HomeMy WebLinkAbout04/09/2013 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING APRIL 9, 2013 The regular meeting of the Fairfax City Council was held Tuesday, April 9, 2013, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Dave Yanecek, Mike Sankot, and Cynthia Stimson. Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Beer to approve the city council minutes from March 12, 2013. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Magers to place on file the Library Board of Trustees minutes dated April 2, 2013, the Parks and Beautification Committee's minutes dated February 21, 2013, and the Planning and Zoning Commission minutes dated March 19, 2013. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff Grote presented the list of calls. Questions were asked about some of the information. Fire Chief Mike Sankot reported that the fire department has received another grant. Alliant Energy has awarded them a $3,000 grant to use for communication issues. They hope to purchase a mobile computer to access important information while on the scene of a call. They have received the paperwork for the new medical vehicle they will be ordering. They plan to try and sell the vehicle this will be replacing. It is estimated that it will take about four months to arrive. Dave Yanecek reported that the maintenance staff has assembled the bike racks and benches for the new park, have been flushing hydrants, and working on the pad for the gas tanks at the shop location. William Barry has started working on maintenance projects. JoAnn Beer discussed the Tree Planting Ceremony which is scheduled for 10:30 AM on Saturday, April 20. There will be a demonstration and education presentation. We will need five planting teams, each with team leaders. The Fairfax Lions Club will be providing refreshments. Motioned by Magers, seconded by Frieden to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Shane Wicks reviewed the park project schedule. Snyder and Associates is planning a meeting about the IDOT projects sometime the first part of May. Mark Reinders and Tom Padly, from MidAmerican Energy, were present to discuss the franchise renewal process. Mark walked through the steps and left information for the council and city attorney to review. Parker Krouse presented an idea to have a weekly street market in Fairfax. The City Council suggested Parker contact current markets to get ideas on how to organize this type of activity, gather information about any regulations that would apply, and form a committee to look into the issue. A route map for a proposed Fairfax 5K to be organized by the Masonic Lodge was reviewed. Motioned by Frieden, seconded by Magers to approve the route for the Masonic Lodge's Fairfax 5K, on Saturday, July 13, 2013. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The proposed lease with FYSA was discussed. Motioned by Otto, seconded by Magers to approve RESOLUTION 2013-11, A RESOLUTION ENTERING INTO A PARK LEASE AGREEMENT WITH FAIRFAX YOUTH SPORTS ASSOCIATION. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-11 duly adopted. Insurance costs for FYSA due to the lease requirements were discussed. The City Council would like to contribute towards this expense so that FYSA can continue to provide the same level of activities for the children with the same cost structure, which is free for Fairfax youth. The City does not employ a Parks and Rec Director because FYSA does many of these type of jobs. Motioned by Magers, seconded by Otto for the City of Fairfax to donate the amount of the insurance costs that FYSA will have due to the lease requirements to FYSA. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Beer to approve RESOLUTION 2013-12, A RESOLUTION ESTABLISHING PARK FEES. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-12 duly adopted. Discussion was held regarding the park hours. The current park closing time is 10:00 PM. Occasionally tournaments and their related activities are still going at this time. The ordinance is not to be changed. FYSA will strive to have all activities completed as close to 10:00 PM as possible. Joe Kell stated that FYSA would like to have a fund raising project, selling naming rights to the sport fields by silent auction. The two baseball/softball fields and the two soccer fields at the Fairfax Regional Sports and Park Complex will be named. The successful bidder, with an approved name, will have a sign posted at the field for one year. They will then receive the sign at the end of the year. Motioned by Wainwright, seconded by Magers to approve this fund raising project and allow the placement of the signs in the city park area. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Joe Kell stated that FYSA would like to have a banner hung above the concession stand window during some of the games. The sign will be vinyl and say, "Welcome to Fairfax". This will be a temporary sign that can be removed and replaced. They would like to have some permanent hooks placed in the side of the building to hold the banner. Motioned by Magers, seconded by Wainwright to allow the placement of this type of temporary banner on the building at the Fairfax Regional Sports and Park Complex. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe opened the public hearing regarding the revisions to the Fairfax Comprehensive Plan and the revised Future Land Use Map at 7:50 PM. The city clerk's office has not received any comments regarding these topics. Dean Spina, an attorney, discussed the zoning designation of the lot located at the corner of Beverly Road and Williams Blvd. His client would like to see this lot have some sort of commercial designation. He suggested the City look into adding a district with mixed uses. Joe Kelly, Chairman of the Fairfax Planning and Zoning Commission, asked that the City Council proceed with adopting the revised comprehensive plan and map as recommended by the P&Z. He stated that this has been a long project, with work over several months. The City Council suggested that if Mr. Spina would like to suggest an amendment, he could bring this topic to the P&Z next week. Mayor Rabe closed the public hearing at 8:00 PM. Motioned by Frieden, seconded by Beer to approve RESOLUTION 2013-13, A RESOLUTION TO ADOPT A REVISED COMPREHENSIVE PLAN AND FUTURE LAND USE MAP FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-13 duly adopted. Mayor Rabe opened the public hearing regarding an amendment to the current budget at 8:01 PM. The city clerk's office has not received any comments regarding this issue. No one present had any questions. A report showing the amendment details was reviewed by the city council. Mayor Rabe closed the public hearing at 8:03 PM. Motioned by Frieden, seconded by Otto to approve RESOLUTION 2013-14, A RESOLUTION AMENDING THE CURRENT BUDGET FOR THE FISCAL YEAR ENDING JUNE 30, 2013. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-14 duly adopted. Motioned by Wainwright, seconded by Otto to approve RESOLUTION 2013-15, A RESOLUTION APPROVING A FIREWORKS PERMIT FOR WILLIAM BARRY. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-15 duly adopted. Motioned by Wainwright, seconded by Otto to approve RESOLUTION 2013-16, A RESOLUTION APPROVING A FIREWORKS PERMIT FOR USA DAY'S FIREWORKS. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-16 duly adopted. Motioned by Magers, seconded by Beer to approve RESOLUTION 2013-17, A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON A VOLUNTARY ANNEXATION REQUEST. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-17 duly adopted. Shane Wicks discussed with the City Council the amount of street easement required along W Cemetery Road and how that will affect the size of the lot for consideration of annexation. The City Council felt that keeping the street easement line consistent along the front is sufficient. This will allow the proposed two lots to each be an acre. Discussion was held concerning the zoning of the lot for consideration of annexation. The City Council referred this matter to the Planning and Zoning Commission per the City of Fairfax's Zoning Code. Motioned by Magers, seconded by Beer to approve RESOLUTION 2013-18, A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON A REZONING REQUEST. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-18 duly adopted. Motioned by Beer, seconded by Magers to approve RESOLUTION 2013-19, A RESOLUTION TO ENTER INTO AN AGREEMENT WITH ADVANCED SYSTEMS, INC. TO IMPLEMENT A DOCUMENT MANAGEMENT SYSTEM. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-19 duly adopted. Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2013-20, A RESOLUTION AUTHORIZING THE PURCHASE OF A 2013 AEV AMBULANCE. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2013-20 duly adopted. Shane Wicks briefly discussed the issue of accessibility along a federally funded trail. Motioned by Frieden, seconded by Beer to approve a commercial building permit application from Travis and Melissa Otto for the remodeling of the second story of the Star Bar. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Travis Otto abstained because this is his building permit application. Motion carried. Motioned by Magers, seconded by Frieden to approve a commercial building permit application from Travis and Melissa Otto for the addition of a garage and pavilion at the Star Bar. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Travis Otto abstained because this is his building permit application. Motion carried. Motioned by Wainwright, seconded by Magers to approve getting fleet gas cards from WEX Fleet. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Wainwright to approve the quote from Aspen Equipment for the new dump truck bed and plow for $60,737.00. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Discussion was held concerning the options for the utility vehicle. Motioned by Magers, seconded by Frieden to approve the quote of$24,160.44, which includes the STD steel hard cab and the sweeper, from Kubota Tractor Corporation, for a V Series RTV900XTW-H. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Beer, seconded by Frieden to approve the quote of$2,710.00 from Altorfer Rents, for an auger and attachments. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Beer to set June 1st as the city-wide clean-up date and to have a household hazardous waste collection event at the same time as well as a trailer from Midwest Computer Brokers on hand for the electronics. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Discussion was held about the parking situation during the city-wide garage sale day. The maintenance staff are to place extra temporary no parking signs in the no parking area near Highland and 2nd Street. Motioned by Magers, seconded by Beer to set May 18 as the city-wide garage sale date. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Discussion was held about a request the city clerk's office received to have the new convenience store on Dean Road to be able to sell the Fairfax garbage tags. The city council feels that we should keep this activity within the city limits. Motioned by Beer, seconded by Frieden to approve the claims dated April 9, 2013. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Discussion was held about proposed projects in the E Cemetery Road area. Connection fees were reviewed as well as areas of possible service expansion with these projects. Shane Wicks was instructed to start design work for all of the proposed projects. Speer Financial and the bonding attorney will be contacted. Projects included will be: water and sewer extensions, drainage, street improvements, and two bonds refunded. JoAnn Beer asked about the number of agenda topics and the idea of requiring a second city council meeting when agenda topics reach a certain number. It was decided not to go by the number of the items, because some items are handled quickly. The Council will work to keep on topic and keep the meeting moving to help with the length of meetings. Bernie Frieden asked Shane Wicks to view some of the ponding in the new park. Mark Magers asked if the streets have been inspected for dips and cracks. Kluesner has been out and should have a proposal for the next meeting. The correspondence was reviewed. Motioned by Wainwright, seconded by Magers to adjourn the meeting.
