Home My WebLink About12/10/2013 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING DECEMBER 10, 2013 The regular meeting of the Fairfax City Council was held Tuesday, December 10, 2013, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:01 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marc Magers. Marianne Wainwright was absent. Other city staff present: Dave Yanecek, Cathy Bayne, and Kathy Everett. Motioned by Magers, seconded by Beer to approve an amended agenda, moving the Insurance Renewal after the reports. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Motioned by Magers, seconded by Frieden to approve the City Council minutes dated November 12, 2013. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Motioned by Magers, seconded by Otto to place on file the Planning and Zoning Commission minutes dated November 19, 2013; the Library Board of Trustees minutes dated November 5, 2013 and December 3, 2013; and the Parks and Beautification Committee minutes dated October 17, 2013 and November 21, 2013. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Deputy Egli from the Linn County Sheriff's department arrived at 7:17 p.m. and presented the Calls for Service log dated November 12 through December 10, 2013. Council expressed concerns to Deputy Egli about an 80's model red Ford pickup truck that has been seen racing around the Complex parking lot and driving recklessly on residential streets. Jason presented a report prepared by Gary Prybil on the condition of the Library building. The report shows several problems that need repair. The topic will be included in the budget planning work session to be held in January. Mike Sankot asked about using a portion of the extended local option sales tax to help pay debt for one of the new trucks. After discussion, the council decided $115,000.00 from local option sales tax will be used over the next four years towards the fire department's debt payments for the new truck. There was discussion of the street repair work done by Pace Asphalt earlier this fall. The city expressed concerns about the quality of work to the company but did not receive a response. The balance of the repair invoice will not be paid at this time. Dave Yanecek reported the new dump truck is in service, all of the equipment is ready for winter, and there is plenty of salt in reserve. JoAnn Beer expressed concern that someone appears to be taking cans from the recycling containers at the Complex. Dave said the maintenance department has been emptying the recycling containers. Trash is being placed in the containers, and it has to be removed before the cans can be turned in for deposit refund. JoAnn asked whether the trail project coming up for bids includes a parking lot, and was told the plans do not include a parking lot. Jason reported the audit went well. Motioned by Magers, seconded by Beer to approve the financial reports. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Jim Schiltz with Group Benefits Design Corporation presented information about plans available for the employee health insurance renewal, and answered questions about plan provisions and premiums. After discussion, council chose Alternate 6. Motioned by Magers, seconded by Beer to approve Alternate 6, Wellmark Premier Blue 750 Platinum for the employee health insurance renewal effective February 1, 2014, with the city continuing to pay one-hundred percent of the premium. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Discussion was held concerning an amendment to the animal control chapter. Motioned by Frieden, seconded by Otto to approve the second reading of ORDINANCE NO. 08, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2012, BY AMENDING PROVISIONS PERTAINING TO THE ANIMAL PROTECTION AND CONTROL. Roll call vote: Ayes: None. Nays: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Motion defeated. Because it was defeated, the ordinance will not go on to a third reading. Motioned by Frieden, seconded by Otto to approve RESOLUTION 2013-74, A RESOLUTION TO APPROVE PAY APPLICATION NO. 3 FROM RICKLEFS EXCAVATING, LTD FOR PHASE 1 EAST CEMETERY ROAD RECONSTRUCTION, DRAINAGE, STORM SEWER, WATER MAIN, AND SANITARY SEWER PROJECT IN FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe declared RESOLUTION 2013-74 duly adopted. Motioned by Beer, seconded by Magers to approve RESOLUTION 2013-75, A RESOLUTION TO APPROVE CHANGE ORDER NO. 2 FROM RICKLEFS EXCAVATING, LTD. FOR THE PHASE 1 EAST CEMETERY ROAD RECONSTRUCTION, DRAINAGE, STORM SEWER, WATER MAIN, AND SANITARY SEWER IMPROVEMENTS PROJECT. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe declared RESOLUTION 2013-75 duly adopted. Discussion was held concerning the calculation of water and sanitary sewer connection fees for the Phase 1 East Cemetery Road Improvement Project. A spreadsheet showing the properties was reviewed. Further review is needed before connection fees are finalized. Discussion was held concerning the request to approve P.O.S. 41887. No action was taken, pending Planning and Zoning Commission revision of accessory structure regulations. Motioned by Magers, seconded by Otto to approve RESOLUTION 2013-76, A RESOLUTION SETTING PUBLIC HEARING CONCERNING ADOPTING AN UPDATED ZONING MAP FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe declared RESOLUTION 2013-76 duly adopted. Discussion was held concerning the Preliminary Plan of Improvements for Phase 2 of the East Cemetery Road Improvements. An Open House concerning the project is scheduled for Tuesday, December 17th from 5:30-7:00 p.m. at Fairfax City Hall. Discussion was held concerning the Arp Homestead Addition Site Plan and Final Plat. Motioned by Magers, seconded by Frieden to approve Casey's commercial sign permit application. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. The Highway 151 bridge project meeting with the Iowa DOT and Snyder and Associates was discussed. There was discussion of the tablets the council currently uses being passed on to the Planning and Zoning Commission, and purchasing iPads for the council. There are seven members of the P&Z, so an additional tablet would need to be purchased. Motioned by Magers, seconded by Beer to purchase six of the iPad 2 with retina display, with cases and/or keyboards for the council, and to purchase one tablet for the Planning and Zoning Commission. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. The vacancy on the Planning and Zoning Commission was discussed. One person has offered to serve on the commission, but the person cannot be appointed until January due to gender equity requirements. Any female residents interested in serving on the commission should contact the city clerk's office. Magers and Otto will serve on a committee planning for two new splash pads at city parks. Motioned by Magers, seconded by Otto to send the city clerk to the IIMC National Conference to be held in Milwaukee in 2014; travel will be by tour bus if possible, and hotel accommodations will be a single room. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Motioned by Frieden, seconded by Beer to approve the American Legion's liquor license renewal, pending receipt of dram endorsement. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Motioned by Wainwright, seconded by Magers to approve the claims list dated December 10, 2013. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. There was concern about snow from several driveways on Linn Street being pushed into the ditch on the south side of the road. Snow removed from driveways and sidewalks must stay on the owner's property. The Holiday Lights Decorating contest will be judged by JoAnn Beer, Cathy Bayne, and Bernie Frieden. The deadline for nominations is December 16th. The clerk's office will email nominations to the judges. A date for the budget work session will determined at the January 14, 2014 council meeting.
