Council member absent Wainwright. Also present Ron Dusil, Nancy Flickinger, Randy Sclholer & numerous citizens. Motion Beer 2"d Scott to approve agenda & Clerk's Financial Reports Aye 4 MC. Motion Beer 2"d Frieden approval Jan. 13, Jan. 28 & Feb. 4, 2004 Council Meeting Mins. Aye 4 MC. Sheriff Report was given. Motion Beer 2nd Frieden to open the Public Hearing on the rezoning application of Union Pacific Aye 4 MC. Mayor, 'Voss declared the Public Hearing open at 7:07PM. City Attorney Randy Scholer spoke to Gary Bates from Union Pacific on Feb. 5. Union Pacific will accept the Dec. 8, 2003 letter from Tom Osbe listing the 9 conditions. Discussion rather or not it is a spur line, future ordinances & options of rezoning. Construction on project will commence as soon as weather permits. Motion Beer 2nd Scott to close the Public Hearing at 7:35PM. Motion Frieden 2"d Scott to approve ORDINANCE 18 subject to the letter from Tom Osbe dated Dec. 8, 2003 listing the 9 conditions on its first reading Roll Call Vote Aye Beer, Frieden & Scott Nay Glick MC. Don Kleis, owner of Prairie Road Builders, discussed seal coating necessary streets. The price is the same as last year. Motion Beer 2nd Scott to approve Prairie Road Builders Proposal Aye 4 MC. SECTION MODIFIED. Section 65.02 of the Code of Ordinances of the City of Fairfax, Iowa, 2002, is repealed and the following adopted in lieu thereof. 65.02 STOP REQUIRED. Every driver of a vehicle shall stop in accordance with the following: 1. Vehicles traveling west on East Southview Road shall stop at Highway 151. 2. Vehicles traveling on East Southview Road shall stop at Williams Boulevard. 3. Vehicles traveling north on Williams Boulevard shall stop at Highway 151. 4.
