Box 337 Fairfax, IA 52228-0337 Re: Rezoning Request Dear Mayor, City Council, and Planning &Zoning: On behalf of Mr. Gordon Sevig we are respectfully requesting to rezone 2 lots in Fairfax Heights. The legal descriptions of the lots are: Lot 104 and Lot 105 of Fairfax Heights Second Addition to the City of Fairfax, IA. Currently the lots are zoned C2 and we are requesting these to be rezoned as 2 RM. The reason for the rezoning is due to the lack of interest in commercial lots and a current request for lots zoned for multi-family. Two-12 plexes are proposed on Lot 105 if geometries will allow, of which a site plan will be submitted for City approval at a later date. The names and addresses of all known property owners within two hundred feet of the lots are listed on the attached sheet. Lecrrlel's are Laa)d Deavlopoei�7 5irtre 19-5 3 L Date: August 11 2'003 To: Honorable Mayor and City Council City of Fairfax, Iowa From: Dick Ransom,, City Engineer Subject: Recommended Policy for Sanitary Sewer and Water Main Extensions Honorable Mayor and City Council: At the May City Council Meeting Dennis Keitel presented a Preliminary Engineering Report for Sanitary Sewer and Water Main (Extension on 80th Street to serve Karal's 2nd Addition. Since that time we have considered recommendations for a policy for cost sharing approach for sanitary sewer and water main extensions. The following) lis a proposed policy for those extensions. Commercial/Industrial Properties: In general most of the commerciallindustrial property that is developed and does not have sanitary sewer and water main service is located north of Prairie Creek along Highway 151. This area is also included in the Ciity's TIF district. Based on that consideration we would recommend the following policy for Commercial/Industrial Property: The cost of any sanitary sewer and/or water main extension be shared on a 50-50 basis between the City and the area served by said extension. The cost to the individual lots served wound be divided on an area basis for each lot compared to the total area served. This recommendation is based on the following considerations: 1. Commercial/industrial properties are generally wiithin the City's TIF district which provides the City with a mechanism to finance new sanitary sewer and water main extensions independent from the City's general tax base or rate structure. 2. Cost sharing for services to Commercial/Industrial properties provides an incentive for new growth in this area. 3. Commercial/Industrial Property is currently taxed at 100 percent of its assessed value. Determining the cost share between the propertiies served on an area basis is more representative of the value of the service to the parcel than other methods. Residential Property We would recommend sanitary sewer and water main extensions that serve residential property be extended on a cost per front foot basis. This method provides a better comparison for residential properties than the area method. It is also consistent with the current code provisions which establishes a fixed fee and front foot cost for connections to sanitary sewers. The Municipal Code for water mains does not have a similar provision. A copy of the sanitary sewer code section regarding connections is attached. For ease of administration we would recommend a fixed amount for the residential) connection fee. Based on a price to install sanitary sewer on a per foot basis of$20.00 per foot, we would recommend the set fee would be $10.00 per front foot for sanitary sewer. For water main we would recommend a set front foot connection fee of $8.00 because the cost of installation of water main is generally lower. Following City Council consideration of the policy, it appears that ordinance amendments would be needed to establish the policy. Donna Grgurich Iowa Department of Economic Development 200 East Grand Avenue Des Moines, IA 50309 RE: Contract Amendment to 1010-HSG-042, Fairfax Owner-Occupied Rehabilitation Program Dear Ms. Grgurich: The City of Fairfax is seeking an amendment to our owner-occupied housing rehabilitation program. The request is to extend the contract end date from September 301 2003 to March 31, 2004. To date, eight homes have been completed. The final two homes, are under construction. The city is requesting an additional six months to assist the final applicants in the program. The time is to ensure that adequate time is budgeted for the completion requiring no additional extension requests. The Fairfax City Council approved this contract amendment request on August 12, 2003. Thank you for your consideration of this request. SUBSECTION MODIFIED. Subsection 92.04(1)of the Code of Ordinances of the City of Fairfax, Iowa,2002, is repealed and the following adopted in lieu thereof: 1. Meters Read. Water meters shall be read monthly and the reading recorded on the water bill and returned by each customer by the fifteenth (15`h) day of each month. If a customer has not completed and returned the reading by the fifteenth (15`') day of each month, a fifteen dollar ($15.00)late meter reading penalty will be added to the customer's bill. The City reserves the right to read any meter when warranted. Enforcement of this ordinance will commence on August 15, 2003. SECTION 2. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section,provision or part thereof not adjudged invalid or unconstitutional.
