Home My WebLink About09-30-2010 Special Meeting CITY OF FAIRFAX SPECIAL CITY COUNCIL MEETING SEPTEMBER 30, 2010 The special meeting of the Fairfax City Council was held Thursday, September 30, 201 Q, at Fairfax City Hall. Mayor Rabe called the meeting to order at 6:15 PM. Council members present: JoAnn Beer,Bernie Frieden, and Marianne Wainwright. Other city staff present: Cynthia Stimson, Lynn Miller,and City Engineer Shane Wicks. Also present were Jeff Then and John Huber. Motioned by Beer, seconded by Frieden to approve the agenda. Ayes: Beer, Frieden, and Wainwright. Absent: Otto and Magers. Motion carried. Shane Wicks discussed the status of the final plat submission for Prairie Creek Estates h Addition from Prairie Creek Partners, L.L.C. We have received the Plan of Improvements, but no surety bond or letter of credit.. Shane recommended that the City Council take action to allow the developer to proceed with installation of the public improvements,but wait for the final plat approval. Discussion was held about storm water flow. The City Council reviewed and placed on file RECOMMENDATION 2010-07 from the Fairfax Planning and Zoning Commission. They recommended approval of the final plat with the conditions as set out by the engineer. Motioned by Frieden,seconded by Wainwright to approve RESOLUTION 2010-45,A RESOLUTION TO PROCEED WITH THE PUBLIC IMPROVEMENTS INSTALLATION IN PRAIRIE CREEK ESTATES FIFTH ADDITION TO THE CITY OF FAIRFAX,LINN COUNTY,IOWA. Roll call vote: Ayes: Beer, Frieden, and Wainwright. Nays: None. Absent: Otto and Magers. Motion carried. Mayor Rabe declared. RESOLUTION 2010-45 duly adapted. Motioned by Frieden, seconded by Beer to adjourn the meeting. Ayes: Beer, Frieden, and Wainwright. Nays: none. Absent: Otto and Magers. Motion carried. Mayor Rabe adjourned the meeting at 6:25 PM. C. and Brain Engineering,Inc.; and WHEREAS, Hall and Hall Engineers, Inc. has reviewed the Final Plat for Prairie Creek Estates Fifth Addition as submitted by Prairie Creek Partners, L.L. C. and Brain Engineering, Inc.; and WHEREAS,Hall and Hall Engineers, Inc. has recommended approval of this Final Plat for Prairie Creek Estates Fifth Addition, with the stipulation of the following conditions: 1. That the public improvements for this development are completed and accepted by the City of Fairfax or that an engineer's cost opinion of the remaining public improvements, along with some form of financial surety to cover these costs are provided to the City of Fairfax 2. The following documents are submitted to the City of Fairfax: a. Bound documents for Prairie Creek Estates Fifth Addition b. Boundary closures for the overall Fifth Addition and each individual lot C. All utility company sign-offs for this plat NOW,THEREFORE,BE IT RESOLVED,by the City Planning and Zoning Commission of the City of Fairfax, Iowa that the Final Plat for Prairie Creek Estates Fifth Addition as submitted by Prairie Creek Partners, L.L. C. and Brain Engineering, Inc. is hereby acknowledged and approved on the part of the City Planning and Zoning Commission and this Commission hereby recommends to the City Council the approval of the same with the stipulation of the following conditions: 1. That the public improvements for this development are completed and accepted by the City of Fairfax or that an engineer's cost opinion of the remaining public improvements,along with some form of financial surety to cover these costs are provided to the City of Fairfax 2. ATTEST: Joe 1 Cl ' �nan Cyn 'a Stimson, City Clerk RESOLUTION NO. 2010-45 RESOLUTION TO PROCEED WITH THE PUBLIC IMPROVEMENTS INSTALLATION IN PRAIRIE CREEK ESTATES FIFTH ADDITION TO THE CITY OF FAIRFAX,LINN COUNTY,IOWA WHEREAS, a Plan of Improvements dated September 27, 2010, from Prairie Creek Partners, L.L.C. and Brain Engineering, Inc. for paging, erosion control, water, sanitary sewer, and storm sewer improvements in Prairie Creek Estates Fifth Addition to the City of Fairfax, Linn County, Iowa has been submitted to the City of Fairfax, Iowa; and WHEREAS, Hall and Hall Engineers, Inc. has reviewed said plans and profiles for construction of said improvements in Prairie Creek Estates Fifth Addition to the City of Fairfax, Linn County, Iowa and has recommended approval of this Plan of Improvements with the following conditions: 1. That NPDES Permit Authorization is obtained for this site and an executed SWPPP is completed prior to grading activities for this development. 2. That the Iowa DNR Construction permits for the sanitary sewer and water main be obtained prior to beginning the installation of the sanitary sewer and water main. 3. That prior to the City's acceptance of these public improvements, the following items be completed: a. The remaining unbuildable portion of Lot 17, Prairie Creek Estates Third Addition, (the east 50.51 feet)be connected to Lot A of Prairie Creek Estates Third Addition with a Plat of Survey. b. That a drainage easement be established on lot(s) 4 and/or 5 of Prairie Creek Estates Third Addition to accommodate overland storm water drainage. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, that Prairie Creek Partners, L.L.C. is hereby granted permission for their contractors to proceed with installation of paving, erosion control, water, sanitary sewer, and_ storm sewer improvements at Prairie Creek Estates Fifth Addition to the City of Fairfax, Linn County, Iowa,with the following conditions: 1.
