Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Marc Magers, and Marianne Wainwright. Travis Otto was absent. Other city staff present: Cynthia Stimson, Lynn Miller, and Cathy Bayne. Motioned by Magers, seconded by Frieden to approve the agenda. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Frieden, seconded by Beer to approve the City Council minutes dated December 10, 2013. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Magers, seconded by Beer to place on file the Planning and Zoning Commission minutes dated December 17, 2013 and the Library Board of Trustees minutes dated January 7, 2014. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mike Sankot reported that the fire department had 143 calls in 2013. They will place a graph in the next FACTS about the types of calls. The new tires are on the vehicles and the department did ice rescue training. JoAnn Beer stated that the Parks and Beautification Committee will meet on Thursday night. They will be discussing future projects. Lynn Miller reported that the new sewer lift station is in service. Cathy Bayne informed the City Council that the new doors are installed at the library but, she would like someone to come look at them. They can see daylight through the middle of the doors. Motioned by Magers, seconded by Beer to approve the financial reports. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Discussion was held about the signs at the Pit Stop by Riley's. One of the signs is already installed; the other has not been completed. Mr. Pankey was asked to be sure to inquire about and then follow the City of Fairfax's procedures. Motioned by Magers, seconded by Frieden to approve the Commercial Sign Permit Application for the Pit Stop by Riley's. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Rabe appointed Marianne Wainwright as the Mayor Pro Tempore. Motioned by Magers, seconded by Beer to appoint Cynthia Stimson Fairfax's City Clerk/Treasurer. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Cynthia Stimson read the oath of office. Motioned by Magers, seconded by Beer to appoint the firm of Simmons, Perrine, Moyer, Bergman, PLC as Fairfax's legal representatives. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Beer, seconded by Magers to approve the election of Mike Sankot as Fairfax's Fire Chief. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Motioned by Magers, seconded by Beer to designate The Gazette,published in Cedar Rapids Iowa, as Fairfax's official newspaper for legal publications. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. The City Council reviewed a list of six people interested in being appointed to the Fairfax's Planning and Zoning Commission. Discussion was held on a gender balanced board, addresses, and community involvement. Motioned by Frieden, seconded by Magers to appoint Kali Schoon to Fairfax's Planning and Zoning Commission to fulfill an unexpired term, until December 31, 2015. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Frieden, seconded by Beer to re-appoint Joe Kell to a regular, full term on Fairfax's Planning and Zoning Commission. His new term will end December 31, 2018. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Gib Boxa, a P&Z member, discussed their work on revisions to the CIA Zoning District regulations along with help from Hall and Hall Engineers. The draft was discussed. Gib Boxa and Marc Magers discussed the P&Z's input about the accessory structure regulations and the proposed P.O.S. 41887. They were not prepared to take action on the accessory structure regulations. They do not feel that allowing combining of lots is a good idea. Mayor Rabe stated that he has met with Michael Sullivan. Mr. Sullivan does not plan to place an accessory building on the vacant lot. He has plans to install a basketball court. Mayor Rabe noted that this property owner met with the City of Fairfax and completed the steps as outlined to him. Mayor Rabe suggested the city council approve this plat of survey and then put a stop to them until they feel all necessary regulations are in the place to guide the process. Motioned by Magers, seconded by Beer to approve RESOLUTION 2014-01, A RESOLUTION TO APPROVE THE PLAT OF SURVEY NO. 1887—COMBINING LOTS 136 AND 141 OF PRAIRIE VIEW HEIGHTS, PHASE TWO. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-01 duly adopted. The next steps necessary to establish a process to handle requests to combine lots was discussed. The Planning and Zoning Commission is to make recommendations for needed code changes, the council will review them and make changes they feel necessary. The City Council will then establish a process for their review of these types of requests. The City Council is now considering an amendment to the Animal Control Chapter that does not contain the breed specific language. Discussion was held about this amendment. Motioned by Magers, seconded by Beer to introduce and approve the first reading of ORDINANCE NO. 09, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2012, BY AMENDING PROVISIONS PERTAINING TO THE ANIMAL PROTECTION AND CONTROL. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mike Dufoe, Hall and Hall Engineers, gave an update about the Phase 1 East Cemetery Road Improvements Project. The lift station is working, they are starting to install storm sewers, and there will be a disincentive of$300. Shane Wicks, Hall and Hall Engineers, informed the City Council that the final revision to the table showing connection fees for the Phase 1 East Cemetery Road Improvements Project by address is complete. Motioned by Frieden, seconded by Magers to approve RESOLUTION 2014-02, A RESOLUTION ESTABLISHING WATER MAIN CONNECTION FEES RELATIVE TO THE 2013 PHASE 1 EAST CEMETERY ROAD RECONSTRUCTION, DRAINAGE, STORM SEWER,WATER MAIN, AND SANITARY SEWER PROJECT. Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2014-08, A RESOLUTION TO ENTER INTO AN AGREEMENT WITH JOSEPH AND ROXANE BLOOD FOR CONNECTION TO THE CITY OF FAIRFAX'S SANITARY SEWER SYSTEM. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-08 duly adopted. The Plans and Specifications for Phase 2 East Cemetery Road Improvements Project were placed on file and discussed. The IDOT permit has been verbally approved. We are still waiting for the permit. Jeff Iben will be given a quote to install the in the bottom of his detention basin for better drainage. If he doesn't want to pay for that part of the project, it will be removed and then he will be responsible to make the necessary changes and hook into the drainage system. REC will be doing the street lighting. They have made a verbal commitment to do that for free. If we receive that commitment in writing, the street lighting costs will be removed from the project. The speed limit will need to be changed to 25 miles an hour. Discussion was held about how far down East Cemetery Road the 25 miles an hour will be made effective. Possible installation of stop signs was discussed, they are not part of the project bid, but they could be added later by staff The engineer's cost estimate for the project is $1,070,000. The start date will be between March 17 and April 14, with 75 working days. That should make most of the project complete in August with seeding in September. After the contract is awarded, we will hold a neighborhood meeting about phasing. The only permanent easement requested is from Arps for drainage. The other easements will be temporary construction easements. The owner of Pace plans to attend the next city council meeting to discuss property owners' responsibility for the trail. Motioned by Beer, seconded by Magers to approve RESOLUTION 2014-09, A RESOLUTION SETTING PUBLIC HEARING FOR PLANS AND SPECIFICATIONS FORM OF CONTRACT, AND ESTIMATED COST AND SETTING THE DATE AND TIME TO RECEIVE BIDS FOR PHASE 2 —EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-09 duly adopted. The IDOT received bids in December for the Trail Project. The low bid was from Taylor Construction for $788,651.00. Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2014-10, A RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATED COST FOR THE FAIRFAX TRAIL PROJECT ALONG THE EAST SIDE OF UNNAMED TRIBUTARY TO PRAIRIE CREEK BETWEEN E. CEMETERY ROAD AND FRONT STREET, IOWA DOT PROJECT STP-E-2462(601)-8V-57. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. It was suggested an article be placed in the FACTS about recycling containers and wind conditions and always use the lid on the recycling. A special city council meeting will be held on Monday, January 27, at 6:00 PM to discuss the FY15 budget. The city clerk reminded council members to pick up their new iPad and turn in their old tablet, charger, and cover as soon as possible; that this is the open enrollment period for AFLAC; and that Kathy Everett will be gone for about a week and a half at the end of January–first of February.
