Mayor Voss called the meeting to order at 7:00 p.m Council members present:Ekstrom,
Stockton,Wainwright, Scott and Beer.
Motion Stockton,tad Beer approval of Agenda and Minutes of the May 8,May 22 and
May 31,2001 Meetings.Aye: 5 MC
John Stokesberry-Star West Cable mentioned that a Communication Tower would need to be put
up near their building before the old water tower is dismantled.The property will need to be rezoned to C-2.
Mayor Voss opened the Public Hearing for the Demolition of the Elevated Storage Tank at
7:15 p.m.Dick Ransom commented the Completion Date will be August 31'll.
Mayor Voss closed the Public Hearing at 7:16 p.m.

Lillian Schuctzle—Prey Plat Schuetzle Addition to Fairfax,IA has been tabled by the
Planning&Zoning Commission since the lot frontages do not meet City Code.

Don Heisler stated he had purchased the parcel of land adjacent to Vance's 151 Self Storage.He
intends to extend the storage area of Vance's 151 Self Storage.Mayor Voss addressed the problem with the
grade on Don Heisler's property.Mayor Voss'concern was making sure there would be no water running
to the East.There was also concern of the highway drainage.
Dick Ransom presented discussion on the agreement from the City of Cedar Rapids Sanitary
Sewer Service in Prairie View Estates.
Brian Stillman led the discussion for the Fire Department The Fire Department has been having
problems with vehicles parking in front of the Fire Station.
Greg Fetter led the discussion on the public restrooms at the park,weeds in the North Diamond,
trimming the trees at the ball park„North Dugout needs painting and items purchased for City Ball Teams. .
Sgt. Carol Curran presented the list of calls from the Sheriff's Department.Discussion on 2 extra
Deputies for the USA Days.Discussion on parking on the South side of Main Street,open drinking and
vandalism occurring in town..Any citizen that has been vandalized needs to report it to the Sheriffs
Department
Carol Niles presented the Library Report.Discussion on getting an estimate on cleaning the stone
on the Library Building.
Ron led the discussion on the Maintenance Report.The generator pads have been set and also
adding street signs to Fairfax Heights.

Television Franchise from TCI American Cable Holdings,L.P.to Mediacom Communications Corporation

Motion Stockton,2nd Wainwright RESOLUTION 01-06-12-6 Authorizing the City Building
Inspector to have charge of planting,care for and maintaining trees and shrubs in any street,park or public
place.Aye: 4 Nay: 1 Ekstrom MC
Mary informed Councilperson Beer on MOT mowing at the end of Main Street.The State would
be mowing the area within the next week.The State may not be mowing any more this year due to the
budget cuts.Mayor Voss will be looking into this further.
Vern Cerveny and Marcus Soukup presented the cost of the Cream Maze(Eagle Scout Project).
Total approximate cost of materials$15 Labor and Transportation of materials will be at no cost to the
City. Councilperson Scott stated she will talk to the Manager of Menards if they can donate towards the
materials.Completion of project should be done around August 1'.
Motion Stockton,2nd Scott for approval of paying for the cost of the Cretan Maze. Aye: 5 MC
Vern Cerveny presented a list of ideas to the Council for future improvements to our City.
Motion Wainwright,2"d Ekstrom issuing Cigarette Renewal Permit for HandiMart. Star Bar on the
contingency that payment and application is delivered to City Hall by Wednesday,June 13th.Aye: 5 MC

Mary mentioned she talked to Rita Nierling about the City Web Page.Prairie High School-
Students will begin this project next fall.There will be a display of(4)Project Boards(at St.Patrick's
Church Auditorium)during USA Day from the 3'd graders at Prairie Heights of pictures and facts of the
city.
Discussion was led by Mary to look into getting a different cell phone package for Ron.
Mary had mentioned that someone from the Council will need to take the minutes at the July 1()"
Meeting.Mary will be attending Clerk's School.

ELEVATED STORAGE TANK DEMOLITION PROJECT
WHEREAS, on the '° °° day of 2001, plans, specifications,
farm of contract and estimate of cost for the Elevated Storage Tank Demolition Project were
filed with the clerk of Fairfax, Iowa, and
WHEREAS, notice of hearing on plans, specifications, form of contract, and estimate
of cost was published as required by law;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAIIRFAX, IOWA, that said plans, specifications, form of contract and estimate of cost are
hereby approved as the plans, specifications, form of contract and estimate of cost for said
improvements for said project.

RESOLUTION APPROVING PRELIMINARY PLAT
WHEREAS,MARTIN FIRST ADDITION TO LINN COUNTY,IOWA,has been
filed with the City Clerk, Fairfax,Iowa, and after consideration,the same is found to be correct
and in accordance with the provisions of the laws of the State of Iowa and the ordinances of the
City of Fairfax,Iowa.
WHEREAS,the City Planning and Zoning Commission, Fairfax, Iowa,has
recommended approval of the Preliminary Plat of Martin First Addition To Linn County, Iowa,
NOW THEREFORE,be it resolved by the City Council of the City of Fairfax,Iowa,

WHEREAS,MARTIN FIRST ADDITION TO LINN COUNTY,IOWA,has been
filed with the City Clerk, Fairfax,Iowa, and after consideration,the same is found to be correct
and in accordance with the provisions of the laws of the State of Iowa and the ordinances of the

RESOLUTION APPROVING AND MAKING
AWARD OF CONTRACT
ELEVATED STOARGE TANK DEMOLITION PROJECT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, IOWA, that the
bid of Watertower Demolition Co, of Waterloo, Iowa in the amount of $23,800.00 for the
Elevated Storage Tank Demolition Project, described in the plans and specifications
heretofore adopted by this Council after public hearing, be and is hereby accepted, as the
lowest responsible bid received., and a contract.is hereby awarded.
The contractor is hereby instructed to promptly execute the construction contract and return
the same to the Mayor along with all the supporting documents required therein, including
surety bond covering work to be performed and proof of satisfactory insurance coverage.
That the Mayor, with the assistance of the City Engineer is thereafter directed to examine
the contract for proper execution and all supporting documents, including surety bond and
proof of insurance coverage to determine satisfactory compliance with contract
specifications. If all documents are in order the Mayor shall approve the same in writing and
place written approval on file in the office of the City Clerk.
That the Mayor and City Clerk are hereby authorized and directed to execute the contract
for and on behalf of the City and upon execution the contract shall be in full force and effect.

RESOLUTION APPROVING ASSIGNMENT OF CABLE TELEVISION FRANCHISE FROM
TCI AMERICAN CABLE HOLDINGS,L.P.TO MEDIACOM COMMUNICATIONS
CORPORATION AND ITS DESIGNATED AFFILIATE
WHEREAS, TCI American Cable Holdings, L.P., doing business as AT&T Broadband
("AT&T"), owns, operates, and maintains a cable television system(the"System") in the City of
Fairfax, Iowa, pursuant to a cable franchise ("Franchise") granted by the City Council of the City
of Fairfax("City"), and is the duly authorized holder of the franchise; and
WHEREAS, AT&T and Mediacom Communications Corporation are parties to an Asset
Purchase and Sale Agreement ("Agreement") pursuant to which the System and the Franchise
will be assigned to Mediacom Communications Corporation, or any entity controlling, controlled
by, or under the common control with Mediacom Communications Corporation (collectively
"Mediacom"), (the"Assignment"); and
WHEREAS, AT&T and Mediacom have requested the consent of the City to the Assignment in
accordance with the requirements of the Franchise, and have provided information necessary in
order to facilitate a decision by the City("Assignment Application""); and
WHEREAS,the City finds Mediacom to be a suitable assignee.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAIRFAX,IOWA THAT:
1. The City of Fairfax accepts the Assignment Application and consents to the Assignment
to Mediacom,in accordance with the terms of the Franchise.
1 This Resolution shall become effective upon the closing of the transaction contemplated
by the Agreement.

The City Council of Fairfax, Iowa is authorizing the City Building Inspector to have charge of all
trees and shrubs growing in any street,park or public place and shall plant, care for,and maintain
or remove such trees and shrubs.
WHEREAS,PERMIT TO PLANT,TREAT OR REMOVE TREES,no person shall plant,
move, spray, fertilize, brace,trim,cut or otherwise disturb any tree or shrub in any street,park,or
public place without first obtaining a written permit from the City Building Inspector. The City
Building Inspector shall issue the permit if in his judgment the desired work is necessary, and the
proposed method and workmanship thereof are of a satisfactory nature. Such work shall be done
under the supervision of the City Building Inspector. A permit is not required for the trimming or
maintaining of shrubbery growing on any street,park, or public place if such shrubbery does not
constitute a public nuisance. Every permit shall describe the work to be done,the species, sizes
and locations of trees or shrubs concerned, and the date of expiration.Any permit may be
declared void if its terms are violated.
WHEREAS,FASTENING MATERIALS TO TREES,no person shall place or maintain upon
any street,park or public place any material which will impede the free passage of water,air and
fertilizer to the roots of any tree or shrub growing therein, except by permission of the City
Building Inspector, or when such materials are designed for the construction of sidewalks,
paving,gutters or other public improvements, and have been placed under a permit granted by the
City.
WHEREAS,DAMAGING TREES,no person shall break, deface, injure or destroy any tree or
shrub in any street,park or public place.No person shall knowingly permit any leak to exist in
any gas pipe or main within the root zone of any such tree or shrub.No person shall knowingly
permit any wire designed to carry electric current to come in contact with any such tree or shrub
unless protected by approved methods. Whenever the City Building Inspector determines it to be
necessary, in order to prune or remove any tree or shrub to protect,move or cut off the electricity
from any service wire, he shall serve written notice on the owner of such wire,to protect such
wire and the owner shall comply with such order within 24 hours after service of the notice,
WHEREAS,STREET TREE PLANTING GUIDE,attached is the guide of the tree species
that are recommended and prohibited including the tree spacing. The City of Fairfax reserves the
right to amend the Street Tree Planting Guide at their discretion..
BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF'THE CITY OF FAIRFAX,
IOWA,that the City Building Inspector is hereby authorized and directed to execute said
Resolution.

A RESOLUTION SETTING THE SALARIES AND BENEFITS FOR EMPLOYEES OF THE
CITY OF FAItFAX FOR THE FISCAL YEAR 200112002.
BE IT RESOLVED BY THE CITY COUNCIL OF FAIRFAX,IOWA.
Section 1.The following positions named shall be paid the salaries or wages indicated and the
City Clerk is authorized to issue checks,less legally required or authorized deductions
from the amounts set out below, and make such contributions to IPER'S,FICA and
other purposes as required by law,or order of the City Council„all subject to audit
and/or review by the City Council,
CITY CLERK: $10.77 per hour @ 40 hours per week
LIBRARIAN: $9.73 per hour @ 23 hours per week
CHILDREN'S LIBRARIAN: $7.00 per hour @ 13 hours per week
PART TIME HELP: $6.08 per hour @ 3 hours per week
JANITORIAL CLEANING(LIBRARY): $10.915 per hour @ 4 hours per week
MAINTENANCE MEN: $12.93 per hour @ 40 hours per week
MAINTENANCE WORKER II: $15.00 per hour @ 40 hours per week
DEPUTY CITY CLERK: $5,000,.00 maximum per year
PART TIME MAINTENANCE: $5,000,00 maximum per year
Section 2. OVERTIME:In lieu of overtime compensation for any hours worked in excess of
40 hours in a designated workweek, compensatory time off shall be taken within
2 weeks of the week in which overtime hours are worked, after making a request for
such time off to the City Clerk,Mayor or City Council,if the use of compensatory time
off does not unduly disrupt the operations of the city.
Section 3.INSURANCE: The City shall provide the Clerk,Maintenance Men and Maintenance Worker 11
(full time positions)with Wellmark(Blue Cross)Insurance.The City shall be responsible for
the$500 deductible(Single Policy Only).
Section 4.PAID HOLIDAYS;The Clerk,Maintenance Men and Maintenance Worker H(full-time
positions)shall be paid for the following Holidays:
NEW YEAR'S DAY, GOOD FRIDAY,MEMORIAL DAY„ 4m OF JULY,LABOR DAY,
THANKSGIVING,THE DAY AFTER THANKSGIVING, CHRISTMAS EVE DAY AND
CHRISTMAS DAY,
Section 5. SICK DAYS AND BEREAVEMENT DAYS: The Clerk,Maintenance Men and Maintenance
Worker H(full-time positions)shall be allowed
four(4)sick days per year. Sick days may be accumulated up to thirty(30)days.
They shall be allowed three(3)bereavement days per year.
This includes immediate fancily members only(Spouse, Children,Parents,Brothers, Sisters and
In-Laws). They may not be accumulated.After five(5)consecutive sick days,at the discretion of
the Mayor,a doctor's verification may be requested.
Section 6. VACATION:Forty(40)hours after one(1)year, eighty(80)hours after three(3)years and
120 hours after seven(7)years for Clerk,Maintenance Men and Maintenance Worker IT(full-
time positions).The Librarian and Children's Librarian receive forty(40)hours after one(1)
year
and eighty(80)hours after five(5)years of employment.

FOR THE CITY OF FAIRFAX, IOTA
NOTICE OF PUBLIC HEARING ON PROPOSED PLANS, SPECIFICATIONS, PROPOSED
FORM OF CONTRACT'AND ESTIMATE OF COST FOR THE ELEVATED STORAGE
TANK DEMOLITION IN AND FOR THE CITY OF FAIRF'AX,IOWA,FIXING TIME AND
PLACE FOR HEARING AND FOR RECEIVING OF BIDS.
NOTICE IS HEREBY GIVEN:
That the City of Fairfax, Iowa, is requesting sealed bids for the Elevated Storage Tank Demolition
project for which proposed plans., specifications, form of contract and estimate of cost are officially on
file in the office of the Fairfax City Clerk. Said documents may be inspected by any interested person
and by this reference are made a part of this Official Publication.
That the Fairfax City Council will conduct a Public Hearing on said documents in accordance with the
requirements of the Iowa Code,and all parties concerned are at liberty to appear and file objections to
the improvements proposed. The Hearing will be held at the City Hall in Fairfax,Iowa,on June 12,
200lat 7:00 P.M.
That sealed bids for the construction of said improvements will be received by the City Clerk at the City
Clerk's office in the City Hall in Fairfax,Iowa,until 10:00 A.M., on the 11th day of June 2001 and will
be publicly opened and read. The bids will be acted upon by the Fairfax City Council immediately
following the Hearing, or at such later time and place as may then be fixed.
All work and materials are to be in accordance with the proposed plans, specifications, form of contract.
and estimate of costs now on file in the office of the City Cleric of Fairfax,Iowa, and by this reference
made a part hereof as though fully set out and incorporated herein.
Plans and specifications governing the construction of the proposed improvements, and also the prior
proceedings of the City Council referring to and defining said proposed improvements are hereby made a.
part of this notice and the proposed contract by reference and the proposed contract shall be executed in
compliance therewith.
The Council reserves the right to defer acceptance of any proposal for a period of not to exceed thirty
(30)calendar days from the date of hearing and letting.
Payment to the Contractor will be on the basis of monthly estimates equivalent to ninety-five percent
(95%)of the contract value of the work completed and payments made to material suppliers for materials
ordered specifically for the project or delivered to the site during the preceding calendar month.
Estimates will be prepared on the 1st day of each month by the Contractor,subject to the approval of the
Engineer, who will certify to the City for payment each approved estimates on or before the tenth(10th)
day of the following month. Such monthly payments shall in no way be construed as an act of
acceptance for any part of the work partially or totally completed. Upon completion of the work and its

acceptance by the Council,the Contractor will be paid an amount,which,together with previous
payments,will equal ninety-five percent(95%), of the contract price of the contract. Final payment of
the remaining five percent(5%) will be made not less than thirty-one(3 1) days after completion and
acceptance by resolution of the City Council of the completed contract,subject to the conditions and in
accordance with the provisions of Chapter 573 of the Code of Iowa, 1995,as amended. No such partial
or final payments will be due until the Contractor has certified to the City that the materials, labor and
services involved in each estimate have been paid for in accordance with the requirements stated in the
specifications. Lien waivers shall be submitted with Final Pay Request certifying that all labor and
services have been paid.
Before final payment will be made,the Contractor shall file, in duplicate,with the Engineer an itemized
statement showing the amount of Iowa Sales Tax, or Use Tax, and to whom paid on all materials which
have become part of the finished work.
That all proposals shall be made on official bidding blanks furnished by the City of Fairfax, and any
alterations thereof will entitle the Council, at its option, to reject the bid involved from consideration.
Each proposal shall be sealed and plainly identified.
That each proposal shall be accompanied by a Cashier's or certified check drawn on an Iowa bank, or a
certified share draft drawn on a credit union in Iowa or chartered under the law of the United States, or a
Bid Bond in the form prescribed in the specifications, executed by a Corporation authorized to contract
as a Surety in Iowa and filed in an envelope separate from the one containing the Proposal, sealed in an
amount 10% of bid. The Check, Share Draft, or Bid Bond shall be made payable to the City of Fairfax.
Said check, share draft, or bond may be cashed by the City of Fairfax,Iowa as liquidated damages in the
event the bidder to whom the contract is awarded fails or refuses to; (l)Enter into the contract; or(2)
Post bond satisfactory to the City Council insuring the faithful fulfillment of the contract of said
improvements as required by law and the specifications within ten days after the contract is awarded.
Each successful bidder shall be required to furnish a Corporate Surety Bond in an amount equal to 100%
of its contract price, said Bond to be issued by a responsible surety approved by the City and shall
guarantee the faithful performance and maintenance of the contract and the terms and conditions therein
contained and shall guarantee prompt payment of all materials and labor and protect and save harmless
the City from claims and damages of any kind caused by the operation of the Contractor.
That plans, specifications and proposed form of contract may be examined free of charge at the office of
the City Clerk in Fairfax or at the office of Hall and Hall Engineers,Inc., 209 29th Street NE, Cedar
Rapids,Iowa,Consulting Engineers. Bidders may obtain personal copies at the Engineer's office by
depositing Fifty dollars ($50.010,,Twenty Five Dollars and no cents($25.00)of which will be refunded
when the Plans and Specifications.are returned within ten(10)days following the award of the Contract.
Payment to the Contractor for said improvements will be made in cash derived from the proceeds of the
issuance and sale of such bonds and/or from such cash funds of the City as may be legally used for said
purposes. Any combination of the above methods of payment may be used at the discretion of the City
Council.
The work shall commence within 10 days after written notice to proceed and shall be completed on or
before August 31, 2001.
Liquidated damages in the amount of two hundred dollars ($200)per consecutive calendar day will be
assessed for each day that work shall remain uncompleted after the end of the contract period,with due
allowance for extensions of the contract period due to conditions beyond the control of the Contractor.

That preference will be given to products grown or produced within the Mate of Iowa,by virtue of
statutory authority.
That the City Council reserves the right to reject any and all bids and to waive any formalities,
technicalities and irregularities.
The scope of the work for the Elevated Storage Tank Demolition project includes tank demolition,
removal, and disposal of tank,tank columns, footings, and other related appurtenances to a point one (1)
foot below the existing ground level.

existing road ditch grade along Southview Road East and a recommended grade
for the road ditch shall be approved by the City.

9. This area has a history of flooding from local runoff. Prior to the issuance of
building permits for this subdivision, the developer shall provide low foundation
opening elevation certification for each building from a Civil Engineer licensed in
the State of Iowa, certifying the structure has been elevated to protect from
flooding.
