Home My WebLink About09/11/2012 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING SEPTEMBER 11, 2012 The regular meeting of the Fairfax City Council was held Tuesday, September 11, 2012, at Fairfax City Hall. Mayor Jason Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers and Marianne Wainwright. Other city staff present: Cynthia Stimson and Dave Yanecek. Motioned by Beer, seconded by Magers to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Beer to approve the city council minutes from August 14, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Magers to place on file the Planning and Zoning Commission minutes dated August 21, 2012, the Library Board of Trustees minutes dated August 7 and September 4, 2012, and the Parks and Beautification minutes dated July 19, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff Richard Snow presented the list of calls. Marc Magers informed the council that the new rescue is here and that fire school is coming soon. Dave Yanecek stated that the narrow banding has been delayed, that they have been working on moving the dirt for the building, and getting ready for winter. JoAnn Beer reported that the tree planting in the new park will not happen until next spring. Trees Forever has been informed. John Berns is organizing a phone tree to recruit volunteers for the playground assembly. Suggestions for a name for the new park will be taken until December 31, 2012. The Parks and Beautification Committee will then review them and make a recommendation. The city council will then make the final selection. Motioned by Magers, seconded by Frieden to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Discussion was held concerning the building project. The problem with the mop sink should be handled between the architect and the builder. Something needs to be figured out for the area where the stainless steel meets the serving window. Shane Wicks stated that an area near one of the diamonds does not have enough fall to drain properly. It needs an intake and tile installed to take the water away from the edge of the field. The estimated cost of this change is $3,000. Joe Horaney gave a presentation about the services available through the Cedar Rapids/Linn County Solid Waste Agency. Mayor Rabe opened the public hearing regarding revising the Fairfax Zoning Code at 7:45 PM. The city clerk’s office has not received any comments. No one was present to make any comments on this topic. Mayor Rabe closed the public hearing at 7:47 PM. The Planning and Zoning Commission’s recommendation to revise the Fairfax Zoning Code was reviewed. ORDINANCE 132, AN ORDINANCE AMENDING Marianne Wainwright introduced THE FAIRFAX ZONING CODE, 2000, BY AMENDING PROVISIONS PERTAINING TO TREES. Motioned by Magers, seconded by Frieden to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 132 . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. ORDINANCE 132, AN Motioned by Magers, seconded by Otto to give final approval of ORDINANCE AMENDING THE FAIRFAX ZONING CODE, 2000, BY AMENDING PROVISIONS PERTAINING TO TREES. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. No action was taken concerning the commercial building permit application from Richard Kruger because no new information has been received and no one attended on their behalf. Discussion was held concerning the options for security coverage. The neighborhood watch areas are to be organized. Per Mar’s proposal is to be reviewed during budget to consider for the warmer months. Shane Wicks stated that most of the punch list items for Gordon Sevig’s drainage basins are completed. RESOLUTION NO. 2012-58, A Motioned by Wainwright, seconded by Beer to approve RESOLUTION ACCEPTING OUTLOTS A, B AND E OF PRAIRIE VIEW HEIGHTS, PHASE ONE, FAIRFAX, IOWA FOR THE PURPOSES OF ACCESS AND STORMWATER MANAGEMENT . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and RESOLUTION 2012-58 Wainwright. Nays: None. Motion carried. Mayor Rabe declared duly adopted. RESOLUTION NO. 2012- Motioned by Wainwright, seconded by Magers to approve 59, A RESOLUTION ACCEPTING OUTLOTS C, D AND E OF PRAIRIE VIEW HEIGHTS, PHASE TWO, FAIRFAX, IOWA FOR THE PURPOSE OF STORMWATER MANAGEMENT . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: RESOLUTION 2012-59 None. Motion carried. Mayor Rabe declared duly adopted. RESOLUTION NO. 2012-60 Motioned by Beer, seconded by Magers to approve A RESOLUTION TO APPROVE PAY APPLICATION NO. 5 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX CITY PARK AND ATHLETIC FIELDS COMPLEX . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and RESOLUTION 2012-60 Wainwright. Nays: None. Motion carried. Mayor Rabe declared duly adopted. RESOLUTION NO. 2012-61 Motioned by Wainwright, seconded by Magers to approve A RESOLUTION TO APPROVE PAY APPLICATION NO. 4 FROM SEYDEL CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX BUILDING IMPROVEMENT PROJECT . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and RESOLUTION 2012-61 Wainwright. Nays: None. Motion carried. Mayor Rabe declared duly adopted. Shane Wicks discussed the trail project’s status. We are working at getting all of the required information to the IDOT for their review of the engineering agreements and invoices. RESOLUTION NO. 2012-62 Motioned by Magers, seconded by Beer to approve A RESOLUTION APPROVING STREET FINANCE REPORT FOR FISCAL YEAR 2011-2012 . Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. RESOLUTION 2012-62 Motion carried. Mayor Rabe declared duly adopted. The quotes for the new cold storage building are due by 4:00 PM on Tuesday, September 25. If quotes are received, a special city council meeting will be held on that day or the next to review the quotes. Motioned by Magers, seconded by Beer to approve Mediacom’s IDOT Agreement for Use of Highway Right-of-Way. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Beer to approve the claims dated September 11, 2012. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The city clerk asked if Fairfax would be doing the Holiday Decorating Contest again. Yes we will, with the same rules as previous years. Dave Yanecek asked about new construction sites laying sod. That will now be allowed. Motioned by Magers, seconded by Frieden to adjourn the meeting. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
