Adjournment CITY OF FAIRFAX REGULAR COUNCIL MEETING 3une 14, 2005 Regular meeting of the Fairfax City Council was held Tuesday,, June 14, 2005 at Fairfax City Hall at 7:00 PM. Mayor Voss presided. Council members present: Beer, Frieden, Glick, Wainwright. Absent: Scott. Others present: Nancy Flickinger, Ron Dusil, Dave Yanecek, Dennis Keitel, Deputy Dunn, Patrick Slater,Frank Gardner and Vernon Cerveny. Beer moved to approve the agenda and Clerk's Financial Statements, seconded by Frieden. Roll call vote- Ayes: Beer, Frieden, Glick, Wainwright, Nays: None. Absent,, Scott. Motion carried. Frieden moved to approve and place on file the minutes of the regular council meeting dated May 10, 2005, and to accept and place on file the minutes of the Planning and Zoning Commission meeting dated May 9, 2005, seconded by Glick. The Sheriffs report was given by Deputy Dunn and the Call for Service Log was submitted and. discussed. Mayor Voss announced that this was the time and place for a public hearing on the matter of the proposed action of amending the Fairfax Zoning Ordinance of 2000, Section 1.05 Rules and Definitions, Subsection B. Definitions and Section 1.07,C RM: Multi-Family Residential, Subsection D. Bulk Regulations. Notice of this hearing was published in the Cedar Rapids Gazette on June 3, 2005. There being no further comments or objections, Mayor Voss closed the Public Heating at 7:03 PM. Patrick Slater discussed the events and schedule for the Fairfax USA Days and assured Council that all vendors would provide the City with Certificates of Insurance. FraA,,, Gardner discussed approval to build a house at 80 Stallnian Drive. Council recommended he proceed with applying.far a variance and go before the Board of Adjustment. Discussion was held on the need for additional help for the water, sewer, streets and building department. Council recommended to proceed with the hiring process. Joe Blood,Royale Pools, requested a building permit for two building and inquired about City sewer and water to his property. Wainwright made a motion to approve Joe Bloods building permit subject to grading approval from Hall & Hall, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Glick, Wainwright. Nays: None. Absent: Scott. Council approved Joe Blood's request to hook onto City sewer if he keeps as much on his property as he can before it comes out on. City driveway and as long as be agrees that the line is private and is his to the manhole and the City is not involved in it monetarily, Sewer and water access to his property is a future pr of ect. After discussion, Hall &Hall was directed to research a document from Sevig Development. Discussion was held on the purchase of property for future expansion. Councilor Wainwright left the meeting at 8:07 p.m. Ron Dusil reported on the waterway between Skyview Ave, & Highland Ave, Dennis Keitel, Hall & Hall, will do research and recommend a solution to this matter at the next meeting. A discussion was hold in regard to the City's financial assets. As per audit requirements, Council reviewed interest rates/terms offered by various banks. It was the consensus of Council that the monies will be re-invested with the financial institution offering the most reasonable rate of return while maintaining the necessary liquidity and safety of principal. No action was taken on items 21 and 22. Beer introduced the following Resolution and moved its adoption, seconded by Glick. Roll call vote: Ayes: Beer, Frieden, Glick. Nays: None. Whereupon the Mayor declared the following duly adopted: Resolution No. 20,05-18 entitled, "A RESOLUTION AUTHORIZING THE TRANSFER OF LOST FUNDS FROM THE SPECIAL REVENUE FUND TO THE LOST SAVINGS ACCOUNTS." Passed and approved this 14h day of June 2005. Dermis Keitel, Hall & Hall Engineers, Inc. reported on the Waste Water Treatment Facility Plan. A work session will be set to discuss the financials. Reports: Vernon Cerveny, Library, reported about ideas for future library expansion and a recreation center for the City. The next library meeting is Monday, July 18, 2005 at 7:00 p.m. Mike Sankot, Fire Chief, reported that the fireworks are July 2 and that they have 35 members now with the addition of two new junior firefighter members. He discussed a possible ambulance-style vehicle for medical calls in the future. The fire department has had 68 calls so far this year. Ron Dusil, Maintenance, reported that Waste Pickup Day went fine. He recommends that wet wells be cleaned every 6 months, Council directed the maintenance department to put up a "No Parking Here To Comer," sign on the South East comer of Vanderbilt St. & Main St. Councilor Beer, Parks department, reported on showing movies in, the park once a month during the summer. The movie "Shrek 11" will be shown on Friday., July I" at dusk at the ballpark. An auction will be held on Saturday, July 2 at St. Patrick's at 1:00 p.m. The next Visioning Meeting is Monday, July, 11, 2005 at 6:00 p.m. Council approved the Deputy City Clerk to purchase a copy machine and the clerks to proceed with implementing the Disaster Recovery plan with the assistance of the Fire Chief and Emergency Management personnel. Council also approved the clerks to draft an Employee Handbook with help from Councilor Frieden. There being no further business, Beer moved adjournment at 938 P.M., seconded by Frieden. Farm--An area of not less than ten(10)acres which is used for the growing of the usual farm products such as vegetables, fruits and grain,and their storage on the area,as well as for the raising thereon of the usual farm poultry and farm animals. Mobile Home--A vehicle without motive power used, or so originally constructed as to permit being used, as a conveyance upon the public streets or highways and duly licensed as such, and constructed in such a manner as will permit occupancy thereof for human habitation, capable of dwellings,or sleeping quarters and which is being moved,towed,or transported by another vehicle. This definition shall also include a-ad apply to such vehicles or structures that are located on a permanent or temporary foundation. Mobile Home Park--Any site,lot,field or tract of land upon which two or more occupied mobile homes are harbored whether free of charge or for revenue purposes and intended for such use and shall include any building,stractaTc,tent,vehicle,or enclosure intended for use as part of the equipment of such mobile home park. Mobile Home Converted to Real Estate--A mobile home which has been attached to a pennanent foundation on real estate owned by the mobile home owner,rendering it totally immobile, and which has been inspected by the assessor,the mobile home vehicle title, registration,and license plates collected from the owner, and the property entered upon the tax rolls of Linn County. Motel--A building or group of buildings in which lodging is provided and offered primarily to transient occupancy and in which each unit has convenient access to a parking space for the use of the units occupants. Nonconforming Building--A building,or portion thereof which lawfully does not conform to the provisions of this Chapter relative to height,bulk, area or yard size requirements for the district in.which it is located. Nonconforming Use--A use which occupied a building or land but lawfully does not conform to the use regulations of the district in which it is located. IM--An institution which is advertised,announced,or maintained for the express or implied purpose of providing nursing or convalescent care for persons unrelated to t1re licensee.Anursing home is a home for chronic or convalescent patients who, on admission, are not as a rule,acutely ill and who do not usually require special facilities, such as an operating room,x-ray facilities,laboratory facilities, and obstetrical facilities.A nursing home provides care for persons who have remedial ailments,for which continuing medical and skilled nursing me is indicated,who,however,are not sick enough to require general hospital care.Nursing care is their primary need,but they will require continuing medical supervision.A major factor which distinguishes a nursing home is that the residents will require the individualization of medical care.For the purpose of this Ordinance,a"nursing home" shall also be considered a"convalescent home." p Qpgn,Space--The land area of a site not covered by buildings,rights-of-way,parking � structures,or accessory buildings, except recreational,structures,and which is available to all occupants of units for whose use the space is intended, Parking Space--A surfaced area,enclosed in the main building or in an accessory building, or unenclosed,having an area of not less than one hundred and eighty(180),permanently reserved for the temporary storage of vehicles and connected with a street or alley by a surfaced driveway which affords satisfactory ingress and egress for vehicles. Plan--The Comprehensive Plan of the City of Fairfax. PT -The primary use of land or structures as distinguished from secondary or accessory use.For example,a house is a principal use in a residential area; a garage or pool is air accessory use. Private--In reference to a building, structure,utility,-facility, or use, "private"means owned by someone other than a unit of government, or an agency of government,unless the context clearly indicates that"private"is being used in a broader sense of something not open or available to the general populace. Public---In reference to a building,structure,utility,facility,or use,"public" means owned and/or Operated by a unit of government or an agency thereof,unless the context clearly indicates that"public"is being used in the broader sense of something available to the general populace. Setback--The distance required to obtain the front,side or rear yard open space provisions of this Ordinance. Si=--Any structure or part thereof or device attached thereto or painted, or represented thereon,which shall display or include any letter,word,model,banner,flag,pennant, insignia, device or representation used as, or which is in the nature of an announcement, direction, Or advertisement. The word"sign" includes the word"'billboard". Staly--That portion of a building included between the surface of any floor and the surface of the floor next above it or,if there be no floor above it then the space between the floor and the ceiling next above it. Sto alf--A partial story under a gable,hip or gambrel roof,the wall plates of which on at least two opposite exterior walls are not more than four(4) feet above the floor of such story,except that any partial story used for residence purposes,other than for janitor Or caretaker or his/her family, or by a family occupying the floor immediately below it,shall be deemed a full story. Street--An approved public or private thoroughfare which provides the principal means of vehicular access to abutting property and/or for vehicular passage. Structure--Anything constructed or erected,the use of'which requires More Or less permanent location on the ground, including,but without limiting the generality of the foregoing,advertising sip-is,billboards,backstops for tennis courts,gazebos, fences,towers, ground-based satellite dishes,buildings and solar collectors. Each investment must be authorized by applicable law and is subject to conditions of this Investment Policy. Each investment made pursuant to this Investment Policy must be authorized by applicable law and this written Investment Policy. The investment of bond funds or sinking funds shall comply not only with this investment policy,but also be consistent with any applicable bond resolution. The Investment Policy is intended to comply with Iowa Code Chapter 12B. Upon passage and upon future amendment, if any, copies of this Investment Policy shall be delivered to all of the following: • The governing body or officer of the City of Fairfax to which the Investment Policy applies. • All depository institutions or fiduciaries for public funds of the City of Fairfax. • The auditor engaged to audit any fiends of the City of Fairfax.. SECTION 2—DEJ.,F(AT.1ON OF AUTHORITY In accordance with Section 1213.10(l), the responsibility for conducting investment transactions resides with the Treasurer of the City of Fairfax. Only the Treasurer and those authorized by ordinance or resolution may invest public fund's and a copy of any empowering resolution shall be attached to this Investment Policy. The Treasurer shall establish a written system of internal controls and investment practices. The controls shall be designed to prevent loss of public funds, to document those officers and employees of the City of Fairfax responsible for elements of the investment process, and to address the capability of investment management. The controls shall provide for receipt and review of the audited financial statement and related reports on internal control structure of all outside persons performing any of the following for the City of Fairfax-. 1. Investing public funds. 2. Advising on the investment of public funds. 3. Directing the deposit or investment of public funds. 4. Acting in a fiduciary capacity for the City of Fairfax. A bank, savings and loan association or credit union providing only depository services shall not be required to provide an audited financial statement and related report on internal control structure. All contracts and agreements with outside persons providing any of the above listed,services shall require written notification to the City of Fairfax within thirty days of receipt of any communication from either their auditor or any regulatory authority which denotes any of the following: the existence of a material weakness in their internal control structure, regulatory orders or sanctions in regard to the services being provided to the City of Fairfax by the outside person. SECTION 3—OBJECTIVES OF INVESTMENT POLICY The primary objectives, in order of priority, of all investment activities involving the financial assets of the City of Fairfax shall be the following: s SAFETY: Safety and preservation of principal in the overall portfolio is the foremost investment objective. • LIQUIDITY: ',Maintaining the necessary liquidity to match expected, liabilities is the second priority. • RETURN: Obtaining a reasonable return is the third priority. SECTION 4—PRUDENCE When investing or depositing public funds, the Treasurer of the City of Fairfax shall exercise the care, skill,prudence and diligence under the circumstances then prevailing that a prudent person acting in a like capacity and familiar with such matters would use to attain the Section 3 investment objectives. This standard requires that when making investment decisions, the City Council shall consider the role that the investment or deposit plays within the portfolio of assets of the City of Fairfax and the investment objectives stated in Section 3. SECTION 5-DEPOSITORIES All deposits shall be in depositories located in the State of Iowa. Each bank must be on the most recent Approved Bank List as distributed by the Treasurer of the State of Iowa or as amended as necessary by notice inserted in the monthly mailing from the State Treasurers Office. Each financial institution shall be properly declared as a depository by the City Council of the City of Fairfax. Deposits in any financial institution shall not exceed the$ limit approved by the City Council of the City of Fairfax. SECTION 6—INSTRUMENTS ELIGIBLE FOR INVESTMENT Assets of the City of Fairfax may be invested in the following: • Interest-bearing savings accounts, interest-bearing money market accounts, and interest-bearing checking accounts at any bank, savings and loan association or credit union in the State of Iowa.. Each bank must be on the most recent list of Approved Bank List as provided by the State Treasurer. Deposits will only be made with financial institutions that are properly declared as a depository by resolution of the Fairfax City Council. Deposit amounts shall not exceed the statutory limit approved by the governing body of Fairfax. • Obligations of the United States government,its agencies and instrumentalities. • Certificates of deposit and other evidences of deposit at federally insured Iowa depository institutions approved and secured pursuant to Chapter 1213. SECTION —PROHIBITED INVESTMENTS AND INVESTMENT PRACTICES Public funds of the City of Fairfax shall not be invested in the following: 1. Reverse repurchase agreements. 2. Futures and options contracts. Assets of the City of Fairfax shall not be invested pursuant to the following investment practices: 1. Trading of securities for speculation or the realization of short-term trading gains. 2. Pursuant to a contract providing for the compensation of an agent or fiduciary based upon the perfort-nance of the invested assets, 3. If a fiduciary or other third party with custody of public investment transaction records of the City of Fairfax fails to product requested records when requested by this public body within a reasonable time, the City of Fairfax shall make no new investment with or through the fiduciary or third party and shall not renew maturing investments with or through the fiduciary or third party. SECTION 8—INVESTMENT MATURITY LIMITATIONS Operating funds must be identified and distinguished from all other funds available for investment. Operating funds are defined as those funds, which are reasonably expected to be expended during the current budget year or within fifteen months of receipt. All investments authorized in Section 5 are farther subject to the following investment maturity limitations: 1. Operating funds may only be invested in instruments authorized in Section 5 of this Investment Policy that mature within three hundred ninety-seven(397) days. 2, The Treasurer may invest funds of the City of Fairfax that are not identified as Operating Funds in investments with maturities longer than three hundred ninety-seven (397) days. However, all investments of the City ofFairfax shall have maturities that are consistent with the needs and use of City of Fairfax. SECTION 9—DIVERSIFICATION The City of Fairfax maintains no investments of a type requiring diversification. SECTION 10—SAFEKEEPING AND CUSTODY All invested assets of the City of Fairfax involving the use of public funds custodial agreement, as defined in Section 1213.10C, shall comply with all rules adopted pursuant to Section 12B.10C relating to those investments. All custodial agreements shall be in writing and shall contain a provision that all custodial services be provided in accordance with the laws of the State of Iowa. The investment report shall set out the current portfolio in terms of maturity, rates of return and other features and summarize all investment transactions that have occurred during the reporting period and compare the investment results with the budgetary expectations. SECTION 13 -INVESTMENT POLICY REVIEW ANIL)AMENDMENT This Investment Policy shall be reviewed every two years or -ore frequently as appropriate.
