SPECIAL CITY COUNCIL MEETING
JULY 23, 2013
The special meeting of the Fairfax City Council was held Tuesday, July 23, 2013, at
Fairfax City Hall. Mayor Rabe called the meeting to order at 6:00 PM. Council members
present: JoAnn Beer, Bernie Frieden, and Travis Otto. Marianne Wainwright and Marc Magers
were absent. Other city staff present: Cynthia Stimson.
Motioned by Beer, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, and
Otto. Nays: None. Absent: Magers and Wainwright. Motion carried.
Mayor Rabe opened the public hearing regarding a loan agreement in a principal amount
not to exceed $600,000 for trail improvements at 6:01 PM. No comments have been received at
the city clerk's office and no one present had any comments. Mayor Rabe closed the public
hearing at 6:02 PM.
Mayor Rabe opened the public hearing regarding a loan agreement in a principal amount
not to exceed $3,450,000 for essential purpose projects and refunding at 6:03 PM. No comments
have been received at the city clerk's office. Discussion was held about the status of the
remaining water main projects. Mayor Rabe closed the public hearing at 6:10 PM.
Mayor Rabe opened the public hearing regarding a proposed 2013 amendment to the
urban Renewal Plan for Fairfax Urban Renewal Area at 6:11 PM. No comments have been
received at the city clerk's office. The area was reviewed and it was discussed that the City can
extend an urban renewal area up to two miles outside of the city limits. Mayor Rabe closed the
public hearing at 6:13 PM.
Mayor Rabe opened the public hearing regarding the proposed plans, specifications, form
of contract, opinion of probable cost and the proposed improvements described thereby for the
Phase 1 East Cemetery Road Reconstruction, Drainage, Storm Sewer, Water Main, and Sanitary
Sewer Improvements Project at 6:14 PM. No comments have been received at the city clerk's
office. Discussion was held concerning the scope of these plans and probable cost. Mayor Rabe
closed the public hearing at 6:16 PM.
Loren Hoffman, from Hall and Hall Engineers, discussed the current status of the rain
gardens in the new park project. Pictures and a drawing of the area were viewed. The City is
disappointed at the condition of these areas and small effect, if any, the previous the fix made.
An estimate from Dave Schmitt Construction was reviewed to do some more work on these
areas. Input from city staff was also reviewed. It was decided to have city staff view the area
with the Mayor and determine if the the can be ran directly through these areas to have the water
outlet in the previous location and then make these areas as shallow as possible and plant with
maintainable growth. Shane Wicks will be consulted about the depth requirements.
A request from the 319 Fest organizing group to use city park area to hold their event in
Fairfax was reviewed. It was determined and this event would not be a good match for our park
area. The request was not approved.
Motioned by Otto, seconded by Frieden to approve RESOLUTION 2013-42, A
RESOLUTION APPROVING LOAN AGREEMENTS IN PRINCIPAL AMOUNT NOT
TO EXCEED $4,050,000 FOR ESSENTIAL CORPORATE PURPOSES, TRAIL
IMPROVEMENTS AND REFUNDING, SETTING DATE FOR SALE OF GENERAL
OBLIGATION CORPORATE PURPOSE AND REFUNDING BONDS, SERIES 2013
AND AUTHORIZING THE USE OF A PRELIMINARY OFFICIAL STATEMENT IN
CONNECTION WITH THE SALE OF THE BONDS. Roll call vote: Ayes: Beer, Frieden,
and Otto. Nays: none. Absent: Magers and Wainwright. Motion carried. Mayor Rabe
declared RESOLUTION 2013-42 duly adopted.
The minutes from the July 16, Fairfax Planning and Zoning Commission's meeting were
reviewed. The P&Z have reviewed the proposed 2013 amendment to the Urban Renewal Plan
for the Fairfax Urban Renewal Area and found that this amendment is consistent with Fairfax's
Comprehensive Plan and are recommending approval of this proposed amendment.
Motioned by Beer, seconded by Otto to approve RESOLUTION 2013-43, A
RESOLUTION TO APPROVE 2013 URBAN RENEWAL PLAN AMENDMENT FOR
THE FAIRFAX URBAN RENEWAL AREA. Roll call vote: Ayes: Beer, Frieden, and Otto.
Nays: none. Absent: Magers and Wainwright. Motion carried. Mayor Rabe declared
RESOLUTION 2013-43 duly adopted.
Bernie Frieden introduced ORDINANCE 06, AN ORDINANCE PROVIDING FOR
THE DIVISION OF TAXES LEVIED ON TAXABLE PROPERTY IN THE 2013
AMENDMENT TO THE FAIRFAX URBAN RENEWAL AREA, PURSUANT TO
SECTION 403.19 OF THE CODE OF IOWA.
Motioned by Beer, seconded by Frieden that the initial consideration of said
ORDINANCE 06 be approved. Roll call vote: Ayes: Beer, Frieden, and Otto. Nays: none.
Absent: Magers and Wainwright. Motion carried. Whereupon, Mayor Rabe declared the
motion duly carried and declared that the ordinance had been given its initial consideration.
Motioned by Beer and seconded by Frieden that the statutory rule requiring an ordinance
to be considered and voted on for passage at two Council meetings prior to the meeting at which
it is to be finally passed be suspended. Ayes: Beer, Frieden, and Otto. Nays: none. Absent:
Magers and Wainwright. Motion carried. Whereupon, Mayor Rabe declared the motion duly
carried.
Motioned by Frieden and seconded by Beer that the ORDINANCE 06, AN
ORDINANCE PROVIDING FOR THE DIVISION OF TAXES LEVIED ON TAXABLE
PROPERTY IN THE 2013 AMENDMENT TO THE FAIRFAX URBAN RENEWAL
AREA, PURSUANT TO SECTION 403.19 OF THE CODE OF IOWA, now be put upon its
final consideration and adoption. Ayes: Beer, Frieden, and Otto. Nays: none. Absent:
Magers and Wainwright. Motion carried. Whereupon, Mayor Rabe declared the motion duly
carried and ORDINANCE 06 duly adopted.
Motioned by Otto, seconded by Frieden to approve RESOLUTION 2013-44, A
RESOLUTION TO APPROVE THE FINAL PLAT FOR ARP'S MEADOWS FIRST
ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes:
Beer, Frieden, and Otto. Nays: none. Absent: Magers and Wainwright. Motion carried.
Mayor Rabe declared RESOLUTION 2013-44 duly adopted.
Discussion was held regarding the property acquisition process. Property values, use of
the property, and the final price were reviewed.

RESOLUTION APPROVING A PURCHASE AGREEMENT WITH THOMAS J. ARP
AND PATRICIA A. ARP FOR LOT A OF ARP'S MEADOWS FIRST ADDITION. Roll
call vote: Ayes: Beer, Frieden, and Otto. Nays: none. Absent: Magers and Wainwright.
Motion carried. Mayor Rabe declared RESOLUTION 2013-45 duly adopted.

RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT AND
ESTIMATED COST FOR THE PHASE 1 —EAST CEMETERY ROAD
RECONSTRUCTION, DRAINAGE, STORM SEWER, WATER MAIN, AND SANITARY
SEWER IMPROVEMENTS PROJECT. Roll call vote: Ayes: Beer, Frieden, and Otto.
Nays: none. Absent: Magers and Wainwright. Motion carried. Mayor Rabe declared
RESOLUTION 2013-51 duly adopted.
The City of Fairfax received two bids on Thursday, July 18, for the Phase 1 East
Cemetery Road Reconstruction, Drainage, Storm Sewer, Water Main, and Sanitary Sewer
Improvements Project. They were as follows:
• Dave Schmitt Construction for $1,782,151.40
• Ricklefs Excavating, Ltd for $1,411,555.00
The lowest bid is approximately $160,000 over the engineer's estimate of$1,250,000. Mike
Dufoe discussed the high price for de-watering the open trenches and the possibility to save
some money with a change order to directionally drill the sanitary sewer line and change its
alignment within an existing utility easement between 85 and 75 east Cemetery Road. Mike
recommended that the City Council award the construction contract to Ricklefs Excavating Ltd
and then look into this possible change order at a future meeting. Discussion was held about the
City's expectations for Ricklefs and how those will be conveyed to them during the
preconstruction meeting.
Motioned by Otto, seconded by Frieden to approve RESOLUTION 2013-52, A
RESOLUTION APPROVING AND MAKING AWARD OF CONTRACT FOR THE
PHASE 1 —EAST CEMETERY ROAD RECONSTRUCTION, DRAINAGE, STORM
SEWER, WATER MAIN, AND SANITARY SEWER IMPROVEMENTS PROJECT.
Roll call vote: Ayes: Beer, Frieden, and Otto. Nays: none. Absent: Magers and Wainwright.
Motion carried. Mayor Rabe declared RESOLUTION 2013-52 duly adopted.
The employee reviews have not been completed, so the personnel topics will be discussed
during the next council meeting.
JoAnn Beer stated concerns about where FYSA was collecting for a tournament.
Residents should be free to use the rest of the park without paying to enter the parking lot. She
informed the council that the old school building has not been sold and discussed the current
zoning and also asked about the municipal election to be held later this year.
Bernie Frieden asked that the weeds in the batting cages and warning tracks at the ball
fields be removed or sprayed.
The city clerk/treasurer reminded the council that she and the deputy city clerk will be
going to some training in Ames the rest of the week.

and Otto. Nays: None. Absent: Magers and Wainwright. Motion carried.
Mayor Rabe adjourned the meeting at 7:30 PM.
