SPECIAL MEETING
TUESDAY,JANUARY 27,2009
A special meeting of the Fairfax City Council was held on Tuesday, January 27, 2009, at 7:00
PM at Fairfax City Hall. Mayor Voss presided. Council members present: Beer,Frieden, Magers,
Rabe. Absent: Wainwright. Others present: Dick Ransom, Shane Wicks,Nancy Flickinger.
Rabe moved to approve the agenda, seconded by Beer, Roll call vote: Ayes: Beer, Frieden,
Magers, Rabe. Nays:None. Motion carried.
Frieden introduced the following Resolution and moved its adoption, seconded by Magers.
Roll call vote: Ayes: Beer, Frieden, Magers, Rabe. Nays: None... Motion carried. Whereupon the
Mayor declared the following duly adopted: Resolution 2009-01-04 entitled, "A
RESOLUTION CALLING FOR A PUBLIC REFERENDUM TO AUTHORIZE THE
IMPOSITION OF A LOCAL SALES AND SERVICE TAX IN THE CITY OF FAIRFAX,
IOWA.,AT THE RATE OF 1%." Passed and approved this 27th day of January, 2009.
Rabe moved to remove Resolution 2008-57 from the table, seconded by Beer. Roll call vote:
Ayes: Beer, Frieden, Magers,Rabe, Nays: None. Motion carried,
Rabe moved to deny the passage of the following Resolution, seconded by Magers. Roll call
vote: Ayes: Beer, Frieden, Magers, Rabe. Nays: None. Motion carried. Whereupon the Mayor
declared the following duly denied: Resolution 2008-57 entitled, "RESOLUTION SETTING
PUBLIC HEARING FOR PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATED COST OF EAST DRAINAGE WAY PROJECT ON EAST CEMETERY
ROAD." Denied this 27th day of January, 2009.
Magers moved to remove Resolution 2008-58 from the table, seconded by Frieden. Roll call
vote: Ayes: Beer, Frieden, Magers,Rabe. Nays: None. Motion carried.
Magers moved to deny the passage of the following Resolution, seconded by Rabe. Roll call
vote: Ayes: Beer, Frieden, Magers, Rabe. Nays: None. Motion carried. Whereupon the Mayor
declared the following duly denied: Resolution 2008-58 entitled, "RESOLUTION
APPROVING PROPERTY PURCHASE AGREEMENT WITH REGIS AND BARBARA
ARP AND KENNETH ARP FOR PROPERTY ON EAST' CEMETERY ROAD." Denied
this 27th day of January, 2009.

Magers introduced the following Resolution and moved its adoption, seconded by Frieden.

Mayor declared the following duly adopted: Resolution 2009-01-05 entitled, "RESOLUTION

CONTRACT, AND ESTIMATED COST OF EAST DRAINAGE WAY PROJECT ON
EAST CEMETERY ROAD."Passed and approved this 27th day of January, 2009.
Dick Ransom and Shane Wicks discussed proposed changes to the detention basin near .
Commercial Court.
Councilperson Magers discussed issues at the Wastewater Treatment Facility. City Engineer
told Council that Ron Dusil, Maintenance, was working on devising a solution to the problem of
needing to shut down one of the cells.
Mayor Voss discussed the abandoned house at 510 Church Street and the inspection done by
Linn County Public Health.
There being no further business before the Council, Mayor Voss adjourned at 6:55 PM.

RESOLUTION NO.2009-01-04
A RESOLUTION CALLING FOR A PUBLIC REFERENDUM TO AUTHORIZE THE
IMPOSITION OF A LOCAL SALES AND SERVICE TAX IN THE CITY OF FAIRFAX,IOWA,
AT THE RATE OF 1%
WHEREAS,Chapter 422B of the Code of Iowa authorizes the imposition of certain local option
taxes after an election in which the majority of the electors vote in the affirmative; and
WHEREAS,The City Council of the City of Fairfax declares its intent to participate in a special
county-wide election for the purpose of permitting the electorate to pass upon the proposition of imposing
a one percent (1%) sales and service tax for the City of Fairfax according to Chapter 422B.1.3.b of the
Code of Iowa.
NOW,THEREFORE,BE IT RESOLVED,By the City Council of the City of Fairfax,Iowa„
SECTION 1. The City Council of Fairfax,Iowa,requests the County Commissioner of Elections
to submit to the voters in Linn County a proposition authorizing imposition of a local sales and service
tax in the City of Fairfax at one percent(1%)
"To authorize the imposition of a local sales and service taxx in the City of Fairfax, Linn County,
Iowa,at the rate of one percent(1%)to be effective the earliest calendar quarter."
SECTION 2. The revenues from the local option sales and service tax are to be allocated in the
City of Fairfax as follows:
100% of said local option sales and service tax are to be allocated for any lawful purpose of the City of
Fairfax.
SECTION 3. That the City Clerk is hereby authorized and directed to provide a certified copy of
this resolution to the County Commissioner of Elections of Linn County and to the Board of Supervisors
of Linn County.

RESOLUTION SETTING PUBLIC HEARING FOR PLANS, SPECIFICATIONS, FOR
OF CONTRACT,AND ESTIMATED COST OF EAST DRAINAGE WAY PROJECT ON
EAST CEMETERY ROAD
BE IT RESOLVED, By the City Council of the City of Fairfax, Iowa, that bids shall be
received on Wednesday, November 26, 2008, at 10:00 AM in the office of the City Clerk for the
East Drainage Way Project on East Cemetery Road; and
BE IT FURTHER RESOLVED, That the Public Hearing for the plans, specifications,
form of contract, and estimated cost for the East Drainage Way Project on East Cemetery Road
shall be held at the Special City Council Meeting on Tuesday, December 2, 2008, at 6:00 PM at
City Hall.
NOW, THEREFORE, BE IT RESOLVED, By the City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk are hereby authorized and directed to execute said
Resolution.

AND BARBARA ARP AND KENNETH ARP FOR PROPERTY ON EAST CEMETERY

WHEREAS, A property purchase agreement has been submitted by Regis and Barbara
Arp and Kenneth Arp; and
WHEREAS, Hall and Hall Engineers, Inc. has recommended acceptance by the City of
Fairfax of said purchase agreement.
BE IT RESOLVED, By the City Council of the City of Fairfax, Iowa, that the property
purchase agreement submitted by Regis and Barbara Arp and Kenneth Arp be and the same is
hereby approved.
NOW, THEREFORE,BE IT RESOLVED, By the City Council of the City of Fairfax

Purchase Agreement
For and in Consideration of One ($1.00) in hand paid,, receipt of which is herby
acknowledged, Harold Ray McCormick and Jeanette Marie McCormick, husband)
and wife, Owners (hereinafter referred to as GRANTOR) of the following
described property:
All that part of Lot 1 Irregular Survey SE 114 SW 114 north of the Railroad and the
NE 1/4 SW 114 and Lot 2 (Irregular Survey SE 114 SW 1/4 except the Railroad, all
in Section 10-82-8, except that part of Lots 1 and 2, Irregular Survey S 112 SW
114 Section 10-82-8 in Linn County, Iowa, subject to all easements and
restrictions of record and to all highways.
Hereby agrees to sell to the CITY of Fairfax, Iowa (hereinafter referred to as
CITY) a portion of the above described property for the sole purpose of
construction, maintenance and use of a storm water drainage way, more
particularly described as follows:
See attached Plat Exhibiit
Upon the following conditions to-wit:
1. The area disturbed by the project will be graded, shaped and seeded upon
completion of the project by the CITY,
2. As compensation for the property, the CITY will,' commit to paying the
GRANTOR $10,000..00 per acre of land for the (purchase of 1.83 acres, for
a total of$18,300.00. As compensation for the temporary construction
easement, the CITY will commit to paying the GIRANTOR $5,000.00 per
acre of land for the temporay use of 0.61 acre for the purpose of
constructing the drainage swale, for a total of$3,050.00.
3. The GRANTOR shall have five-years from the date of said settlement to
renegotiate construction or maintenance damages not apparent at the time
of the signing of this contract as required by Section 613.52 of the Code o
Iowa
4. The GRANTOR grants and warrants that there is no known burial site(s),
well(s), solid waste disposal site(s), hazardous substance(s), nor
underground storage tank(s) on the premises described and sought herein.
5. This Purchase Agreement shall be contingent on GRANTOR obtaining a
partial release of any real estate mortgage Tien that is currently
encumbering the property. It is the CITY'S intent to acquire the property
free and clear of all liens.
6. This Purchase Agreement is a binding and legally enforceable agreement
and the terms set forth in this Purchase Agreement executed by
GRANTOR and the CITY. Upon execution of this Purchase Agreement,
the CITY'S attorney shall prepare the acquisition plat for the right-of-way
and record at Linn County.
7. The GRANTOR will not be assessed by CITY for improvements associated)
with this project.
Words and phrases herein shall be construed as in the singular or plural
number, and as masculine, feminine or neuter gender, according to the context.
