REGULAR CITY COUNCIL MEETING
FEBRUARY 11, 2014
The regular meeting of the Fairfax City Council was held Tuesday, February 11, 2014, at
Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members
present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marc Magers. Marianne Wainwright was
absent. Other city staff present: Cynthia Stimson, Lynn Miller, and Cathy Bayne.
Motioned by Beer, seconded by Magers to approve the agenda. Ayes: Beer, Frieden,
Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried.
Motioned by Magers, seconded by Otto to approve the City Council minutes dated
January 14, 2014 and January 27, 2014. Ayes: Beer, Frieden, Otto, and Magers. Nays: None.
Absent: Wainwright. Motion carried.
Motioned by Beer, seconded by Frieden to place on file the Planning and Zoning
Commission minutes dated January 21, 2014 and the Library Board of Trustees minutes dated
February 4, 2014. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright.
Motion carried.
Cathy Bayne reported that the library needs to hire a new janitor and that they are getting
quotes for a least one new furnace at the library. The city clerk was instructed not to pay the bill
for the library doors until they are working properly.
Brian Merta reported that the fire department has the rest of the gear ordered and that
they have been busy.
Lynn Miller reported that they will have the Christmas decorations down tomorrow.
They have used about half of their pile of salt.
JoAnn Beer stated that there will be a Fairfax Easter Egg Hunt on April 12, 2014.

Mayor Rabe opened the public hearing concerning the proposed plans, specifications,
form of contract, and the engineer's opinion of cost for Phase 2 East Cemetery Road Street
Reconstruction, Trail, and Drainage Improvements Project at 7:05 PM. The city clerk's office
did not receive any written or oral comments. No one present wished to make any comments.
Mayor Rabe closed the public hearing at 7:06PM.
Motioned by Magers, seconded by Beer to approve RESOLUTION 2014-15, A
RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATED COST FOR THE PHASE 2 EAST CEMETERY ROAD STREET
RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT. Roll
call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion
carried. Mayor Rabe declared RESOLUTION 2014-15 duly adopted.
Matt St. Germain was present to discuss his concerns and requests about the planned trail
area along East Cemetery Road, near his business, Pace. He asked for written assurance that he
will not be responsible for the installation or maintenance of the trial and asked why it is being
placed on that side of the road. While the City Council is unwilling to give him a written
statement that he will never be responsible for the maintenance of the trail, they did assure him
that there are no plans for adjoining property owners to be assessed any of the installation or
maintenance costs. The trail area is being built to the same standards as the road, so traffic
should not do any more damage to the trail area than the street area. The slope of his approaches
was discussed and a layout of the area was viewed.

FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers.
Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe declared RESOLUTION
2014-19 duly adopted.
An estimate from Linn County REC for street lighting along East Cemetery Road was
discussed. The estimate amount is $25,000 - $28,000 with conduit included and non-LED lights.
Mike Dufoe will check with Linn County REC about other details, such as type of pole.
Linn County Deputy Sheriff Elgi presented the list of calls. A vehicle was reported doing
suspicious activity at the Fairfax car wash area. It was found in Cedar Rapids and the driver was
arrested. Also, another report about an incident at City Park lead to an arrest.
The bid tab for Phase 2 of the East Cemetery Road Street Reconstruction, Trail, and
Drainage Improvements Project was discussed. Seven bids were received. There were several
alternates, none of them will be used. Rathje Construction Company, with a base bid of
$973,267.26, was the lowest responsible bid received.
Motioned by Beer, seconded by Magers to approve RESOLUTION 2014-20, A
RESOLUTION APPROVING AND MAKING AWARD OF CONTRACT FOR THE
PHASE 2 —EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND
DRAINAGE IMPROVEMENTS PROJECT. Roll call vote: Ayes: Beer, Frieden, Otto, and
Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe declared
RESOLUTION 2014-20 duly adopted.
Proposed debt schedules were reviewed. The City Council will have a special city
council meeting on Tuesday, February 25, 2014, at 6:00 PM to take action for the bonding.
A commercial building permit application for Allee Salon and Spa was reviewed. The
process was discussed.
Motioned by Magers, seconded by Otto to approve the commercial building permit
application for Allee Salon and Spa at 326 80th Street Court, in Fairfax. Ayes: Beer, Frieden,
Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried.
Motioned by Magers, seconded by Beer to approve the commercial sign permit
application for Allee Salon and Spa. Ayes: Beer, Frieden, Otto, and Magers. Nays: None.
Absent: Wainwright. Motion carried.
Representatives from Signal 88 and Per Mar were on hand to discuss their proposals for
one year of patrolling in Fairfax. This topic will be discussed at the special city council meeting
on February 25, 2014.
Mayor Rabe opened the public hearing regarding the City of Fairfax's requested zoning
changes at 8:14 PM. The city clerk's office had not received any oral or written comments.
There were no comments from the audience. Mayor Rabe closed the public hearing at 8:15 PM.

ORDINANCE 10, AN ORDINANCE AMENDING THE FAIRFAX ZONING

FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF
CERTAIN PROPERTY, NOW KNOWN AS:

regulations at 8:16 PM. The city clerk's office had not received any oral or written comments.
No one present made any comments. Mayor Rabe closed the public hearing at 8:17 PM.

Mike Dufoe gave an update on the Phase 1 East Cemetery Road Area Improvements
Project. Marc Magers asked about the large dirt pile. Some of this will be used for Phase 2 and
then the remainder will be removed.

RESOLUTION TO APPROVE PAY APPLICATION NO. 4 FROM RICKLEFS
EXCAVATING, LTD FOR PHASE 1 EAST CEMETERY ROAD RECONSTRUCTION,
DRAINAGE, STORM SEWER, WATER MAIN, AND SANITARY SEWER PROJECT
IN FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and
Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe declared
RESOLUTION 2014-21 duly adopted.
A preconstruction meeting will be held Wednesday, February 19, for the trail project.
Shane Wicks discussed the final plat from Arps and the process.

RESOLUTION TO APPROVE THE FINAL PLAT FOR ARP HOMESTEAD ADDITION
IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer,
Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe
declared RESOLUTION 2014-22 duly adopted.
Motioned by Magers, seconded by Frieden to approve the second reading of
ORDINANCE NO. 09, AN ORDINANCE AMENDING THE CODE OF ORDINANCES
OF THE CITY OF FAIRFAX, IOWA, 2012, BY AMENDING PROVISIONS
PERTAINING TO THE ANIMAL PROTECTION AND CONTROL. Roll call vote: Ayes:
Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried.
Mayor Rabe discussed his idea that commercial building permits that are only remodels,
with no change in the footprint of an existing building, should not have to get City Council
approval. It was the general consensus to use this as the standard procedure going forward,
unless city staff felt they needed City Council approval for a commercial remodel because of an
aspect of the project. Commercial building permits for new buildings or additions to an existing
building will still need to obtain City Council approval.
Mayor Rabe reported that the Splash Pad Committee has met. They are looking at cost
estimates and placement options. The committee will meet again on Tuesday, February 18, at
6:00 PM.
Shane Schrader discussed his plans to put 44 condo units in Fairfax, near the intersection
of Williams Blvd. and Beverly Road. The road will be private and the units all on one lot. He
would like to have the utilities public. He will start the rezoning procedure immediately.
Shane Wicks discussed his costs estimates for servicing a new development along 80th
Street. Shane Schrader stated that he plans to develop maybe 40 acres at a time. The condo
development will be first, with the 80th Street area getting started in about a year and a half.
Lynn Miller presented two quotes for a new pick-up. One would be purchased from a lot,
through Thys. The other quote was from Decry Brothers for a new truck to be ordered. The
truck is to be fitted with a plow.
Motioned by Magers, seconded by Otto to authorize the purchase of a new pick-up. The
preferred option would be to purchase one from a lot through Thys for less than the quote for the
ordered one, but if that is no longer available, then order a new one from Decry Brothers. The
truck is to have a plow mounted. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent:
Wainwright. Motion carried.
Two quotes for drainage improvements behind city hall were reviewed. This topic is to
be reviewed at the next regular city council meeting.
The fiscal year 14-15 budget spreadsheets were reviewed. These will be revised and
reviewed at the special city council meeting on February 25.

RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S
PROPOSED FISCAL YEAR 2014-2015 BUDGET. Roll call vote: Ayes: Beer, Frieden,
Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe declared
RESOLUTION 2014-23 duly adopted.

RESOLUTION APPROVING THE CONTRACT FOR LAW ENFORCEMENT
SERVICE WITH LINN COUNTY AND THE LINN COUNTY SHERIFF'S
DEPARTMENT FOR FISCAL YEAR 2014-2015 BUDGET. Roll call vote: Ayes: Beer,
Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe
declared RESOLUTION 2014-24 duly adopted.

JoAnn Beer suggested that the City of Fairfax apply for the All Star Community Awards
for the new park project and showed an article from the Gazette about discussing how your
hometown has changed.
Marc Magers stated that he feels the snow removal efforts have been great, but asked that
the snowplow drivers slow down a bit so that not so much snow is placed on the sidewalk area.
The city clerk mentioned that the bus is not going to Milwaukee for the conference, so
she will be driving and that a second check has been received for restitution for the park damage.
