HomeMy WebLinkAbout05/08/2012 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING MAY 8, 2012 The regular meeting of the Fairfax City Council was held Tuesday, May 8, 2012, at Fairfax City Hall. Mayor Jason Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marianne Wainwright. Marc Magers was absent. Other city staff present: Cynthia Stimson, Dave Yanecek, and Jeff Ammeter. Cathy Bayne entered later. Motioned by Beer, seconded by Frieden to approve the agenda. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Motioned by Frieden, seconded by Otto to approve and place on file the City Council minutes from April 10, 2012 and the Building Project Pre-Construction Meeting minutes from April 26, 2012. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Motioned by Otto, seconded by Beer to place on file the Library Board of Trustees minutes dated April 4, 2012, the Parks and Beautification minutes dated March 15, 2012, and the Planning and Zoning minutes dated March 20 and April 17, 2012. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. A Linn County Deputy presented the list of calls from the Linn County Sheriff’s Department. The City Council asked that the deputies watch speeding on Sunflower. Fire Chief Mike Sankot and Firefighter Will Zamastil showed the City Council some new fire department medical equipment. Jeff Ammeter discussed the IDNR Report. He said he has done what was listed to do and is working on the suggestions. JoAnn Beer stated that the Parks and Beautification Committee completed the park tour and has submitted a list of projects to Mayor Rabe and the maintenance department. The monthly financial reports were reviewed. A request was made to give a shorter summary at the start of the reports. Motioned by Beer, seconded by Frieden to approve the monthly financial reports. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Shane Wicks stated that he and Mayor Rabe have met with Arps about the trail project. Several residents were present to discuss the Triple Crown Condo Association’s request. Association President Steve Pittman asked that the City help the Association by removing the snow on their streets. Discussion was held about street standards and the reasons why this development was originally set up with private streets. An aerial view of their property was reviewed. The Metro Street Standards are to be sent to the Association so they can look into bringing the streets up to our standards. Steve Pittman asked if the City cannot remove the snow, could the City rebate a portion of their property taxes paid to help cover their costs. The City Council did not think they would be able meet either of their requests. Mapping and cost estimates were discussed with Shane Wicks and Shane Schrader th regarding Mr. Schrader’s request to annex property along 80 Street for a future housing development and to run city utilities to this location. Information was viewed concerning a proposed remodeling project at Lattice Communications. Motioned by Frieden, seconded by Beer to approve the Commercial Building Permit Application from Bruce Leventhal for Lattice Communications. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Gordon Sevig was present to discuss the status of several drainage basins in the Prairie View Heights Development. Shane Wicks reviewed what is still needed for the City to be able to accept these basins. Basin A we need to verify that it will overflow to the street, Basin B is very close, Basin C we need verification of an easement or engineering verification of the elevation showing that is not necessary, and finally, for Basin D we need corrected engineering calculations. Motioned by Wainwright, seconded by Beer to require Gordon Sevig to have these items completed before the basin acceptance. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. RESOLUTION 2012-24, A CITY Motioned by Beer, seconded by Frieden to approve BUDGET AMENDMENT AND CERTIFICATION RESOLUTION . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Mayor RESOLUTION 2012-24 Rabe declared duly adopted. RESOLUTION 2012-25, A Motioned by Beer, seconded by Frieden to approve RESOLUTION TAKING ADDITIONAL ACTION TO ENTER INTO A GENERAL OBLIGATION LOAN AGREEMENT, SETTING DATE FOR SALE OF GENERAL OBLIGATION FIRE TRUCK AND REFUNDING BONDS AND AUTHORIZING THE USE OF A PRELIMINARY OFFICIAL STATEMENT IN CONNECTION WITH THE SALE OF THE BONDS . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: RESOLUTION 2012-25 None. Absent: Magers. Motion carried. Mayor Rabe declared duly adopted. RESOLUTION 2012-26, A Motioned by Beer, seconded by Frieden to approve RESOLUTION APPROVING THE WASTE AND RECYCLING COLLECTION AGREEMENT WITH JOHNSON COUNTY REFUSE, INC . RESOLUTION 2012-27, A Motioned by Beer, seconded by Frieden to approve RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT INTEREST AND PRINCIPLE DUE JUNE 1, 2011 . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Mayor Rabe RESOLUTION 2012-27 declared duly adopted. RESOLUTION 2012-28, A Motioned by Beer, seconded by Frieden to approve RESOLUTION ACCEPTING THE PUBLIC IMPROVEMENTS TO PRAIRIE CREEK ESTATES SIXTH ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. RESOLUTION 2012-28 Motion carried. Mayor Rabe declared duly adopted. RESOLUTION 2012-29, A Motioned by Beer, seconded by Frieden to approve RESOLUTION TO APPROVE THE FINAL PLAT FOR PRAIRIE CREEK ESTATES SIXTH ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion RESOLUTION 2012-29 carried. Mayor Rabe declared duly adopted. The proposed revised Official Zoning Map and Planning and Zoning’s Recommendation 2012-01 were reviewed and discussed. The notification and adoption process was discussed. The designation of a Core District on the proposed Official Zoning Map and Planning and Zoning’s Recommendation 2012-02 were reviewed. The adoption of this district will be done along with the Official Zoning Map process. Planning and Zoning’s Recommendation 2012-03 concerning the stormwater management ordinance was reviewed. These changes will not be made until the Core District is adopted. Information from the city attorney concerning ITC’s request for an electrical franchise was discussed. The City Council does want ITC to cover the costs involved and they would like to establish this franchise without an election. RESOLUTION 2012-30, A Motioned by Beer, seconded by Frieden to approve RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON ITC MIDWEST’S REQUEST FOR AN ELECTRIC FRANCHISE . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Mayor Rabe RESOLUTION 2012-30 declared duly adopted. Five submitted quotes for playground equipment were reviewed and discussed. The City Council and staff liked the layout from Outdoor Recreation, option 1. They would want to add the pads specified in the Boland Recreational quote. Motioned by Wainwright, seconded by Frieden to accept the quote from Outdoor Recreation, option 1 for the playground equipment in the new park along Linn Street, with the addition of the pads. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Discussion was held about the park equipment quote. Joe Kell and Shane Wicks are to look at these items more closely before the City Council will take action. RESOLUTION 2012-31, A Motioned by Beer, seconded by Frieden to approve RESOLUTION TO APPROVE CHANGE ORDER NO. 1 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX CITY PARK AND ATHLETIC FIELDS COMPLEX . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2012-31 duly adopted. RESOLUTION 2012-32, A Motioned by Beer, seconded by Frieden to approve RESOLUTION TO APPROVE PAY APPLICATION NO. 1 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX CITY PARK AND ATHLETIC FIELDS COMPLEX . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2012-32 duly adopted. Robert Peck, from Design Dynamics, presented material samples for the new park building. The City Council agreed on a hunter green for the roof, a light tan for the outside walls, Castlewood for the brick, white for the ceilings, ivory/almond for the inside walls, and beige for the toilet partitions. RESOLUTION 2012-33, A Motioned by Beer, seconded by Frieden to approve RESOLUTION TO APPROVE CHANGE ORDER NO. 1 FROM SEYDEL CONSTRUCTION FOR THE FAIRFAX PARK BUILDING PROJECT . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. RESOLUTION 2012-33 Mayor Rabe declared duly adopted. RESOLUTION 2012-34, A Motioned by Beer, seconded by Frieden to approve RESOLUTION TO APPROVE CHANGE ORDER NO. 2 FROM SEYDEL CONSTRUCTION FOR THE FAIRFAX PARK BUILDING PROJECT . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. RESOLUTION 2012-34 Mayor Rabe declared duly adopted. RESOLUTION 2012-35, A Motioned by Beer, seconded by Frieden to approve RESOLUTION TO APPROVE PAY APPLICATION #3 TO DAVE SCHMITT CONSTRUCTION CO. FOR THE WATER MAIN REPLACEMENT PROGRAM, PHASE III IMPROVEMENTS . Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. RESOLUTION 2012-35 Nays: None. Absent: Magers. Motion carried. Mayor Rabe declared duly adopted. Shane Wicks stated he is working with the IDOT on the consultant agreement for the trail project and is starting to work on the design phase. A drawing showing the maintenance shop area was reviewed. Possible placements for the new storage building were discussed. Motioned by Beer, seconded by Otto to approve Casey’s Cigarette/Tobacco Permit renewal. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. A report about insurance costs was reviewed. Motioned by Frieden, seconded by Otto to approve the claims list dated May 8, 2012. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Dave Yanecek mentioned he will need help during the city-wide clean-up day, on June 2. Cathy Bayne reported that the library bathroom partitions have been ordered, the landscaping looks good, and she has a possible name for the Library Board. Motioned by Otto, seconded by Frieden to adjourn the meeting. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Mayor Rabe adjourned the meeting at 9:40 PM.
