HomeMy WebLinkAbout02-10-2009 Council Meeting FAIRFAX CITY COUNCIL REGULAR MEETING TUESDAY,FEBRUARY 10,2009 The regular meeting of the Fairfax City Council was held on Tuesday, February 9, 2009, at 7:00 PM at Fairfax City Hall. Mayor Voss presided. Council members present: Beer, Frieden, Magers, Rabe, Wainwright. Absent: None. Others present: Jeff Iben, Joe Kell, Shane Schrader, Dick Ransom, Shane Wicks, Cathy Bayne, Ron Dusil, Dave Yanecek, Dan Zamastil. Magers moved to approve the agenda and Clerk's financial statements, seconded by Beer. Roll call vote: Ayes: Beer, Frieden,Magers, Rabe, Wainwright.Nays:None. Motion carried. Rabe moved to approve and place on file the minutes of the regular Council meeting dated .January 13, 2009, and the special Council meeting dated January 27, 2009, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden,Magers, Rabe,Wainwright,Nays:None. Motion carried. The Sheriff s report was given by Deputy Egli and the Call for Service log was submitted and discussed. Cathy Bayne reported that the sidewalk is sinking at the Library and that a teen advisory group has been created. The Fire Department had no news. The Maintenance Department reported that they had to clean out the ditch on East Southview Road during the thaw because it was full of ice and snow. Discussion was held on adding a deadline extension to Temporary Occupancy permits for certain circumstances. An Ordinance amendment will be on the agenda at the next scheduled meeting for consideration. Until the proposed Ordinance takes effect, Council approved a deadline extension for all Temporary Occupancies that are currently on file, JoAnn Beer reported that the Parks department is planning to finish some projects, including using the rest of the grant money for trees in the new park. They will be looking into fundraising options for new playground equipment. The Visioning Committee had no news. Discussion was held on the bond sale. Council agreed on the 12-year debt schedule, and set a date for the bond sale of February 24,2009. Discussion was held on the bids received for the detention basin improvements at Commercial Court. Mayor Voss reported that he received a call from Dan Bushman of Bushman Excavating, Inc., who indicated that Bushman Excavating had kept their bid below $25,000 to avoid the performance bond, which is required in the bid documents and is based on Engineer's estimate... Magers moved to award the project to Schrader Excavating. The motion died due to lack of a second. After further discussion, Magers moved to award the project to Schrader Excavating, seconded by Wainwright. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion carried. Magers introduced the following Resolution and moved its adoption, seconded by Wainwright. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2009- 02-06 entitled, "RESOLUTION TO ACCEPT BID FOR. THE DETENTION BASIN IMPROVEMENTS AT COMMERCIAL COURT". Passed and approved this 10ffi day of February, 2009. Wainwright moved to approve the claims list dated February 10, 2009, seconded by Rabe. Roll call vote: Ayes: Beer, Frieden, Magers,Rabe, Wainwright.Nays:Done. Motion carried. Joe Kell discussed the Fairfax youth Sports Association. They are planning another pancake breakfast in April. They are also planning to start a T-ball league. There will be an informational meeting on March 3. Clerk reported that valuations were finally available from the County, so a budget session will be held during the special meeting February 17, 2009, at 6:00 PM. There being no further business before the Council, Mayor Voss adjourned at 8:07 PM. Mayor Voss presided. Council members present: Beer, Frieden, Magers, Rabe, Wainwright. Absent: None, Others present: Scott Drzycimski, Dick Ransom, Shane Wicks, Cathy Bayne, Dave Yaneeek. Cathy Bayne submitted end of year statistics and reported on the library activity. Dave Yanecek reported that the fire department has had a few calls, but been relatively quiet. Tile maintenance department has been busy plowing snow. Parks has been quiet, starting to plan for spring. Visioning had a successful fundraiser with the Holiday House Walk. They are also starting to plan for spring, Mayor Voss announced that this was the time and place for a public hearing on the matter of granting franchise to Interstate Power and Light Company. Notice of this hearing was published in The Cedar Rapids Gazette on January 5, 2009. There being no further comments or objections, Mayor Voss closed the public hearing at 7:07 PM. Wainwright moved to approve the American Legion liquor license renewal, seconded by Beer. Roll call vote: Ayes: Beer, Frieden,Magers, Rabe, Wainwright...Nays:None. Motion carried. Magers moved to renew Wellmark health insurance with a $1500 deductible and 20% copay, seconded by Beer. Roll call vote: Ayes: Beer, Magers, Rabe, Wainwright. Nays: Frieden. Motion carried. Dick Ransom, City Engineer, led a discussion on the Capital Improvements Planning Committee report and discussed the funding request list for City projects for Infrastructure Stimulus Package. Wainwright introduced the following Resolution and moved its adoption, seconded by Magers. Roll call vote: Ayes Beer, Frieden, Magers, Rabe, Wainwright, Nays: None. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2009-01-01 entitled, "RESOLUTION AUTHORIZING ENGINEERING SERVICES TO PROCEED WITH PRELIMINARY INVESTIGATIONS AND PREPARATION OF PLANS AND SPECIFICATIONS FOR PHASE 1 OF THE WATER MAIN REPLACEMENT PROJECT IN FAIRFAX PROPER". Passed and approved this 13th day of January, 2009. No action was taken on Agenda.items 14 and 15 regarding Resolution 2008-57. No action was taken on Agenda items 16 and 17 regarding Resolution 2008-58. No action was taken on Agenda items 18 and 19 regarding Resolution 2008-59. Whereupon the Mayor declared the following duly adopted: Resolution 2009-01-02 entitled, "A RESOLUTION APPROVING THE CONTRACT FOR LAW ENFORCEMENT SERVICES WITH LINN COUNTY AND THE LINN COUNTY SHERIFF FOR FISCAL YEAR 2009-2010". Passed and approved this 13th day of January, 2009. Frieden introduced the following Resolution and moved its adoption, seconded by Magers. Roll call vote. Whereupon the Mayor declared the following duly adopted: Resolution 2009-01-03 entitled, '`'A RESOLUTION AUTHORIZING ASSESSMENT OF A LIEN AGAINST THE PROPERTY FOR NONPAYMENT OF CITY UTILITIES." Passed and approved this 13th day of January, 2009. Discussion was held on unsafe house and race track issues. City will continue to work closely with attorney on these issues. Discussion was held on the tree ordinance. Dave Yanecek and Dick Ransom will look into this. Discussion was held on potential repairs needed on Horizon Avenue because the road is sinking in parts. Beer moved to approve the claims list dated January 13, 2009, upon clarification of payments to Dan's Overhead Doors and Linn County Secondary Roads, seconded by Rabe. Passed and approved this 27th day of January, 2009. Dick Ransom and Shane Wicks discussed proposed changes to the detention basin near Commercial Court. Councilperson Magers discussed issues at the Wastewater Treatment Facility. City Engineer told Council that Ron Dusil, Maintenance, was working on devising a solution to the problem of needing to shut down one of the cells. Mayor Voss discussed the abandoned house at 510 Church 'Street and the inspection done by Linn County Public Health. There being no further business before the Council, Mayor Voss adjourned at 6:55 PM.
