HomeMy WebLinkAbout08/13/2013 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING AUGUST 13, 2013 The regular meeting of the Fairfax City Council was held Tuesday, August 13, 2013, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Lynn Miller, Dave Yanecek, Cathy Bayne, and Cynthia Stimson. Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Otto to approve the City Council minutes dated July 9, 2013 and July 23, 2013. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Beer to place on file the Planning and Zoning Commission minutes dated July 16, 2013; Board of Adjustment minutes dated July 15, 2013; Library Board of Trustees minutes dated August 6, 2013; and the Parks and Beautification Committee minutes dated July 18, 2013. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff Grote distributed the list of calls. Vandalism of mailboxes and Per Mar's reporting were discussed. Cathy Bayne reported that the replacement doors have been ordered for the library. Lynn Miller reported that the fire department has been quiet, the truck chassis is at the manufacturer, and that the flag pole plaque is in place. He discussed a quote for concrete in front of the maintenance buildings and fencing behind city hall. JoAnn Beer reported that the Parks and Beautification Committee held their second movie in the park, that they will not be meeting in August, and that they found a couple of people to adopt the garden at the welcome sign. Motioned by Otto, seconded by Beer to approve the submitted financial reports. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe opened the public hearing regarding the MidAmerican energy franchise agreement at 7:09 PM. No comments were received at the city clerk's office or from the audience. The public hearing was closed at 7:10 PM. Motioned by Wainwright, seconded by Magers to introduce and present the first consideration of ORDINANCE NO. 07, AN ORDINANCE GRANTING TO MIDAMERICAN ENERGY COMPANY, ITS SUCCESSORS AND ASSIGNS, THE RIGHT AND NON-EXCLUSIVE FRANCHISE TO ACQUIRE, CONSTRUCT, ERECT, MAINTAIN AND OPERATE IN THE CITY OF FAIRFAX, IOWA, A NATURAL GAS SYSTEM AND TO FURNISH AND SELL NATURAL GAS TO THE CITY AND ITS INHABITANTS AND AUTHORIZING THE CITY TO COLLECT FRANCHISE FEES FOR A PERIOD OF 25 YEARS. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Magers, seconded by Otto to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 07. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Magers, seconded by Beer to dispense with the requirement that an election be held to approve ORDINANCE 07 and that said ordinance shall become effective upon the date of publication. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Maggie Burger, from Speer Financial, discussed the bond bids the City of Fairfax received this morning. They were as follows: Name and Address of Bidder Final Bid UMB Bank, n.a., Kansas City, Missouri 2.4644% Bankers' Bank, Madison, Wisconsin 2.5801% D.A. Davidson & Co., Denver, Colorado 2.6668% Northland Securities, Inc., Minneapolis, Minnesota 2.8812% She is recommending accepting the bid from UMB Bank, n.a., Kansas City, Missouri. Motioned by Magers, seconded by Beer to approve RESOLUTION 2013-53, A RESOLUTION AWARDING SALE OF GENERAL OBLIGATION CORPORATE PURPOSE AND REFUNDING BONDS, SERIES 2013. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2013-53 duly adopted. A commercial building permit application from Wayne Meier for the MAC was reviewed. The building department is recommending approval. Motioned by Magers, seconded by Otto to approve the commercial building permit application from Wayne Meier for the MAC. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Charlie Fisher discussed his interest in purchasing the old school property on Church Street. He asked about application of the core district regulations to allow the use of the existing lots and being able to place a new construction single family homes on these lots. The current zoning is 9-RS, which is single family residential. This property is in the core district and would be eligible to have some of the zoning code requirements lessened as stated in the core district regulations. A representative from Casey's General Stores, Inc., was present to discuss the site development plan. Shane Wicks, of Hall and Hall Engineers, Inc., has reviewed the site development plan for the proposed improvements of a new Casey's General Store and is recommending the City of Fairfax approve this site development plan. Motioned by Magers, seconded by Frieden to approve Casey's site development plan. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. A letter from Mandy Roster concerning the snowmobile route in Fairfax was reviewed. This letter is to be forwarded to the local snowmobile club. It was suggested that the public be kept informed about the specifics about the pedestrian trail bridge and a trail use policy as might be developed. Don Kleis, from Prairie Road Builders, Inc., presented their work proposal list for 2013. He discussed some options. Southview Road was discussed. Part of the roadway is owned by Linn County. They are to be contacted to see if they will participate in the cost of this maintenance. Motioned by Wainwright, seconded by Magers to approve the street work as follows: Items 41-8 are to be done in chips Item 49 - Fairfax Road is to be done in pea gravel Items 410 -13 are to be done as listed Optional Item 41 is to be included with the city clerk checking with Linn County about participation on Southview Road. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. A commercial sign permit application from Eastern Iowa Building, Inc. was reviewed. The sign ordinance was reviewed concerning sign lighting and size. The building department has found the application to be in compliance with the regulations. Motioned by Magers, seconded by Otto to approve the commercial sign permit application from Eastern Iowa Building, Inc. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. A commercial sign permit application from Marc Blazek for Chaos Motors was reviewed. The building department has found the application to be in compliance with the regulations. Motioned by Magers, seconded by Otto to approve the commercial sign permit application from Marc Blazek for Chaos Motors. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Frieden, seconded by Magers to approve RESOLUTION 2013-54, A RESOLUTION TO APPROVE THE FINAL PLAT FOR J. STALLMAN ESTATES TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2013-54 duly adopted. Motioned by Magers, seconded by Beer to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 06. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Beer, seconded by Magers to approve final passage and adoption with respect to ORDINANCE NO. 06, AN ORDINANCE PROVIDING FOR THE DIVISION OF TAXES LEVIED ON TAXABLE PROPERTY IN THE 2013 AMENDMENT TO THE FAIRFAX URBAN RENEWAL AREA, PURSUANT TO SECTION 403.19 OF THE CODE OF IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared ORDINANCE 06 duly adopted. A reminder was given about a meeting on Monday, August 19, concerning the IDOT plans to replace three bridges in the Fairfax area. Shane Wicks discussed Phase 1 of the East Cemetery Road Projects. The contractor plans to start on Monday, August 19. The bid is over the engineer's estimate. Possible changes to the sanitary sewer placement were discussed to save costs. The open trench specification caused extra costs to be included in the bid for de-watering. Direct boring, using a shorter route was discussed as well as the size of easement needed for this placement. Motioned by Magers, seconded by Beer to approve RESOLUTION 2013-55, A RESOLUTION TO APPROVE CHANGE ORDER NO. 1 FROM RICKLEFS EXCAVATING, LTD. FOR THE PHASE 1 EAST CEMETERY ROAD RECONSTRUCTION, DRAINAGE, STORM SEWER, WATER MAIN, AND SANITARY SEWER IMPROVEMENTS PROJECT. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2013-55 duly adopted. The connection fees were not discussed. These will be discussed during the September meeting. A meeting was held on August 8 to discuss and view the rain gardens in the new park. It was decided to install the plants as specified and extend the tile to drain out farther. Linn County needs input from Fairfax concerning the LOSST vote specifics. The wording from the last vote was reviewed. Motioned by Magers, seconded by Frieden to approve RESOLUTION 2013-56, A RESOLUTION CALLING FOR A PUBLIC REFERENDUM TO AUTHORIZE THE IMPOSITION OF A LOCAL SALES AND SERVICE TAX IN THE CITY OF FAIRFAX, IOWA, AT THE RATE OF 1%. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2013-56 duly adopted. Mayor Rabe presented a spreadsheet showing current employee wages. Responsibilities, reviews, length of service, cost of living, and merit increases were discussed in reference to employee wages for the 2014 fiscal year. Motioned by Otto, seconded by Wainwright to approve a 2.8% increase for the full-time maintenance staff and full-time city clerk's office employees. Ayes: Beer, Otto, and Wainwright. Nays: Frieden and Magers. Motion carried. Motioned by Beer, seconded by Otto to approve RESOLUTION 2013-57, A RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes: Beer, Otto, and Wainwright. Nays: Frieden and Magers. Motion carried. Mayor Rabe declared RESOLUTION 2013-57 duly adopted. Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2013-58, A RESOLUTION TO APPROVE THE PERSONNEL POLICY MANUAL. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2013-58 duly adopted. A report on checking account rates and services currently provided by FSSB was reviewed. A listing of budget amendment items and a LOST fund report were discussed. Motioned by Magers, seconded by Wainwright to set a public hearing date for a budget amendment for the next regular meeting date, Tuesday, September 10, 2013. The clerk was directed to make the required publications. Motioned by Magers, seconded by Wainwright to approve the claims list dated August 13, 2013, with the property payments as listed to be paid after all required paperwork is received. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Marc Magers reported that the street light in front of his house is out and mentioned the nuisance business properties. A potential block party was discussed. The City Council should draft a policy about requested street closings. Mowing along Main Street and the Sheriff Department's list of calls were discussed. Motioned by Magers, seconded by Wainwright to adjourn the meeting. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
