HomeMy WebLinkAbout06/12/2012 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING JUNE 12, 2012 The regular meeting of the Fairfax City Council was held Tuesday, June 12, 2012, at Fairfax City Hall. Mayor Jason Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Cynthia Stimson, Lynn Miller, and Ron Dusil. Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Beer to approve the city council minutes from May 8 and May 22, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Beer to place on file the Library Board of Trustees minutes dated May 7, 2012, the Parks and Beautification Committee minutes dated April 19, 2012, and the Planning and Zoning Commission minutes dated May 16, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff Egli presented the list of calls. Vandalism was discussed. The City Council made the Deputy aware of the USA Days celebration on June 22 and 23. Mayor Rabe reported that the library is making some staffing changes. Lynn Miller reported that the fire department has been getting ready for USA Days. The location for the fireworks will depend on the weather. Ron Dusil expressed his concerns about the community’s total water usage. The pumps are running many hours a day, the day tanks are not lasting very long, and it is hard to find a time to flush the system. He stated he believes the reason for this increased water usage is the second meters and installation of sod. The City Council requested that information about this situation be placed in the next FACTS, asking for voluntary water conservation. If usage changes are not made, they will consider other measures during their July city council meeting. The water quality report was discussed. Updates to the Iowa One Call system have been made, Ken-Way fixed a water main break, and the locator has been ordered. Progress on the Hawks Ridge Park bathroom building was reviewed. JoAnn Beer discussed the Branching Out grant application. Marc Magers discussed a Tree City designation. The Parks and Beautification Committee did a park tour, working up a list of needed park projects. A few of them were discussed. They were asked to prioritize the list and review their budget authority to determine what could be accomplished next fiscal year. The City Council reviewed the proposed colors of the new playground systems and discussed the spring rider. Motioned by Beer, seconded by Magers to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The engineering report and invoices were reviewed. Shane Wicks mentioned that he has been contacted about the IDOT doing a study on 151. Mayor Rabe opened the public hearing regarding ITC Midwest’s request for an electric franchise at 7:51 PM. The city clerk’s office had not received any comments. No one in the audience had a comment. Mayor Rabe closed the public hearing at 7:53 PM. RESOLUTION 2012-37, A Motioned by Magers, seconded by Frieden to approve RESOLUTION DISPENSING WITH AN ELECTION OF THE VOTERS TO GRANT AN ELECTRIC FRANCHISE TO ITC MIDWEST LLC . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2012-37 duly adopted. ORDINANCE 125, AN ORDINANCE AMENDING THE JoAnn Beer introduced CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY ADDING A CHAPTER GRANTING AN ELECTRIC FRANCHISE TO ITC MIDWEST, LLC . Motioned by Frieden, seconded by Beer to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 125 . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. ORDINANCE 125, Motioned by Frieden, seconded by Magers to give final approval of AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY ADDING A CHAPTER GRANTING AN ELECTRIC FRANCHISE TO ITC MIDWEST, LLC . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. RESOLUTION 2012-38, A Motioned by Magers, seconded by Otto to approve RESOLUTION TO APPROVE CHANGE ORDER NO. 2 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX CITY PARK AND ATHLETIC FIELDS COMPLEX . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and RESOLUTION 2012-38 Wainwright. Nays: None. Motion carried. Mayor Rabe declared duly adopted. RESOLUTION 2012-39, A Motioned by Magers, seconded by Otto to approve RESOLUTION TO APPROVE PAY APPLICATION NO. 2 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX CITY PARK AND ATHLETIC FIELDS COMPLEX . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and RESOLUTION 2012-39 Wainwright. Nays: None. Motion carried. Mayor Rabe declared duly adopted. RESOLUTION 2012-40, A Motioned by Wainwright, seconded by Magers to approve RESOLUTION TO APPROVE CHANGE ORDER NO. 3 FROM SEYDEL CONSTRUCTION FOR THE FAIRFAX PARK BUILDING PROJECT . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor RESOLUTION 2012-40 Rabe declared duly adopted. Discussion was held regarding Change Order No. 4. This was to change the stainless steel shelving in the concession stand area. After reviewing the possible cost savings, no change will be made at this time. It was felt that the two adjustable shelves under the counter top will be fully utilized by the stand users. RESOLUTION 2012-41, A Motioned by Magers, seconded by Otto to approve RESOLUTION TO APPROVE CHANGE ORDER NO. 5 FROM SEYDEL CONSTRUCTION FOR THE FAIRFAX PARK BUILDING PROJECT . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor RESOLUTION 2012-41 Rabe declared duly adopted. RESOLUTION 2012-42, A Motioned by Magers, seconded by Otto to approve RESOLUTION TO APPROVE PAY APPLICATION NO. 1 FROM SEYDEL CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX BUILDING IMPROVEMENT PROJECT . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and RESOLUTION 2012-42 Wainwright. Nays: None. Motion carried. Mayor Rabe declared duly adopted. Discussion was held concerning the two quotes for park equipment. Marc Magers stated that he recommends getting the two bike racks from Northtowne Cycling and Fitness. Discussion was held about the cost and style. Shane Wicks recommended purchasing the other equipment from Boland Recreational. Motioned by Beer, seconded by Magers to remove the bike racks from the Boland recreational quote for park equipment and then accept the quote for the other items. Also, to purchase two racks from Northtowne Cycling and Fitness. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. RESOLUTION 2012-43, A Motioned by Wainwright, seconded by Frieden to approve RESOLUTION AUTHORIZING THE ISSUANCE OF $590,000 GENERAL OBLIGATION FIRE TRUCK AND REFUNDING BONDS, SERIES 2012, AND PROVIDING FOR THE LEVY OF TAXES TO PAY THE SAME . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe RESOLUTION 2012-43 declared duly adopted. Shane Wicks discussed the process of the services agreements for the trail project. These should be ready for the next city council meeting. Discussion was held about the process to adopt a new city zoning map and a core district. The city will hold an open house on Tuesday, July 10, 2012, from 4:00 – 7:00 PM and the public hearing during their August city council meeting on Tuesday, August 14, 2012. RESOLUTION 2012-44, A Motioned by Frieden, seconded by Magers to approve RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON A NEWLY REVISED OFFICIAL ZONING MAP, WHICH IS AN AMENDMENT TO THE FAIRFAX ZONING ORDINANCE OF 2000, OF THE CITY OF FAIRFAX, IOWA . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. RESOLUTION 2012-44 Mayor Rabe declared duly adopted. RESOLUTION 2012-45, A Motioned by Frieden, seconded by Magers to approve RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON A NEWLY DESIGNATED CORE DISTRICT, WHICH IS AN AMENDMENT TO THE FAIRFAX ZONING ORDINANCE OF 2000, OF THE CITY OF FAIRFAX, IOWA . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor RESOLUTION 2012-45 Rabe declared duly adopted. The Planning and Zoning Commission’s Recommendation 2012-04 was reviewed. This is proposing a correction to a bulk graph in the zoning code. RESOLUTION 2012-46, A Motioned by Magers, seconded by Otto to approve RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON AN AMENDMENT TO THE FAIRFAX ZONING ORDINANCE OF 2000, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE BULK REGULATIONS GRAPH IN THE RM: MULTIPLE-FAMILY RESIDENTIAL DISTRICT . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2012-46 duly adopted. ORDINANCE 126, AN ORDINANCE AMENDING THE Marc Magers introduced CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY AMENDING PROVISIONS PERTAINING TO THE FEES FOR SOLID WASTE COLLECTION . ORDINANCE 126, AN Motioned by Magers, seconded by Otto to give final approval of ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY AMENDING PROVISIONS PERTAINING TO THE FEES FOR SOLID WASTE COLLECTION . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Three proposals for GIS services were reviewed. Benefits and drawbacks of each system proposed were discussed. It was decided to hire Midland GIS Solutions to gather the information and set-up their web-based system. The City of Fairfax will try the web-based system for two years and evaluate the usage regularly. Motioned by Magers, seconded by Otto to accept the quote from Midland GIS Solutions and to enter into a contract agreement and scope of services for professional GIS mapping services for the City of Fairfax. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. The city council discussed the audit report. The City was found to be in good financial shape with all accounts in order. Mayor Rabe appointed Mary Rita Meyers, Linda Pribyl, and Theresa Whittlesey to the Library Board of Trustees. Motioned by Wainwright, seconded by Magers to approve the American Legion’s request for an Outdoor Service endorsement on the current Class C Liquor License. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Magers, seconded by Otto to approve the claims list dated June 12, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. The city clerk informed the city council about the Municipal Professional’s Academy July 25 -27 and the Iowa League of Cities’ 2012 Annual Conference in Sioux City in September. The clerk is to attend the Academy, but no one will be going to the Annual Conference, due to the long distance. Mayor Rabe asked about the items to complete for the Phase II Water Main Project. Shane Wicks is in contact with Shane Schrader about the punch list items for Phase II. Discussion was held about the speed limit on Fairfax Road and “Children at Play” signs for Sunset. JoAnn Beer informed the city council about the National Railway Historical Society’s conference in Cedar Rapids. Marc Magers stated that he feels the change concerning residential garage sales seems to have worked. He also said that the City needs to figure out a solution to the city-wide garage sale day parking. Emergency vehicles would not have a clear path. Marianne Wainwright asked about the status of notices to Rust Free for nuisance abatement. A notice was sent and Mayor Rabe has met with the owner. He has moved some cars from the front and mowed that area. It was suggested to place a notice in the FACTS that the City of Fairfax will be doing regular notices about nuisance issues. Travis Otto asked that information about acceptable burning be placed in the FACTS. Motioned by Magers, seconded by Wainwright to adjourn the meeting.
