Motion Scott,2"d Beer to table ORDINANCE 234.Aye 3 MC Mayor Voss opened the Public Hearing ORDINANCE 235 Amending City Ordinance Title VI,Chapter 1, Section 6-1.0302 Water Rates at 7:48 p.m Motion Beer,2nd Scott to close the Public Hearing at 7:49 p.m.Aye 3 MC Motion Beer,tad Scott to table ORDINANCE 235.Aye 3 MC Barb Conner led discussion on removal of No Parking Signs on one side of Stal man Drive.It was decided to hold a Public Hearing on Oct.9"s to amend the Ordinance;to state No Parking on Vest Side of Stallman Drive. Vernon Cerveny led discussion on having uniform hours for the library.Discussion on consideration for librarian to be considered for benefits. Carol Niles gave library Report.The library has a new Children's Librarian—her name is Pam Edwards. The library is currently running a book sale&raffle—donations have been greatly appreciated. Discussion on change requirements of RS44 Zoning.The Planning&Zoning Commission has recommended to the City Council that the requirements be changed as follows:Minimum Lot Width from 200 feet to 150 feet,and Minimum Lot Area from 44,000 square feet to 43,560 square feet.This will be on the November Agenda. Lud led discussion on the Maintenance Report.The City purchased a1990, Ford Truck.Hynek Farms will continue mowing until weather permits.Ron led discussion on Electric Pump and Ace Electric. Vernon Cerveny led discussion on the Iowa Living Roadways Grant.'The Grant Funds are from the IA DOT and the State of Iowa, Vernon would like to ask for a$15,000 Grant.The City would be responsible for 30%of total expenditures.The City would receive credit for volunteer hours at the rate of$'8.00 per hour,Vernon stated that it would be nice to plant trees on City Property in Fairfax Heights Addition.There have been complaints on the littering at the Star Bar. The meeting was called to order by the Mayor,and the roll was called showing the following Council Members present and absent: Presen , *O—m --5c Absent:S+0C-kJM b, J The Council investigated and found that a notice of intention to institute proceedings to enter into a loan agreement had been duly published as provided by law and that this is the time and place at which the Council shall receive oral or written objections from any resident or property owner of the City. The City Clerk announced that no written objections had been placed on file. Whereupon, the Mayor called for any written or oral objections, and there being none,the Mayor announced that the Council may authorize the loan agreement in the amount as published. This also being the time and place fixed by the Council for the consideration of bids for the purchase of General Obligation Water Notes to be issued in evidence of the City's obligation under The aforesaid loan agreement,the Mayor announced that bids had been received and canvassed on behalf of the City at the time and place fixed therefor. General Obligation Water Notes, Series 2001 A WHEREAS,pursuant to the provisions of Section 384.24A of the Code of Iowa,the City of Fairfax, Iowa(the "City"),has heretofore proposed to contract indebtedness and enter into a loan agreement (the "Loan Agreement") for the purpose of financing improvements to the municipal waterworks utility,and has published notice of the proposed action and has held a hearing thereon, and the Council may now authorize the Loan Agreement in an amount not exceeding the amount as published; and WHEREAS, pursuant to advertisement of sale, bids for the purchase of$450,000 General Obligation Water Notes,Series 2001A(the"Notes"),to be issued in evidence of the City's obligation under the Loan Agreement were received and canvassed on behalf of the City and the substance of such bids noted in the minutes; and WHEREAS, upon final consideration of all bids by the City Council, the bid of is the best, such bid proposing the lowest interest cost to the City;. NOW, THEREFORE, Be It Resolved by the City Council of the City of Fairfax, Iowa, as follows. Section 1. The City shall enter into the Loan Agreement with the aforesaid bidder, as lender (the "Lender"), in substantially the form as will be placed on file with the City Council, providing for a loan to the City in the principal amount of$450,000, for the purpose or purposes set. forth in the preamble hereof.
