TUESDAY, OCTOBER 14,2008
'The regular meeting of the Fairfax City Council was held on Tuesday, October 14, 2008, at
7:00 PM at Fairfax. City Hall. Mayor Voss presided. Council members present: Beer, Frieden.,
Magers, Rabe, Wainwright. Absent: None. Others present: Larry Burger, Jeff lben, hied Wood,
Doug Elliot, Dick Ransom, Shane Wicks, Chief Sankot, Ron Dusil, Dave Yanceek, Nancy
Flickinger.
Beer moved to approve the agenda and the Clerk's financial statements, seconded by Rabe.
Roll call vote: Ayes: Beer,Frieden,Magers, Rabe, Wainwright. Nays:None. Motion carried.
Rabe moved to approve and place on file the minutes of the regular Council meeting dated
September 9, 2008, and the special Council meeting dated September 23, 2008, seconded by
Frieden. Roll call vote: Ayes Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion
carried.
The Fire Department report was given by Chief Sankot. Council agreed that the City will pay
for half of the concrete and half of the flag pole for work done in front of City Hall/Fire Station,
Discussion was held on replacing two furnaces in the Fire Station. Council agreed that the City
will pay for them if the Fire Department installs them. Council asked for a price to be brought to
them at a future meeting. Discussion was held on requirements for smoke alarms and carbon
monoxide detectors in rental units, as well as sprinkler system inspections.
Ron Dusil reported that the Maintenance Department has been working on cleaning out the
ditch on E. Southview Road. He also reported that the new snow plow is on the truck and ready.
Jo Ann Beer reported that the Parks Committee is still waiting for to plant the trees in the new
park once the leaves are off and they are also waiting for the trail to be done.
Jason Rabe reported that the Visioning Committee is planning to do more planting around the
South entryway sign.
Mayor Voss announced that this was the time and place for a public hearing on the matter of
Synergy Development Group, LLC Rezoning Classification Request from 9 RS to 5 RM.
Notice of this hearing was published in the Cedar Rapids Gazette on September 26, 2008.
There being no further comments or objections, Mayor Voss closed the Public Hearing at 7:25
PM.
Frieden moved to accept Planning & Zoning Recommendation 2008-01, seconded by Beer.
Roll call vote: Ayes: Beer, Frieden,Magers, Rabe, Wainwright.,Nays: None. Motion carried.
Wainwright introduced Ordinance No. 77, AN ORDINANCE AMENDING THE
FAIRFAX ZONING ORDINANCE OF 2000, OF THE CITY OF FAIRFAX, IOWA, BY
AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES
OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING
CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS LOT 23 (175
RIDGEVIEW DRIVE), LOT 24 (165 RIDGEVIEW DRIVE), AND LOT 25 (155
RIDGEVIEW DRIVE) OF PRAIRIE CREEK ESTATES THIRD ADDITION TO THE
CITY OF FAIRFAX, LINN COUNTY, IOWA, AS 5 RM (MULTIPLE FAMILY
RESIDENTIAL).
Frieden moved that the rule requiring that an ordinance be considered and voted upon for
passage at two council meetings prior to this meeting be suspended with respect to Ordinance
No. 77, seconded by Rabe. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright.
Nays:None. Motion carried.
Frieden moved that Ordinance No. 77, AN ORDINANCE AMENDING THE FAIRFAX
ZONING ORDINANCE OF 2000, OF THE CITY OF FAIRFAX,IOWA, BY AMENDING
THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE
CITY OF FAIRFAX, IOWA,,BY DESIGNATING THE ZONING CLASSIFICATION OF
CERTAIN PROPERTY,NOW KNOWN AS LOT 23 (175RIDGEVIEW DRIVE), LOT' 24
(165 RIDGEVIEW DRIVE), AND LOT 25 (155 RIDGEVIEW DRIVE) OF PRAIRIE
CREED ESTATES THIRD ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY,
IOWA, AS 5 RM (MULTIPLE FAMILY RESIDENTIAL)„ be considered for third time,
placed upon its passage and adopted, seconded by Rabe. Roll call vote: Ayes: Beer, Frieden,
Magers,Rabe, Wainwright.Nays:None. Motion carried.
Ordinance No. 77 is declared to have been adopted.
Mayor Voss announced that this was the time and place for a public hearing on the matter of
the$1,000,000 General Obligation loan agreement.
Notice of this hearing was published in the Cedar Rapids Gazette on October 6, 2008.
There being no further comments or objections, Mayor Voss closed the public hearing at 7:33
PM.
Magers introduced the following Resolution and moved its adoption, seconded by Rabe. Roll
call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion carried.
Whereupon the Mayor declared the following duly adopted: Resolution No. 2008-48,
"RESOLUTION TAKING ADDITIONAL ACTION TO ENTER INTO A LOAN
AGREEMENT."Passed and approved this 14'h day of October,2008.
Magers introduced the following Resolution and moved its adoption, seconded by Beer. Roll
call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Whereupon the Mayor
declared the following duly adopted: Resolution No. 2008-4 , '`RESOLUTION REGARDING
CHANGE ORDER NO. 8 TO RICKLEFS EXCAVATING, LTD FOR THE 2006
SANITARY SEWER SYSTEM IMPROVEMENTS." Passed and approved this 14th day of
October, 2008.
Magers introduced the following Resolution and moved its adoption, seconded by Frieden.
Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion carried.
Whereupon the Mayor declared the following duly adopted: Resolution No. 2008-50�,
"RESOLUTION ACCEPTING THE 2006 SANITARY SEWER SYSTEM
IMPROVEMENTS AND ISSUING FINAL PAYMENT NO. 10 TO RICKLEFS
EXCAVATING,LTD." Passed and approved this 14'h day of October, 2008.
Discussion was held on the Red Flag Policy. Council directed Clerk to remove Paragraph V1,
subparagraph B from the Policy.
Wainwright introduced the following Resolution and moved its adoption, seconded by
Frieden. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion
carried. Whereupon the Mayor declared the following duly adopted: Resolution No. 2008-5I,
`'`RESOLUTION ADOPTING IDENTITY THEFT PREVENTION PROGRAM." Passed
and approved this 14th day of October, 2008.
Fred Wood discussed his concerns about the water issues along E. Cemetery Road. Council
assured him that they are working on potential solutions that will be discussed later on in the
meeting.
Doug Elliot, ECICOG, updated the Council on services that they offer. He will get back to the
Council regarding whether the City of Fairfax should be looking:for assistance from the MPO or
ECICOG.
The Sheriff's report was given by Deputy Taylor and the Call. for Service Log was submitted
and discussed.
Discussion was held on the SRF bond retirement and Sewer rate's.
]Discussion was held on decorative banners, Council approved purchase of six of each style.
Discussion was held on the Capital Improvements Plan. Regarding the water issue on E.
Cemetery Road, the Council is unwilling to commit to doing the two-part fix through the Arp
property when there is the possibility that one part will fix the problem. The CIP committee will
meet again later this month.
Magers moved to approve the Claims list, seconded by Frieden. Roll call vote: Ayes: Beer,
Frieden,Magers, Rabe, Wainwright.Nays: None. Motion carried.
Clerk commented on property issues that had been reviewed by the City attorney. Council
directed Clerk to send a letter to the owners of the properties..
There being no further business before the Council, Mayor Voss adjourned the meeting at 9:07
PM.

WHEREAS, The Planning & Zoning Commission at a public meeting on
Tuesday, October 7, 2008, considered a rezoning request and an amendment to the
Official Zoning Map and Zoning District Boundaries of the City of Fairfax, Iowa, by
designating the Zoning Classification of certain property owned by Synergy
Development Group, LLC, now known as Lot 23 (175 Ridgeview Drive), Lot 24 (165
Ridgeview Drive), and Lot 25 (155 Ridgeview Drive) of Prairie Creek Estates Third

Resolution taking additional action to enter into a Loan Agreement
WHEREAS, pursuant to the provisions of Section 384.24A of the Code of Iowa, the City
of Fairfax, (the "City") in the County of Linn, State of Iowa, has heretofore proposed to contract
indebtedness and enter into a loan agreement (the "Loan Agreement") in a principal amount not
to exceed $1,000,000, for the purpose of paying the cost, to that extent, of constructing street,
water, storm sewer and drainage improvements, and has published notice of the proposed action
and has held a hearing thereon;
NOW, THEREFORE, It Is Resolved by the City Council of the City of Fairfax, Iowa, as
Follows:
Section 1. The City Council hereby determines to enter into the Loan Agreement in
the future and orders that general obligation bonds or notes be issued in evidence thereof at such
tirne as it is determined to be necessary. The City Council further declares that this resolution
constitutes the "additional action'' required by Section 3 84.24A of the Code of Iowa.
Section 2. All resolutions and orders or parts thereof in conflict with the provisions
of this resolution, to the extent of such conflict, are hereby repealed.
Section 3. This resolution shall be in full force and effect immediately upon its
adoption and approval, as provided by law.
