All applicants that are issued a building permit for the construction of a new structure must maintain during the construction process a rubbish container that satisfies the following requirements: 1. The rubbish container must be maintained on the premises for which the building permit was issued; 2. The volume of the rubbish container must not be less than (4) four cubic yards; and 3. The rubbish container shall have a hard cover that includes a mechanism to secure the cover from being blown open by the wind. All rubbish from the construction of the structure must be placed in the rubbish container at least daily. B. Title 6, Chapter-9 of the Code of Ordinances, Fairfax, Iowa is amended by adding a new Section 6-9.03(45), which reads as follows: 6-9.03(45) EXTERIOR FALLS — RESIDENTIAL CONSTRUCTION. The company and the insured expressly agree and state that the purchase of this policy of insurance by the insured does not waive any of the defenses of governmental immunity available to the insured under Iowa Code Section 670.4 as it now exists and as it may be amended from time to time. IT IS NOW AGREED by parties hereto as follows: 1) DURATION - This agreement shall commence on the date that both parties sign this agreement and shall continue thereafter until one party notifies the other party, in writing, of an intent to end the agreement. 2) PURPOSE - The purpose of this agreement is to accomplish the proposed project as described herein in accordance with the aforesaid scope of work and in agreement with conditions specified in this agreement. 3) The County Engineer shall be responsible for the administration of this project.
