HomeMy WebLinkAbout05/14/2013 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING MAY 14, 2013 The regular meeting of the Fairfax City Council was held Tuesday, May 14, 2013, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Travis Otto, Marc Magers, and Marianne Wainwright. Bernie Frieden was absent. Other city staff present: Dave Yanecek, Lynn Miller, and Cynthia Stimson. Motioned by Beer, seconded by Magers to approve the agenda. Ayes: Beer, Otto, Magers, and Wainwright. Nays: None. Absent: Frieden. Motion carried. Motioned by Magers, seconded by Beer to approve the city council minutes from April 9, 2013. Ayes: Beer, Otto, Magers, and Wainwright. Nays: None. Absent: Frieden. Motion carried. Motioned by Beer, seconded by Magers to place on file the Library Board of Trustees minutes dated May 6, 2013, the Parks and Beautification Committee's minutes dated March 21, 2013 and April 18, 2013, and the Planning and Zoning Commission minutes dated April 16, 2013. Ayes: Beer, Otto, Magers, and Wainwright. Nays: None. Absent: Frieden. Motion carried. The fire department members discussed their efforts to sell a vehicle. The department has purchased nine computer tablets, one for each vehicle and one for staff The maintenance department has purchased three computer tablets for staff, the hydrant flushing is completed, the water tower has been cleaned, the students did a great job painting at Prairie Creek Park, and the investigation into the graffiti at Hawks Ridge Park continues. The Parks and Beautification Committee is working on a brochure update, they are looking at options to get the Hawks Ridge Park basketball court installed this summer, will be showing the Lorax in June, and has approved the design for the flag pole area at the Complex. The audit report was discussed and the monthly financial reports were reviewed. Motioned by Magers, seconded by Otto to approve the financial reports. Ayes: Beer, Otto, Magers, and Wainwright. Mayor Rabe opened the public hearing regarding the rezoning request from Thomas Arp and Zack Sobaski at 7:14 PM. the city clerk's office had not received any input. The site plan, zoning uses, floodway, and floodplain were discussed with area residents and the council. Mayor Rabe closed the public hearing at 7:35 PM. Marc Magers introduced ORDINANCE NO. 03,AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS: A part of the NW 1/4 SE 1/4 of Section 9, Township 82 North, Range 8 West of the 5th Principal Meridian, City of Fairfax, Linn County, Iowa described as follows: Commencing as a point of reference at the S 1/4 corner of said Section 9; thence N02124'51"W along the west line of the SE 1/4 of said Section 9, 1321.50 feet to the SW corner of said NW 1/4 SE 1/4; thence N88127'15"E along the south line of said NW 1/4 SE 1/4, 107.80 feet to the east right- of-way line of U. Mayor Rabe opened the public hearing regarding a voluntary annexation request from J. Stallman for Lot 2, Auditor's Plat No. 369, Linn County, Iowa, at 7:36 PM. No comments have been received at the city clerk's office. No input was given from the audience. Mayor Rabe closed the public hearing at 7:38 PM. Motioned by Wainwright, seconded by Otto to approve RESOLUTION 2013-21, A RESOLUTION APPROVING THE VOLUNTARY ANNEXATION REQUEST FROM JACQUELINE STALLMAN DATED MARCH 14, 2013 FOR LOT 2,AUDITOR'S PLAT NO. 369, LINN COUNTY, IOWA INTO THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Mayor Rabe declared RESOLUTION 2013-21 duly adopted. Discussion was held concerning the preliminary plat from Thomas and Patricia Arp and Eastern Iowa Buildings. The conditions of approval were reviewed. Motioned by Otto, seconded by Magers to approve RESOLUTION NO. 2013-22, A RESOLUTION TO APPROVE THE PRELIMINARY PLAT FOR SOBASKI'S ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Mayor Rabe declared RESOLUTION 2013-22 duly adopted. Patrick Slater discussed the financials from the 2012 USA Day celebration, the plans for 2013, and requested a donation from the City of Fairfax for this year's activities. Motioned by Beer, seconded by Otto for the City of Fairfax to contribute $3,000.00 to the USA Day Committee to help fund the 2013 activities. Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Linn County Deputy Sheriff Grote presented the list of calls. Questions were asked about the vandalism investigation. The Deputy was made aware of the city-wide garage sale day on May 18. They were asked to patrol and ensure that the parking situation is kept safe. Joyce Freese was present to request the City of Fairfax allow chickens within the city limits, with stipulations. She suggested no more than six chickens and no roosters. The City Council discussed requiring area property owners to sign a statement they did not oppose the placement of chickens. The clerk is to work up an ordinance and permit process for the next meeting. Discussion was held concerning the franchise agreement ordinance. They asked for the attorney to forward his revised version to MidAmerican Energy for their input. Lynn Miller asked if the fire department could use the maintenance building behind city hall that is to be demolished as a training structure. The city council felt that would be fine. Motioned by Magers, seconded by Otto to approve the quote from Dave Schmitt Construction for $26,763.00 for the demolition of the old maintenance building behind the fire station and parking lot work. Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Quotes from Kluesner Construction for street work were reviewed. At least two other competitive quotes are to be obtained for this work and all presented at the next meeting. Discussion was held about security in Fairfax. A previous quote from PerMar for patrolling was reviewed. The city clerk is to contact PerMar for an updated quote for 6 hours each day, for three or six months, and have a representative attend the next meeting. Discussion was held concerning the planned E Cemetery Road projects. The City Council decided to include street lighting as an alternate bid item. Motioned by Magers, seconded by Wainwright to approve RESOLUTION NO. 2013-23 A RESOLUTION AUTHORIZING CIVIL ENGINEERING AND LAND SURVEYING PROFESSIONAL SERVICES FOR THE DESIGN AND CONSTRUCTION ADMINISTRATION FOR THE E. CEMETERY ROAD AND 80TH STREET SANITARY SEWER, WATER MAIN, DRAINAGE AND STREET IMPROVEMENTS. Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Mayor Rabe declared RESOLUTION 2013-23 duly adopted. The City will hold an open house, at city hall, on Thursday, May 16, 2013, from 5:30 — 7:00 PM about the planned projects in the E. Cemetery Road area. Shane Wicks discussed the projected schedule for the planned projects. Most are to be completed by early December 2013 and then the street improvements in the spring of 2014. He asked about the driveways with retaining walls along E. Cemetery Road. The City Council indicated that they would want those restored as much as possible. The paving will be centered in the street easement, the current street surface is not. An easement on Franklin Karal's property is needed for the sewer line to service some of the properties along Highway 151. A reasonable cost is to be negotiated. The park project is almost completed. They are planting trees this week. Motioned by Magers, seconded by Beer to approve RESOLUTION NO. 2013-24,A RESOLUTION ACCEPTING THE ATHLETIC FIELDS, SOUTHEAST PARKING LOT, BATTING CAGE PAD, AND THE TRASH ENCLOSURE IN THE FAIRFAX CITY PARK AND ATHLETIC FIELD COMPLEX. Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Mayor Rabe declared RESOLUTION 2013-24 duly adopted. Motioned by Magers, seconded by Otto to approve RESOLUTION NO. 2013-25, A RESOLUTION TO APPROVE CHANGE ORDER NO. 6 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX CITY PARK AND ATHLETIC FIELDS COMPLEX. Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Mayor Rabe declared RESOLUTION 2013-25 duly adopted. The possibility of submitting a Funding Application for the MPO's STP & TAP funding was discussed. It was decided not to do this at this time. The procedure to place an accessory structure on a second, vacant lot owned by an adjoining property owner was reviewed. The city clerk and city engineer are to work on formalizing a procedure that will address the City's concerns. The bridge inspection report was discussed. Motioned by Otto, seconded by Magers to approve RESOLUTION NO. 2013-26, A RESOLUTION AUTHORIZING AND DIRECTING THE CITY CLERK/TREASURER TO WRITE-OFF CERTAIN UTILITY ACCOUNTS' AMOUNTS DUE AS UNCOLLECTIBLE. Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Mayor Rabe declared RESOLUTION 2013-26 duly adopted. Motioned by Magers, seconded by Otto to approve RESOLUTION NO. 2013-27, A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT PRINCIPLE, INTEREST, AND FEES DUE JUNE 1, 2013. Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Mayor Rabe declared RESOLUTION 2013-27 duly adopted. Motioned by Magers, seconded by Otto to approve RESOLUTION NO. 2013-28, A RESOLUTION ENTERING INTO A MEMORANDUM OF UNDERSTANDING WITH THE CEDAR RAPIDS LINN COUNTY SOLID WASTE AGENCY. Roll call vote: Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Mayor Rabe declared RESOLUTION 2013-28 duly adopted. Motioned by Magers, seconded by Otto to approve a cigarette/tobacco permit for Casey's. Ayes: Beer, Otto, Magers, and Wainwright. Nays: none. Absent: Frieden. Motion carried. Motioned by Wainwright, seconded by Magers to approve the renewal of a Class C Liquor License for the Star Bar. Ayes: Beer, Magers, and Wainwright. Nays: None. Absent: Frieden. Abstain: Otto. Travis Otto abstained because of a conflict of interest. He is the owner of the Star Bar. Motion carried. Motioned by Wainwright, seconded by Magers to appoint Sharon Langenberg to the Fairfax Board of Adjustment. Ayes: Beer, Otto, Magers, and Wainwright. Nays: None. Absent: Frieden. Motion carried. Motioned by Magers, seconded by Otto to approve the claims list dated May 14, 2013. Ayes: Beer, Otto, Magers, and Wainwright. Nays: None. Absent: Frieden. Motion carried. Discussion was held about highway access for the property next the Casey's store. The property owner was instructed to contact the IDOT to determine if an access will be allowed and what type would be required, based on the use of the property. The city clerk reminded the council and mayor about the municipal election in 2013, that 2013 City Candidate's Guides are available, if any councilmembers are interested in attending the Small City Workshop please contact the clerk's office so that she can get you registered, and that the city-wide garage sale day is Saturday, May 18. Discussion was held about additional postings needed in some of the no parking areas. JoAnn Beer stated that a lot of pea gravel is in the grass area in front of properties on Main Street. Lynn Miller will try to get this removed so the areas can be mowed. Marc Magers asked that the limitations about garage sales in residential areas be posted in the next FACTS. Gib Boxa had submitted a letter about weeds on city property. Lynn Miller will check on getting a bid for spraying the detention basins. Discussion was held about grass being blown into the street and the condition of property near a detention basin. Jeff Iben is to be contacted about the property condition. Marc Magers had to leave the meeting at approximately 9:45 PM due to a fire call. Travis Otto asked about the status of the swale along the Star Bar. The maintenance department will check on this. The city clerk asked about parking lot requirements from years ago at this same location. City staff is trying to research this issue for a resident's question.
