Mayor Voss called the meeting to order at 7:05 PM Council members present Beer,
Frieden, Scott, Ekstrom & Wainwright. Also present Ron Dusil, Dick Ransom, Randy
Scholer-City Attorney, representation from Union Pacific Railroad & numerous citizens.
Motion Beer 2"a Scott to approve agenda& Clerk's Financial.Reports Aye 5 MC. Motion
Ekstrom 2nd Beer approval Oct. 14 & Oct. 29, 2003 Council Meeting Mins. Aye 5 MC.
Sheriff Report was given. Mayor Voss asked the council to discuss the conditions agreed
upon by Union Pacific. Councilor Frieden addressed concerns of the conditions & the
language that was omitted by Union Pacific. Randy Scholer discussed the preemption
law. The railroad at this time is not looking to do this, Discussion about Surface
Transportation Board, infraction to stop construction & obtaining a copy of Linn Co.
conditions. Motion Beer 22"'d Wainwright to open the Public Hearing on the rezoning
application of Union Pacific Railroad Aye 5 MC. Mayor Voss declared the Public
Hearing open at 7:23 PM.. Each condition was read by the Clerk. Concerns were
addressed by the public & council that the conditions agreed upon by Union Pacific are
final. Mr. Bates of Union Pacific Railroad mentioned that the restriction of the
commodities transported is not negotiable. The tree buffer can be negotiated, but keep it
reasonable. Randy Scholer suggested forming a committee to meet with Union Pacific to
negotiate the conditions of rezoning. Councilors Wainwright &Frieden will represent the
city. A conference call will be scheduled before the next special council meeting on Nov.
20tH Motion Beer 2"d Scott to adjourn the Public Hearing to the next regularly scheduled
council meeting - Tues, Dec. 9th Aye 5 MC, Chief Sankot asked the council for
permission to start the procedure of placing the 1969 tanker & 1973 pumper up for sale.
The trucks are no longer used & the proceeds of the sale will go back to the FD (for the
purchase of a cascade system or into the truck fund) since the vehicles were purchased
through their budget tax dollars. Motion Frieden 2nd Scott authorizing the FD to publish
the sale of the trucks for sealed bids. If the process of obtaining a buyer fails during the
sealed bid process, the FD can openly sell the vehicles. Aye 5 MC. Chief Sankot gave
fire dept. report. Dick Ransom led discussion on the recommendations from Hall & Hall
Engineers, consisting of 70 feet street reservation for future expansion of Church ST. The
preliminary plat of Selzer Enterprises, Inc. First Addition To Fairfax, lA shows the
subdivision of the parcel between the buildings of Fairfax Meat Co., JR'S Cafe & the
Dairy Queen. The preliminary plat was approved by the Planning & Zoning Commission
without any recommendations from Hall & Hall Engineers. Discussion on street
reservation (around 8,000 square feet), no buildings to be built on the reservation,
affecting the sale of Dairy Queen Property, compensation from the City at the time of
purchase of street reservation, eminent domain & moving Veteran's Memorial. Motion
Frieden 2nd Beer to table this agenda item to Thurs. Nov. 20'h special council meeting at
5:30 PM Aye 5 MC. Motion Beer 2nd Ekstrom to table the building permit for Trent &
Jill Muckler—Dairy Queen subject to the preliminary plat of'Selzer Enterprises, Inc. First
Addition To Fairfax, IA to Thurs, Nov. 20th special council meeting Aye 5 MC.
Presentation from Area Ambulance Service. Discussion on drainage issues on Lots 1, 2, 4
& 5 of Karal's 3'd Addition. Motion Frieden 2"d Scott authorizing Hall & Hall Engineers
to commence with a drainage study not to exceed $1,500 in cost Aye 5 MC. All
documents for any agenda item must be in by Wed. before any scheduled meeting for the
City. If the documents are not in at that time it will not be on the agenda. Motion Beer 2„d

RESOLUTION
ESTABLISHING A CAPITAL PROJECT'S FUND
FOR$465,000 GENERAL OBLIGATION NOTE
WHEREAS, a comment was documented in the Schedule of Findings during the state audit for
fiscal year ending June 30,2003; and,
WHEREAS, the recommendation from the state auditor John Vanis, stated the City should
establish a separate Capital Project Fund to account for all General Obligation Note proceeds and the uses
of these funds;and,
WHEREAS, as a result to the recommendation the remaining balance of the $465,000 GO Note
proceeds as of July 31, 2003 currently reported in the General Fund to be transferred to a new Capital
Projects Fund-$465,000 General Obligation Note;and,

REPEALING RESOLUTION 02-06-11-1 SOLID WASTE COLLECTION FEES
WHEREAS, on June 11, 2002, Resolution 02-06-11-1 was passed and approved outlining the
schedule of fees for recyclables collection and disposition as well as solid waste collection and disposal
services from each residential prerndses being assessed onto residents monthly utility bill;and,
WHEREAS, a comment was documented in the Schedule of Findings during the state audit for
fiscal year ending June 30,2003;,.and,
WHEREAS,the recommendation from the state auditor John Vanis,stated Chapter 384.84 of the
Code of Iowa requires garbage rates to be approved by a city ordinance; and,
WHEREAS, on November 12, 2003, Ordinance No. was introduced and approved
amending provisions pertaining to yard waste collection and collection fees of solid waste in the Code of
Ordinances of the City of Fairfax,Iowa, 2002;and,
NOW THEREFORE BE IT RESOLVED,by the City Council of Fairfax,Iowa that the Mayor
and the City Clerk are hereby authorized and directed to execute said Resolution.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX,IOWA,2002,BY AMENDING PROVISIONS PERTAINING TO YARD
WASTE COLLECTION AND COLLECTION FEES OF SOLID WASTE
IN'THE CITY OF FAIRFAX,IOWA
BE IT ENACTED by the City Council of the City of Fairfax,Iowa:
SECTION 1. SECTION MODIFIED. Sections 106.04 and 106.08 of the Code of
Ordinances of the City of Fairfax, Iowa, 2002, is repealed and the following sections are
adopted in lieu thereof:
106.04 FREQUENCY OF COLLEC'T'ION. All solid waste shall be
collected from residential premises once each week and all yard waste shall
be collected once each week,from the first Tuesday in April through the
second Tuesday in November,
106.08 COLLECTION FEES.
1. Fee for Collection. A fee of $10.00 for recyclables collection and
disposition as well as solid waste collection and disposal service, used or
available, from, each residential premises will be assessed each month. The
fee allows one (34-gallon)container or bag of solid waste, not to exceed forty
(40) pounds, and unlimited recyclables and yard waste. Each additional
solid waste container or bag must have a tag affixed. The cost per Waste
Collection Tag is a $1.25 and available for purchase at the Fairfax City Hall
and the Fairfax HandiMart.
SECTION 2. SEVERABILITY CLAUSE. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect
the validity of the ordinance as a whole or any section, provision or part thereof not
adjudged invalid or unconstitutional.
SECTION 3.WHEN EFFECTIVE. This ordinance shall be in effect from and after its
final passage, approval and publication as provided by law.

building at 314 & 320 Highland Court, Lot 91, Fairfax il-leights Second
Addition, Fairfax, for the area of the rear of the }property that extends
Over the rear Y and setback.
As required In Zoning Code Section 1,07.0, the rear, yard is required to
have a minimum 20 ft. setback, As you can see ors the attached survey
of the property, the rear yard setback is only 14,85 ft as is bUt.
Due to the irregular size of this lot, this minor infrootiioin allowed for the
continuation of construction,

building so that if the'tn- ding was ever destroyed and could not be rebuilt,without moving the fouxidation,the imurance
would pay. TAT as seller would be asked to pay for the cost of that imurance endorsement for years into tf e indofinite
future. The;worst case sl.ettado is that thou'building burns and at that thne you ask the Board of Adjustment fox a variance to

Although the li&eliliood of not getting a variance under option 3 for such a minor infraction is wxemely small,I still
TecorAmend that you fix the problem,now by doing options l or 2. This way the City has officially waived the encroachment
and you can avoid the ccst of the insurance endorsement.

section on f;J or noncomplying buildirt . Otherwise I suggest that you visit with the Fairfax building officials about getting
