REGULAR COUNCIL MEETING
SEPTEMBER 12, 2006
Regular meeting of the Fairfax City Council was held Tuesday, 'September 12, 2006 at Fairfax City
Hall at 7:00 PM, Mayor Voss presided. Council members present: Beer, Frieden, Magers,
Wainwright. Absent: Scott. Others present: Nancy Flickinger, Ron Dusil, Dave Yanecek, Dan
Zamastil, Dick Ransom, John Hill,Kathy Kelly.
Beer moved to approve the agenda and Clerk's Financial Statements, seconded by Magers. Roll call
vote: Ayes: Beer,Frieden, Magers, Wainwright. Absent: Scott. Nays: None. Motion carried.
Frieden moved to approve and place on file the minutes of the regular meeting dated August 8, 2006,
and the minutes of the special meeting dated August 23, 2006, seconded by Beer. Roll call vote:
Ayers: Beer, Frieden, Magers, Wainwright, Absent: Scott. Nays: None. Motion carried.
Beer moved to accept and place on file the minutes of the Planning and Zoning Commission meeting
dated August 15, 2006, the minutes of the Planning and Zoning Commission meeting dated September
5, 2006, and the minutes of the Board of Adjustment meeting dated September 7, 2006, seconded by
Magers. Roll call vote: Ayes: Beer, Frieden, Magers, Wainwright, Absent: Scott. Nays: None.
Motion carried.
The sheriff's report was given by Deputy Brady and the Call for Service Log was submitted and
discussed.
Mayor Voss announced that this was the time and place for a public hearing on the matter of the
proposed Urban Renewal Plan Amendment September 2006.
Notice of this hearing was published in the Cedar Rapids Gazette on August 31, 2006.
There being no further comments or objections, Mayor Voss closed the Public Hearing at 7:10 PM.
Frieden moved to accept Planning & Zoning Commission's Recommendation No. 2006-07 to
approve Urban Renewal Plan Amendment--- September 2006, seconded by Beer. Roll call vote: Ayes:
Beer,Frieden,Magers, Wainwright. Absent: Scott, Nays: None. Motion carried.
Magers introduced the following Resolution and moved its adoption, seconded by Frieden. Roll call
vote: Ayes: Beer, Frieden, Magers, Wainwright. Absent: Scott. Nays: None. Motion carried.
Whereupon the Mayor declared the following duly adopted: Resolution No. 2006-66 entitled, "A
RESOLUTION TO APPROVE URBAN RENEWAL PLAN AMENDMENT FOR THE
FAIRFAX URBAN RENEWAL AREA— SEPTEMBER 2006". Passed and approved this 12th day
of September 2006.
Mayor Voss announced that this was the time and place for a public hearing on the matter of the
sewer revenue loan disbursement agreement.
Notice of this hearing was published in the Cedar Rapids Gazette on August 30, 2006.
There being no further comments or objections, Mayor Voss closed the Public Hearing at 7:15 PM.
Magers introduced the following Resolution and moved its adoption, seconded by Beer. Roll call
vote: Ayes: Beer, Frieden, Magers, Wainwright, Absent: Scott. Nays: None. Motion carried.
Whereupon the Mayor declared the following duly adopted: Resolution No. 2006-67 entitled, "A
RESOLUTION AUTHORIZING AND APPROVING A SEWER REVENUE LOAN AND
DISBURSEMENT AGREEMENT AND PROVIDING FOR THE ISSUANCE AND SECURING
THE PAYMENT OF $2,400,000 SEWER REVENUE BONDS". Passed and approved this 12th
day of September 2006.
Mayor Voss announced that this was the time and place for a public hearing on the matter of the
vacation of Utility Easement.
Notice of this hearing was published in the Cedar Rapids Gazette on September 1, 2006.
There being no further comments or objections,Mayor Voss closed the Public Hearing at 7:19 PM.
Wainwright introduced the following Resolution and moved its adoption, seconded by Magers. Roll
call vote: Ayes: Beer, Frieden, Magers, Wainwright. Absent: Scott. Nays: None. Motion carried,
Whereupon the Mayor declared the following duly adopted: Resolution No. 2006-68 entitled, "A
RESOLUTION APPROVING THE VACATION OF UTILITY EASEMENT LOTS 103 AND
104 OF FAIRFAX HEIGHTS 'SECOND ADDITION, LINN COUNTY, FAIRFAX, IOWA".
Passed and approved this 12th day of September 2006.
Wainwright introduced Ordinance No. 59, AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002, BY AMENDING PROVISIONS
PERTAINING TO STOP OR YIELD REQUIRED.
Frieden moved that the rule requiring that an ordinance be considered and voted on for passage at two
council meetings prior to this meeting be suspended with respect to Ordinance No. 59, seconded by
Beer, Roll call vote: Ayes: Beer, Frieden, Magers, Wainwright. Absent: Scott. Nays: None.
Motion carried.
Frieden moved that Ordinance No. 59, AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002, BY AMENDING PROVISIONS
PERTAINING TO STOP OR YIELD REQUIRED be considered for the third time,placed upon its
passage and adopted, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Magers, Wainwright.
Absent: Scott. Nays: None. Motion carried.
Ordinance No. 59 is declared to have been enacted.
Wainwright introduced Ordinance No. 60, AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002, BY AMENDING PROVISIONS
PERTAINING TO THE UNIFORM BUILDING CODE.
Magers moved that the rule requiring that an ordinance be considered and voted on for passage at two
council meetings prior to this meeting be suspended with respect to Ordinance No. 60, seconded by
Wainwright. Roll call vote: Ayes: Beer,Frieden, Magers, Wainwright. Absent: Scott. Nays: None.
Motion carried.
Frieden moved that Ordinance No. 60, AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002, BY AMENDING PROVISIONS
PERTAINING TO THE UNIFORM BUILDING CODE be considered for the third time, placed
upon its passage and adopted, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Magers,
Wainwright. Absent: Scott. Nays: None. Motion carried.
Ordinance No. 60 is declared to have been enacted.
Discussion was held on the building permit fee schedule.

final plat of Prairie Creek Estate Third Addition to the City of Fairfax, Iowa, seconded by Frieden.

John.Hill, Planning & Zoning Cormnission, made comments on green space and parks in Fairfax. He
requested that the engineer or a member of the city council attend the Planning & Zoning mectings to
answer any questions.

Councilor Beer discussed a request for movie equipment fends of $2,500.00 for a projector and
inflatable screen. Council was in agreement for this expenditure..
Discussion on the purchase of bagger-vac system for the lawn mower for $2,599.00 was held.
Council agreed that it should be purchased.
Magers moved to approve the claims list dated September 12, 2006, seconded by Wainwright, Roll
call vote: Ayes: Beer, Frieden,Magers,Wainwright. Absent: Scott. Nays: None. Motion carried.
Reports: Dan Zamastil, Fire Department,reported that they have been busy. Ron Dusil,Maintenance
Department reported that they are putting up street signs in the new developments. Mayor Voss
reported that the outside structure of the public works building is framed in. Councilor Beer
commented on the IDOT mowing of the vacant lot at the end of Main Street and the concern about the
Visioning Committee bushes that were planted next to the bean field. Councilor Beer, Parks, reported
that the "Movies in the Park" was successful. Discussion was held on the money disbursement for the
Trails grant. Discussion was held about repair on the tennis court at Linn Street Park. The Parks
Committee will leave at 5:30 Ply'][ from the library on Thursday„ September 21" for a field trip to
Marengo's Gateway Park. Councilor Beer, Visioning, commented on finishing the fall planting. Plans
to put up the north entry Fairfax sign will not proceed until the sewer is installed and use of the
easement is finished.
Discussion: A citizen had comments on a letter that was received regarding his animals. A specified
area to view trains was mentioned. Kathy Kelly, Kafe Europa, requested information on a temporary
liquor license.

CONSULTATION SESSION
AUGUST 28, 2006 AT 4:00 PM
Can August 19, 2006, letters were sent to the Linn County Board of Supervisors, the
Superintendent of College Community School District and the President of Kirkwood
Community College. The purpose of the letter was to inform them of a consultation
session that was going to be held on August 28, 2006, at 4:00 PM at Fairfax City Hall,
525 Vanderbilt St., Fairfax, Iowa, in which they would have the opportunity to discuss
the proposed amendment to the Fairfax Urban Renewal Plan.Amendment.
Those in attendance were Bill Voss, Mayor, City of Fairfax, and Nancy Flickinger,
Finance Administrator.
As of September 6, 2006, there have been no written recommendations or objections filed
with the City Clerk concerning the amendment from the aforementioned entities.

A resolution to approve urban renewal plan amendment for the Fairfax. Urban
Renewal Area
WHEREAS, as a preliminary step to exercising the authority conferred upon Iowa cities
by Chapter 403 of the Code of Iowa (the "Urban Renewal Law'), a municipality must adopt a
resolution finding that one or more slums, blighted or economic development areas exist in the
municipality and that the rehabilitation, conservation, redevelopment, development or a
combination thereof, of such area or areas is necessary in the interest of the public health, safety
or welfare of the residents of the municipality; and
WHEREAS, this Council previously created the Fairfax Urban Renewal Area (the
""Urban Renewal Area"); and
WHEREAS, an amendment to the plan for the Urban Renewal Area has been prepared
which would authorize the development and enhancement of city park and recreational facilities;
and
WHEREAS, notice of apublic hearing by the City Council of the City of Fairfax, Iowa,
on the proposed urban renewal plan amendment for the Fairfax Urban Renewal Area was
heretofore given in strict compliance with the provisions of Chapter 403 of the Code of Iowa,
and the Council has conducted,said hearing; and
WHEREAS, copies of the urban renewal plan amendment, notice of public hearing and
notice of a consultation meeting with respect to the urban renewal plan amendment were mailed
to Linn County, College Community School District and the Kirkwood Community College; the
consultation meeting was held on the day of , 2006; and

WHEREAS, this Council by resolution previously created the Fairfax Urban Renewal
Area(the "Urban Renewal Area"); and
WHEREAS, an amendment to the urban renewal plan has been prepared which would
authorize the development and enhancement of a city park and recreational facilities, and it is
now necessary that a date be set for a public hearing on that plan amendment;
NOW, THEREFORE, lie It Resolved by the City Council of the City of Fairfax, Iowa, as
follows:
Section 1. This Council will meet at the CTIA/ Lai Fairfax, Iowa, on
the 12th day of September, 2006, at 7 _ o'clock m., at(which time and place it will hold a

Area.
Section 2. The City Clerk shall publish notice of said hearing, the same being in the
form attached hereto, which publication shall be made in a legal newspaper of general circulation

SECTION 5. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance
shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision or part thereof not adjudged invalid or
unconstitutional.
SECTION 6. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final

WHEREAS, the Iowa Department of Transportation has programmed the HMA
Pavement Widening with HMA 'Resurfacing Project on US Hwy 151 (Williams Boulevard) from
Fairfax northeasterly to the west junctions with US Hwy 30, STPN-151-3-30(120)- -2J-57 and
the installation of a traffic signal at the intersection of US Hwy 151 (Williams Boulevard) and
Beverly Road/Stoney Point Road, STPN-151-3(124)- -2J-57, and
WHEREAS, the Iowa D.O.T. is requiring financialparticipation and operation and
maintenance responsibilities from the Cities of Cedar Rapids and Fairfax and Linn County for
implementation of the above projects, and
WHEREAS, the Traffic Engineering Department recommends approval of a 28E
,Agreement with Linn County end the City of Fairfax for operation and maintenance of traffic
signals at-the intersection of US 151 (Williams Boulevard) and !Beverly Road/Stoney Point-Road-
SW, now therefore

BE IT FURTHER RESOLVED that traffic signals be installed at the intersection of US
151 (Williams Boulevard) and (Beverly Road/Stoney Point Road SW and the Traffic Engineering
Department is authorized to operate said traffic signals in a flashing mode during off-peak
hours.

CHAPTER 28E AGREEMENT
BETWEEN THE CITY OF CEDAR RAPIDS, IOWA,
CITY OF FAIRFAX, IOWA AND
LINN COUNTY, IOWA
WHEREAS, the Iowa D.O.T. is proposing to install traffic signals at the intersection
of U_S. Highway 151 (Williams Boulevard) & Beverly Road/Stoney Point Road SW as part
of the HMA Pavement Widening with HMA Resurfacing Project on U.S. 151 (Williams
Boulevard) from Fairfax northeasterly to the west junctions with U.S. Highway 30, STPN-
151-3-30(120) - - 2J - 57, and
WHEREAS, portions of said project occur within the Corporate Limits of Cedar
Rapids, Fairfax, and within Linin County as identified on Exhibit A.
BE IT RESOLVED, that the Cities of Cedar Rapids and Fairfax, and Linn County
enter into an agreement pursuant to Chapter 28E of the Code of the State of Iowa,
providing for certain understandings relating to the construction, maintenance and operation
of the traffic signals and street lighting at the intersection of U.S. Highway 151 (Williams
Boulevard) & Beverly Road/Stoney Point Road SW, and these understandings shall be as
follows:
A. This agreement shall apply to the construction, maintenance, and operation)
of traffic signals and street lighting at the intersection of U.S, Highway 151
(Williams Boulevard) & Beverly Road/Stoney Point Road SW. Said traffic
signals and street lighting shall be in effect for the time length mutually
agreed upon by the Cities of Cedar Rapids and Fairfax, Linn County, and the
Iowa D.O.T.
B. The construction cost for the new traffic signal) installation is provided in a
separate Preconstruction Agreement.
C. Four (4) new or reconstructed street lights will 'be provided at the intersection
with construction of the new traffic signals. Any street lighting construction
costs incurred by the City of Cedar Rapids will' be shared by Linn County and
the City of Fairfax. Linn County will reimburse the City of Cedar Rapids for
50% of the street (light costs and Fairfax will reimburse the City of Cedar
Rapids for 25% of the street light costs.

D. The City of Cedar Rapids shall be responsible for all maintenance associated
with said signals and street lighting, payment of all utility costs associated/
with said signals and street lights, and replacement of said signals and street
lights should they be damaged or otherwise caused inoperable. Linn County
will reimburse the City of Cedar Rapids for 50'% of the utility costs and 50% of
the replacement and maintenance costs and Fairfax will reimburse the City of
Cedar Rapids for 25% of the utility costs and 25% of the replacement and
maintenance costs associated with operation maintenance and replacement
of the signals and street lighting.
The City of Cedar Rapids shall submit to Linn County and Fairfax periodic
invoicing of the utility, replacement, and maintenance costs upon which said
reimbursement will be made. The City of Cedar Rapids shall provide a
summary of labor, equipment and material expenses as the basis for
reimbursement.
E. The Cities of Cedar Rapids and Fairfax, and Linn County shall share all
liabilities which may incur in connection with said signal and street light,
installation, operation and maintenance, 25% Cedar Rapids, 25% Fairfax,
and 50% Linn County.
F. Should the southeast and/or the northwest quadrants of this intersection be
annexed into either of the cities, with the limits of the annexation area(s) at
least 500 feet each way from the centerline of the intersection, this 28E
agreement shalll be modified such that the percentages of utility,
maintenance, replacement, and liability costs will be adjusted to reflect the
number of quadrants of the intersection within each jurisdiction divided by
four (4) quadrants.
This agreement shall be in full force and effect upon execution and shall remain in
effect until such time as it maybe further amended by agreement of all parties or the
conditions of Section F are met.
