AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FAIRFAX,
IOWA
Be It Enacted by the City Council of the City of Fairfax,Iowa:
SECTION 1. Section 1,07.G., C2:Highway Commercial District, of the Zoning Ordinance of the City of
Fairfax, Iowa, is amended by repealing Subsection E. Outdoor Storage Requirements and adopting the
following in lieu thereof:
E. Outdoor Storage Requirements:
All storage,except for motor vehicles in operable condition, shall be located in the rear yard of the
principal permitted building and effectively screened by a solid wall,fence or landscaping,not less
than six(6)feet nor more than eight(8)feet in height.
SECTION 2. Section 1.07.H.,Ml:Light Industrial, of the Zoning Ordinance of the City of Fairfax, Iowa,
is amended by repealing Subsection.D. Outdoor Storage Requirements and adopting the following in lieu
thereof:
D. Outdoor Storage Requirements:
All storage,except for motor vehicles in operable condition,shall be located in the rear yard of the

SECTION 5. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage,
approval and publication as provided by law,

RESOLUTION
DENY REZONING OF PROPERTY
WHEREAS, SCOTT LARSON, OWNER OF LOTS 1, 2, 4, AND 5, KARAL'S
THIRD ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA, submitted an
application and site plan to rezone from C2 (Highway Commercial District) to M1 (Light
Industrial); and,
WHEREAS, the City Planning and Zoning Commission, Fairfax, Iowa met on
November 11, 2002 and made a recommendation to the City Council to deny rezoning of this
property; and,
WHEREAS, the Commission felt that the description of M1 zoning did not fit with the
intent of the Comprehensive Plan (1999) of the City of Fairfax for that area (Residential) and
although the current use intended by Mr. Larson-might not.be a problem, future use under M1
zoning could be a problem and not a good fit for the intended zoning for that area; and,
WHEREAS,the City Council of the City of Fairfax,Iowa,has denied the rezoning based
on the recommendation from the City Planning and Zoning Commission; and,
NOW THEREFORE RE IT RESOLVED,by the City Council of the City of Fairfax,
Iowa, the Mayor and the City Clerk are hereby directed to certify this resolution.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES
OF THE CITY OF FAIRFAX,IOWA,2002,BY REPEALING
SECTION 69.10,SUBSECTION 7,PERTAINING TO THE
MOTOR VEHICLE PARKING AND STORAGE

BE IT ENACTED by the City Council of the City of Fairfax,Iowa:
SECTION I. SUBSECTION REPEALED. The Code of Ordinances of the City of Fairfax,Iowa, 2062,
is hereby amended by repealing Section 69.10 Motor Vehicle Parking and Storage, Subsection 7 Hard
Surface Pads and adopting the following in lieu thereof:
7. Hard Surface Pads. For purposes of this section,a hard surface pad shall be surfaced and
maintained with asphaltic concrete,brick,asphaltic macadam,crushed rock or similar method
approved by the City Engineer.
SECTION 2. SEVERABILITId CLAUSE. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a
whole or any section,provision or,part thereof not adjudged invalid or unconstitutional.
SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its fmal passage,
approval and posting as provided by law.

CITY CREDIT CARD POLICY
WHEREAS, the City of Fairfax has discussed the benefits of the purchasing card
program which is to provide an efficient, cost-effective method of purchasing, reserving,
guaranteeing and purchasing; and,
WHEREAS, having three (3) City Charge Cards (City Clerk and two (2) Maintenance
Men)with Elan Visa at a credit limit of$6,000.00; and,
WHEREAS,in the best interest of all is to implement a credit card policy which follows:
Policy
1.When not in use, cards will be kept in a secure location;
2.A written logbook will be kept indicating who has possession of the cards,date/time taken,
date/time returned, and acknowledgement of employee responsibility;
3.Each transaction can be no more than five hundred dollars($500.00).Any exceptions to this
limit shall be made in writing and approved in advance by the Mayor;
4. Employee use of the card will require that all detailed transaction receipts and documentation
be returned to the City Clerk for payment;
5. Employee will be responsiblle for all activities of the card when it is in their control.No
personal items shall be charged on the card.No exceptions to the policy will be allowed for
purchases made for lost or stolen cards that have not been reported to the financial institution
issuing the card;
6. The use of the card when away on City business...there will be no charging of liquor expenses;
7.Any misuse or variance from the procedures established for use of the card will not be allowed,
and if proven,may result in disciplinary action including termination; and,
NOW THEREFORE BE IT RESOLVED,by the City Council of Fairfax, Iowa that the
Mayor and the City Cleric are hereby authorized and directed to execute said Resolution.

WAGE INCREASE BASED ON MERIT PERFORMANCE
WHEREAS, during the November 12, 2002 City Council Meeting, the City Council
evaluated Ron Dusil, Dave Yanecek, Mary Pacha and Nancy Flickinger based on the evaluation
forms that were completed;and,
WHEREAS, an increase of a $1.00 an hour for all four (4) employees will be effective
on January 1, 2003; and,
NOW THEREFORE BE IT RESOLVED,by the City Council of the City of Fairfax,
Iowa, the Mayor and the City Clerk are hereby directed to certify this resolution of approval and
the City Clerk is authorized to issue checks,less Iegally required or authorized deductions, and
make such contributions to 1PER°S, FICA and other purposes as required by law.
