Council members present: Beer, Frieden, Ma,gers, Wainwright. Absent: Scott, Others present: Debra Warner and Vickie Kindl. Wainwright moved to approve the agenda, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Magers, Wainwright. Nays: None. Absent: Scott. Motion carried. Mayor Voss stated that the special meeting was called to interview candidates for the City Clerk position. He stated that the City Attorney advised that the Council can close the meeting pursuant to Iowa Code Section 21.5 (i). Mayor Voss introduced candidate Vickie Kindl and informed her of her right to request a Closed Session. This applicant chose to have her interview held in Closed.Session. Wainwright moved to enter into Closed Session at 7:02 PM pursuant to Iowa Code Section 21.5(l)(i) to evaluate the professional competency of an individual whose appointment, hiring, performance or discharge is being considered when necessary to prevent needless and irreparable injury to that individual's reputation and in which Vickie Kindl has requested a Closed Session, seconded by Beer. Census Bureau refund 22, Adjournment CITY OF FAIRFAX REGULAR COUNCIL MEETING MARCH 13, 2007 The regular meeting of the Fairfax City Council was held Tuesday, March 13, 2007 at Fairfax City Hall at 7:00 PM. Mayor Voss presided. Council members present: Beer, Frieden, Magers, Wainwright. Absent: Scott. Others present: Dave Yanecek, Ron Dusil, Dan Zamastil, Dick Ransom, Tom Kleiman;Aaron Voss, Dee Meese,Brad Larson, Chief Sankot. The agenda was amended to defer action on Item 12: Discussion on CRANDIC RR and the proposed 60/20/20 plan. Magers moved to approve the agenda as amended and the Clerk's Financial Statements, seconded by Beer. Roll call vote: Ayes. Beer, Frieden, Magers, Wainwright. Nays: None. Absent: Scott, Motion carried. Beer moved to approve and place on file the minutes of the regular meeting dated February 13, 2007 and the minutes of the special meeting dated February 1 , 2007, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden,Magcrs, Wainwright, Nays: None. Absent: Scott. Motion carried. The Sheriff's report was given by Deputy Peshek and the Call for Service Log was submitted and discussed. Beer moved to accept and place on file the minutes of the Planning & Zoning Commission's regular meeting dated February 20, 2007, seconded by Magers. Roll call vote: Ayes: Beer, Friedcn, Magers, Wainwright. Nays: None. Absent: Scott. Motion carried. Mayor Voss announced that this was the time and place for public hearing on the matter of the proposed action on the Fiscal Year 2007-2008 annual budget. It was noted that the Notice of this hearing was published in the Cedar Rapids Gazette on.March 1, 2007 and that no changes had been made after the Council's last budget work session. There being no further comments or objections, Mayor Voss closed the Public Hearing at 7:12 PM. Magers introduced the following Resolution and moved its adoption, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Magers, Wainwright. Nays: None. Absent: Scott. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2007-13 entitled, "A. RESOLUTION APPROVING THE ANNUAL BUDGETFOR FISCAL YEAR 2007-2:008". Passed and approved this 13th day of March 2007. Dee Meese, Eagle Property Management, addressed Council on various parking issues on Commercial Court and inquired as to if a portion of the street could be allowed for resident parking. It was the consensus of Council and Chief Sankot that the No Parking on Commercial Court was established for safety reasons and felt that the No Parking area should remain as set forth. Council addressed a letter submitted by the Members of the Fairfax Heights Condo Association in which they stated concerns about the condition of the vacant lots that surround their properties and the rust on the water tower. The condition of the lots will be investigated and the property owners that are in violation of the code will be contacted. Dusil stated that the water tower is already scheduled for painting this spring, Brad Larson, Linn County Planning Commission, led a discussion on the importance of the City implementing a Hazard Mitigation Plan. Council decided to discuss this matter further before making a decision to proceed. Frieden introduced the following Resolution and moved its adoption, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Magers, Wainwright. Nays: Name. Absent: Scott. Motion carried. Whereupon the Mayor declared the following duly adopted Resolution No. 2007-14 entitled, "A RESOLUTION AUTHORIZING THE TRANSFER OF GENERAL FUND MONEY" TO THE GENERAL MAINTENANCE FUND & THE NA"T"URE TRAIL PROJECT FUND". Passed and approved.this 13th day of March 2007. Wainwright introduced the following Resolution and moved its adoption, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Magers, Wainwright. Nays: None. Absent: Scott. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2007-15 entitled, "A RESOLUTION TO ISSUE PARTIAL PAYMENT NO. S TO KLEIMAN CONSTRUCTION, INC. FOR THE CONSTRUCTION OF THE NEW MECHANICAL WASTEWATER TREATMENT FACILITY, 2006 WASTEWATER TREATMENT PLANT IMPROVEMENTS". Passed and approved this 13th day of March 2007. Veenstra and Kimm's clarification of the specifications for the dewatering of the 2006 Wastewater Treatment Plant Improvements will be discussed at the next regularly scheduled meeting. Magers moved to deny Polar Bird Peppy's, Inc. Peddler's Permit due to an invalid signatory date on the application, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Magers, Wainwright. Nays: None. Absent: Scott. Motion carried. Council reviewed and discussed the web site bid proposal submitted by Aaron Voss. Magers moved to table awarding a contract for the design &maintenance of a web site until next month, seconded by Beer. Roll call vote: Ayes: Beer, Frieden,Magers, Wainwright. Nays: None. Absent: Scott. Motion carried.. Magers moved to approve the claims list dated March 13, 2007, seconded by Wainwright. Roll call vote: Ayes: Beer, Frieden,Magers, Wainwright. Nays: Name, Absent: Scott. Motion carried. Other items of discussion/reports: Library - A clarification was made to the library's February report. It was noted that Cedar Rapids, Marion, Fairfax and Hiawatha were awarded a joint grant to conduct a telephone & paper survey of citizens in their areas to find out how they could beast serve them as a group. This survey will take place in mid-March. It was also noted that the Fairfax Public Library, in conjunction with the State of Iowa Library Services, is participating in the PLOW Project (Putting Libraries On the Web). The PLOW project has been made possible by a grant that was received from the Bill & Melinda Gates Foundation. Fire Department — In considering the circumstances of February's power outage and storm, Chief Sankot felt that everything went very well in respect to the response teams. He stressed the need of purchasing generators and requested that council start addressing other equipment and additional shelters that are needed for disaster situations. Maintenance -- IDusil reported that Ricklef Excavating has started on the lift station at Prairie View Estates, the progress of the Public Works building and that 7 aerators are down. Parks & Visioning — Councilor Beer reported that the Park's Committee will be hosting an Open.House in the community room at the Guaranty Bank building on April 21st at 3:00 PM. A Parks Survey will be distributed and the Disney movie "Cars" will be shown during this event, She stated that the next Park's meeting will be held at 7:00 PM on April 19th. She also reported that the Visioning Committee will be hosting a fund raiser called "Hats, Hats, Hats" on March 25th at 2:00 PM in the community room at the Guaranty Bank building. The upcoming Visioning meetings are slatted for March 22"d and April 17th at 7:00 P . In the past the vacant lots surrounding the Fairfax Heights Condo Association properties have not been maintained to city code Chapter 50 Nuisance Abatement procedure section 2"T'code of ordinance of the city of Fairfax states grass, weeds,brush. Dense growth of all;grass,weeds,vines, brush or other vegetation in the city so as to constitute a health, safety or fire hazard each owner and each person in possession or control of awry property shall be responsible to keep said lot mowed. The lots listed below have not been maintained according to the city code that was instituted by the Fairfax City Council, 1. The lots at the end of the cul-de-sac of Highland Court,adjacent to the water tower 2. The entrance to our development,off of highway 151 and adjacent to the car wash. 3, The water retention basin in the new development,and behind Highland Court condos. 4. The comer lot by Highland Ave and Commercial Drive. In the past the said lots have been allowed to grow one to three feet tall and iinstead of being mowed they were"hush. hogged", The code states the properties should be mowed! (not bush hogged)to prevent dense growth of grass,weeds and brush. The members of the Fairfax Heights Condo Association expect the city of Fairfax to follow through to keep the lots maintained as indicated in the city cede. The Fairfax City code also states there should be no dead growthsince this does cause a health and safety hazard'. We agree with the city,that dense grevnh is a health and safety hazard to the community. Standing water and weeds can created an increase in bug and rodent infestation. With that said,the members would like to know when the city plans to take care of the dense growth in the retention basin behind the Highland Avenue condos. We also would like to know how the city plans to handle tlhv growth in the future? Last year the water tower on Highland Cou t wus cleaned,which was greatly appreciatedl However,some of the paint„ on the tower was removed during the cleaning process. A large area of rust has developed on the water tower. This rusty spot is not only unattractive, but can't be good on the structure of the tower itself, What are the cities plans to repair this rust spot? We are sure the items listed above are not just the concerns of the members of'the Fairfax Heights Association,but concern all the residents in this area of Fairfax. We are sure the members of the city council have the same desires for the city of Fairfax as we do to keep our city a safe,healthy and beautiful place to live.
