RESOLUTION APPROVING THE VOLUNTARY ANNEXATION OF PROPERTY
LOCATED AT 4507 80TH STREET SW(Robert and Lois Boland's Request)
WHEREAS,Robert and Lois Boland are the owners of property at 4507 80'x'Street SW,legally described as
follows:
PARCEL A PLAT OF SURVEY NO.888 LINN COUNTY,IOWA.
WHEREAS,Robert and Lois Boland,have applied in writing for annexation to the City of Fairfax,Linn
County,Iowa,the above described property;
WHEREAS,said Petitioner has attached to the petition a plat of said territory showing the location thereof
with reference to the City limits of Fairfax,Linn County,Iowa;and,
WHEREAS,from an examination of the application and plat attached thereto it appears that said petition and
plat are in proper form and comply with all of the provisions of Section 368.7 of the
Iowa Code of 2001;and,
WHEREAS,the City of Fairfax includes as part of annexation the east°/2 of 80th Street and all of State
Highway 151 which abuts aforementioned property.
NOW,THEREFORE,IT IS HEREBY RESOLVED,by the City Council of the City of Fairfax,Iowa,that
said Application be and the same is hereby approved by the City Council of the City of Fairfax,Iowa which assents to
the annexation of the following described premises to the City of Fairfax,Linn County,Iowa,and resolves that said
real estate be part of the City of Fairfax,Linn County,Iowa and entitled to all of the privileges and subject to all
obligations as an integral part of the said City:
Parcel"A",Plat of Survey No.888 is that part of the Northwest Quarter of the Northwest Quarter of
the Northwest Quarter of Section 10,Township 82 North,Range 8 West of the 5°&P.M.,Linn County,Iowa,
including the right-of-way for the east'.of 80''Street and all of State Highway 151,which abuts the property.

CITY BUDGET AMENDM'EN'T AND CERTIFICATION RESOLUTION
To the Auditor of LINN County, Iowa:
The City Council of FAIRFAX in said County/Counties met,on -May 2002
,at the pllace and hour set in the notice,a copy of which accompanies this certificate and is certified as to
publication, Upon taking up the proposed amendment,it was considered and taxpayers were heard for and against
the amendment.
The Council,after hearing all taxpayers wishing to be heard and considering the statements made by them,gave
final consideration to the propsed amendment(s)to the budget and modifications proposed at the hearing, if any,

ORDINANCE 250
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF FAIRFAX,IOWA, 1996,BY ADDING PROVISIONS PERTAINING TO
PEDDLERS, SOLICITORS AND TRANSIENT MERCHANTS IN THE CITY OF
FAIRFAX, IOWA
BE IT ENACTED by the City Council of the City of Fairfax,Iowa:
SECTION 1.ARTICLE ADDED.The Code of Ordinances of the City of Fairfax,Iowa,
1946, is amended by adding a new Article 1 to Title VII, Chapter 1,entitled PEDDLERS,
SOLICITORS AND TRANSIENT MERCHANTS,which is hereby adopted to read as follows:

PEDDLERS, SOLICITORS AND TRANSIENT
MERCHANTS

7-1.0110 Time Restrictions
7-1.0101 PURPOSE. The purpose of this chapter is to protect residents of
the City against fraud, unfair competition and intrusion into the privacy of their
homes by licensing and regulating peddlers, solicitors and transient merchants.
7-1.0102 DEFINITIONS. For use in this chapter the following terms are
defined:
1. "Peddler"' or "peddling" means any person carrying goods or
merchandise who sells or offers for sale for irninediate delivery such
goods or merchandise from house to house or upon the public street.
2. "Solicitor''" or "soliciting" means any person who solicits or attempts
to solicit from house to house or upon the public street any contribution or
donation or any order for goods, services, subscriptions or merchandise to
be delivered at a future date.
3. "Transient merchant" means any person who engages in a
temporary or itinerant merchandising business and in the course of such
business hires, leases or occupies any building or structure whatsoever, or
who operates out of a vehicle which is parked anywhere within the City
limits. Temporary association with a local merchant, dealer, trader or
auctioneer, or conduct of such transient business in connection with, as a
part of, or in the name of any local merchant, dealer, trader or auctioneer
does not exempt.any person from being considered a transient merchant.
7-1.0103 LICENSE REQUIRED. Any person engaging in peddling,
soliciting or in the business of a transient merchant in the City without first
obtaining a license as herein provided is in violation of this chapter.
ARTICLE I PEDDLERS,SOLICITORS AND TRANSIENT MERCHANTS
7-1.0104 APPLICATION FOR LICENSE. An application in writing shall
be filed with the City Clerk for a license under this chapter. Such application
shall set forth the applicant's name, permanent and local address and business
address if any. The application shall also set forth the applicant's employer, if
any, and the employer's address, the nature of the applicant's business, the last
three places of such business and the length of time sought to be covered by the
license. An application fee of fifteen dollars ($15.00) shall be paid at the time of
filing such application to cover the cost of investigating the facts stated therein.
7-1.0105 LICENSE FEES. In addition to the application fee, the following
license fees shall be paid to the City Clerk prior to the issuance of any license:
1. For one year or major part thereof...............$10.00
7-1.0106 INSURANCE REQUIRED. Before a license under this chapter is
issued, an applicant shall provide to the City Clerk a certificate of insurance
showing evidence that the following insurance is maintained by the application:
1. Workers' Compensation and Employers Liability Insurance as
prescribed by Iowa law minimum limits shown below covering Employers
Liability:
Bodily Injury by accident $500,000 each accident
Bodily Injury by disease $500,000 each accident
Bodily Injury by disease $500,000 policy limit
2. Commercial General Liability Insurance Combined Single Limits
shown below covering Bodily Injury, Property Damage and Personal
Injury:
General Aggregate Limit $2,000,000
Products-Completed Operations
Aggregate Limit $2,000,000
Personal and Advertising Injury
Limit $1,000,000
Each Occurrence Limit $1,000,000
Fire Damage Limit (for any one fire) $ 50,000
Medical Damage Limit (any one person) $ 5,000
3. Each policy shall be issued by an insurance company authorized to
write such insurance in the State of Iowa and shall be reasonably
acceptable to City. These insurance policies shall not be canceled without
at least 10 days prior written notice to City.
7-1.0107 LICENSE ISSUED. If the City Clerk finds the application is
completed in conformance with the requirements of this chapter, the facts stated

immediately.
7-1.0108 DISPLAY OF LICENSE. Each solicitor or peddler shall keep
such license in possession at all times while doing business in the City and shall,
upon the request of prospective customers, exhibit the license as evidence of
compliance with all requirements of this chapter. Each transient merchant shall
display publicly such merchant's license in the merchant's place of business.
7-1.0109 LICENSE NOT TRANSFERABLE. Licenses issued under the
provisions of this chapter are not transferable in any situation and are to be
applicable only to the person filing the application.
7-1.0110 TIME RESTRICTION. All peddler's and solicitor's licenses shall
provide that said licenses are in force and effect only between the hours of eight
o'clock (8:00) a,m. and seven o'clock(9:00)p.m.
7-1.0111 REVOCATION OF LICENSE. After notice and hearing, the
Mayor may revoke any license issued under this chapter for the following
reasons:
1. Fraudulent Statements, The licensee has made fraudulent
statements in the application for the license or in the conduct of the
business.
2. Violation of Law. The licensee has violated this chapter or has
otherwise conducted the business in an unlawful maunrer.
3. Endangered Public Welfare, Health or Safety. The licensee has
conducted the business in such manner as to endanger the public welfare,
safety, order or morals.
7-1.0112 NOTICE. 'The City Clerk shall send a notice to the licensee at the
licensee's local address, not less than ten (10) days before the date set for a
hearing on the possible revocation of a license. Such notice shall contain
particulars of the complaints against the licensee, the alleged violation, and the
date, time and place for hearing on the matter.
7-1.0113 HEARING. The Mayor shall conduct a hearing at which both the
licensee and any complainants shall be present to determine the truth of the facts
alleged in the complaint and notice. Should the licensee, or authorized
representative, fail to appear without good cause, the Mayor may proceed to a
determination of the complaint
7-1.0114 RECORD AND DETERMINATION. The Mayor shall make and
record findings of fact and conclusions of law, and shall revoke a license only

when upon review of the entire record the Mayor finds a violation of this chapter
or State law based on a preponderance of the evidence,
7-1.0115 APPEAL. If the Mayor revokes or City Clerk refuses to issue a
license, the reasons therefor shall be made a part of the record. The licensee, or
the applicant, shall have a right to a hearing before the Council at its next regular
meeting. The Council may reverse, modify or affirm the decision by a majority
vote of the Council members present.
7-1.0116 EFFECT OF REVOCATION. Revocation of any license shall
bar the licensee from being eligible for any license under this chapter for a period
of one year from the date of the revocation.
7-1.0117 REBATES. Any licensee, except in the case of a revoked license,
shall be entitled to a rebate of part of the fee paid if the license is surrendered
before it expires. The amount of the rebate shall be determined by dividing the
total license fee by the number of days for which the license was issued and then
multiplying the result by the number of full days not expired. In all cases, at least
five dollars ($5.00) of the original fee shall be retained by the City to cover
administrative costs.
7-1.0118 LICENSE EXEMPTIONS. The following are excluded from the
application of this chapter.
1. Newspapers. Persons delivering, collecting for or selling
subscriptions to newspapers.
2. Club Members. Members of civic or service clubs that conduct
regular meetings within the city limits, including by way of illustration,
but not necessarily limited to, Boy Scout, Girl Scout, 4-H Clubs, and
Future Farmers of America.
3, Local Residents and Farmers. City residents and farmers who offer
for sale their own products.
4. Students. Students representing projects sponsored by organizations
recognized by the College Community School District conducting school.
5. Route Sales. Route delivery persons who only incidentally solicit
additional business or make special sales.
6. Resale or Institutional Use. Persons customarily calling on
businesses or institutions for the purposes of selling products for resale or
institutional use,.
ARTICLE 1 PEDDLERS, SOLICITORS AND TRANSIENT MERCHANTS
7-1.0119 CHARITABLE AND NONPROFIT ORGANIZATIONS.
Authorized representatives of charitable or nonprofit organizations operating
under the provisions of Chapter 504A of the Code of Iowa desiring to solicit
money or to distribute literature are exempt from the operation of Sections .0104
and .0105. All such organizations are required to submit in writing to the City
Clerk the name and purpose of the cause for which such activities are sought,
naives and addresses of the officers and directors of the organization, the period
during which such activities are to be carried on, and whether any commissions,
fees or wages are to be charged by the solicitor and the amount thereof. If the
City Clerk finds that the organization is a bona fide charity or nonprofit
organization the City Clerk shall issue, free of charge„ a license containing the
above information to the applicant. In the event the City Clerk denies the
exemption, the authorized representatives of the organization may appeal the
decision to the Council, as provided in Section .0115 of this chapter.
SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect
the validity of the ordinance as a whole or any section, provision or part thereof not
adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its
final passage, approval and publication as provided by law..

MUNICIPAL INFRACTIONS IN THE CITY OF FAIRFAX, IOWA
BE IT ENACTED by the City Council of the City of Fairfax,Iowa:
SECTION 1.ARTICLE ADDED.The Code of Ordinances of the City of Fairfax, Iowa,
1996, is amended by adding a new Article 6 to Title 1,Chapter 1, entitled MUNICIPAL
INFRACTIONS,which is hereby adopted to read as follows:

4.01 MUNICIPAL INFRACTION. A violation of this Code of Ordinances or

provisions specifically provided under State law as a felony, an aggravated
misdemeanor, or a serious misdemeanor, or a simple misdemeanor under Chapters
687 through 747 of the Code of Iowa, is a municipal infraction punishable by civil
penalty as provided herein.

4.02 ENVIRONMENTAL VIOLATION. A municipal infraction which is a
violation of Chapter 455B of the Code of Iowa or of a standard established by the
City in consultation with the Department of Natural Resources, or both, may be
classified as an environmental violation. However, the provisions of this section
shall not be applicable until the City has offered to participate in informal
negotiations regarding the violation or to the following specific violations:

1. A violation arising from noncompliance with a pretreatment
standard or requirement referred to in 40 C.F.R. X403.8.
2. The discharge of airborne residue from grain, created by the
handling, drying or storing of grain, by a person not engaged in the
industrial production or manufacturing of grain products.
3. The discharge of airborne residue from _grain, created by the
handling, drying or, storing of grain, by a person engaged in such industrial
production or manufacturing if such discharge occurs from September 15 to
January 15.
4.03 PENALTIES. A municipal infraction is punishable by the following civil
penalties:
(Code of Iowa, Sec. 364.22 1])
1. Standard Civil Penalties.
A. First Offense - Not to exceed $500.00
B. Each Repeat Offense -Not to exceed $750.00
Each day that a violationn occurs or is permitted to exist constitutes a repeat
offense.
2. Special Ciyil Penalties.
A. A municipal infraction arising from noncompliance with a
pretreatment standard or requirement, referred to in 40 C.F.R.
§403.8, by an industrial user is punishable by a penalty of not more
than one thousand dollars ($1,000.00) for each day a violation exists
or continues,
B. A municipal infraction classified as an environmental
violation is punishable by a penalty of not more than one thousand
dollars ($1,000.00) for each occurrence. However, an environmental
violation is not subject to such penalty if all of the following
conditions are satisfied:
(1) The violation results solely from conducting an initial
stamp, cleaning, repairing, performing scheduled
maintenance, testing, or conducting a shutdown of either
equipment causing the violation or the equipment designed to
reduce or eliminate the violation.
(2) The City is notified of the violation within twenty-four
(24) hours from the time that the violation begins.
(3) The violation does not continue in existence for more
than eight (8) hours.
4.04 CIVIL CITATICNNS. Any officer authorized by the City to enforce this
Code of Ordinances may issue a civil citation to a person who commits a
municipal infraction. The citation may be served by personal service as provided
in Rule of Civil Procedure 56.1, by certified mail addressed to the defendant at
defendant's last known mailing address, return receipt requested, or by publication
in the manner as provided in Rule of Civil Procedure 60 and subject to the
conditions of Rule of Civil Procedure 60.1. A copy of the citation shall be
retained by the issuing officer, and one copy shall be sent to the Clerk of the
District Court. The citation shall serve as notification that a civil offense has been
committed and shall contain the following information:
`Code of Iowa, Sec. 364.22 4])
1. The name and address of the defendant.
2. The name or description of the infraction attested to by the officer
issuing the citation.
3. The location and time of the infraction.
4. The amount of civil penalty to be assessed or the alternative relief
sought, or both.
5. The manner, location, and time in which the penalty may be paid.
6. The time and place of court appearance.
7. The penalty for failure to appear in court.
4.05 ALTERNATIVE RELIEF. Seeking a civil penalty as authorized in this
chapter does not preclude the City from seeking alternative relief from the court in
the same action. Such alternative relief may include, but is not limited to, an order
for abatement or injunctive relief

4.06 CRIMINAL PENALTIES. This chapter does not preclude a peace officer
from issuing a criminal citation for a violation of this Code of Ordinances or
regulation if criminal penalties are also provided for the violation. Nor does it

Ordinances by criminal sanctions or other lawful means.

Y Upon drilling the well number 3 in April of 1999 at the new elevated storage tank,
N it was found that the water pumped from this well was less than satisfactory due
a to the high elemental iron content Of 1.1 mg/l. Since welllls numbers 1 and 2 were
able to be successfully treated for iron by chemical sequestering, provisions were
PL made for the addition of the polymer chemical additive CalciQuest, which is a
sequestering agent. The sequestering agent was not successfully able to provide
Na satisfactory product due to the higher natural iron content of well number 3.
I, Since the water demand did not warrant the need to pump from well number 3 at
N the time, the well use was discontinued. Investigation ii nto other possible iron
removal methods was started.
L The best risk iron removal method would be from the construction of an aeration
Nand filtration plant. Aeration and filtration will remove enough iron to yield a
5 satisfactory product. Thee high cost of aeration/filtration equipment (Preliminary
cost estimates are around $250,000.00) warrant investigation into acceptable
A more inexpensive treatment methods. Since preliminary use of a sequestering
P
E agent proved to be unsuccessful, modification of the source was investigated.
R For these three reasons, extending the casing deeper at well number three might
C prove to provide a more quality product:

1 1. Wells number 1 and 2 have casings at a lower elevation and yield a
satisfactory product.
C
U2. Historically, the deeper the water source, the Ibetter the water quality.
R .
E 3. The elevation of the casing depth of well number 3 may have been
pumping some from the Devonian aquifer, a historically unsatisfactory
source, extending the casing so that all the product was pumped from the
Silurian aquifer wound provide a better chance of a more quality product.
After researching iron removal methods and results with geologists, hydrologists,
and the well drilling contractor, it was decided that it was worth the risk to try a
packer test. This consists of extending the casing and sealing the well off with an
inflatable "packer".
The original well drilling contractor, Gingerich well service of Kalona, Iowa, was
contracted to:
1. Pull the pump
2. Video the existing well to find a suitable location for the packer location
3. Place well packer at a location to draw well water from a lower
elevation.
4. Sample the water to gauge performance.
Upon placing the well packer approximately 65 feet bellow the existing casing
depth (approximately 310 feet deep). A bench mark water sample yielded an iron
content of 1 .1 mgll which is consistent with original samples. After pumping all
night after the packer was placed, the sample taken showed an iron
concentration of 0.9 mg/ll., This was not a substantial drop (Wells Nos. 1&2 yield
water with a natural iron content of approximately 0.5 mg/1). The well contractor
was asked to pull the packer and restore the well to the original casing depth.
At this time the City of Ely is researching iron removal treatment by various
sequestering brands, dosages and mixing times and locations with promising
results. The raw iron content of 1 .1 mgll for which Ely Is treating for is the same
as what Fairfax is experiencing in water pumped from well number 3. If the
natural iron can be successfully treated chemically by simply modifying the
chemical brand, dosage, and introduction location, this would be the next
method to try before constructing an iron filter plant.
It is therefore recommended that the City of Fairfax follow the methods and
results of the research being conducted at the City of Ely before trying to further
pursue chemical treatment of well number 3.
