SPECIAL CITY COUNCIL MEETING
JANUARY 25, 2011
A special meeting of the Fairfax City Council was held Tuesday, January 25, 2011 at
Fairfax City Hall. Mayor Jason Rabe called the meeting to order at 6:00 PM. Council members
present: JoAnn Beer, Bernie Frieden,Marc Magers, and Marianne Wainwright. Travis Otto was
absent. Other city staff present: Cynthia Stimson, Lynn Miller, and Cathy Bayne. Also present
were Fire Chief Mike Sankot, City Engineer Shane Wicks, Library Board Members Mary Rita
Meyers and Jim Stallman, and Planning and Zoning Member Dennis Kunze.
Motioned by Beer, seconded by Magers to approve the agenda. Ayes: Beer, Frieden,
Magers, and Wainwright. Absent: Otto. Motion carried.
Motioned by Magers, seconded by Frieden to approve RESOLUTION NO. 2011-07,A
RESOLUTION REDUCING THE AMOUNT OF THE LETTER OF CREDIT FROM
GUARANTY BANK AND TRUST COMPANY FOR PUBLIC IMPROVEMENTS IN
PRAIRIE CREEK ESTATES FIFTH ADDITION TO THE CITY OF FAIRFAX, LINN
COUNTY,IOWA. Ayes: Beer,Frieden, Magers, and Wainwright. Absent: Otto. Motion
carried. Mayor Rabe declared RESOLUTION 2011-07 duly adopted.
A quote from Future Line Truck Equipment for a tailgate spreader was reviewed. The
current system's limitations were discussed.
Motioned by Magers, seconded by Wainwright to approve the purchase of the tailgate
spreader for$4,450 to be paid for from the Road Use Fund. Ayes: Beer, Frieden,Magers, and
Wainwright. Absent: Otto. Motion carried.
The audit report for the fiscal year 2009-2010 was reviewed. No problems were found.
The farming operation will be set up as an enterprise fund.
Extensive discussion was held about the budget for the 2011-2012 fiscal year.
Mike Sankot discussed the levy level for the fire department. With Fairfax's growth,he
felt that keeping the levy level the same should work fine.
Mary Rita Meyers, Jim Stallman, and Cathy Bayne were present to discuss the library
budget. Tim reviewed areas needing increases. Mary Rita asked about the building issues being
in their budget. The city clerk/treasurer explained that the library building expenses will be paid
from this area of the budget, but that the budget will be increased to include the projected
expenses. Cathy Bayne discussed the condition of the windows in the meeting room. The other
windows have been replaced,but these have not. They leak and the wood is rotting. Lynn
Miller discussed some needed work on the planter area. New computers for the library were
discussed. Keeping the levy level the same should also work for the library budget.
Other budget issues that were discussed were the possibility of another LOST election,,a
new skid loader, a gate at the tennis court,needed sidewalk at two park areas,bathrooms for
Hawk's Ridge Park, extending the Linn Street trail, funding the required $125,000 for the trail.
project, and needed field tiling.
Mayor Rabe opened a public hearing regarding the designation of the 2011 Addition to
the Fairfax Urban Renewal Area and Plan at 7:00 PM. The city clerk/treasurer stated that the

Motioned by Frieden, second by Magers that ORDINANCE 114 be adopted. Ayes:
Beer,Frieden, Magers, and Wainwright. Absent: Otto. Motion carried.
Motioned by Magers, seconded by Beer to suspend the statutory rule requiring
ORDINANCE 114 to be considered and voted on for passage at two council meetings prior to
the meeting at which it is to be finally passed. Ayes: Beer, Frieden,Magers, and Wainwright...

Motioned by Magers, seconded by Beer that ORDINANCE 114,AN ORDINANCE
PROVIDING FOR THE DIVISION OF TAXES LEVIED ON TAXABLE PROPERTY IN
THE 2011 ADDITION TO THE FAIRFAX URBAN RENEWAL AREA,PURSUANT TO
SECTION 403.19 OF THE CODE OF IOWA be given final adoption. Ayes: Beer, Frieden,
Magers, and Wainwright. Absent: Otto. Motion carried. Mayor Rabe declared ORDINANCE
114 duly adopted.
Mayor Rabe opened the public hearing regarding the plans, specifications, form of
contract, and estimated cost for the Water Main Replacement Program---Phase 2 Improvements
Project at 7:06 PM. The city clerk/treasurer stated that the clerk's office had not received any
oral or written comments on this topic. City Engineer Shane Wicks stated that the estimate of
probable cost is $364,000. After asking for input from the audience and receiving none, Mayor
Rabe closed the public hearing at 7:08 PM.
Motioned by Magers, seconded by Frieden to approve RESOLUTION 2011-09,A
RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT AND
ESTIMATED COST FOR THE WATER MAIN REPLACEMENT PROGRAM--PHASE
2 IMPROVEMENTS PROJECT. Ayes: Beer, Frieden, Magers, and Wainwright. Absent:
Otto. Motion carried. Mayor Raabe declared RESOLUTION 2011-09 duly adopted.
Shane Wicks asked the city council if they wanted to require asphalt in the street crossing
areas. They do want to have this as a bid item.
Discussion continued on the budget for the 2011-2012 fiscal year. The water fund is to
start setting aside $20,000 each year to save for water tower work,the debt service levy for the
sewer system will need to be raised$2.00 a month, an estimate is to be gotten for field tile work,
cost proposals for drainage issues will be reviewed, and Shane Wicks will talk to the IDOT about
T their bridge plans.
. ...The projected LOST fund balance was reviewed. A list of possible projects included;
sidewalks,tiling work, Linn Street trail extension,Prairie Creek trail funding, culverts, a pickup
track with blade, city hall storage,restrooms at Hawks Ridge Park,and parking paving at Hawks
Ridge and City Parks.

The excess in the TIF Fund was discussed. It was proposed to use these funds for the
Prairie Creek trail project.
JoAnn Beer asked about the status of Casey's plans. She would like to have the City of
Fairfax contact Casey's about the possibilities of renovating the existing Casey's building.
Motioned by Wainwright, seconded by Frieden to adjourn the meeting. Ayes: Beer,
Frieden, Magers, and Wainwright. Absent: Otto. Motion carried.

RESOLUTION REDUCING THE AMOUNT OF THE LETTER OF
CREDIT FROM GUARANTY BANK AND TRUST COMPANY FOR
PUBLIC IMPROVEMENTS IN PRAIRIE CREEK ESTATES FIFTH
ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA
WHEREAS, Synergy Development Group, L.L.C, has requested a reduction in
the amount of the Letter of Credit approved by Resolution for the completion of the
public improvements in Prairie Creek Estates Fifth Addition; and
WHEREAS, Hall and Hall Engineers, Inc. has reviewed the public improvements
currently installed and recommends a reduction in the amount of this Letter of Credit by
$17,242.50 to make partial payment for work completed on these public improvements..
This reduction will effectively reduce the Letter of Credit to $33,479.15.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, that the Letter of Credit from Guaranty Bank and Trust Company is hereby
revised to the amount of $33,479.15 for the completion of the public improvements in
Prairie Creek Estates Fifth Addition to the City of Fairfax,.Linn County, Iowa.
BE IT FURTHER RESOLVED, by the City Council of Fairfax, Iowa, that the
Mayor and the City Clerk are hereby authorized and directed to execute said Resolution..

Re: Draw No. 3 on the Letter of Credit for Prairie Creek Estates (Fifth Addition
Honorable Mayor and City Council,
We have reviewed the invoice submitted by Schrader Excavating and Grading Co. (see attached)for
work completed on the public improvements for Prairie Creek Estates Fifth Addition relative to the letter
of credit submitted by Synergy (Development Group, L.L.C. We have completed an on-site inspection
of these improvements to verify that the public facilities installed are consistent with this request.
Based upon this, we recommend the third draw from the Letter of Credit be in the amount of
117,242,50 to cover the public improvements that have currently been installed. This will effectively
reduce the remaining Letter of Credit to $33,479.15.

The City Council of the City of Fairfax, Iowa, met on January 25, 2011, at 7:00 o'clock,
p.m., at the City Hall, in the City for the purpose of conducting a public hearing on the
designation of an urban renewal area and on a proposed urban renewal plan amendment. The
Mayor presided and the roll being called the following members of the Council were present and

The Council investigated and found that notice of the intention of the City Council to
conduct a public hearing on the designation of the 2011 Addition to the Fairfax Urban Renewal
Area and on an urban renewal plan amendment had been published according to law and as
directed by the Council and that this is the time and place at which the Council shall receive oral
or written objections from any resident or property owner of the City. All written objections,
statements, and evidence heretofore filed were reported to the Council, and all oral objections,
statements, and all other exhibits presented were considered.

RESOLUTION NO. .
A resolution to declare necessity and establish an urban renewal area, pursuant to
Section 403.4 of the Code of Iowa and approve urban renewal plan amendment
for the 2011 Addition to the Fairfax Urban Renewal Area
WHEREAS, as a preliminary step to exercising the authority conferred upon Iowa cities
by Chapter 403 of the Code of Iowa (the "Urban Renewal Law"), a municipality must adopt a
resolution finding that one or more slums, blighted or economic development areas exist in the
municipality and that the rehabilitation, conservation, redevelopment, development or a
combination thereof, of such area or areas is necessary in the interest of the public health, safety
or welfare of the residents of the municipality; and
WHEREAS, the City Council of the City of Fairfax. (the "City") has created the Fairfax
Urban Renewal Area(the "Urban Renewal Area"); and
WHEREAS, a proposal has been made which shows the desirability of expanding the
Urban Renewal Area to add and include all the property within the legal description set out in
Exhibit A hereto; and
WHEREAS, the proposal demonstrates that sufficient need exists to warrant finding the
area shown in Exhibit A an economic development area; and
WHEREAS, notice of a public hearing by the City Council of the City on the question of
establishing the area shown in Exhibit A hereto as an urban renewal area and on a proposed
urban renewal plan amendment for the 2011 Addition to the Fairfax Urban Renewal Area was
heretofore given in strict compliance with the provisions of Chapter 403 of the Code of Iowa,
and the Council has conducted said hearing; and
WHEREAS, the Planning and Zoning Commission of the City has reviewed and
conunented on the proposed urban renewal plan amendment; and
WHEREAS, copies of the urban renewal plan amendment, notice of public hearing and
notice of a consultation meeting with respect to the urban renewal plan amendment were mailed
to Linn County, College Community School District and Kirkwood Community College; the
consultation meetingwas held on the t da of _,�`��' , 2011; and responses to an

comments or recommendations received following the c ,nsultation meeting were made as
required by law;
NOW, THEREFORE, It Is Resolved by the City Council of the City of Fairfax, Iowa., as
follows:
Section 1. An economic development area as defined in Chapter 403 of the Code of
Iowa, is found to exist in the City of Fairfax within the boundaries set out in Exhibit A hereto.

Section 2. The area identified in Section 1 hereof is hereby declared to be an urban
renewal area, in conformance with the requirements of Chapter 403 of the Code of Iowa, and is
hereby designated the 2011 Addition to the Fairfax Urban Renewal Area.
Section 3. The development of this area is necessary in the interest of the public
health, safety or welfare of the residents of the City.
Section 4. It is hereby determined by this Council as follows:
A. The proposed urban renewal plan amendment for the 2011 Addition to the
Fairfax Urban Renewal Area conforms to the general plan of the municipality as a whole;
B. Proposed economic development in the 2011 Addition to the Fairfax
Urban Renewal Area is necessary and appropriate to facilitate the proper growth and
development of the city in accordance with sound planning standards and local
community objectives.
Section 5. The amendment to the urban renewal plan for the Fairfax Urban Renewal
Area incorporating this area, attached hereto and made a pant hereof, is hereby in all respects
approved.
Section 6. All resolutions or parts thereof in conflict herewith are hereby repealed,to
the extent of such conflict.

A RECOMENDATION APPROVING THE 2011 ADDITION TO THE FAIRFAX
URBAN RENEWAL AREA DESIGNATION AND PLAN
WHEREAS, the Planning and Zoning Commission of the City of Fairfax, Iowa,has
reviewed the map, legal description, and reasons for the 2011 Addition to the Fairfax Urban.
Renewal Area Designation and.Plan; and
WHEREAS,this addition to the Fairfax Urban Renewal Area Designation and Plan is
in the interest of the public health, safety, or welfare of the residents of the City of Fairfax;
and
WHEREAS,this addition to the Fairfax Urban Renewal Area Designation and Plan
conforms to the fixture planning of improvements for the City of Fairfax.
NOW, THEREFORE,IBE IT RESOLVED, by the City Planning and Zoning
Commission of the City of Fairfax, Iowa that 2011 Addition to the Fairfax Urban Renewal
Area Designation and Plan are hereby acknowledged and approved on the part of the City
Planning and Zoning Commission and that this Commission hereby recommends to the City
Council the approval of the same and the chairman is hereby authorized and directed to certify
this recommendation of approval as provided by law.

AN ORDINANCE PROVIDING FOR THE DIVISION OF TAXES LEVIED ON
TAXABLE PROPERTY IN THE 2011 ADDITION TO THE FAIRFAX URBAN
RENEWAL AREA, PURSUANT TO SECTION 403.19 OF THE CODE OF
IOWA
WHEREAS, the City Council of the City of Fairfax, Iowa (the "City") enacted an
ordinance entitled "An Ordinance Providing For The Division Of Taxes Levied On Taxable
Property In The Fairfax Urban Renewal Area of the City of Fairfax, Iowa, Pursuant To
Section 403.19 of the Code of Iowa"; and
WHEREAS, pursuant to that ordinance, the Fairfax Urban Renewal Area in the City of
Fairfax was designated a"tax increment area"; and
WHEREAS, the City Council now desires to increase the size of the "tax increment area"
by adding additional property;
BE IT ENACTED by the Council of the City of Fairfax, Iowa:
Section 1. Purpose, The purpose of this ordinance is to provide for the division of
taxes levied on the taxable property in the 2011 Addition to the Fairfax Urban Renewal Area of
the City of Fairfax, Iowa, each year by and for the benefit of the state, city, county, school
districts or other taxing districts after the effective date of this ordinance in order to create a
special fiend to pay the principal of and interest on loans, moneys advanced to or indebtedness,
including bonds proposed to be issued by the City of Fairfax to finance projects in the such area.
Section 2. Definitions. For use within this ordinance the following terms shall have
the following meanings:
"City" shall mean the City of Fairfax, Iowa.
"County" shall mean Linin County, Iowa.
"2011 Urban Renewal Area Addition" shall mean the 20111 Addition to the Fairfax Urban
Renewal Area of the City of Fairfax, Iowa, the legal description of which is set out below,
approved by the City Council by resolution adopted on the 25th`day of January, 2011:
Beginning at the point of intersection of the east right-of--way line of Nickolet
Street and the south right-of-way line of Prairie Avenue, thence north along the
east line of Nickolet Street to the south right-of-way line of Front Street, thence
east along the south line of Front Street to the east right-of-way line of Park
Street, thence south along the east line of Park Street to the north right-of-way
line of Quarry Drive, thence east along the north line of Quarry Drive to the most
easterly end of Quarry Drive, thence south along the east right-of-way line of
Quarry Drive and extended south across the Union Pacific Railroad to the north
right-of-way line of Railroad Street, thence east along the north line of Railroad
Street to the cast right-of-way line of Siepman Drive extended, thence south along

the east line of Siepman Drive to the north right-of-way line of Main Street,
thence east along the north line of Main Street to the west right-of-way line of
Burger Lane, thence south along the west line of Burger Lane extended to the
south right-of-way line of Main Street, thence west along the south line of Main
street to the east right-of-way line of Park Street, thence north along the east line
of Park Street to the north right-of way line of Railroad Street, thence west along
the north line of Railroad Street to the east right-of-way line of Vanderbilt Street,
thence north along the east line of Vanderbilt street to the north right-of-way line
of Losey Avenue extended, thence west and north along the north and east lines
of Losey Avenue to the south right-of-way line of Prairie Avenue, thence east
along the south line of Prairie Avenue to the east right-of-way line of Nickolet
Street and the point of beginning.
Said parcel contains approximately 30.09 acres, subject to easements and
restrictions of record.
Section 3. Provisions for Division of Taxes Levied on Taxable Property in the 2011
Urban Renewal Area Addition. After the effective date of this ordinance, the taxes levied on the
taxable property in the 2011 Urban Renewal Area Addition each year by and for the benefit of
the State of Iowa, the City, the County and any school district or other taxing district in which
the 2011 Urban Renewal Area Addition is located, shall be divided as follows:
(a) that portion of the taxes which would be produced by the rate at which the tax is
levied each year by or for each of the taxing districts upon the total sum of the assessed value of
the taxable property in the 2011. Urban Renewal Area Addition, as shown on the assessment roll
as of January 1 of the calendar year preceding the first calendar year in which the City certifies to
the County Auditor the amount of loans, advances, indebtedness, or bonds payable from the
special fund referred to in paragraph(b) below, shall be allocated to and when collected be paid
into the fund for the respective taxing district as taxes by or for said taxing district into which .all
other property taxes are paid. For the purpose of allocating taxes levied by or for any taxing
district which did not include the territory in the 2011 Urban Renewal Area Addition on the
effective date of this ordinance, but to which the territory has been annexed or otherwise
included after the effective date, the assessment roll applicable to property in the annexed
territory as of January 1 of the calendar year preceding the effective date of the ordinance which
amends the plan for the 2011 Urban Renewal Area Addition to include the annexed area, shall be
used in determining the assessed valuation of the taxable property in the annexed area.
(b) that portion of the taxes each year in excess of such amounts shall be allocated to
and when collected be paid into a special fund of the City to pay the principal of and interest on
loans, moneys advanced to or indebtedness, whether funded, refunded, assumed or otherwise,
including bonds issued under the authority of Section 403.9(1), of the Code of Iowa, incurred by
the City to finance or refinance,, in whole or in part, projects in the 2011 Urban Renewal Area
Addition, and to provide assistance for low and moderate-income family housing as provided in
Section 403.22, except that taxes for the regular and voter-approved physical plant and
equipment levy of a school district imposed pursuant to Section 298.2 of the Code of Iowa, and
taxes for the payment of bonds and interest of each taxing district shall be collected against all
taxable property within the taxing district without limitation by the provisions of this ordinance.

Unless and until the total assessed valuation of the taxable property in the 2011 Urban Renewal
Area Addition exceeds the total assessed value of the taxable property in such area as shown by
the assessment roll referred to in subsection(a) of this section, all of the taxes levied and
collected upon the taxable property in the 2011 Urban Renewal. Area Addition shall be paid into
the funds for the respective taxing districts as taxes by or for said taxing districts in the same
manner as all other property taxes. When such loans, advances, indebtedness, and bonds, if any,
and interest thereon, have been paid, all money thereafter received from taxes upon the taxable
property in the 2011 Urban Renewal Area Addition shall be paid into the fiends for the respective
taxing districts in the same manner as taxes on all other property.
(c) the portion of taxes mentioned in subsection(b) of this section and the special
fund into which that portion shall be paid may be irrevocably pledged by the City for the
payment of the principal and interest on loans, advances, bonds issued under the authority of
Section 403.9(1) of the Code of Iowa, or indebtedness incurred by the City to finance or
refinance in whole or in part projects in the 2011 Urban Renewal Area Addition.
(d) as used in this section, the word "taxes" includes, but is not limited to, all levies
on an ad valorem basis upon land or real property.
Section 4. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 5. Saving Clause. If any section, provision, or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision or part thereof not adjudged invalid or
unconstitutional.
Section b. Effective Date. This ordinance shall be effective after its final passage,
approval and posting as provided by law.

Replacement Program—Phase 2 Improvements Project; and
WHEREAS, notice of hearing on plans, specifications, form of contract, and estimated
