Council members present: Beer, Scott, Magers, Absent: Frieden. Wainwright arrived at 5:50 PM. Others present: Dick Ransom, Tom Kleiman. ,'Scott moved to approve the agenda, seconded by Beer. Roll call vote: Ayes: Beer, Scott, Magers, Nays: None. Absent: Frieden, Wainwright. Motion carried. Beer introduced the following..Resolution and moved its adoption, seconded by Scott. Roll call vote: Ayes: Beer, Scott, Magers. Nays: None. Absent: Frieden, Wainwright. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution No.. 2006-92 entitled, "A RESOLUTION APPROVING CHANGE ORDER NO. 1 TO KLEIMAN CONSTRUCTION, INC. FOR THE CONSTRUCTION OF THE NEW MECHANICAL WASTEWATER TREATMENT FACILITY, 2006 WASTEWATER TREATMENT PLANT IMPROVEMENTS". Passed and approved the 28th day of November 2006. Wainwright arrived at 5:50 PM. Wainwright introduced the following Resolution and moved its adoption, seconded by Beer. Roll call vote: Ayes: Beer, Scott, Magers, Wainwright. Nays: None, Absent: Frieden. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2006-93 entitled, "A RESOLUTION APPROVING CHANGE ORDER NO. 2 TO KLEIMAN CONSTRUCTION, INC. FOR THE CONSTRUCTION OF THE NEW MECHANICAL WASTEWATER TREATMENT FACILITY, 2006 WASTEWATER TREATMENT PLANT IMPROVEMENTS". Passed and approved the 28th day of November 2006. Magers introduced the following Resolution and moved its adoption, seconded by Wainwright. Roll call vote: Ayes: Beer, Scott, Magers, Wainwright. Nays: None, Absent: Frieden. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2006-94 entitled, "A RESOLUTION APPROVING CHANGE ORDER NO. 3 TO KLEIMAN CONSTRUCTION, INC. FOR THE CONSTRUCTION OF THE NEW MECHANICAL WASTEWATER TREATMENT FACILITY, 2006, WASTEWATER TREATMENT PLANT IMPROVEMENTS". Passed and approved the 28th day of November 2006. Wainwright moved to table Resolution No. 2006-95 entitled, "A RESOLUTION APPROVING CHANGE ORDER NO. 4 TO KLEIMAN CONSTRUCTION,INC. FOR THE CONSTRUCTION OF THE NEW MECHANICAL WASTEWATER TREATMENT FACILITY, 2006 WASTEWATER TREATMENT' PLANT IMPROVEMENTS WHEREAS, The City Council of Fairfax, Iowa has contracted with Kleiman Construction Co., Inc. for the construction of the new mechanical wastewater treatment facility, 2006 Wastewater Treatment Plant Improvements, within the corporate limits; and WHEREAS, Hall and Hall Engineers, Inc., has recommended Change Order No. 1 to Kleiman Construction, Inc., as per the attached document, and whereas, the City Council decided to delete Item No. 6 from this Change Order, with a net decrease in Contract Price of$6,066:.35 for a total revised Contract Amount of$2,059,714.65, BE IT RESOLVED, By the City Council of the City of Fairfax, Iowa, to approve Change Order No. 1, with Item No. 6 deleted, for the changes in construction of the new mechanical wastewater treatment facility, 2006 Wastewater Treatment Plant Improvements. NOW, THEREFORE, BE IT FURTHER RESOLVED, By the Fairfax City Council of the City of Fairfax, Iowa, that the Mayor and the acting City Clerk are hereby authorized and directed to execute said Resolution.
