Adjournment CITY OF FAIRFAX REGULAR COUNCIL MEETING October 11, 2005 Regular meeting of the Fairfax City Council was held Tuesday, October. ll, 2005 at Fairfax City Hall at 7:00 p.m. Mayor Voss presided. Council members present: Beer, Frieden, Scott, Wainwright, Absent: Glick. Others present: Nancy Flickinger, Ron Dusil, Dave Yanecek, Dan Zamastil, Dick Ransom, Dennis Keitel, Deputy Crosser, Vernon Cerveny, Any Peterson, Joe Moorman, Mick Heintz, Don Grisham. The agenda was amended by adding an item to read as follows: Approval of Claims List dated October 11, 2005. Beer moved to approve the agenda as amended and.Clerk's Financial Statements, seconded by Scott. Roll call vote: Ayes: Beer, Friedcn, Scott, Wainwright. Nays: None. Absent: Glick. Motion carried. The September 13, 2005 minutes were amended by changing the motion setting salaries to be seconded by Frieden instead of Wainwright. Roll call vote: Ayes,:: Beer, Frieden, Scott, Wainwright. Nays: None. Absent: Glick. Motion carried. Frieden moved to approve the amended minutes and place on file the minutes of the regular council meeting dated September 13, 2005, the minutes of the work session meeting dated September 13, 20015, and the minutes of the special meeting dated September 25, 2005, seconded by Beer. Roll call vote: Beer,Frieden, Scott,Wainwright. Nays: None. Absent: Glick. Motion carried. Scott moved to accept and place on file the minutes of the Planning and Zoning Commission meeting dated October 3, 2005,. seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None. Absent: Glick. Motion carried. Mayor Voss announced that this was the time and place for a public hearing on the matter of the sewer service charges. Notice of this hearing was published in the Cedar Rapids Gazette on October 3,2005. It was noted that the purpose of the hearing was. to inform the public that the Council will be considering a sewer rate increase of a $6.00 flat charge per month to provide funding for the new Wastewater Treatment Facility.. Ransom commented that the sewer rates will be reviewed every year. Muck Heintz requested a reduction of the water and sewer usage break-off points of 25,000 gallons to 15.„000 gallons. Ransom will talk to Larry Burger regarding the'revenue impact for the City and will discuss it at the next meeting. There being no further comments or objections,:Mayor Voss closed the Public Hearing at 7:08 p�.m. Beer introduced Ordinance No. 46,. AN ORDINANCE AMENDING. THE. CODE OF ORDINANCES OF THE'CI Y OF FAIRFAX,. IOWA, 2002, BY AMENDING PROVISIONS PERTAINING TO SEWER SERVICE CHARGES. Frieden moved that Ordinance No. 46, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2012,:BY AMENDING PROVISIONS PERTAINING TO SEWER SERVICE CHARGES be considered for the first time, seconded by Wainwright. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright; _Nays: None. Absent:.. Glick. Motion carried. Mayor Voss announced that this was.the time and place for a public hearing on the.matter, of the aerated lagoon modifications. Notice of this hearing was published in the Cedar Rapids Gazette on October 3, 2005. Ransom reported that this public hearing was to discuss the adoption of the plans, specifications, form of contracts and the estimated costs for construction and equipment for the aerated lagoon modifications which includes three divisions: aerators,baffle walls and electrical extensions. There being no further comments or objections,Mayor Voss closed the Public Hearing at 7:12 p.m. Beer introduced the following Resolution and moved its adoption, seconded.by Scott. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None. Absent:. Glick. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2005-38 entitled,. "A RESOLUTION ADOPTING PLANS., SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATED COST FOR AERATED LAGOON MODIFICATIONS PROJECT". Passed and approved this 11th day of October 2005. Ransom reported that we received 2 bids back on all of 3 divisions for the aerated lagoon modifications. He recommended that we award the electrical work.to Mayberry Electric tonight so he can place his orders and get his prices stabilized. The other two divisions will be discussed next month after the engineers have reviewed them. The Mayor announced that seated bids were canvassed on behalf of the City on the 11th day of October,2005, and the.following sealed.bids,were received; DIVISION 1 —AERATORS Unit Price Amount 1. Absent: -Glick. .Motion carried, Whereupon the Mayor declared the following duly adopted: Resolution No. 2005-44 entitled, A RESOLUTION APPROVING AND MAKING AWARD OF CONTRACT FOR THE DIVISION III — ELECTRICAL WORD FOR AERATED LAGOON MAIDIFICATIONS TO FAIRFAX WASTWATER FACILITY". 'Passed and approved this l l'h day of October 2005. Amy Petersen, ECICOG, discussed the process of the Housing Rehabilitation Grant. She reported that the state recommends doing 6 homes which will be completed in.the 2 year time limit and that 4 people are still on the list from the last program. The recommended local match from the City is $1,500 - $2,000. The housir committee will consist.of Cheryl Scott, Marianne Wainwright, Nancy Flickinger and Wendy Voss. The deadline for:applications is November 18th. Clerk was instructed to set up a committee meeting and to contact. Fairfax State Savings Bank.to see if they would be interested in lender participation„ Joe Moorman, Guaranty Bank & Trust, reported that they have purchased land along Highway 151. He discussed using a mobile home as a temporary office. Council agreed to consider the request after receiving the site plan and written request and subject to the engineer's.approval. Wainwright moved to approve Fairfax Handimart's Liquor License, seconded by Frieden. Roll call vote: Ayes: Beer,Frieden, Scott,Wainwright. Nays: None. Absent: Glick. Motion carried.. The census bureau has notified the City th4t the official population of Fairfax is 1662, with 624 housing units. Wainwright introduced the following Resolution and moved its adoption, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None.. Absent: Glick. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2005-39 entitled, "A RESOLUTION RECOGNIZING AND APPROVING THE OFFICIAL RESULTS OF THE SPECIAL CENSUS CONDUCTED IN JUNE OF 2005". Passed and approved this 11th day of October 2005. Discussion was held regarding returned checks. Council agreed to a$25.60 returned check fee with a "cash payment only" for any individual who attempts payment to the City with a dishonored check more than one time in any given period of 12 months. Whereupon the Mayor declared the following duly adopted: Resolution No. 2005-40 entitled, "A RESOLUTION ESTABLISHING. A FEE FOR RETURNED CHECKS DUE TO INSUFFICIANT FUNDS. AND CREATING A,CASH PAYMENT ONLY POLICY". Passed and approved this 11th.day of October 2'005: Discussion was held on the issue of requiring .developers to plant trees on each lot and specifying height,trunk diameter, type, and warranty. . Wainwright introduced Ordinance No. 47,- AN ORDINANCE AMENDING THE CODE OF OIIDINANCES OF THE CITY OF FAIRFAX! IOWA, 2002, BY ADDING NEW PROVISIONS PERTAINING TO SUBDIVISION REGULATIONS. Beer moved that the rule requiring that an ordinance be considered and voted on for passage at two council meetings prior to this meeting be suspended with respect to Ordinance No. 47, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None. Absent: . Glick. Motion carried. Wainwright moved that Ordinance No. 47, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX; IOWA, 2002, BY ADDING NEW PROVISIONS PERTAINING TO. SUBDIVISION-REGULATIONS, be changed by. the word temporary be stricken, and be considered for the third time, placed upon its passage and adopted, seconded by Frieden. Roil call vote:. Passed and approved this 11th day of October,2005. Scott introduced the following Resolution and moved its adoption, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None. Absent;; Glick. Motion carried. Resolution No. 200542 entitled, "A RESOLUTION AUTHORIZING ASSESSMENT OF A LIEN AGAINST THE PROPERTY FOR NONPAYMENT OF BILLED CHARGES FOR 'SNOW REMOVAL.". Passed and approved this 11th day of October 2005. Beer introduced the following'Resolution and moved its adoption, seconded by!Scott. Resolution No. 2005-43 entitled, "A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FROM THE GENERAL FUND TO FAIRFAX VISIONING FUND". Passed and approved this 11th day of October 2005. Discussion was held on the sex offender ordinance. Comments were made regarding legality, enforcement,. and insurance coverage. Clerk was directed to get the City's insurance coverage in writing from the insurance company for the next meeting. Discussion was held on the resignation of Mike Glick from the City Council. Citizens interested in filling the vacant council seat can contact Mayor Voss. and he will make recommendations for appointment to the council at the November 8th meeting. Wainwright moved.to accept Mike.Glick's resignation, effective October 14, 2005, from the City Council, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None. Absent: Glick. Motion carried. Frieden moved to reclassify Nancy Flickinger's title from Deputy Clerk to Finance Administrator, seconded by Beer: Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None. Absent: Glick. Motion carried. Reports: Vernon Cerveny, Library, reported that the current library-was built when Fairfax had a population of 600, which has now grown to 1662. Comments.were made regarding a new library or reunodeling the current one to accommodatethe growth. Vernon recommended thinking now for future plans for a new fire station, city hall, library, and recreation center- similar to North Liberty and Coralville. Dave Yanecek, Fire Department, reported that ten members went to fire.school. Ron Dusil, Maintenance Department, reported that they flushed hydrants at Prairie View Estates and raised some fire hydrants, trimmed trees and finished the mowing. The storm sewer from Front St. to Prairie Creek was extended 39 feet to the creek and 25 manholes were raised to grade level. Street sips at Highland Ave. & Commercial Ct. were replaced. Ratluje will be coming next week to begin the water and sewer extension on 80th Street to Highway 151, Councilor Beer,Visioning Committee, reported that they are waiting on an IDOT' permit to proceed with the Fairfax sign. 'Discussion on a $2,500 match for the Alliant Energy Branching Out Grant was held and approved by Council. The clerk will write a letter of support from the mayor saying we are committed to it. This amount will be put in the budget for next year. The quote for the Fairfax sign did not include the sign installation, assembly, or foundation. Council suggested Beer do more checking on a similar sign with another company or using different material. Councilor Beer, Parks Committee, reported on the Park Survey results from September's newsletter, Rated as follows: 1; Trails: 2. Parks in the-new additions. 3. Refurbishing existing tennis courts. 4. Restroom at Prairie Creek Park, 5. Recreation center. She also stated that they were gaining new members on the-Parks Committee every month. Discussion was held about the purchase of land for a park. The next Parks meeting is Monday, November 21 at 6:30 at the library. Discussion; Don Grisham had comments'about the proposed stop light at Stoney Point Rd. and Beverly Rd. Citizen comments were made regarding the fast traffic on Church St. by the day care. Thele being no further business, Wainwright moved adjournment at 8;47 p.m.; seconded by Scott. All in favor.
