SECTION l. Section 1.13(F),Fee, of the Zoning Ordinance of the City of Fairfax, Iowa, is amended by repealing Subsection F. and adopting the following in lieu thereof: F. Fee: Before any action is taken upon an application of an appeal, variance, conditional use or revised site plan is filed, as provided in this Ordinance, the applicant shall pay to the administrative Officer a non-refundable fee of one hundred (100) dollars as established by ordinance of the City Council. The Administrative Officer shall forthwith pay over such fees to the credit of the General Fund of the City of Fairfax, Iowa.. The failure to approve an application shall not be construed as any reason for refunding the fee to the applicant. SECTION 2. Section 1.16 Rezonings and Amendments of the Zoning Ordinance of the City of Fairfax, Iowa, is amended by adding Subsection D.: D. Rezoning Signs. The Clerk shall provide each applicant for rezoning with two (2) rezoning notification signs, which shall be clearly posted by the applicant on the property for which a rezoning request has been made. The applicant shall pay the clerk such costs at the time the signs are received as may be prescribed by the council. The signs shall be placed so that they may be seen from the street and, in cases of through lots and on corner lots, a sign shall be posted on both frontages. Said signs shall be posted at least ten (10) days prior to the commission meeting date which said date shall be noted by the clerk on the signs. It shall be the applicant's responsibility to see that said signs remain posted during the entire period. If the signs are not posted in accordance with the preceding requirements, no action shall be taken on the petition by the cormission. The signs shall be removed no later than five (S) days after denial by the City Council or the date of posting of the ordinance granting the rezoning by the City Council. SECTION 3. Section L 16(A), Procedure, of the Zoning Ordinance of the City of Fairfax, Iowa, is amended by repealing the first sentence and adopting the following in lieu thereof. A. Procedure: The regulations imposed and the districts created by this Ordinance may be amended from time to time by the City Council, but no such amendments shall be made without public hearing before the City Council and, in the case of rezoning amendments, after a report upon the rezoning amendment from the Planning and Zoning Commission. SECTION 4. Section 1.16(0), Application Fee, of the Zoning Ordinance of the City of Fairfax, Iowa, is amended by repealing Subsection C. and adopting the following in lieu thereof: C. Application Fee: Before any action is taken upon an application as provided in this Ordinance, the applicant shall pay to the administrative Officer a non-refundable fee of fifty (50) dollars plus the cost of signs as established by ordinance of the City Council. The Administrative Officer shall forthwith pay over such fees to the credit of the General Fund of the City of Fairfax, Iowa. The failure to approve an application for rezoning shall not be construed as any reason for refunding the fee to the applicant. SECTION 5. SEVERAILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 6. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law. Please let me know if this is acceptable. If there are any additional requirements or restrictions,. please notify me. Thank you. Ron,just for comparison, I did some research regarding the treatment of this type of walkway by the city of Cedar Rapids. Below is what I found out, Please consider these items in reaching your decision regarding my request. Thank you. City of Cedar Rapids - Engineering Department- Sidewalk Inspector-Robert Burns Cedar Rapids has no regulations or restrictions regarding this type of walkway. The walkway is considered to be a private walk and does not need sloped access at the curb. Since it is a private walk and not a pedestrian sidewalk, it can be any width and be of any material. The walkway is not the "primary access" to the property, and this land is part of a utility right of way. If the walkway is torn up(destroyed:) as a result of such utility work, it would have to be replaced at my expense. The primary access, should it be destroyed/damaged,would be repaired by the city. Due to the nature of the request, a building permit is not required. A "1-Call" should be made prior to installation. Americans with Disabilities Act requires: (see attached,page 15�, Section D) Curb ramps are required only at intersections. . A sloped surface is required where pedestrian walkways cross curbs. Houses without sidewalks, driveways only, don't have handicap access, so why would my walkway be required? RESOLUTION NO. 02-09-10-2 RESOLUTION ACCEPTING 2001 WATER MAIN REPLACEMENT PROJECT, APPROVING MAINTENANCE BOND AND AUTHORIZING FINAL PAYMENT WHEREAS, the City Council of the City of Fairfax, Iowa has contracted for the construction of the 2001 Water Main Replacement Project with Yordi Excavating, Inc. and WHEREAS, work on said project is now complete and the City Engineer has recommended acceptance of said project, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Fairfax, Iowa that the 2001 Water Main Replacement Project is hereby accepted and the City Clerk is hereby directed to mare a final payment to Yordi Excavating, Inc. in the amount of$5,642.93, after 30 days have elapsed from the date of acceptance if no claims against said project are filed, and BE IT FURTHER RESOLVED that the Maintenance Bond in the amount of $106,036.00 written by Employers Mutual Casualty Company be and the same is hereby approved. RESOLUTION 02-09-10-3 AUTHORIZING CONSTRUCTION FOR STREET REPAIR WHEREAS,on August 21,2002 the City Clerk requested proposals for street repair work on Vanderbilt Street involving North and South of the Union Pacific Railroad tracks and on the curve of Railroad and Reynolds Streets; and, WHEREAS,on a separate letter the City Clerk requested a proposal for street work on Church Street from Highway 151 to Vanderbilt Street;and, WHEREAS,on August 28,2002 the City Clerk sent an amendment amending the two(2)original requests as follows: 1. Removed the segment of Vanderbilt Street North of the Union Pacific Railroad tracks. 2. Clarified the work proposed for each segment. 3. Included traffic control provisions. 4. Clarified the cost responsibility for the Union Pacific Railroad. 5. Title VI, Chapter 3, Article 2 of the Code of Ordinances of the City of Fairfax, Iowa, 1996, is repealed and the following adopted in lieu thereof; TITLE VI-COMMUNITY DEVELOPMENT AND ENVIRONMENT CHAPTER 3 -ABANDONED AND JUNK,HOBBY VEHICLES AND JUNK VEHICLES ARTICLE 2 JUNK, HOBBY VEHICLES AND JUNK. VEHICLES 6-3.0201 DEFINITIONS. For use in this chaster, the following terms are defined: . 1. "Junk" means all old or scrap copper, brass, lead, or any other non- ferrous metal; old or discarded rope, rags, batteries, paper, trash, rubber, debris, waste or used lumber, or salvaged wood; dismantled vehicles, machinery and appliances or parts of such vehicles, machinery or appliances; iron, steel or other old or scrap ferrous materials; old or discarded glass, tinware, plastic or old or discarded household goods or hardware. Neatly stacked firewood located on a side yard or a rear yard is not considered junk. 2. "Hobby vehicle" means an unlicensed motor vehicle, including but not limited to dragsters, stock cars, Indy-type racers, midget racers, all- terrain vehicles, dune buggies, go-carts, or competition pulling garden or farm tractors. For the purpose of this chapter, golf carts, boat trailers, common utility trailers, camping trailers or snowmobile trailers are not considered hobby vehicles. 3. "Junk vehicle" means any vehicle, which has any of the following characteristics: A. Inoperable. Any vehicle not capable of being driven upon a public road under manufacturer's specifications. B. Broken, Loose or Missing Part. Any vehicle with a broken, loose or missing windshield, window, headlight, taillight, fender, door,bumper,hood, steering wheel or trunk lid. C. Habitat for Nuisance Animals or Insects. Any vehicle which has become the habitat for rats, mice, or snakes, or any other vermin or insects. D. Defective or Obsolete Condition. Any other vehicle which, because of its defective or obsolete condition, in any other way constitutes a threat to the public health and safety. E. Unlicensed. Any vehicle that is not currently licensed. Mere licensing of such vehicle shall not constitute a defense to the finding that the vehicle is a junk vehicle. 3. "Vehicle" means every device in, upon.,, or by which a person or property is or may be transported or drawn upon a highway or street, excepting devices moved by human power or used exclusively upon stationary rails or tracks, and includes without limitation a motor vehicle, automobile, track, motorcycle, tractor, buggy, wagon, farm machinery, or any combination thereof. 6-3.0202 JUNK, HOBBY VEHICLES AND JUNK VEHICLES PROHIBITED. It is unlawful for any person to store, accumulate, or allow to remain on any private property within the corporate limits of the City any junk, a hobby vehicle or a junk vehicle. 6-3.0203 JUNK AND JUNK VEHICLES A NUISANCE. It is hereby declared that any junk, hobby vehicle or junk vehicle located upon private property, unless excepted by Section 6-3.0204, constitutes a threat to the health and safety of the citizens and is a nuisance within the meaning of Section 657.1 of the Code of Iowa and Chapter 1 of Title III of the Fairfax Municipal Code. If any junk, hobby vehicle or junk vehicle is kept upon private property in violation hereof, the owner of or person occupying the property upon which it is located shall be prima facie liable for said violation. "Code of Iowa, See. 364.12[3 ];1 6-3.0204 EXCEPTION'S. The provisions of this chapter shall not apply to junk, hobby vehicle or junk vehicle located within a garage or other completely enclosed structure. The provisions of this chapter shall not apply to a hobby vehicle or junk vehicle located upon any of the following premises as long as the premises is not in violation of any provision of the Municipal Code of the City of Fairfax: 1. Authorized vehicle recycler (as defined in Iowa Code Chapter 321H); or 2. Licensed motor vehicle dealership (as defined in Iowa Code Chapter 322); or 3. Motor home and travel trailer dealership (as defined in Iowa Code Chapter 322C); or 4. Farm implement dealership (as defined in Iowa Code Chapter 322d); or 5. Motorcycle, snowmobile, ATV, and/or other recreational vehicle dealership (as defined in Iowa Code Section 321.1 (40) and Iowa Code Chapter 321 G); or 6. Motor vehicle franchiser and franchisee (as defined in Iowa Code Chapter 322A); or 7. Towing Services Company licensed to operate as such through the Iowa Department of Transportation; or 8. A vehicle under active repair parked upon the driveway of a residentially zoned property not having a garage, provided the owner has notified City Officials in writing of the owner's intent to actively repair the vehicle and the repairs are completed within thirty (30) days of the notification; or 9. Construction vehicles that are stored; or 10. Commercial areas approved for outside storage; or 11. A business whose primary function is the sale of, manufacture of, or repair of, one or more of the above listed hobby vehicles. A hobby vehicle or junk vehicle shall not be placed at any of the above listed commercial properties for more than 180 days. Any of the above listed businesses may apply for a one-time 10-day extension of this time limit by contacting the City Clerk's Office. 6-3.0205 RIGHT OF ENTRY. The Linn County Sheriff, his/her authorized representative, and/or the person, firer or corporation designated to abate nuisances pursuant to this article and the Municipal Code of the City of Fairfax, are hereby authorized to access any property upon which junk, a hobby vehicle or a junk vehicle is located for the purpose of carrying out any and all actions required by this chapter, at the City's direction. 6-3.0206 NOTICE TO ABATE. Upon discovery of any junk, hobby vehicle or junk vehicle located on private property in violation of this chapter, the City Clerk or his/her duly authorized representative shall notify, in writing, the owner of the property upon which the vehicle is located and the owner of the vehicle, if known, that. 1. The junk, hobby vehicle or junk vehicle constitutes a nuisance under the provision of this chapter; and 2. The junk, hobby vehicle or junk vehicle must be removed in accordance with the provisions of Section 6-3.0208 of this chapter or repair the vehicle and properly display current registration, plates or stickers for the vehicle within 20 days; and 3. Failure to abate nuisance as prescribed by the notice shall be sufficient cause for removal of the junk, hobby vehicle or junk vehicle by the City as set forth in Section 6-3.0209 of this chapter. 6-3.0207 SERVICE OF NOTICE. Any notice shall be deemed to be properly served when a copy thereof is delivered to him/her personally or by certified mail with return receipt requested to his/her last known address. If the City selects service by certified mail, notice shall be deemed given when mailed. 6-3.0208 DUTY OF OWNER TO REMOVE OR REPAIR AFTER. NOTICE. The owner of a junk, hobby vehicle or junk vehicle and the owner of the property upon which it is located shall, within 20 days after notice has been given as provided in Section 6-3.0206 hereof- 1. Repair any and all conditions as defined under Section 6-3.0201 of this chapter which cause such vehicle to be a nuisance as defined herein; or 2. Remove the junk, hobby vehicle or junk vehicle or cause to have the junk,, hobby vehicle or junk vehicle removed to an authorized junk/salvage yard or to any other location provided the same complies with all applicable provisions of the Municipal Code of the City of Fairfax. 6-3.0209 ABATEMENT BY CITY. If the owner of the junk, hobby vehicle or junk vehicle or owner of the property upon which the junk, hobby vehicle or,junk vehicle is located shall fail to abate the nuisance as prescribed in Section 6-3.0208 of this chapter, the City of Fairfax by and through the Linn County Sheriff or his/her designated representative may abate such nuisance by causing the junk, hobby vehicle or junk vehicle to be removed and impounded and sold or disposed of as provided for abandoned vehicles under Section 6-3.0101 of the Municipal Code of the City of Fairfax. The Council may also, by resolution, establish reasonable fees for any other costs incurred through the enforcement of this chapter. All costs of such abatement and enforcement shall be charged to the owner of the junk, hobby vehicle or junk vehicle, if known. If, in the event that it is not possible to determine the owner of the vehicle all costs of such abatement and enforcement shall be charged to the owner of the property where such vehicle was located. All such costs may be assessed against the property being deemed as benefiting from the removal and collected as a special assessment in the same manner as property taxes. SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law. Adopted this day of , 2002.
