REGULAR COUNCIL MEETING
JUNE 12,2007
The regular council meeting of the Fairfax City Council was held Tuesday, June 12, 2007at
Fairfax City Hall at 7:00 PM. Mayor Bill Voss presided. Council members present: Beer,
Frieden, Scott, Wainwright. Absent: Magers. Others present: Ron Dusil, Dave Yaneeck, Dan
Zamastil, Tom Hill, Dave Bagdonas, Steve & Teresa Waln, Ed Mulholland, Melissa Tomash
and residents of the Fairfax Heights Addition. Due to the absence of the Clerk, Nancy
Flickinger recorded the minutes.
Beer moved to approve the agenda and the Clerk's Financial Statements, seconded by
Frieden. Roll call vote: Ayes:. Beer, Frieden, Scott, Wainwright, Nays: None. Absent: Magers.
Motion carried.
Scott moved to approve and place on file the minutes of the work session dated May 8, 2007
and the regular meeting dated. May 8, 2007, seconded by Frieden. Roll call vote: Ayes: Beer,
Frieden, Scott, Wainwright.Nays: None. Absent: Magers. Motion carried.
Mayor Voss announced that this was the time and place for a public hearing on the matter of
the proposed 2007-2027 Comprehensive Plan for the City of Fairfax. Notice of this hearing
was published in the Cedar Rapids Gazette on June 7, 2007. There being no further comments
or objections,Mayor Voss closed the public hearing at 7:03 PM.
Beer introduced the following Resolution and moved its adoption, seconded by Frieden.
Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None, Absent: Magers. Motion
carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2007-2
entitled, `sA RESOLUTION ADOPTING THE 2007-2027 COMPREHENSIVE PLAN
OF THE CITY OF FAIRFAX,IOWA." Passed and approved this 12th day of June, 2007.
The Sheriffs report was given by Deputy Brady and the Call for Service Log was submitted
and discussed.
David Bagdonas led a discussion on parking on Park Street. Further discussion on this
matter will be held at the next meeting.
Leon Evans led a discussion on the truck traffic on East Soutliview Road. Mayor Voss was
directed to contact legal counsel on this matter.
Ed.Mulholland, `Linn County Supervisors by District', led a discussion on the election that
Will be held on July 24, 2007,regarding reforming Linn County government.
Discussion was held on the replacement of the tree at 155 Highland Avenue. This will be
handled through the maintenance department.
Discussion was held on Little League uniform costs. Representation from the League is
requested at the next council meeting.
Frieden moved to approve Casey's Cigarette Permit, seconded by Beer. Roll call vote:
Ayes: Beer, Frieden, Scott, Wainwright.Nays: None. Absent Magers. Motion carried.
Wainwright introduced Ordinance No. 65, AN ORDINANCE AMENDING THE CODE
OF ORDINANCES OF THE CITY OF FAIRFAX, IO'' A, 2002, BY AMENDING
SECTION 1.55.02, SUBSECTION 8, PERTAINING TO DRAINAGE
REQUIREMENTS —UNIFORM PLUMBING CODE.
Wainwright moved that the rule requiring that an ordinance be considered and voted on for
passage at two council meetings prior to this meeting be suspended with respect to
Ordinance No. 65, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Scott,
Wainwright. Nays: None, Absent: Magers. Motion carried.
Scott moved that Ordinance No. 65, AN ORDINANCE AME DING THE CODE OF'
ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002, BY AMENDING
SECTION 155,021 SUBSECTION 81 PERTAINING TO DRAINAGE
REQUIREMENTS -- UNIFORM PLUMBING CODE, be considered for the third time,
placed upon its passage and adopted, seconded by Beer. Roll call vote: Ayes: Beer, Frieden,
Scott, Wainwright.Nays: None.,Absent: Magers. Motion carried.
Ordinance No. 65 is declared to have been enacted.
Wainwright introduced Ordinance No. 66, AN ORDINANCE AMENDING THE CODE
OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002, BY AMENDING
'SECTION 155,02, SUBSECTION 13, PERTAINING TO PIPING REQUIREMENTS —
UNIFORM PLUMBING CODE.
Wainwright moved that the rule requiring that an ordinance be considered and voted on for
passage at two council meetings prior to this meeting be suspended with respect to
Ordinance No. 66, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright.
Nays: None. Absent: Magers.. Motion carried.
Frieden moved that Ordinance No. 66, AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002, BY AMENDING

OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2002, BY AMENDING
SECTION 168.06 PERTAINING TO SIGN PERMIT FEES, APPLICATION, &

SECTION 168.06 PERTAINING TO SIGN PERMIT FEES, APPLICATION, &
INSPECTION, be considered for the third time, placed upon its passage and adopted,
seconded by Scott. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None.
Absent: Magers. Motion carried.
Ordinance No, 67 is declared to have been enacted.
Frieden moved to accept lowa Codification, Inc,'s proposal to readopt the existing Code of
Ordinances of the City of Fairfax and instructed staff to proceed with this matter, seconded
by Scott. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright, Nays: None. Absent:
Magers. Motion carried.
Discussion was held on Cell Tower Ordinance. No action was taken,
Frieden introduced the following Resolution and moved its adoption, seconded by Beer..
Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright, Nays: None. Absent: Magers. Motion
carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2007-30
entitled, "FIREWORKS PERMIT RESOLUTION". Passed and approved this 12th day of
.tune, 2007.
Scott introduced the following Resolution and moved its adoption, seconded by Frieden.
Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays None. Absent: Magers. Motion
carried. Whereupon the Mayor, declared the following duly adopted: Resolution No. 2007-31
entitled, "FIREWORKS PERMIT RESOLUTION". Passed and approved this 12th day of
June,2007.
Discussion was held on proposals for the city website. A committee was formed to meet
with the website developer to determine the design and cost.
Frieden moved to accept Aaron Voss as developer of city website, seconded by Scott. Roll.
call vote: Ayes: Beer, Frieden, Scott, Wainwright, Nays: None. Absent: Magers. Motion
carried.
Discussion was held on bids submitted for a permanent generator. Due to budget restraints,
no action was taken.
Wainwright moved to accept proposal from Dietz, Donald, & Company for the 2006-2007
.Audit, seconded by Scott. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright, Nays:
None. Absent: Magers. Motion carried,
Frieden moved to accept proposal. from LL Pelting for wok on E. Cemetery Rd., seconded
by Scott. Roll call vote: Ayes: Beer, Frieden, Scott. Nays None. Abstain: Wainwright.
Absent: Magers. Motion carried.
Wainwright moved to accept proposal for two 500 gpm lift station pumps from Quality
Pump, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, 'Scott, Wainwright, Nays: None.
Absent: Magers. Motion carried.
Wainwright introduced the following Resolution and moved its adoption, seconded by
Frieden. Roll call vote: Ayes: Beer, Frieden, Scott, Wainwright, Nays: None. Absent: Magers.
Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution No.
2007-32 entitled, "A RESOLUTION APPROVING SITE PLAN FOR LOT 2, KARALIS
SECOND ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA". Passed.
and approved this 12th day of June, 2007.

MECHANICAL WASTEWATER TREATMENT FACILITY, 2006 WASTEWATER
TREATMENT PLANT IMPROVEMENTS". Passed and approved this 12th day of June,
2007.

MECHANICAL WASTEWATER TREATMENT FACILITY, 2006 WASTEWATER
TREATMENT PLANT IMPROVEMENTS". Passed and approved this 12th day of June,
2007.

EXCAVATING, LTD FOR THE 2006 SANITARY SEWER SYSTEM
IMPROVEMENTS". Passed and approved this 12th day of June, 2007.
Discussion was held on the hiring of a Grade III Wastewater'Treatment Operator. Staff was
instructed to advertise for this position in the local papers.
Scott introduced the following Resolution and moved its adoption, seconded by Beer. Roll

carried. Whereupon the Mayor, declared the following duly adopted: Resolution No. 2007-3�7

THE FAIRFAX VISIONING FUND TO THE GENERAL FUND". Passed and approved
this 12th day of June, 2007.

REIMBURSEMENT TO THE GENERAL FUND FOR CLAIMS PAID BY THE CITY
FOR THE FAIRFAX LIBRARY & FIRE DEPARTMENT". Passed and approved this

Beer moved to approve the claims list dated June 12, 2007, seconded by Scott. Roll call
vote: Ayes: Beer, Frieden, Scott, Wainwright. Nays: None. Absent: Magers. Motion carried.
Other items of discussion/reports: Library — A Summer Scavenger Hunt will be held in
Fairfax and Walford from June 19th — June 30th. Fire Department — Busy planning for
fireworks and have had quite a few calls. Maintenance Department — Discussed problems
that they were having with the lagoon aerators. Mayor Voss will contact legal counsel on this
matter. Parks Committee — Next meeting June 21st. The movie "A League of Their Own"
will be showing at the Linn Street ball diamond on June 29th'. Visioning —Next meeting will
be June 26th. Installation of north entrance sign will wait until highway construction slows
down. Council approved Tom Hill to begin work on the footing for the entrance sign. Nadine
Kirk will be the Fairfax representative to Linn County Trails Association. Other - Residents
discussed their concerns with Council.
There being no further business before the Council, Mayor Voss adjourned the meeting at.

OF FAIRFAX, IOWA, 2002, BY AMENDING SECTION 155.02, SUBSECTION 8,
PERTAINING TO DRAINAGE REQUIREMENTS —UNIFORM PLUMBING
CODE
BE IT ENACTED by the City Council of the City of Fairfax, Iowa:
SEC'T'ION 1. SUBSECTION MODIFIED. Chapter 155, Section 155.02, Subsection 8,
of the Code of Ordinances of the City of Fairfax, Iowa, 2002, is repealed and the
following adopted in lieu thereof:
155.02 MODIFICATIONS OF THE UNIFORM PLUMBING CODE.
S. Drainage„ The Fairfax Plumbing Code is hereby amended by repealing
the following subsections of Section 701.1, of the Uniform Plumbing
Code, 1997 Edition, and adding new subsection as follows:
Section 701.1.2 ABS and PVC D FV piping installation shall be
limited to thirty-five (35) feet in height and to those structures
where combustible construction is allowed.
EXCEPTIONS: The requirements of Subsection 701.1.2 shall
apple only when it is determined necessary by the administrative
authority of the City Engineer based on local conditions.
Section 701.1.4 Copper tube for underground drainage and vent
piping shall have a weight of not less than that of Type L copper
tube.
Section 701.1.5 Copper tube for above ground drainage and vent
piping, shall have a weight of not less than that of Type M copper
tube,.
Section 701.1.6 Plastic, cast iron, capper Type X, cement and
vitreous fitted pipe 3" and larger shall be used exterior
underground for sump pump drainage required to be connected to
the City curb drains and or storm drains.
SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE. If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect
the validity of the ordinance as a whole or any section, provision or part thereof not
adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall bein effect from and after its
final passage, approval and publication as provided by law,

BE IT ENACTED by the City Council of the City of Fairfax., Iowa;
SECTION L SUBSECTION MODIFIED. Chapter 168, Section 168.06, of the Code of
Ordinances of the City of Fairfax, 2002, is repealed and the following adopted in lieu thereof,
168.06 SIGN PERMIT FEES, APPLICATION &INSPECTION
1, Permits for signs shall be required as outlined in Section 168.27,
Permitted Signs By Type and Zoning District, except those specifically
exempt by section 168:04, Exemptions, and 168,09, Temporary Signs.
2. It shall be unlawful for any person to erect, alter structurally or relocate
within the City of Fairfax any sign as herein defined without first
obtaininga permit from the building official, All electrically illuminated.
signs shall be subject to the provisions of all electrical codes adopted by
the City of Fairfax.
3, Every applicant before being granted a permit hereunder shall pay the
permit fee, as determined by Resolution of the City Council, for each
such sign or other advertising structure.
4. Applications for permits shall be made upon forms provided by the
building,official and shall contain or have attached thereto the following
information.
a. The name, address and telephone number of the applicant.
b. The location of building, structure„ or lot where the sign is to be
located,
c. Position of signs in relation to nearby buildings or structures.
d. Two (2)blueprints or ink drawings of the plans and specifications
and method of construction and attachment to the building or on
the ground.
e, Written consent of the owner of the building, structure, or land to
which or on which the sign is to be erected. The lease between
landlord and tenant will constitute written consent.
f. The name of the person, firm, corporation, or associated which is
registered with the City of Fairfax to do the work if installing or
erecting the sign.
g Such other information as the building official shall require to
show full compliance with this an all other laws and ordinances of
the City of Fairfax which may be applicable, including the
intended duration of temporary signs.
5, Applications for permits will be brought before the City Council for
approval based on the recommendations of the building official.
6, The building official or designees may inspect signs subject to the
provisions of the sign regulations for the purpose of determining whether
the same is in compliance with the sign regulations.
SECTION 2. REPEALER, All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.

OF THE CITY OF FAIRFAX,IOWA
NNIHEREAS, The Fairfax City Council, by Resolution No. 99-06-08 previously adopted the Fairfax
Comprehensive Plan 1.999; and
WHEREAS, A proposal has been made which shows the desirability of updating Comprehensive Plan of
1999„ and
WHEREAS, The City of Fairfax, Iowa, believes the Fairfax Co€nprehensivc Plan (hereinafter "Plan"), as
amended and adopted in 2007, will be a guiding policy document for future decisions; and
WHEREAS, The citizens of Fairfax have attended pubiic meetings to provide input and assistance in
creating this document; and
WHEREAS, The Fairfax Planning and Zoning Commission has unanimously approved the Plan and
recommended to the City Council that they approve the Plan as presented;and
WHEREAS, The Fairfax City Council announced the review of .said Plan at their May 8, 2007 Council
meeting and held a Public Hearing for interested parties to submit comments at the lune 12, 2007 Council meeting.

Operator: A person trained in fireworks safety who will set up and explode the fireworks,
Sponsor: The group paying for or otherwise providing for the fireworks display.
BE IT RESOLVED, By the City Council, Fairfax, Iowa, this date met in lawful session, that

5, That the operator must meet the following fireworks safety requirement:
a) Possess a current, valid fireworks license issued by a state of the United States which
