Adjournment CITY OF FAIRFAX REGULAR COUNCIL MEETING December 12, 2006 The regular meeting of the Fairfax City Council was held Tuesday, December 12, 2006 at Fairfax City Hall at 7:00 PM. Mayor Voss presided. Council members present: Frieden, Beer, Scott, Wainwright. Absent: Magers. Others present: Ron Dusil, Dave Yanccek, Dan Zamastil„ Debi Warner, Dick Ransom, and Cathy Bayne. Beer moved to approve the agenda and Clerk's Financial Statements, seconded by Scott. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright, Nays: None. Absent: Magers. Motion carried. Beer moved to approve and place on file the minutes of the regular meeting dated November 14, 2006 and the minutes of the special meeting dated November 28, 2006, seconded by Frieden,. Roll call vote: Ayes: Beer, Frieden,, 'Scott, Wainwright. Nays: None. Absent: Magers Motion carried. Beer moved to accept and place on file the minutes of the Planning and Zoning Commission meeting dated November 21, 2006, seconded by Scott. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None. Absent: Magers. Motion carried. The Sheriff's report was given by Deputy McElmeel and the Call for Service Log was submitted and discussed. Mayor Voss announced that this was the time and place for a public hearing on the matter of the proposed Amended Budget for the fiscal year 2006-2007. Notice of this hearing was published in the Cedar Rapids Gazette on November 30, 2006. There being no further comments or objections, Mayor Voss closed the Public Hearing at 7:07 PM. Whereupon the Mayor declared the following duly adopted: Resolution No. 2006-96 entitled, "A RESOLUTION AMENDING THE CURRENT BUDGET FOR FISCAL YEAR ENDING MUNE 30, 2007." Passed and approved this 12'� day of December 2006. Mayor Voss announced that this was the time and place for a public hearing on the matter to present information and receive comments on proposed Sign Regulation Ordinance. Notice of this hearing was published in the Cedar Rapids Gazette on December 4, 2006. There being no further comments or objections, Mayor Voss closed the Public Hearing at 7:17 PM. Wainwright introduced Ordinance No. 62, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINACNES OF THE CITY OF FAIRFAX, IOWA, 2002, BY ADDING A NEW CHAPTER PERTAINING TO SIGN REGULATIONS. Wainwright moved to suspend rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting be suspended with respect to Ordinance No. 62, seconded by Scott. Nays: None. Absent: Magers. Motion carried.. Frieden moved to approve a 3.5% cost of living increase for all maintenance and administration positions, retroactive to July 1, 2006, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None. Absent: Magers. Motion carried. Council discussed a request to support Cedar Rapids Helicopter Program. The consensus of council was not to participate. Council discussed Housing Rehabilitation Program regarding a property that is in the process of foreclosure. Other items of discussion: Fire Department had their inspection and all went well. Dave Yanecek reported that the city had their scheduled 3 year inspection from the Iowa Department of Natural Resources (IDNR). IDNR recommended the city change from 4" to 6" water mains. It was stated that the newer additions already have 8" water mains. It was reported that the Parks & Visioning Committees will not meet in the month of December. There being no further business before the Council, Mayor Voss adjourned the meeting at 8:25 PM. RESOLUTION NO. .DO A RESOLUTION APPROVING SIGN]PERMIT FEE BE IT RESOLVED, By the City Council of the City of Fairfax, Iowa, that effective December 12, 20,06, before any action is taken upon a sign application, as provided by the Sign Regulations Ordinance, the applicant shall pay to the Administrative Officer a non-refundable fee of$3.00 per square foot for each sign. The Administrative Officer shall forthwith pay over such fee to the credit of the General Fund. of the City of Fairfax, Iowa. The failure to approve an application for signage shall not be construed as any reason for refunding the fee to the applicant. ZDDG A RESOLUTION ACCEPTNG THE IMPROVEMENTS IN PRAIRIE VIEW HEIGHTS ADDITION PHASE ONE AND APPROVING THE LETTER OF CREDIT SUBMITTED BY GORDON SEVIG FOR THE MAINTENANCE OF THE IMPROVEMENTS WHEREAS, The construction of improvements in Prairie View Heights, Phase One to Fairfax, Iowa, was authorized by the City Council; .and WHEREAS, Said improvements have been completed; and WHEREAS, The City Engineer has recommended the acceptance of said improvements; and WHEREAS, Gordon Sevig has submitted a Letter of Credit in the amount of $75,000.00 to provide financial security for the maintenance period of 2 years for said improvements.
