HomeMy WebLinkAbout12-02-11 Council Minutes (002)CITY OF FAIRFAX SPECIAL CITY COUNCIL MEETING DECEMBER 2, 2011 A special meeting of the Fairfax City Council was held Friday, December 2, 2011 at Fairfax City Hall. Mayor Jason Rabe called the meeting to order at 5:30 PM. Council members present: JoAnn Beer, Travis Otto, and Marianne Wainwright. Bernie Frieden and Marc Magers were absent. Shane Wicks entered the meeting at 5:34 PM. Other city staff present: Kathy Everett. Residents in attendance: Cory Stockton and Gary Stockton. Motioned by Beer, seconded by Otto to approve the agenda. Ayes: Beer, Otto, and Wainwright. Nays: None. Absent: Frieden and Magers. Motion carried. Mayor Rabe stated that the Board of Adjustment approved a variance to allow Cory Stockton to build a 26’x26’ detached garage in a side yard, and five feet from an existing structure at 429 Front Street. The placement of the garage will result in an encroachment into the existing sewer easement, and council action is needed to allow the garage to be built as planned. Motioned by Otto, seconded by Beer to approve RESOLUTION NO. 2011-80, A RESOLUTION APPROVING A BUILDING ENCROACHMENT INTO A SANITARY SEWER EASEMENT, LOCATED ON LOT 5, SELZER’S LAKESIDE ADDITION TO FAIRFAX. Ayes: Beer, Otto, and Wainwright. Nays: None. Absent: Frieden and Magers. Motion carried. Mayor Rabe declared RESOLUTION 2011-80 duly adopted. The city engineer has determined the sewer line located on Lot 5, Selzer’s Lakeside Addition to Fairfax, is not centered in the existing sewer easement and that changing the location of the easement would be beneficial to the city and the homeowner. The City would vacate the existing sewer easement, and require the homeowner to dedicate a portion of Lot 5 to a new sanitary sewer easement. In order to consider vacating a sanitary sewer easement, a public hearing must be held. Motioned by Beer, seconded by Wainwright to approve RESOLUTION NO. 2011- 81, A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING CONCERNING VACATING A SANITARY SEWER EASEMENT. Ayes: Beer, Otto, and Wainwright. Nays: None. Absent: Frieden and Magers. Motion carried. Mayor Rabe declared RESOLUTION 2011-81 duly adopted. Motioned by Wainwright, seconded by Otto to adjourn. Ayes: Beer, Otto, and Wainwright. Nays: None. Absent: Frieden and Magers. Motion carried. Mayor Rabe adjourned the meeting at 5:39 PM.
