discussed the energy efficiency code for the State of IA in regards to the current building ordinance Council concern is the safety of construction using R Board A special City Council meeting will be held on Oct 14 at 6:00 PM to discuss the current language of the building ordinance with possible amendments for the Nov Council meeting Chief Sankot discussed the specs for a basic pumper&pumper tanker He will be receiving specs for the bid process Fire Dept Report-Chief stated it is Fire Prevention Week this week please remember to check smoke detectors&to make sure chimneys are clean Fire Dept will be passing out candy on the night of Halloween at the comer of Vanderbilt St&Prairie Ave Cordon Sevig introduced the preliminary plat for Fairfax Heights Third Addition Replat of Lots 107 through 110 of Fairfax Heights Second Addition The sight distance at the intersection of Hillview DR&Highland Ave is acceptable Recommendation from Planning&Zoning Commission for approval of plat MC Tina Merta addressed concerns in regards to the work done with Prairie Road Builders at the end of E Cemetery Rd to Hwy 151 There was a low spot in the road which was not raised properly&the excess IO'T'A, 2002" DE IT ORDAINED by the City Council of the City of Fairfax, Iowa, that: SECTION 1. Pursuant to published notice and following public hearing on the day of h , 2002, so required by Sections 362.3 and 380.8, Code of Iowa, there is hereby adopted by the City of Fairfax, Iowa, the "CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002." SECTION 2. All of the provisions of the "CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002," shall be in force and effect on and after the effective date of this ordinance. SECTION 3. All ordinances or parts thereof in force on the effective date of this ordinance are hereby repealed from and after the effective date of this ordinance, except as hereinafter provided. SECTION 4. The repeal provided for in the p receding section of this ordinance shall not affect any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of this ordinance; nor shall such repeal affect any ordinance or resolution promising or guaranteeing the payment of money by the City or authorizing the issuance of any bonds of said City or, any evidence of said City's indebtedness or any contract or obligation assumed by said City; nor shall said repeal affect the administrative ordinances or resolutions of the Council not in conflict or inconsistent with the provisions of "THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002", nor shall it affect the following ordinances specifically saved from repeal: URBAN RENEWAL ORDINANCES: ORDINANCE NO. Section I.05(B), Definitions, of the Zoning Ordinance of the City of Fairfax, Iowa, is amended by adding Driveway: D_riv may—A driveway shall be considered to be that designated area to provide access from the street to a parking area, an attached or basement garage, carport or detached garage, and shall be surfaced, free of grass and weeds and maintained with asphaltic concrete, brick, asphaltic macadam, crushed rock or similar method approved by the City Engineer. SECTION 2. SEVERABILITY CLAUSE, If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section., provision or part thereof not adjudged invalid or unconstitutional, SECTION 3. WHEN EFFECTIVE. This ordinance shalt be in effect from and after its final passage, approval and publication as provided by law. RECITALS i. Section 364.16 of the Code of Iowa requires each city to provide for the protection of life and property against fire; ii. Walford does not maintain a fire department and desires to contract with Fairfax for fire protection; iii. Fairfax maintains a fire department and is agreeable to providing fire protection to Walford pursuant to this Agreement; iv. Walford and Fairfax are public agencies as defined by Section 28E.2 of the Code of Iowa and desire to enter into this Agreement pursuant to Chapter 28E of the Code of Iowa. In consideration of the mutual covenants contained herein, Fairfax and Walford agree as follows: I. Fire Protection,. beginning on the date of execution of this Agreement, and continuing from year to year until terminated in the manner set out in paragraph 8 hereof, Fairfax agrees to fiunish fire fighting and fire prevention services to Walford utilizing on-call volunteer firemen who are members of the Fairfax Volunteer Fire Department, one or more of whom may be regular employees of Fairfax, and fire fighting apparatus and equipment owed and operated by Fairfax. Fairfax will station a fire truck at a firehouse within the City limits of Walford. 2. Compensation. Walford agrees to pay, and Fairfax agrees to accept as full payment for all such services rendered and expenses incurred, eighty cents ($.80) per thousand dollars ($1,000.00)of Wal ord's assessed property valuation. These payments shall be made annually based on the assessed valuations for that year. One half of the annual payment shall be made on December 1 of each year (for the period from July I though December 31 of that year), and one half of the annual payment shall be made on June 1 of each year (for the period from January I through June 30 of that year). 3. Administration. The chief of the Fairfax fire department shall be administrator of this agreement. The Fairfax fire chief or his designee shall have the sole and exclusive right, responsibility and authority to direct and control any and all fire fighting or fire prevention activities, and other emergency operations. 4. Expenses. All of the expenses incurred by Fairfax in the maintenance of equipment, apparatus, salaries, insurance premiums, and all other items of expense connected with the services to be performed by Fairfax under this Agreement shall be at Fairfax's expense. 5. Termination. This Agreement may be terminated by either Fairfax or Walford at the end of any fiscal year ending June 30, by giving the other party written notice of the termination at least sixty (60) days prior to the end of the fiscal year. 6. Such insurance shall be in an amount not less than$1,000,000.00 for injuries to any one person, and not less than$2,000,000.00 for any one accident or occurrence.
