Adjournment CITY" OF FAIRI,"AXREGULXR COUNCIL M EETING OCTOBER R 12, 2004 Regular meeting of the Fairfax City Council was held Tuesday, October 12, 2004 at Fairfax City Hall at 7:00 PM, Mayor Voss presided. Council members present: Beer, Frieden, Scott, Glick, Wainwright. Others present: Dick Ransom, Ron Dusil, Dave Yanecek, Nancy Flickinger, Dave Selzer, Deputy Pete Wilson, Doug Stepanek, Brad Meyers, Mike Sankot, Jeff Krouse, Deanna Heintz, Joyce Elsbury and various citizens. The agenda was amended by adding 1. Review bids for sale of truck to Item 18. Reports, d. Maintenance Department. Wainwright moved to approve the agenda as amended and the Clerk's Financial Statements, seconded by Scott. Roll call vote: ayes: Beer, Frieder,, Scott, Glick, Wainwright. Nays: None. Motion carried. Beer moved to approve and place on file the minutes of the regular council meeting dated September 14, 2004 and to receive and place on file the minutes of the Planning and Zoning Commission meeting dated September 13, 2004, seconded by Scott. Roll call vote: Ayes:. Beer, Frieden, Scott, Glick, Wainwright. Nays: None. Motion carried. The Sheriff's report was given by Deputy, Pete Wilson and the Call for Service Log was submitted and discussed. Mayor Voss announced that this was the time and place fora public hearing on the matter of the proposed action to institute proceedings to enter into a loan agreement in the principal amount not to exceed $700,000 (General Obligation). Notice of this hearing was published in the Cedar Rapids Gazette on October 12, 2004, Dick Ransom, Hall & Hull Engineers, Inc., explained that the need for the bond was to maintain& expand the municipal sewage collection and treatment facility. He stated that the City's existing wastewater treatment system does not meet the current State permit requirements, so the City must expand or replace the existing system. City officials have met with the IDNR officials to discuss this situation and plan for short term and long range capital improvements. Due to the rapid growth of the City, it was decided to make a treatment facility plan -which would accommodate modular expansion.. The first module serving approximately 4,000 people and the 2nd module will provide service for 6,000. The plan is also being developed for new collector sewers to serve existing areas with no public service now and for all new undeveloped areas. He reported that the immediate improvement plan was to remove accumulated sludge from the p p y Farms, LTD has been selected, a west pond. and that this process was underway now as Clark price and budget have been established, the sludge testing is completed and negotiations are underway with the landowners. He reported that the preliminary project cost estimate was prepared based on construction of an activated sludge plant on the existing treatment pond site. The total cost for treatment improvements is estimated at $2,250,000 with the costs for collector sewers and pumping stations not estimated as of yet. Jeff Krouse, 734 Church Street, inquired as to if there will be an increase in the sewer rates. Jeff was informed that due to the costs for capital improvements, annual operation and maiiitenance,the City will be required to increase the public sewer rates. There being no farther comments or objections, 'Mayor Voss closed the Public Hearing at 7:34 PM. ........ . . . Beer introduced the following Resolution and moved its adoption, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Scott, Glick, Wainwright. Nays: None. 'Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2004-30 entitled, ''A RESOLUTION TAKING ADDITIONAL ACTION TO ENTER INTO A LOAN AGREEMENT". Passed and approved this 12th day of October. Council set October 25, 2004 at 6:00 PM for a special meeting to review bids on the General Obligation Sewer Improvement bond. Mayor Voss announced that this is the time and place for a public hearing on the matter of proposed Ordinance No. 24, an Ordinance amending the Fairfax Zoning Ordinance of 2000 - Section 1.07.B.RS: Single-Family Residential 1, Adding Item 5. Agriculture, to Subsection A and 2. Adding Item 6. Farm buildings incidental to agriculture-uses, to Subsection B. Notice of this hearing was published in the Cedar Rapids Gazette on October 2, 2004, Council reviewed Recommendation 2000-3 submitted by the Planning and Zoning Commission to approve proposed amendment. Council questioned Dave Selzer as to why he wanted the property zoned residential. He stated that he would like it done now before the laws change and inquired as to if the land could be subdivided for future development, if it were to remain AG. He was informed of the regulations regarding his question and told that he could also request a zoning change. The definition of Agriculture was discussed. Upon due consideration, it was the consensus of Council that amending this ordinance would not be in the best interest of the City. There being no furthere0rurnClItS 017objections, Mayor Voss closed the Public Hearing at 7:54 Pm. Beer moved to DISMISS ORDINANCE NO. 24, AN ORDINANCE AMFNDING THE FAIRFAX ZONING ORDINANCE OF 2000 — SECTION 1.07.13. RS, seconded by Scott. Roll call vote: Ayes: None. Nays: Beer, Frieden, Scott, Glick, Wainwright. Motion carried. There being five negative votes, the motion failed. Mayor Voss declared Ordinance No. 24 failed adoption and will be dismissed. Beer introduced the following Resolution and moved its adoption, seconded by Glick. Roll call vote: Beer, Frieden, Scott, Glick, Wainwright. Nays: None. Motion carried. Whereupon, the Mayor declared the following duly adopted: Resolution No. 2004-31, entitled, '''A RESOLUTION APPROVING THE ANNUAL FINANCIAL STATEMENT". Passed and approved on this 12th day of October, 2004. Beer introduced the following Resolution and moved its adoption, seconded by Glick. Roll call vote: Beer, Frieden, Scott, Glick, Wainwright. Nays: None. 'Motion carried. Whereupon, the Mayor declared the following duly adopted: Resolution No. 2004-32 entitled, "A RESOLUTION APPROVING THE TRANSFER OF FUNDS FROM 2001-2002 LOST STREET IMPROVEMENTS FUND TO THE GENERAL FUND". Passed and approved this 12th day of October, 2004. Dick Ransom, Hall &Hall Engineers, discussed the installation of speed humps designed for 25 mph to slow traffic on Fairfax Road and Church Street. Council reviewed quotes that were submitted for installing the speed humps excluding the warning signs. It was noted the lowest bidder was Pace Asphalt Systems. Beer moved to accept Pace Asphalt Systems quote of$2,540.00 to install one speed hump on Fairfax Road and one on Church Street, seconded by Scott. Roll call vote: Ayes: Beer, Frieden, Scott, Glick, Wainwright, 'Nays. None. Motion carried. 4 Ransom reported on the City's ordinances regarding the sewer and water connection fees. He stated that under the current code connection charges are allowed for sewer but nothing has been established for the water connection fees. He also recommended establishing a policy for a cost � sharing approach for sanitary sewer and water main extensions. Ransom will work with the Clerk in drafting the appropriate ordinances to amend the section of the Code that addresses these fees and policies. He also recommended that the front foot fee be established by resolution in order to allow greater flexibility for adjustments. These issues will be put on the agenda for the November meeting. Doug Stepanek discussed the need for direction signs to the Legion Hall. He proposed to have a sign at the NE corner of Main St. and Vanderbilt St. and at the corner of Vanderbilt St. and Church St. Beer said that the city has a grant that may provide signs at the Solith entry way to Church. St., but this will come at a later date. 'Beer said she recommends putting temporary signs Up for now. The uniform retention basin and trees for future development was discussed. Council decided that a requirement should be made to include one tree in the public right-of-way. Ransom will assist in the details of this project. Ransom said property owners can be made to conform to our design standard regarding driveways and intersection standards. Councilor Beer reported on the Community Visioning meeting that was held on October 5th. She said the committee's main priority is the trail system and the south entrance into Fairfax will have plantings and signage. The project is moving forward with the next meeting to be held on October 19th. She stated that a grant has been applied for in the amount of $5,000 through. Alliant Energy's Branching Out program. Beer will discuss with the Trees Forever committee the type and size of trees that should be used for this project and the ongoing tree project in which $2,000 has already been allocated. Beer moved to approve donating $1,000 to the 'Linn. County Trails Association, seconded by Scott. Roll call vote: Ayes: Beer, Frieden, Scott, Glick, Wainwright. Nays: None. Motion carried. Frieden moved to approve the Claims List dated October 12, 2004, seconded by Wainwright. Roll call vote: Ayes: Beer, Frieden, Scott, Glick, Wainwright. Nays: None. Motion carved. Council reviewed bids that were submitted for the purchase of the 1987 Chevy dump truck and noted the lowest bidder was Bob Costigan. Wainwright moved that we accept Bob Costigan's bid of $5,250 for the 1987 Chevy duunp truck,, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Scott, Glick, Wainwright, Nays: None. Motion carried. Reports: No one was present for the library report. Chief Sankot reported that the fire department has received a FEMA grant in the amount of$67,154 for the purchase of equipment. A discussion was held regarding Ordinance No. 18 in which conditions of the UPRR were set forth. Sankot stated that he was under the assumption that the fire department was to receive $10,000 from the UPRR for fire safety expenses due to the new tracks. The $10,000 was taken into consideration when the grant was applied. for. Since they didn't receive this money he is now unable to meet the obligations of the grant. Council approved allocating$6,715.40 (10% of the grant) the UPRR to the fire department. Op discussion: Brad Meyers, 313 Burger Lane, presented bills and photos of sewer back up damage to his residence. He stated that this damage was the result of an electrical outage at the lift station. He also said that he had previously submitted the bills and. nothing has been done about it yet. The Mayor will contact our insurance agent and,, if necessary our attorney, to get. the problem solved., Deanna Heintz, commented on the retention pond on Cemetery Road and 80th St. and wondered about issues with erosion control. A discussion was held regarding a citizen's delinquent water bill, Arrangements were made for a payment schedule with the bill to be paid in full by November 15, 2004. Mayors Comments: Discussion was held on proposed subdivisions within two miles of Fairfax. Clerk was instructed to send a letter to the City of Cedar Rapids stating that the Fairfax City Council has reviewed and has no objection to the annexation of Hawks Ridge First Addition to the City of Cedar Rapids. Council abstained from responding to the annexation of Glen Meadows Addition, due to litigation regarding the 28 E Agreement made in March of 2001 between the City of Cedar Rapids and the City of Fairfax. Clerk Comments: The Clerk informed Council that the City is the priority insurance carrier when all employee is driving their personal vehicle for City business. .There being no further business, Scott moved adjournment at 9:25 PM, seconded by Wainwright. Items 7 & 8 - Public Hearing on Zoning Ordinance — Amendment to Single-Family Residential As you could probably guess, lave Selzer was not happy with the zoning classification of Agriculture upon the annexation. He is still wanting Single-Family Residential and has requested a change to the zoning ordinance to add Agriculture to Single-Family Residential.. Apparently, there a few residents in town that are zoned RS that are farming the ground. Robert Boland to name one (he was recently annexed in) and Gordon Sevig to name another. He is also wanting to add farm buildings incidental to agricultural uses to the permitted structure section of the code. The P & Z Commission will be meeting on this issue Monday, October 11th to either recommend or deny. I.F. Item fi-Bond, Sale Larry Burger, Speer Financial, can meet with you in the evening on Monday, October 25th or Wednesday, October 27th for taking bids on the bond. If these dates don't work, lie wants to wait until after the election. The night he could come down then is Tuesday, November 9th. Please check your calendars. RE; Item 10 - Funds to purchase truck I talked to John Vanis, the Auditor, about purchasing the new truck out of the Local Option Street Improvements fund. He said that this really wasn't an improvement and we shouldn't do it. So I will make the payment for the truck out of the Road Use Fund and the General Transportation fund and them reimburse the General Transportation fund with the local option money ($11,500) for street work that was done this year...the load Use fund. does not have a line item for reimbursements of such. Nan FVIO.....Gordon Sevig has taken out applications for a voluntary annexation of property located between Prairie View Estates and Fairfax Heights Addition. I guess he is trying to buy the ground from Harold McCormick. I haven't heard anything recently on this though. NOTE: Jeff Schulte may be giving the Sheriffs Report at the Council Meeting. He also may be complaining about his late meter reading fees. Jeff didn't turn in a meter reading for Sept or Oct. The first month I tried calling him, but found out he has an unlisted number. The 2nd month I put a note on his bill to contact City Hall ASAP. He's been to the office twice complaining. He said that we should check to see if he included a meter reading. And the people at the bank should check when he pays at the bank — and let him. know — so be doesn't get the $15.00 late fee. He said .Ron knows where he lives and should come to his house and,let him know he forgot his meter reading, since we can't get a,hold of him by phone. He told me I wasn't doing a good job in trying to get a hold of him. I told,him that he should report nay secretarial duties to the council if he didn't like the way it was handled. Chairman Collett presided. Commission members present: Virginia Soukup, Greg Fetter and Jack Rowray. Absent: Dean Hartman, Harry Stallman and Harold Scott. Others present: Ron Dusil, Nancy Flickinger, Connie Frame, Sam Selzer and Barbara Schrader. Chairman Collett announced that this was the time and place for the public hearing on voluntary annexation and zoning classification. The Deputy Clerk advised notice of the hearing was published in the Cedar Rapids Gazette on August 30, 2004. No written objections were filed and no oral objections were offered from the audience. Chain-nan Collett declared public hearing closed. Soukup introduced the following Recommendation and moved its adoption, seconded by Fetter. The motion carried 4 to 0. Whereupon, the Chairrnan declared the following duly adopted: Recommendation 2004-02 entitled, "A RECOMMEDATION APPROVING ANNEXATION AND REZONING CLASSIFICATION." ', w A RECOMMENDATION AMENDING THE FAIRFAX ZONING ORDINANCE OF 2000 OF THE CITY OF FAIRFAX, IOWA BY AMENDING PROVISIONS PERTAINING TO SECTION 1.07.B. RS: SINGLE-.FAMILY RESIDENTIAL WHEREAS, Section 1.073, RS: Single-Family Residential, of the Zoning Ordinance of the City of Fairfax is amended by repealing Subsection A. and Subsection B. and adopting the following in lieu thereof: A. Permitted Principal Uses and Structures; L Single family dwellings. 2. Home occupations. 3. Public buildings,parks, playgrounds, community centers, libraries, and museums. 4. Family Group Care Homes. 5. Agriculture. B. Permitted Accessary Uses and StruEctures . 1. Private garages. 2. Private swimming pools. 3. Private greenhouses not operated for commercial purposes. 4. Uses and structures accessory to a principal permitted use or a special exception use are permitted subject to the provisions of this ordinance. 5. Temporary buildings used in conjunction,with construction work,provided that such buildings are removed within thirty(30) days upon completion of the construction work. 6. Farm buildings incidental to agricultural uses. WHEREAS,The City Planning and Zoning Commission,Fairfax, Iowa has recommended approval of the amendment to the City Zoning Ordinance; and, NOW THEREFORE, be it resolved by the City Planning and Zoning Commission of the City of Fairfax, .Iowa, that said amendments of the said SECTION OF THE FAIRFAX ZONING ORDINANCE OF 2000, be and the same is hereby acknowledged and approved on the part of the City planning and Zoning Commission and this Commission hereby recommends to the City Council the acceptance of the same, and the chairman is hereby authorized and directed to certify this recommendation of approval and affix the same to said amendment as provided by law. Absent: Harold Scott, Marry Stallman and Bob Collett 1. The minutes of the September 13, 2004 meeting of the Commission were approved.. 2. Regarding Fairfax Zoning Ordinance of 2000 pertaining to Section 1.07 B RS: Single- Family, Subsections A and B, it was moved by Soukup that these subsections be repealed and replaced by Subsections A and B as presented on the attached document, Recommendation No.. 2004-02. Seconded by Mowry. The motion carried 4 to 0. 3. Dave Selzer asked if the street on the north side of the Dairy Queen property could be vacated. He was informed that the initial action on this would come from the City Counsel. 4. The Commission received a notice from James Stallman of his resignation from this Commission, effective 12:00 noon on October 11, 2004. The Commission accepted his resignation with regret. The Commission also recommends that the City Counsel appoint Dave Selzer to replace Mr. Stallman. . The meeting was adjourned at 7:.40 p.m.. That sounds like a lot of miles but many more are needed to catch up with other communities. In addition to more miles we help make improvements to make trails easier to use, safer and more beautiful. In 2004, additions were; 2 miles to the Cedar River Trail (M),paving and 2 underpasses on the Cedar Valley Nature Trail (CVNT), beautification by Prairie grass seeding along the CRT and the Grant Wood Trail (GWT). The seven local Rotary Clubs made some wonderful additions to the trail around Cedar Lake. LCTA is aiding in the planning of a connection to Iowa City through Ely, and Amana through Fairfax. Some other plans in the works are the Cemar trail in Cedar Rapids to connect with Marion, a connecting trail head in Squaw Creek Park to tie together GWT, Sac & Fox, and Marion trails, and the Vision Iowa project. We are participating in the "Fifteen in S"project. This year we are deploying counters developed and built by the Rockwell Collins Retiree Volunteers (RCRV), to affirm what many have known that many people enjoy our trails, Counters confirm the facts and will help in obtaining future governmental support. The Linn County Trails Association (LCTA), serves as a catalyst to the efforts of many organizations. Sometimes it is an endorsement letter, sometimes cooperative planning, sometimes moral support and sometimes a financial match for a grant being sought. Always we must thank our Councilmen and Supervisors for their ongoing support. Our membership dues provide necessary funds for operating the LCTA including the "Trail Connection" newsletter. however we require additional capital funds for materials for the counters and to purchase land such as the case with the GWT, to providing matches as for the parking lot at County Home Road,$15,000 for the Hiawatha trail, (the Hall Perrine Fund was a great.help here) and $35,000 for an upcoming match for Segment"G" of the Cedar River Trail Each fall we reach out to our friends and supporters to ask for capital finds to support our ongoing efforts.
