Home My WebLink About07/10/2012 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING JULY 10, 2012 The regular meeting of the Fairfax City Council was held Tuesday, July 10, 2012, at Fairfax City Hall. Mayor Jason Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marc Magers. Marianne Wainwright was absent. Other city staff present: Cynthia Stimson, Lynn Miller, and Cathy Bayne. Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Motioned by Magers, seconded by Beer to approve the city council minutes from June 12 and 19, 2012. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Motioned by Magers, seconded by Beer to place on file the Library Board of Trustees minutes dated June 5, 2012, the Parks and Beautification Committee minutes dated May 17, 2012. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Linn County Deputy Sheriff Pavelka presented the list of calls. Watching for ATVs and quads on the roads was discussed. Cathy Bayne stated that the library has been busy. The trees need to be trimmed. Fire Chief Mike Sankot stated that enough was donated to pay for the fireworks next year and he thanked everyone who donated or came to their food stand. The new truck should be ready at the end of the month. He also stated that Linn County has a burn ban issued. Grills and recreational fires in a container are exempt. The City Council thanked Mike and the entire Fairfax Fire and Rescue Department for all of their work during the Fairfax USA Days. Lynn Miller gave the maintenance department report. Midland GIS will begin work next Monday, the Hawks Ridge bathroom is open, they have been working to find a site for the new storage building, we have been working with Elster AMCO to get water meters, and the water usage has not decreased – but it seems to have leveled off. JoAnn Beer reported that the USA Days Movie in the Park went great. She asked if we can get a quote to seal coat the parking lots at Prairie Creek Park and City Park. She stated that the top priority of the Parks and Beautification Committee is to replace any slides that have cracks. These will be ordered. She asked about the timing of getting electricity in Hawks Ridge Pavilion. The flushable bathrooms at Hawks Ridge Park and City Park will be left open for park users. The park hours have been posted. Motioned by Magers, seconded by Beer to approve the financial reports as presented. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Shane Wicks discussed the engineering report. He has started working on the permit for under the railroad, the IDOT is doing the audit on the paperwork for the trail project, Dave Schmitt Construction is getting ready to pave the trail at the park project, and the project inspection process was discussed. Mayor Rabe opened the public hearing regarding the Fairfax Zoning Code at 7:57 PM. There were no comments received by the clerk’s office nor during the meeting. Mayor Rabe closed the public hearing at 7:59 PM. ORDINANCE 127, AN ORDINANCE AMENDING THE JoAnn Beer introduced FAIRFAX ZONING CODE, 2000, BY AMENDING PROVISIONS PERTAINING TO THE BULK REGULATIONS GRAPH IN THE RM: MULTIPLE-FAMILY RESIDENTIAL DISTRICT . Motioned by Frieden, seconded by Magers to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 127 . Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: none. Absent: Wainwright. Motion carried. ORDINANCE 127, Motioned by Magers, seconded by Beer to give final approval of AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE, 2000, BY AMENDING PROVISIONS PERTAINING TO THE BULK REGULATIONS GRAPH IN THE RM: MULTIPLE-FAMILY RESIDENTIAL DISTRICT C . Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: none. Absent: Wainwright. Motion carried. Discussion was held concerning the commercial building permit application from Richard and Sandra Kruger. No action will be taken until the engineer’s requests are submitted and reviewed. The preliminary list of street work was reviewed and discussed with Prairie Road Builders. Schrader Excavating will be responsible for part of the listed work. An estimate is to be gotten for the parking lots at Prairie Creek Park and City Park. A recommendation to start an asphalt program will be reviewed during the next meeting. Documents regarding an annexation process from the City of Cedar Rapids were reviewed. RESOLUTION 2012-47, A Motioned by Frieden, seconded by Magers to approve RESOLUTION WAIVING ANY OBJECTION TO THE NOTICE GIVEN BY THE CITY OF CEDAR RAPIDS OF ITS PENDING ANNEXATION . Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe RESOLUTION 2012-47 declared duly adopted. RESOLUTION 2012-48, A Motioned by Magers, seconded by Frieden to approve RESOLUTION TO APPROVE CHANGE ORDER NO. 3 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX CITY PARK AND ATHLETIC FIELDS COMPLEX . Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. RESOLUTION Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe declared 2012-48 duly adopted. RESOLUTION 2012-49, A Motioned by Beer, seconded by Magers to approve RESOLUTION TO APPROVE PAY APPLICATION NO. 3 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX CITY PARK AND ATHLETIC FIELDS COMPLEX . Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. RESOLUTION Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe declared 2012-49 duly adopted. RESOLUTION 2012-50, A Motioned by Magers, seconded by Otto to approve RESOLUTION TO APPROVE PAY APPLICATION NO. 2 FROM SEYDEL CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX BUILDING IMPROVEMENT PROJECT . Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: RESOLUTION 2012-50 None. Absent: Wainwright. Motion carried. Mayor Rabe declared duly adopted. The City held an open house concerning the proposed new zoning map with a designated core district earlier today. The comments were discussed. Most questions were about if the change would affect their tax bill and what their proposed new district meant. Shane Wicks stated that some action will be required by the Board of Adjustment. Discussion was held about a request to have stop signs placed at Nickolet, Vanderbilt, and Park Streets as they meet Front Street, as well as two stop signs on Front Street at the intersection of Park Street. Speed and visibility was discussed. The City Council asked that the city be viewed for other yield signs and consider changing them to stop signs. An ordinance is to be drafted to add these requested stop signs. The City Council reviewed a request to allow non-golf cart types of vehicles to register under the golf cart ordinance. No change in scope will be allowed. Discussion was held concerning the pool regulations. An ordinance is to be drafted to accept the building code’s 48 inch barrier height. The pool regulations are to be enforced for all types of pools in regards to the perimeter barrier requirement. Discussion was held concerning employee pay and benefits. RESOLUTION 2012-51, A Motioned by Frieden, seconded by Otto to approve RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES . Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor RESOLUTION 2012-51 Rabe declared duly adopted. Motioned by Magers, seconded by Otto to approve Casey’s Class C Beer Permit. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Five small past due account utility account balances were reviewed. RESOLUTION 2012-52, A Motioned by Otto, seconded by Magers to approve RESOLUTION AUTHORIZING AND DIRECTING THE CITY CLERK/TREASURER TO WRITE-OFF CERTAIN UTILITY ACCOUNTS AS UNCOLLECTIBLE. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion RESOLUTION 2012-52 carried. Mayor Rabe declared duly adopted. Motioned by Magers, seconded by Otto to approve the claims list dated July 10, 2012. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. The city clerk reminded the City Council that Kathy Everett will be gone next week at training in Ames. Samples of building door colors for the concession stand were shown. Motioned by Magers, seconded by Frieden to adjourn the meeting. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe adjourned the meeting at 9:20 PM.
