HomeMy WebLinkAbout12-09-2008 Council Meeting FAIRFAX CITY COUNCIL REGULAR MEETING TUESDAY,DECEMBER 9,2008 The regular meeting of the Fairfax City Council was held on Tuesday, December 9, 2008, at 7:00 PM at Fairfax City Hall. Mayor Voss presided. Council members present: Beer, Frieden, Magers, Rabe, Wainwright, Absent: None, Others present: Scott Drzycimski, Monica & Kenny Patten,Dick Ransom, Cathy Bayne,Fire Chief' ankot,Ron Dusil, Dave Yanccek,and Dan Zamastil. ]Beer moved to approve the agenda and the Clerk's financial statements, seconded by Frieden. Roll call vote: Ayes:Beer,Frieden,Magers, Rabe,Wainwright.Nays:None.Motion carried. Beer moved to approve and place on file the minutes of the regular Council meeting dated November 11, 2008, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright.Nays:None. Motion carried. Cathy Bayne reported on the Library. Fire Chief Sankot reported that the Fire Department finished up their year with 155 calls. Maintenance Department reported on a water main break downtown on December 7. JoAnn Beer reported that the Parks Department is working on ideas for spring projects. The Visioning Committee is planning for the Holiday House Walk this coming Saturday, December 13. Mayor Voss announced that this was the time and place for a public hearing on the matter of Arp Voluntary Annexation&Zoning Classification. Notice of this hearing was published in The Cedar Rapids Gazette on November 20, 2008. There being no further comments or objections, Mayor Voss closed the public hearing at 7:09 PM. Rabe moved to accept Planning & Zoning Recommendation 2008-02, RECOMMENDATION APPROVING ANNEXATION AND ZONING CLASSIFICATION, seconded by Magers. Roll call vote: Ayes: Beer, Frieden, Magers,Rabe, Wainwright.Nays:None. Motion carried. Magers moved to accept Planning & Zoning Recommendation 2008-03, A RECOMMENDATION AMENDING THE FAIRFAX ZONING ORDINANCE OF 2000 OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Magers,Rabe,Wainwright.Nays: None. Motion carried. Wainwright introduced the following Resolution and moved its adoption, seconded by Magers. Roil call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2008-60 entitled, "RESOLUTION APPROVING THE VOLUNTARY ANNEXATION AND ZONING CLASSIFICATION OF PROPERTY LOCATED IN PART OF THE NW'/a OF THE SWI/4, SECTION 10, TOWNSHIP 82 NORTH, RANGE 8 WEST,LINN COUNTY, IOWA (Kenneth, Regis, and Barbara Arp,Request)"Passed and approved this 9 'day of December, 200$. Wainwright introduced Ordinance No. 80, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE OF 2000, OF THE CITY OF FAIRFAX IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS PART OF THE NW'/,, OF THE SW%, SECTION 10, TOWNSHIP 82 NORTH, RANGE 8 WEST, LINN COUNTY, IOWA, AS AG (AGRICULTURAL DISTRICT). Wainwright moved that the rule requiring that an ordinance be considered and voted upon for passage at two meetings prior to this meeting be suspended with respect to Ordinance No, 80, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion carried. Magers moved that Ordinance No. 80, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE OF 2000, OF THE CITY OF FAIRFAX,, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS PART OF THE NW%a OF THE SWIA, SECTION 10, TOWNSHIP 82 NORTH, RANGE 8 WEST, LINN COUNTY, IOWA, AS AG (AGRICULTURAL DISTRICT"), be considered for the third time, placed upon its passage and adopted, seconded by Rabe. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion carried. Ordinance No. 80 is declared to have been adopted. Mayor Voss announced that this was the time and place for a public hearing on the matter of granting franchise to Interstate Power and Light Company. Due to notice of this public hearing notice not meeting publication requirements,no official action can be taken. Magers moved to remove Ordinance No. 79 from the table, seconded by Wainwright. Roll call vote: Ayes: Beer, Frieden,Magers,„Rabe, Wainwright.Nays:None.Motion carried. Frieden moved to dismiss Ordinance No. 79,AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY AMENDING PROVISIONS PERTAINING TO LOAD AND WEIGHT RESTRICTIONS, seconded by Wainwright. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion carried. Mayor Voss declared Ordinance No. 79 failed adoption and will be dismissed. Rabe introduced the following Resolution and moved its adoption, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None, Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2008- 1 entitled, "A RESOLUTION AUTHORIZING THE APPROVAL OF AND PARTICIPATION IN AN AGREEMENT UNDER IOWA CODE CHAPTER 28E TO ESTABLISH AN AGENCY TO BE KNOWN AS THE IOWA CITIES E-PAYMENT AGGREGATION SYSTEM ("iCash")". Passed and approved this 9'h day of December, 2008. Wainwright moved to approve von Essen Galerie liquor permit, seconded by Rabe. Roll call vote: Ayes:Beer,Frieden, Magers,Rabe„ Wainwright.Nays:None. Motion carried. Discussion was held on purchasing the property adjacent to the City Hall/Fire Station. The owners were willing to give the City twenty-four (24) hours to consider, so a special meeting was called for 7:00 PM on December 10, 2008 for further discussion. Wainwright moved to accept Prairie View Estates Outlot B Warranty Deed, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Magers,Rabe, Wainwright.Nays:None. Motion carried. Capital Improvements Planning Committee had to cancel their meeting for December 8, 2008, due to weather. They will try to meet soon and bring a report to Council. Section 66.03 of the Code of(Ordinances of the City of Fairfax, Iowa,2007, is repealed and the following adopted in lieu thereof: 66.03 LOAD LOUTS UPON CERTAIN STREETS. When signs are erected giving notice thereof, no person shall operate any vehicle with a gross weight in excess of the amounts specified on such signs at any time upon any of the following,streets or parts of streets: Code afkwa, See. 32.1.473 & 475) 1. Bill Voss,Mayor ATTEST: Vickie i dl, ' lerk RESOLUTION NO. 2008-61 A RESOLUTION AUTHORIZING THE APPROVAL OF AND PARTICIPATION IN AN AGREEMENT UNDER IOWA CODE CHAPTER 28E TO ESTABLISH AN AGENCY TO BE KNOWN AS THE IOWA CITIES E-PAYMENT AGGREGATION SYSTEM {"Kash") WHEREAS, Iowa Code section 28E.1 permits political subdivisions to make efficient use of their powers by enabling them to provide joint services with other Public Agencies and to cooperate in other ways of mutual advantage, and to exercise and enjoy jointly any powers, privileges or authority exercised or capable of being exercised by one Public Agency of this state or private agencies for the joint or cooperative action; and WHEREAS, This Governing Body was established as of January 16, 2008; and WHEREAS, This Governing Body has concluded after, consideration and investigation by staff that it is in the best interest of this Governing Body to enter into an Agreement under Iowa Code Chapter 28E to promote efficient public service to the citizens and businesses of Iowa by providing them with the option of paying fees, charges and taxes via electronic transactions. NOW, THEREFORE,BE IT RESOLVED, Section One: The Intergovernmental Agreement is approved and adopted. This Governing Body joins with other public agencies in accordance with the Intergovernmental Agreement, as may be amended, which is incorporated herein by reference with the same effect as if it had been set out in this resolution by becoming a Participant of iCash. The Intergovernmental Agreement is filed in the minutes of the meeting at which this Resolution is adopted. The authorized officials of this Public Agency and to carry out the intent and purpose of this Resolution. Section Two: This Public Agency is authorized to receive fees, charges and taxes via electronic transactions in accordance with the provisions of the Intergovernmental Agreement. The Custodia will hold fiends received via electronic transactions in the name of iCash for the account of the Public Agency. The following officers and officials of this Public Agency and their respective successors in office each are designated as "Authorized Officials" with fall power and authority to effectuate the terms of the Intergovernmental Agreement for this Public Agency, from time to time: Vickie Kindl, City Clerk Nancy Flickinger, Financial Administrator Bill Voss, Mayor iCash must be advised of any changes in Authorized Officials in accordance with the procedures established by Kash. Section Three: The Directors of iCash are designated as having official custody of this Public Agency's monies which are held in accordance with the Intergovernmental Agreement. Section Four: iCash is authorized to designate and name depositories, in accordance with Iowa Code Chapter 12C, and to file form CPE-31019, to execute documents, and to take actions as may be necessary to effectuate the terms of the Intergovernmental Agreement. Section Five: Authorization is given for members and officials of this Public Agency to serve as Directors of iCash from time to time if selected as such pursuant to the provisions of the Intergovernmental Agreement. Section Six: Unless otherwise expressly defined, words that are capitalized in the Resolution have meanings defined in the Intergovernmental Agreement.
