Also present Dennis K.eitel from Hall & Hall Engineers & numerous citizens. Motion Ekstrom 2'd Beer to approve agenda Aye 5 MC. Motion Ekstrom 2nd Beer approval Oct. 14 & Oct. 29, 2003 Council Meeting Mins. Aye 5 MC. Mayor Voss declared the Public Hearing open on amending a loan agreement not to exceed $50,000 for the 80th Street Sewer & Water Extensions Project at 5:31 PM. There being no objections, Mayor Voss declared the Public Hearing closed at 5:32 PM. Motion Frieden 2nd Beer approve RESOLUTION 03-11-20-1 amending loan agreement of the General Obligation Corporate Purpose Notes, dated March 1, 2003 for the purpose of paying costs on 801h Street Sewer & Water Extensions Project Roll Call Vote Aye 5 MC. Bill Voss,Mayor Mary Pacha, City Clerk RESOLUTION NO. �- C Resolution to amend a loan agreement WHEREAS, the City of Fairfax, Iowa (the"Cite, proposes to use the proceeds from its General Obligation Corporate Purpose Notes, dated March 1, 2003 (the"2003 Notes), for the purpose of paying costs of the construction of 801h Street sewer and water extensions (the `Arnended Purposd), in addition to the purposes for which the 2003 Notes were originally issued, and to amend the loan agreement (the"Loan Agreement)pursuant to which the 2003 Notes were issued, and has given notice thereof as required by such law; NOW, THEREFORE, It Is Resolved by the City Council of the City of Fairfax, Iowa, as follows: Section 1. The Council hereby amends the Loan Agreement to include the Amended Purpose. Section 2. All resolutions and orders or parts thereof in conflict with the provisions of this resolution,to the extent of such conflict, are hereby repea ted. Section 3. This resolution shall be in full force and effect immediately upon its adoption and approval, as provided by law. Passed and approved November 20, 2003.
