called the meeting to order at 7:00 p.m. Council members present:Ekstrom,
Stockton, Wainwright, Scott and Beer.
Motion Stockton,2"d Ekstrom to approve the agenda,minutes of the March 13th Council Meeting,
Clerk's Budget and Financial Reports. Council Person Beer had questions on the Budget.Ayes: 5 MC I
At 7:05 p.m.Mayor Voss opened the Public Hearing on ORDINANCE 230 an ordinance
amending the City Zoning Ordinance.To add Approved Day Care Providers to Special Exceptions List in
Section 1.07.0 RM-Multiple-Family Residential Section 1.07.F CIA-Light Commercial&Section 1A7.G
C2-Highway Commercial.Motion Beer to close the Public Hearing,T� Scott at 7:08 p_m Ayes: 5 MC
Motion Stockton,2'Wainwright to approve ORDINANCE 230 on its first reading and that the
requirements as set forth in section 3803,Code of Iowa,be suspended,.and that the Ordinance be adopted
on its second and third readings by title.Roll Call:Ekstrom, Stockton,Wainwright, Scott and Beer MC
Vernon Cerveny presented 2 proposals for the Trees Forever plantings at Prairie Creek Park.
Vernon asked the Council if they would be willing to pay for Proposal i#2.Dwight Hughes will be replacing
2 Maples and I White Pine at Prairie Creek Park for free. Sankot's Garage will donate 3 Blue Spruce and
Dawn Richmond will donate I Blue Spruce if they can be moved.Baurnhoefener Nursery would do the
removal of the Spruce at S 150.00 an hour at a 2 hour minimum. Council wants Vernon to check more into
the time frame if this can be done within 2 hours.
Motion Stockton,2�d Ekstrom to accept the Trees Forever Proposal#1 for plantings at Prairie
Creek Park and to table Proposal#2 until the beginning of the new fiscal year.Ayes: 5 MC
Vernon Cerveny discussed about interviewing the city officials for our Fairfax Facts Newsletter.
Motion Stockton,2"d Ekstrom to approve the addition to the newsletter.Ayes:5 MC
Sheriffs Report was given. There has been trouble at the library and removal of bark off of trees
on Vanderbilt Street.
Motion Stockton,2`1 Ekstrom to vacate the 30 foot Utility Easement located between Lots 71 and
51—Fairfax Heights Addition.Ayes: 5 MC
Gordon Sevig presented)the construction plan for Prairie View Estates_Discussion was on a
detention basin,green space and a walking trail.
Motion Ekstrom, 2`3 Stockton agreeing for use of Highway Right of Way for Utilities
Accommodation Permit No_57-U2001-02. Ayes: 5 MC
Motion Scott,2"0 Wainwright to approve a public hearing to receive bids in the removal of the old
water tower. Ayes. 5 MC
Motion Beer,2"d Ekstrom to approve RESOLUTION 01-0440-2—To set the percentage of
revenues to be devoted to property tax relief for Linn County Local Option Sales Tax It was decided

Motion Wainwright;.2"d.Scott to approve RESOLUTION 0:1-04-10—Amending Payroll

Carol gave the Library Report. Carol discussed the revenues and circulation from last month
Discussion was on Citywide Waste Pickup Day.Mary will be contacting Bluesteam to get more
information.
Motion Ekstrom, rd Scott to purchase a trailer for Ron. Ayes: 5 MC
Motion Wainwright, 2�d Ekstrom to purchase 1989 Chevy Truck and to get estimates on painting
the truck. Ayes: 5 MC
Motion Wainwright, 2"d Ekstrom to have Mary attend the Cler'k's Collective Workshop in Ankeny
on Tuesday,May 8th. Ayes: 5 MC
Discussion on web page and Cannon Copier service agreement.
Mary is to get bids to construct railings for the window wells at Todd Philipp's Apartment
Building.
Letter will be drafted on Earth Tech Project No. 40913.

To fix a date for a public hearing on a loan agreement in the principal amount of
$1,200,000
WHEREAS,the City ofFairfax,inthe County ofLinn,State oflowa(the"City"),proposes to
enter into a loan agreement(the"]Loan Agreement")in the principal amount of$1,200,000 pursuant to the
previsions of Section 3 84.24A ofthe Code of Iowa for the purpose ofpaying the cost,to that extent,of
financing sanitary sewer and water improvements, including the refunding of outstanding Warrants
previously issued by the City to pay costs in connectiontherewith and it is necessary to fix a date ofineeting
ofthe Council at which it is proposed to take action to enter into the Loan Agreement and to give notice
thereof as required by such law-,
NOW,THEREFORE,Be:It Resolved by the City Council ofthe City ofFairfax,Iowa,as follows:
Section 1, This Council shall meet on the 8th day of May, 2001, at the

held d proceedings will be instituted and action taken to enter into the Loan Agreement,
Section2. The City Clerkishereby directedto givenotice oftheproposed actiononthe Loan
Agreement setting forththe amount and purpose thereof,the timewhen and place where the said meeting
will beheld by publication at least once and not less than 4 nor more than 20 days before the meeting,in
a legal newspaper which has a general circulation in the City. The notice shall be in substantially the

NOTICE OF PROPOSED ACTION TO INSTITUTE PROCEEDINGS TO ENTER
INTO A LOAN AGREEMENT AND BORROW MONEY IN THE PRINCIPAL
AMOUNT OF $1,200„000
(GENERAL OBLIGATION)
The City Council of the City of Fairfax, Iowa, will meet on the 8th day of May, 2001, at the
i °9 int e City,at o'clock 0, .m.,forthepurpose ofinstituting proceedings
and taking actionto enter into a loan agreement(the"Loan Agreementl”)and borrow money inthe principal
amount of$1,200,000 for the purpose ofpayingthe cost,to that extent,offlnancing sanitary sewer and
water improvements,including therefunding of outstanding Warrants previously issued by the City to pay
costs in connection therewith.
The Loan Agreement is proposed to be entered into pursuant to authority contained in Section
384.24A of the Code of Iowa and will constitute a general obligation of the City.
At the aforementioned time and place, oral or written objections may be filed or made to the
proposal to enter into the Loan Agreement. After receiving obj ections,the City may determine to enter
into the Loan Agreement,in which case,the decision will be final unless appealed to the District Court
within fifteen (15) days thereafter.

REVENUES TO BE DEVOT D TO PROPERTY TAX RELIEF IN THE EVENT SUCH TAX IS

WHEREAS, pursuant to a resolution of the Council of the City of Cedar Rapids, Iowa,the
Linn County Board of Supervisors has directed the Linn County Auditor to submit the question of
the imposition of a one percent (10/6)local sales and services tax in the incorporated and
unincorporated areas of Linn County on July 10, 2001; and
WHEREAS, Iowa Law authorizing imposition of the tax allows jurisdictions wherein the
tax would be imposed to individually designate what percentage or amount of local sales and
serves tax revenues each will dlevote to property tax relief and what uses it will put the remainder
of said tax revenue to, if any;and
WHEREAS,the City Council of the city of -Ca " _ _ Linn County, Iowa,
has been advised and does believe It would be in the best interest of the City of

ORDINANCE NO. 20
AN ORDINANCE AMENDING THE CITY ZONING ORDINANCE
BE IT ORDAINED by the Council of the City of Fairfax,Iowa:
Section 1. Pursuant to published notice, a public hearing has been duly held and the City
Council of Fairfax,Iowa, hereby amends the 2000 Zoning Ordinance with the following
changes:
Approved day care providers will be allowed as a special exception within the following zoning
districts: RM (Multiple-Family Residential); CIA (Light Commercial District); C2 (Highway
Commercial District).
All special exceptions including, day care providers, will be subject to the approval of the Board
of Adjustment and any specific conditions and requirements intended to make them compatible
with and acceptable to adjacent use.
Specific section changes to the Zoning Ordinance are as follows:
Section 1.07.0 RM -Multiple-Family Residential Special Exceptions
Section 1.07.F CIA -Light Commercial Special Exceptions
Section 1.07.G C2 -Highway Commercial Special Exceptions
Add: "Approved day care providers" to Special Exceptions list.
Section 2. This amendment to the Fairfax Zoning Ordinance shall be in full force and effect
upon publication as required by Iowa law.
Section 3. All zoning ordinance amendments of the City of Fairfax passed hereafter shall be in
the form of an addition or amendment to the Ordinance and,shall include proper references to
Chapter and Section to maintain the orderly codification of the ordinance.
Section 4. This Ordinance Amendment and the various parts,sections, subsections and clauses
thereof, are hereby declared to be severable. If any part, sentence,paragraph, subsection, section
or clause is adjudged unconstitutional or invalid, it is hereby provided that the remainder of the
Ordinance Amendment shall not be affected thereby.
Section S. No ordinance or,part of any ordinance heretofore repealed shall be considered
reordained or reenacted by virtue of this amendment, unless specifically reenacted.
