Home My WebLink About08-30-2011 Special Meeting RESOLUTION NO. 2011- 6 RESOLUTION TO PROCEED WITH THE PUBLIC IMPROVEMENTS TO PRAIRIE CREED ESTATES SIXTH ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA WHEREAS, a Plan of Improvements dated August 25, 2011, from Synergy Development Group, L.L.C. and Brain Engineering, Inc. for paving, erosion control, water, sanitary sewer, and storm sewer improvements in Prairie Creek Estates Sixth. Addition to the City of Fairfax,Linn County, Iowa, and WHEREAS, Hall and Hall Engineers, Inc. has reviewed said plans and profiles for construction of said improvements in Prairie Creek Estates Sixth Addition to the City of Fairfax, Linn County, Iowa and has recommended approval of this Plan of Improvements with the following conditions: 1. That NPDES Permit Authorization is obtained for this site, and an executed SWPPP is completed and is on-site and accessible prior to site grading activities for this development. 2. That the Iowa DNR Construction permits for both the sanitary sewer and water main improvements are obtained prior to beginning installation of the sanitary sewer and water main. 3. That prior to the City's acceptance of these public improvements,the following items shall be completed: a. The drainage from the existing field tile that serves properties to the north and east of this development shall be extended through Prairie Creek Estates Sixth Addition or the adjacent existing Prairie Creek Estates development and to the wet pond located on Parcel B, Plat of Survey No. 1686. This drainage shall be conveyed in an acceptable manner to the City Maintenance Department and the City Engineer,and shall be conveyed within the City Streets Right-of-way and/or easements such that these drainage facilities are accessible for maintenance, repair, and replacement. b. The sidewalk along Driftwood Lane and adjacent to Parcel B, Plat of Survey No, 1686 shall be installed. This sidewalk and right-of-way grading shall be installed per the CR Metro Standard Details. If it is anticipated that vehicle traffic may be crossing this sidewalk, then the sidewalk pavement shall be thickened to a minimum of 6 inches. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, that Synergy Development Group, L.L.C. is hereby granted permission for their contractors to proceed with installation of paving, erosion control, water, sanitary sewer, and storm sewer improvements in Prairie Creek Estates Sixth Addition to the City of Fairfax,Linn County,Iowa with the following conditions: 1. AYES: Beer,Frieden, Otto, Wainwright, and Magers NAYS: None ABSENT: None Jason e, Ma or ATTEST: CyYit#ia Stimson, City Clerk/'Treasurer RESOLUTION NO. 2011-57 RESOLUTION APPROVING CHANGE ORDER NO. 4 FOR THE WATER MAIN REPLACEMENT PROGRAM, PHASE II IMPROVEMENTS WHEREAS, The City Council of Fairfax, Iowa has contracted with Schrader Excavating & Grading, Inc. for the Water Main Replacement Program, Phase 11 Improvements, within the corporate limits; and WHEREAS, Hall and Hall Engineers, Inc., has recommended approval of Change Order No. 4, for an increase to the contract amount of$1,800.00 as Iisted below: C.O. #4, Item 1 - PCC Replacement at the Intersection of Losey Avenue and Nickolet Street The original contract called for Asphalt Pavement to replace the scalcoat at the water main crossing of Nickolet Street. To install the Asphalt per plans would create a three surface material intersection at Nickolet and Losey, going from new Asphalt at the crossing, to Sealcoat at the southernmost end of Nickolet Street, and finally tie into existing PCC pavement further north on Nickolet Street. Replacing the whole section with P'CC would be a better option, and would allow the new FCC pavement to be tied into the existing PCC pavement on Nickolet Street, eliminating differential settlement of the pavement between material types. There is no difference in unit prices of Asphalt vs. PCC for this substitution. The difference in cost comes from the addition of 45 SY to complete the entire area with 1 material. The total additional cost of the PCC Pavement is $1,800.00. BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, to approve Change Order No. 4 for the Water Main Replacement Program, Phase Il Improvements which will result in an increase to the contract amount of$1,800,00 to make a revised total construction contract cost amount of$413,794.86. NOW, THEREFORE,,RE IT FURTHER RESOLVED,by the Fairfax City Council of the City of Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute said resolution. The meeting was called to order by the Mayor, and the roll was called showing the following members of the City Council present and absent: Present: Beer Frieden Otto Wainwright,and Ma ers Absent: None. This being the time and place specified for holding a public hearing on the proposal to enter into an Essential Corporate Purpose Loan Agreement in a principal amount not to exceed 1,010,000, for the purpose of constructing storm drainage and water main improvements, the City Clerk announced that no written objections had been placed on file. Whereupon, the Mayor called for any written or oral objections, and the following persons made comments: Kenneth Selzer stated that he had talked to the land owners and that they won't allow the trail until the drainage improvements meet their approval. He also stated that the East Cemetery Road area has always been wet and that development should not have been allowed in this area,. He asked if the City Council has learned from the past. He asked if the City of Fairfax has ever put dye in the water to check flows or if the City ever uses a soil scientist. Shane Wicks, the City Engineer stated that the City has not placed dye. Shane also stated that geotechnical firms are used if the project and area wal.Tant the additional cost. There being no further comments, the Mayor announced that the hearing was closed. This also being the time .and place specified for a public hearing on the proposal to enter into a General Corporate Purpose Loan Agreement in a principal amount not to exceed $2,300,000, for the purpose of carrying out projects in the Fairfax Urban Renewal Area consisting of developing and constructing the Fairfax Athletics and Park Complex and constructing trail improvements, the City Clerk announced that no petition had been filed asking that the question of entering into the loan agreement be submitted to the registered voters of the City, and the Mayor called for any written or oral comments, and the following persons made comments: Kenneth Selzer asked what would happen to the City's finances if TIF disappeared. He is concerned that the State of Iowa could take away this revenue source as they did the touch screen machines. Mr. Berger also stated that it was higher unlikely that the State of Iowa would eliminate TIF because there are millions of dollars of public debt issued using this financing tool.
