SPECIAL MEETING
FEBRUARY 17,2009
A special meeting of the Fairfax City Council was held on February 17, 2009, at Fairfax. City
Hall at 6:00 PM. Mayor Voss. presided. Council members present: Beer, Frieden, Rabe,
Wainwright. Absent; Magers. (.ethers present: Kevin Arensdorf, Shane Schrader, Dick Ransom
Shane Wicks, Cathy Bayne, Mike Sankot,Nancy Flickinger,Dave Yanecek.
The agenda was amended to add the following items:
• Public Hearing - 6:00 PM: Plans, specifications,, form of contract, and estimated
cost for East Drainage Way Project on East Cemetery Road (Notice of this
hearing was published as required by law, but inadvertently left off the agenda:)
• Consider Resolution adopting plans, specifications, form of contract, and
estimated cost for the East Drainage Way Project on East Cemetery Road
Wainwright moved to approve the agenda, as amended, seconded by Rabe. Roll call vote:
Ayes: Beer, Frieden, Rabe, Wainwright Nays: None. Motion carried.
Mayor Voss announced that this was the time and place for a public hearing on the matter, of
plans, specifications, form of contract, and estimated cost for the East Drainage Way Project on
East Cemetery Road.
Notice of this hearing was published in The Cedar Rapids Gazette on January 31, 2009.
There being no further comments or objections,Mayor Voss closed the public hearing.
Wainwright introduced the following Resolution and moved its adoption, seconded by Rabe.
Roll call vote: Ayes: Beer, Frieden, Rabe, Wainwright. Nays: None. Motion carried. Whereupon
the Mayor declared the following duly adopted: Resolution 2009-02-07 entitled, "A
RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATED COST FOR EAST DRAINAGE WAY PROJECT ON EAST CEMETERY
ROAD." Passed and approved this 17th day of February, 2009.
Wainwright moved to waive the irregularity relating to the bid bond in the bid submitted by
Schrader Excavating, Inc., seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Rabe,
Wainwright. Nays: None, Motion carried. (Upon further review by City Engineer, the bid was
found to be non-responsive and subsequently rejected.)
Wainwright introduced the fallowing Resolution and moved its adoption, seconded by Rabe.
Roll call vote; Ayes: Beer, Frieden, Rabe, Wainwright. Nays: None. Motion carried. Whereupon
the Mayor declared the following duly adopted: Resolution 2009-02-08 entitled,
"RESOLUTION APPROVING AND MAKING AWARD OF CONTRACT FOR THE
EAST DRAINAGE WAY PROJECT ON EAST CEMETERY ROAD." Passed and
approved this 17th day of February, 2009.
Wainwright introduced Ordinance No. 82, AN ORDINANCE AMENDING THE CODE
OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY AMENDING
PROVISIONS PERTAINING TO THE UNIFORM BUILDING CODE.
Wainwright moved that the rule requiring that an ordinance be considered and voted upon for
passage at two meetings prior to this meeting be suspended with respect to Ordinance No. 82,
seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Rabe, Wainwright. Nays: None.
Motion carried.
Wainwright moved that Ordinance No. 82, AN ORDINANCE AMENDING THE CODE
OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY AMENDING THE
PROVISIONS PERTAINING TO THE UNIFORM BUILDING CODE, be considered for
the third time, placed upon its passage and adopted, seconded by Rabe. Roll call vote: Ayes:
Beer,Frieden, Rabe, Wainwright.Nays: None. Motion carried.
Ordinance No. 82 is declared to have been adopted.
Discussion was held on the FY 2009-2010 budget, and Council advised Financial
Administrator to use the same rates as last year for the Fire Department and Library.
Wainwright introduced the following Resolution and moved its adoption, seconded by
Frieden. Roll call vote: Ayes: Beer, Frieden, Rabe, Wainwright. Nays: None. Motion carried.
Whereupon the Mayor declared the following duly adopted: Resolution 2009-02-09 entitled,
`'`RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'''S
PROPOSED FISCAL YEAR 2009-2010 BUDGET." Passed and approved this 17th day of
February, 2009.
Discussion was held on a potential annexation by Joe Robson.
There being no further business before the Council, Mayor Voss adjourned the meeting at 6:55
PM.
