REGULAR CITY COUNCIL MEETING
JULY 9, 2013
The regular meeting of the Fairfax City Council was held Tuesday, July 9, 2013, at
Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members
present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright.
Other city staff present: Lynn Miller, Cathy Bayne, and Cynthia Stimson.
Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden,
Otto, Magers, and Wainwright. Nays: None. Motion carried.
Motioned by Magers, seconded by Otto to approve the City Council minutes dated June
11, 2013 and June 25, 2013. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None.
Motion carried.
Motioned by Magers, seconded by Beer to place on file the Planning and Zoning
Commission minutes dated June 19, 2013. Ayes: Beer, Frieden, Otto, Magers, and Wainwright.
Nays: None. Motion carried.
Linn County Deputy Sheriff Stephens distributed the list of calls. He was made aware of
a green Ford Excursion with Colorado plates going door to door selling without the proper
permit. Mayor Rabe discussed that Per Mar started their patrols on July 1. They are submitting
logs and reports.
Cathy Bayne reported that Professional Plumbing came about the drinking fountain.
The fire department expects their new truck mid-September. They recently responded to
a mutual aid fire at a condo.
Lynn Miller reported that the new dump truck order is on schedule. The council asked
him to have the warning tracks at the ball diamonds cleaned-up.
JoAnn Beer reported that the Parks Board held their first Movie in the Park in June
during USA Days at The Complex. They will be holding another one in August at Hawks Ridge
Park.
Motioned by Magers, seconded by Beer to approve the submitted financial reports.
Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
The Council was informed that the old drainage tile was found in the back of city hall and
repairs were made.
Mayor Rabe opened the public hearing regarding the rezoning application from Stephen
Vlcko at 7:21 PM. No comments were received at the city clerk's office. The map was viewed.
The public hearing was closed at 7:26 PM.
Marc Magers introduced ORDINANCE NO. 5, AN ORDINANCE AMENDING THE
FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY
AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES
OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING
CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS:
THE SOUTH 15.92 FEET OF THE NORTH 55.92 FEET OF LOT 7 AND THE NORTH
55.92 FEET OF LOT 8, ALL IN BLOCK 2,VANDERBILT (NOW FAIRFAX), LINN
COUNTY, IOWA CONTAINING 0.10 ACRES, CITY OF FAIRFAX, LINN COUNTY,
IOWA, FROM 9RS SINGLE FAMILY RESIDENTIAL TO C-1 CENTRAL BUSINESS

Motioned by Wainwright, seconded by Magers to suspend the rule requiring that an
ordinance be voted on for passage at two council meetings prior to this meeting with respect to
ORDINANCE 05 as amended. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and
Wainwright. Nays: none. Motion carried.
Motioned by Wainwright, seconded by Magers to approve final passage and adoption
with respect to ORDINANCE NO. 05, AN ORDINANCE AMENDING THE FAIRFAX
ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE
CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF
CERTAIN PROPERTY, NOW KNOWN AS:

(OTHER THAN THE MULCH AND PLANTINGS IN THE RAIN GARDENS AND
SOME OF THE PLANTINGS IN THE LANDSCAPE BERMS) IN THE FAIRFAX CITY
PARK AND ATHLETIC FIELD COMPLEX. Roll call vote: Ayes: Beer, Frieden, Otto,
Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION
2013-35 duly adopted.

RESOLUTION TO APPROVE PAY APPLICATION NO. 9 FROM DAVE SCHMITT
CONSTRUCTION COMPANY, INC. FOR THE FAIRFAX CITY PARK AND
ATHLETIC FIELDS COMPLEX. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and
Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2013-36 duly
adopted.

RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON A
PROPOSAL TO RENEW FOR A TWENTY-FIVE (25) YEAR PERIOD A NON-
EXCLUSIVE NATURAL GAS SUPPLY, OPERATION AND MAINTENANCE
FRANCHISE WITH MIDAMERICAN ENERGY COMPANY. Roll call vote: Ayes:
Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe
declared RESOLUTION 2013-37 duly adopted.
Motioned by Beer, seconded by Frieden to approve RESOLUTION 2013-38, A
RESOLUTION TO APPROVE THE PLAT OF SURVEY NO. 1850 TO LINN COUNTY,
IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none.
Motion carried. Mayor Rabe declared RESOLUTION 2013-38 duly adopted.
Motioned by Magers, seconded by Otto to approve RESOLUTION 2013-39, A
RESOLUTION TO APPROVE THE PLAT OF SURVEY NO. 1852 TO LINN COUNTY,
IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none.
Motion carried. Mayor Rabe declared RESOLUTION 2013-39 duly adopted.
Motioned by Magers, seconded by Beer to approve the second reading of ORDINANCE
04, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX, IOWA, 2012, BY AMENDING CHAPTER 55, THE ANIMAL PROTECTION
AND CONTROL CHAPTER. Roll call vote: Ayes: Beer. Nays: Frieden, Otto, Magers, and
Wainwright. Motion defeated. This ordinance has failed to be approved at three meetings and
action on this ordinance is hereby stopped.
Motioned by Magers, seconded by Otto to approve RESOLUTION 2013-40, A
RESOLUTION ADOPTING A POLICY FOR THE INVESTMENT OF PUBLIC FUNDS.
Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion
carried. Mayor Rabe declared RESOLUTION 2013-40 duly adopted.
Motioned by Magers, seconded by Frieden to approve RESOLUTION 2013-41, A
RESOLUTION TO APPROVE NAMING DEPOSITORIES. Roll call vote: Ayes: Beer,
Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared
RESOLUTION 2013-41 duly adopted.
Motioned by Magers, seconded by Otto to approve Casey's General Stores' application
for renewal of their Class C Beer permit. Ayes: Beer, Frieden, Otto, Magers, and Wainwright.
Nays: None. Motion carried.
The claims were discussed and a few invoices were reviewed. The Dave Schmitt
Construction line was changed to reflect the Council's decision to retain $5,000.
Motioned by Beer, seconded by Magers to approve the claims list as amended. Ayes:
Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
JoAnn Beer asked about the playground mats at the new playground. Mulch is needed at
all of the parks.
Marc Magers asked about the status of replacing the siding at Hawks Ridge Park, due to
vandalism. The clerk informed the council that the probation officer for the two youths who
were charged has inquired about the possibility of having them do community service instead of
financial reimbursement. The insurance agent is to be contacted again and the community
service option was not viewed positively.
The city clerk/treasurer let the Council know that the city clerk's office will only be open
for about two hours on Wednesday, July 24. This is due to classes in Ames for both the deputy
city clerk and the city clerk/treasurer. A budget amendment report will be prepared for the
August meeting. She gave an update on how the scanning project is progressing.
