Home My WebLink About08/14/2012 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING AUGUST 14, 2012 The regular meeting of the Fairfax City Council was held Tuesday, August 14, 2012, at Fairfax City Hall. Mayor Jason Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers and Marianne Wainwright. Other city staff present: Cynthia Stimson, Kathy Everett, Dave Yanecek, Lynn Miller, and Cathy Bayne. Motioned by Magers, seconded by Frieden to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Beer, seconded by Magers to approve the city council minutes from July 10, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Magers to place on file the Planning and Zoning Commission minutes dated July 17 and July 31, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff Egli presented the list of calls. There has been more vandalism. Residents are encouraged to call the Sheriff’s office anytime they have damage and with any information they may have regarding these incidents. Library Director Cathy Bayne stated the library has been busy. Fire Chief Mike Sankot informed the council that the new rescue has been picked up, it is getting inspected, the burn ban has been lifted, and that the spill this morning was not a hazardous material. Lynn Miller reported that Midland GIS has finished in town for now. They did find some buried manholes. JoAnn Beer reported that the City has received a $6,700.00 grant for trees for the new park project. We need to schedule a tree planting event and place a sign to acknowledge the grant award. The date for the planting event will have to be coordinated with the contractor and weather. The August Movie in the Park went great. The slides for Prairie Creek Park are to be ordered. October 5 and 6 are the dates for the playground installation at the new park project. Volunteers will sign-up through the city clerk’s office. John Berns will coordinate the skills, tools, equipment, and work. Motioned by Magers, seconded by Otto to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The engineering invoices were discussed with Shane Wicks. Mayor Rabe opened the public hearing regarding adopting a new Official Zoning Map with a designated Core District at 7:21 PM. The only comments received were those from the open house in July. They were questions about owners’ specific lot’s zoning classifications and what regulations went with those classifications. Mayor Rabe closed the public hearing at 7:24 PM. The Planning and Zoning Commission’s recommendations to adopt the Official Zoning Map and Core District were reviewed. ORDINANCE 128, AN ORDINANCE AMENDING THE JoAnn Beer introduced FAIRFAX ZONING CODE, 2000, BY ADOPTING A NEW OFFICIAL ZONING MAP WITH A DESIGNATED CORE DISTRICT. Motioned by Frieden, seconded by Magers to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 128 . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. ORDINANCE 128, Motioned by Frieden, seconded by Beer to give final approval of AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE, 2000, BY ADOPTING A NEW OFFICIAL ZONING MAP WITH A DESIGNATED CORE DISTRICT . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. City Engineer Shane Wicks presented a list of properties that need Board of Adjustment action to continue their current use or size due to changes the City has made. Motioned by Magers, seconded by Otto to refer these items to the Board of Adjustment. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Rick Kruger was not present to discuss his building permit application, so no action was taken. Mayor Rabe, stated that the City has experienced some thefts and vandalism. He organized a meeting with residents to gather their thoughts on possible solutions. Mike McElmeel, from Per Mar, has submitted a proposal for a Per Mar car to be in town during designated evening hours to drive around and watch for suspicious activity. They would not apprehend, only observe and report. He stated that communication between Per Mar, the City, and the Sheriff’s department would be key to make this arrangement most effective. Per Mar is willing to sign a six-month contract to let the City see if they like the arrangement. Lt. Greg McGivern, Linn County Sheriff’s office, discussed their efforts and objectives. Mayor Rabe stressed that considering Per Mar is no reflection on the Sheriff’s Department’s performance. It would just be added observations. Marc Magers stated that residents want visible patrolling. Bernie Frieden asked how much of the monthly hours is actual patrolling, not responding to calls. Joe Neuhaus stated that he and others are willing to help establish Neighborhood Watch areas. Mayor Rabe said that he also has a list of residents who volunteered to do that in other areas of town. Mayor Rabe plans to organize some events for residents to get to know each other and start that process. Details are to be gotten concerning hiring the Sheriff’s Department for “specials” and compare that information to the Per Mar proposal during the next meeting. The proposals from Prairie Road Builders for seal coating and Kluesner Construction for asphalting were reviewed and discussed. The asphalting proposal is for Church Street. Water drainage and crown heights were discussed. Asphalting is an upgrade the City should start making on some of the streets. Mayor Rabe suggested a committee be formed to work out a plan for asphalting and put the project out for bids with the work to be completed in the spring of 2013. The committee will be Mayor Rabe, Travis Otto, Marianne Wainwright, and staff. Motioned by Magers, seconded by Wainwright to authorize Prairie Road Builders to do the seal coating only from Plan B for $36,702.10, plus the City Park parking lot for $2,163.50 to be paid from the parks budget. Schrader Excavating’s participation in some of the items due to the Phase II Water Main Project will be determined. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. No action was taken on Kluesner Construction’s proposal. Motioned by Magers, seconded by Otto to approve ITC’s IDOT application. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe signed the application. Kevin Graybill, from Graybill Communications, presented a proposal concerning the water and sewer alarm system. A proposal about the outside warning sirens was reviewed and discussed with Fire Chief Sankot. The siren information is to be considered for the next budget. Motioned by Wainwright, seconded by Magers to approve the proposal of $7,286.03 for work on the water and sewer alarm systems. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. There was no update or action concerning the drainage basins. RESOLUTION 2012-53, A Motioned by Magers, seconded by Beer to approve RESOLUTION TO APPROVE CHANGE ORDER NO. 4 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The Planning and Zoning Commission’s Recommendation 2012-03 was reviewed. Shane Wicks discussed the applicability of these modifications to the Storm Water ordinance. ORDINANCE 131, AN ORDINANCE AMENDING THE Marc Magers introduced CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY AMENDING PROVISIONS PERTAINING TO MODIFICATIONS OF THE STORM WATER ORDINANCE. Motioned by Beer seconded by Magers to suspend the rule requiring that an ordinance be ORDINANCE voted on for passage at two council meetings prior to this meeting with respect to 131 . Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: Frieden. Motion carried. ORDINANCE 131, Motioned by Beer, seconded by Magers to give final approval of AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY AMENDING PROVISIONS PERTAINING TO MODIFICATIONS OF THE STORM WATER ORDINANCE. Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: Frieden. Motion carried. Shane Wicks is still working with the IDOT about the trail engineering agreement. There was no action taken. The proposed site plan of the maintenance area was reviewed. The consensuses was that the proposed placement of a new cold storage building will work. Staff is to proceed with getting bids for the project. Flood insurance coverage was discussed. The city clerk was directed to contact the insurance agent about obtaining flood insurance on the existing building now and on the new building once it is in place. Options and condition were discussed concerning the box culvert at the corner of th Williams Blvd. and 76 Avenue. The Planning and Zoning Commission’s Recommendation 2012-05, concerning trees was reviewed. Motioned by Wainwright, seconded by Frieden to set the date for a public hearing concerning an amendment to the City of Fairfax Official Zoning Code as September 11, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. RESOLUTION 2012-57, A Motioned by Frieden, seconded by Otto to approve RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe RESOLUTION 2012-57 declared duly adopted. Discussion was held concerning an invoice. Motioned by Wainwright, seconded by Magers to approve the claims list dated August 14, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Marc Magers stated that, according to an article on infrastructure, the City of Fairfax is in good shape and he will not be participating in the Mayor’s Bike Ride. Areas of concrete at the new park project were discussed. Motioned by Wainwright, seconded by Beer to adjourn the meeting. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None.
